Ordinance 1958-34 1 AN ORDINANCE CONCERNING DOGS Be It Ordained by the City Council of the United City of the Village of Yorkville, Kendall County, Illinois, that: Section 1. License. Every person who harbors or keeps a dog of over the age of three months in the City shall pay an annual tax on such dog of $3.00 if it be an unspayed female, and $1.00 if it be a male, or a spayed female, which tax shall be paid in advance on or before the first day of January of each year. The Clerk shall keep a record of all dog taxes paid and shall furnish to each person paying such tax a metal tag, having stamped thereon numbers indicating the year for which the tax is paid. A duplicate to replace a lost or destroyed tag may be issued by the Clerk upon the payment of twenty-five cents. The tax required by this ordinance shall be paid to the City Collector and shall be by him turned over to the Treasurer. Section 2, Tags. It shall be unlawful to permit any dog to be on any public street, sidewalk, alley or other public place unless such dog has a collar firmly attached around his neck, with a license tax for the currect year attached to such collar. Section 3. Running at large. It shall be unlawful to permit any dog to run at large within the City. Any dog found upon any public street, sidewalk, alley or any un- enclosed place, shall be deemed running at large unless such dog is firmly held on a leash, or is in an enclosed vehicle. Section 4. Dist;rbances. , Any dog, within the cor- porate limits of the City which shall be barking, biting, howling, whining, or in any other manner disturbing the quiet r 2 - of, or becoming a source of annoyance to any person, or persons, whatsoever, is hereby declared to be a nuisance, and upon complaint being made to the Mayor of such disturb- ance, he shall upon being satisfied of the truth of such complaint, direct the Chief of Police or any other such official, to notify the owner or person having the possess- ion of such dog, or the owner or occupant of the premises on which such dog may be kept, and the person so notified shall, within the twenty-four hours next following the re- ceipt of such notice abate such nuisance. Section 5, Inoculation. It shall be unlawful to permit any dog which is not on a leash, under control, or muzzled to be in any public street, parkway, sidewalk, park, in any store or place of public gathering or in any place in the City other than in an enclosed area unless such dog has been inoculated against rabies by a licensed veterinar- ian within the preceding year. Section 6. Dog Bites. It shall be the duty of the owner or person having custody of any dog which bites any human being to keep such dog locked up in an enclosure for • period of two weeks following the time the dog has bitten • person; and to have the dog examined by a physician or licensed veterinarian at the commencement and termination of this two week period. If such dog during this period shall die or shall show definite signs of illness, it shall be the duty of such owner or person having custody of the dog to turn the dog over to the health officer or Chief of Polide, so that it can be determined whether or not the dog had rabies. z,. R Section 7,, Impounding. Any dog found upon any public street or highway running at large, or any dog for which the annual tax has not been paid as herelnabove pro- vided, shall be impounded by the Police ,Department. If such dog shall not have been redeemed within five days after being impounded, it shall be disposed of in the manner pre scribed by the City Council. Any dog impounded may be redeemed by the owner upon payment of a fee of fifty cents . a day, for each day the dog has been impounded, plus a release fee of $3.00 and the cur rent tax, if the same is unpaid. Such fees shall be paid to the City Collector. ' section 8, Definition. The term "dog" as used in . this ordinance includes any canine three months or more of age. Section 9. Penalty. Any person, firm or corporation violating this ordinance shall be fined not less than $5.0,0 nor more than $100.00 for each offense, and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues. Section 10, Resisting Officer. It.shall be unlaw- ful for any person to molest, resist, interfere with, hinder or prevent any officer or person in the discharge of the duties or powers conferred upon them by this ordinance. Section 11. Any ordinance in conflict herewith_is repealed. Section 12.
