Ordinance 1965-16 AN ORDINANCE ESTABLISHING AND MAINTAINING A PUBLIC LIBRARY AND READING ROOM FOR THE USE AND BENEFIT OF THE INHABITANTS OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS BE IT ORDAINED by the City Council of the United City of the Village of Yorkville, Kendall County, Illinois : Section 1. That there be, and. there is hereby es- tablished in and for the United City of the Village of Yorkville, Kendall County, Illinois, a public library and reading room for the use and benefit of the inhabitants of said city, and said library shall be free to the use of the inhabitants of the city, subject to such reasonable rules and regulations as the library board, hereinafter herein created, may adopt in order to render the use of the library of the greatest benefit to the greatest number. Section 2. That the corporate authorities shall annually levy a tax of not to exceed .12% of the full, fair cash value of all the taxable property in the city as equalized and assessed by the Department of Revenue for library purposes, said tax to be levied and collected in a like manner with other general taxes of the city and the proceeds paid over by the officer charged with the collection thereof to the Board of Directors of the library. The library tax herein provided for is to be in addi- tion to all other taxes or tax rates authorized to be levied by the city and shall not be a part of the taxes making up any rate prescribed as a limitation on the amount of taxes said cityymay levy. Section 3 . The Mayor of said city shall, with approval of the City Council, appoint a Board of nine (9) Directors, chosen from city residents with reference to their fitness for such office . Not more than one member of the City Council shall be at any one time a member of the library board. The Directors 2 shall hold office one-third (1/3) for one (1) ,year, one-third (1/3) for two (2) years and one-third (1/3) for three (3) years from the first of July following their appointment and at their first regular meeting shall cast lots for their re- spective terms. Annually thereafter the Mayor shall, before the first of July of each year, appoint as before three (3) directors to take the place of the retiring directors, wYD shall hold office for three (3) years, and until their successors are appointed, and tte Mayor may remove any director appointed by him whenever he is of the opinion that the interests of the city demand re- moval, but he shall report the reasons for the removal to the City Council at a. meeting to be held not less than five (5) nor more than ten (10) days after the removal,-,and if the Council by two-thirds (2/3 ) vote of all its members disapproves of the removal, the director shall be restored to the office and not re- moved a second time for the same offense. Vacancies in the Board of Directors occasioned by removal, resignation or otherwise, shdl be filled in a like manner as original appcii.ntments . No director shall receive compensation for services as such. Section 4 . The Directors shall, immediately after appoint- ment, meet and organize by the election of one of thEir number as president and one cf their number as treasurer and such other officers as they may deem necessary, and the treasurer shall be designated as the custodian of the monies paid over to such Board and give bond to be approved by the Board in an amount of not less than One Thousand Dollars ($1,000. 00) nor more than Ten Thousand Dollars ($10,000.00) , as may be fixed by the Board, conditioned that hewill safely keep and pay over, upnn the order of such Board, all-finds received and held by him for such Board of DireciDrs . Section 5. The Directors shall make and adopt such bit-laws, rules and regulations for their own guidance and for the - 3 - government of the library and reading room as may be expedient and shall have all the powers as those conferred upon the cor- porate authorities of cities under Division 48.1 of the Illinois Municipal Code for the year 1961 as hereafter amended. Section 6. Within fifteen (15) days after the expira- tion of each fiscal year of the city, the Board of Directors shall make a report of the condition of their trust on the last day of the fiscal year to the City Council. Said report shall be in writing, verified under oath and shall contain an itemized statement of the various sums of money received and e4)ended for the previous fiscal year, a statement of the financial require- ments of the library forthe ensuing fiscal year and of the amount of money which, in the judgment of the Board of Directors, it will be necessary to levy for library purposes in the next annual tax levy ordinance, and all other statitics, information and suggestions that may be of interest or are required to be filed with the Illinois State Library. Section 7 . The City Council may provide for suta.ble penalties for persons committing injury* upon the library or the grounds or otter property thereof and for injury to or failure to return any book belonging to the library. Section 8 . Any person desiring to make donations of money, personal property or real estate, may vest the title to the money or real estate in the Board of Directors of such library to be held and controlled by such Board when accented according to the termsof the deed, gift, devise or bequest of such pro- perty and the Board shell be held and considered to be a special trustee of such donated property. Section 9. This ordinance shall be in full force and 4 - effect after its due passage, approval and publication according; to law. Passed this 12th day of August, A.
