Ordinance 1962-08 AN ORDINANCE CREATING A PLANT CCMMISSION FOR THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS BE IT ORDAINED BY THE MAYOR AND THE CITY CCUN CIL OF THE UNITED CITY OF THE VILLAGE OF YOR VILLE, KENDALL COUNTY, ILLINOIS: Section 1 - That in accordance with the authorization and provisions contained in the Illinois Municipal Code, Article 11, Division 12, there is hereby created in and for the United City of the Village of Yorkville, Kendall County, Illinois, a Plan Commission. Section 2 - Said Plan Commission shall consist of ten (10) members to include the following as ex-officio members, namely: the Mayor, The Chairman of the Zoning Board of Appeals and one member of the City Council of the United City of the Village of Yorkville, Kendall County, Illinois . The remaining members shall be appointed by the Mayor subject to confirmation by the City Council. Of the members so appointed four (4) shall be citizens of the United City of the Village of Yorkville and three (3) shall be citizens of the Township of Kendall or Bristol outside the limits of the City. Section 3 - That the I'iayor and the City Council member as ex-officio members of the Plan Commission shall serve for their respective terms of City office or until their successors shall be elected and qualified but shall be entitled to no vote at Plan Comm- ission meetings or hearings . The Chairman of the Zoning Board of Appeals shall serve for the term of his appointed office, as Chairman of the Zoning Board of Appeals, or until his successor shall have been appointed and qualified. The remaining members shall be appointed for a term of four years and shall serve without compensation, except the Secretary of said Commission, whether he be a member of the Plan Commission or not, may receive such compensation as may be fixed from time to time by Resolution of the City Council of the United City of the Village of Yorkville, Kendall County, Illinois . Vacancies on the clan Commission Board shall be filled by appointment for the unexpired terms only. 2 - Section 4 - That each member of the Plan Commission with the exception of the ex-officio members shall be entitled to one vote on all matters brought before the Commission upon which a vote is required. The presence of any four (4) voting members of the Comm- ission at any meeting shall constitute a quorum. Section 5 - That at the initial meeting of the Plan Commission the voting members shall select from their own number, a Chairman who shall serve for a period of two ( 2) years and in addition the voting members shall select a Secretary who may or may not be a member of the Plan Commission who shall serve for a term of two years. Section 6 - That the Plan Commission shall have all the ko powers authorized by Division 12, Article 11, of Illinois Municipal Code and shall have jurisdiction over the Corporate community and all unincorporated land situated within one and one-half (12) miles of the Corporate limits and they are expressly authorized to prepare a comprehensive plan for the Corporate community unincorporated land situated within one and one-half ( 12) miles beyond the Corporate limits. Section 7 - That this Ordinance shall be in full_ force and effect from and after it ' s passage, approval and publication accord- ing to law. PASSED this / L day of June, A. D. , 1962 .
