Ordinance 1960-15A AN ORDINANCE REGULATING THE COP?STRUCTION
AND CONNECTION OF SANITARY SEWER MAINS
WITHIN THE CORPORATE LIMITS OF THE YORK-
VILLE-BRISTOL SANITARY DISTRICT.
Now Therefore Be It Ordained, by the Board of Trustees of
the Yorkville-Bristol Sanitary District:
1. That all persons, firms or octporations who shall intend
to undertake the construction of sewers or sewer improvements in
and along streets, public and private places, within the corporate
limits of the Yorkville-Bristol Sanitary District and all proposed
connections with, extensions to or new municipally owned sewers or
privately owned sewers, located within the corporate limits of the

Sanitary District when the same shall at any point directly or in-
directly connect to the Yorkville-Bristol Sanitary District inter-
ceptor sewers or when the affluent therefrom shall pass through the
sewage treatment plant of said District shall be governed by the
provisions of this ordinance.
2. Prior to the commencement of ccnstruction of any sewer
mains, or lines, within the corporate limits of the Yorkville-
Bristol Sanitary District, the owner of the property upon which the
mains are to be placed or the subdivider, which ever the case may
be, shall first file a letter or petition with thqtlerk of the
United City of theVillage of Yorkville or the Clerk of the Yorkville-
Bristol Sanitary District requesting that improvements as listed
be made. Copies of said petition or letter shall be directed to
the City Council of the United City of the Village of Yorkville or
the Yorkville-Bristol Sanitary District Clerk and also to the
Yorkville-Bristol Sanitary District engineer or City engineer
with a request that an investigation be made as to the feasibility
ofiaking the improvements requested and that an estimate of the
cost of preparing . detailed plans and specifications for the
improvements together with the preliminary estimate4f of construction
costs of said improvements be made and submitted to either the
Citl> Council or the Yorkville-Bristol Sanitary District. -" � /

3. The sponsors of the improvements , namely, the owners
or subdividers, shall then deposit with the City Treasurer or the
Treasurer of the Yorkville-Bristol Sanitary Listrict, funds in the
amount of said estimates of cost of engineering seriices with
authority granted to the Treasurer to pay said funds to thIity
Engineer or the Sanitary District engineer, which ever the case
may be, from time to time as engineering services are performed
on the work. Upon deposit of the aforesaid funds, the City
Treasurer or Sanitary District Treasurer shall notify the engineer
that such deposit has been made together with the amount thereof,
and the engineer's shall then proceed with the creparatien of the
plans and specifications aforesaid.

improvements shall be sent by the engineer^to the proper State aAo�
Departments for review and approval requesting that permits for the
construction of the work be issued to the City or the Sanitary
District, whichever the case may be. The engineer shall make
alterations in the plans and specifications which may be necessary
to obtain State approval and permits to proceed with the improvement.
5. After completion of plans and specifications and the
approval thereof by the City
Council or Yorkville-Bristol Sanitary
District Board of Trustees, at the request of the sponsors, the
Sanitary District or City Council will advertise for bids for any
proposed improvements . If bids satisfactory to the sponsors and
to the City or Sanitary District are obtained, said sponsors shall
deposit with the proper treasurer, funds in sufficient amount to
cover the construction cost of the improvements, together with the
cost of engineering, supervision of construction and Inspection
of the work, less any part of the cost of such improvements that
may be assumed by the City or Sanitary District. The treasurer
shall be authorized by the sponsors to make payments to the con-

done as outlined in engineer 's estimates which have previously

been submitted to and approved by the City Council or Sanitary
District Board of Trustees.

Should the sponsor elect to act as contractor for
construction of the work, they may do so by depositing with the
proper treasurer, an amount equal to the estimate i cost of the pro-
Ject, including the cost of engineering supervision of construction
and inspection, and the City Treasurer shall then make payments
to the sponsors from funds so deposited on account of work done as
outlined in engineer's estimates which have previously been sub-
mitted to and approved by the City Council or Sanitary District
Board of Trustees. The sponsor shall protect the Sanitary District
and/or City with adequate amounts of workmen's compensation, public
liability, property damage and other insurance as is normally re-
quired from contractors in carrying out work of this character.
7. The charges for engineering services shall be in
accordance with and shall not exceed the current "recommended
schedule of minimum fees and salaries for general engineering
services", of the Illinois Society of Professional Engineers.
8. Upon satisfactory completion of contracts awarded by
the Sanitary District or City, the engineer shall submit to the
appropriate City Council or Sanitary District Board of Trustees,
a certification of final completion which shall include an itemized
cost of the work as constructed. Upon approval of the work under
contract by the Board of Trustees of the Sanitary District or the
City Council, the contractor for said work shall receive final pay-
ment in the approved amount from the Treasurer. Should funds de-
posited by the sponsors be insufficient to pay all construction,
engineering and inspection cost, the sponsor shall deposit sufficient
funds with the Treasurer to make the portion 'o� the deficiency.
Should the construction, engineering and inspection cost be less
than the amount deposited with the Treasurer for this work, the

remaining balance after all costs have been paid shall be refunded
proportionately to the sponsors and the City by the Treasurer upon

action by the City Council or Sanitary District Board of Trustees

' to make such refund.
9. Upon satisfactory completion of improvements by the
sponsors acting as contractors, the engineer shall submit to the
appropriate municipal body, a certificate stating that the work
has been completed in accordance with the plans and specifications
therefore and the balance of the deposit shall be returned to the
sponsors upon acceptance of the work by the City Council or Board
of Trustees of the Yorkville-Bristol Sanitary District.
10. No sewer hook-up shall be permitted to the City sewers
or any Sanitary District interceptor sewer within the jurisdiction
of the Yorkville-Bristol Sanitary District unless all of the above
provisions of this ordinance are complied with in full by the
sponsors.
11. The provisions of this ordinance shall not apply to
any sewer main or lines constructed by the United City of the Village
of Yorkville, except that any construction undertaken solely by the
City shall be commenced only after the City has submitted to the
Clerk of the Yorkville-Bristol Sanitary District, a copy of the
plans and specifications for said improvements, duly certified by
the City engineer.
12. This ordinance shall be in full force and effect
immediately upon its passage and approval as provided by law.
