Citizen Comments None Previous Meeting Minutes September 2, 2014 The minutes were approved as read. New Business 1. EDC 2014-34 Building Permit Report for August 2014 Mr. Ratos reported 5 new permits this month. He said the City will be more strict with concrete inspections this winter due to issues last winter. Concrete can be poured when the temperature is at least 32 degrees and chemicals can be added to speed up the curing process. If a foundation cracks, Mr. Ratos can look at yard receipts that show the chemical mix for each bag. Page 2 of 3 2. EDC 2014- 35 Building Inspection Report for August 2014 New houses are being completed and many residents are building fences and decks this month. Mr. Ratos anticipates a busy November. No further action on this report. 3. EDC 2014-36 Property Maintenance Inspection Update Mr. Ratos reported that weeds and grass complaints had been dismissed after compliance prior to the hearing. The City Attorney informed staff to dismiss these complaints if the violators were in compliance at the time of the hearing or the City could be liable for both malicious prosecution and costs and fees. This is her understanding of the new State statutes. Mr. Ratos also noted that the Nicholson property was recently up for a Hearing and fines were levied since no one appeared. He also reported mowing violations at other locations and the mowing has now been done. A formal complaint regarding bees was filed in September and concerned 2 adjacent properties. A resident on Muirfield has a “portable” beehive that is moved from the garage during the day and placed adjacent to a neighbor's front door. No response has been received from this colony owner. It was also noted that the resident involved in the Dolph St. matter was in attendance at this meeting. 4. EDC 2014-37 Beekeeping Ordinance – Repeal of 1000' Rule Mr. Heinen said 4 complaints (2 are resolved) have been received since the August 4th beekeeping ordinance approval. An aviary permit application was received on September 5th from 508 W. Dolph St., all necessary documents provided and a permit was granted on September 9th. The resident at 507 W. Dolph St. (Matzke) applied for a permit on September 8th and based on the 1000 feet stipulation in the ordinance, that permit was denied. Mr. Heinen said staff is now seeking direction. Alderman Koch asked if the residents could share the permit since the colonies are next to each other. Mr. Olson added there was no technical reason for the1000 feet rule and he recommended removal of this stipulation. As Ward I representative, Alderman Colosimo said he was representing the opponents in his Ward when he asked for the 1000 foot rule. If a child is allergic to bees, he said this might act as a buffer. He was also concerned that Aldermen were considering changing the ordinance that was just passed. He recommended a grandfather clause since both parties had bees prior to the ordinance. Another recommendation was to re-word the ordinance to allow the two colonies within 1000 feet and issue either one or two permits. Alderman Funkhouser commented that language is already in the ordinance for grandfathering colonies and he said prior colony owners had 30 days in which to pull a permit. He said he had no issue with these colonies if proof of ownership prior to the ordinance can be provided. He also had concern about grandfathering for the number of colonies that might possibly be on a larger lot. Mr. Olson said staff will bring some options to the next meeting for consideration. 5. EDC 2014-38 Downtown Overlay District Staff had been asked to create an overlay district for downtown beautification which refers to landscaping, removal of graffiti, etc. The overlay district focuses more on outward appearance of buildings. Staff proposed a short term strategy to create an overlay to deal with beautification and then partner with the Comprehensive Plan consultant, Lakota Group, to create an overlay for building Page 3 of 3 aesthetics. Alderman Funkhouser said in prior years' goal-setting he had been looking for an overlay district and planning tools/incentives to assist with the TIF district expansion. He said he would like to see both elements (beautification and building aesthetics) moving forward concurrently. Ms. Barksdale-Noble said TIF boundaries are now being used, which are not the actual boundaries so an overlay district is needed. She said buy-in of business owners is also needed. Grants are also a possibility. Mr. Funkhouser asked if the City could work with the Chamber for a downtown planning session. Staff will be meeting prior to a session with the Chamber and business owners. She will seek guidance from Lakota before moving forward and she will report back next month. Old Business: 1. EDC 2014-29 Zoning Ordinance Update Ms. Barksdale-Noble said staff received 40-plus comments from the open house, Plan Commission and EDC. Staff has addressed them and she detailed the revisions made. Brief comments were made about fire protection for taller buildings. At this time, the consultant who assisted the Zoning Commission with the ordinance development, Mr. Reddington, was introduced. He discussed windmills and some of the requirements/features of the smaller systems. He said solar and wind-powered streetlights have become very popular and promote a community as being “green”. Alderman Funkhouser noted that Oswego has vertical helix-powered lights along the river and he asked if Yorkville could restrict such systems to vertical helix for residential. It was also noted that windmills are considered special uses and are addressed on a case by case basis. The general consensus of the committee was favorable and it will proceed to Public Hearing. A question regarding the unit of measure of light from LED signs was brought up and Ms. Barksdale- Noble said that there was a request to lower the light level which is now consistent with other communities. Mr. Frieders also noted that there is a very bright neon sign near Game Farm Rd and Rt. 34 that may be misinterpreted as an emergency vehicle. He said there is another sign that flashes at night and should not be flashing. Additional Business: None There was no further business and the meeting was adjourned at 7:02pm. Furthermore, amendments to the current noise ordinance hour ranges and definitions to reflect the new intended uses more accurately. Below are staff’s recommendations for noise decibel levels and appropriate hours. Suggested Text Amendments: Based upon staff’s research, the following proposed definitions and new text identifying amphitheaters and/or outdoor music venues and their respective allowable limits to noise level, under the exemptions. The current noise ordinance does not clearly indicate the current level allowable for each use. These new changes will allow City staff to more regulate and enforce the noise ordinance. 4-4-2: WEIGHTED SOUND LEVEL: Sound pressure level decibels as measured on a sound level meter using the “A” weighing network. The level so read is designated dB(A) or dBA. The following table provides examples of sound pressure levels. As proposed, the Steering Committee, which will meet at certain milestone dates during the process, is a blend of representatives from the elected/appointed public bodies, community businesses and residents. The Lakota Group intends to begin meeting with the Steering Committee within the next few weeks as they continue to move forward with stakeholder interviews, analyses of existing plans, preparation of draft concepts and presentation of direction reports. Proposed Amendments: Current Section 8-18-2B: The City shall issue a total of twelve (12) licenses within the City for beekeeping. The proposed amendments are only applicable for established apiaries. If an application is received and is found to be a new apiary, the regulations originally drafted would apply. If agreeable to the EDC, a text amendment will be drafted by the City Attorney and brought to City Council at an upcoming meeting. Staff will be available at Tuesday night’s meeting to answer any questions the Economic Development Committee may have regarding this agenda item. As you will recall, at the August EDC meeting staff had prepared a new ordinance that would permit residential bee-keeping as an allowable accessory use on certain residentially zoned single-family lots. The ordinance also made provisions for setbacks, separations and fly-way barriers, the permitting process and inspection of the bee colonies, and required notification of adjacent neighbors prior to the installation of the hives. This ordinance was approved by the City Council at their August 12th meeting as Ordinance No. 2014-34 (see attached). Since that time, the City has received a total of four complaints. The City has also received two Residential Apiary permit applications for beekeeping. The first permit application was received on September 5, 2014 from the owner located at 508 W. Dolph Street. After reviewing the application and supporting documents, the permit was approved on September 9, 2014. We received the second Residential Apiary permit on September 8, 2014 from the owner located at 507 W. Dolph Street. With all respect, I feel the wording of this requirement is vague and has numerous loopholes. It appears I would be allowed to keep 2 hives on my property, but 2 individual hives on separate properties are not allowed. There does not appear to be any logic to this. Many beekeepers in the area have as many as 4-5 hives in a single location. I have been meticulous in following Yorkville's regulations. My hive is well maintained and in a location that poses no threat to anyone. I am registered with the IL Dept. of agriculture. My neighbors are all aware that I have a hive in my backyard, and have expressed interest and enthusiasm. Rachel Davis and I attended beekeeping classes together. We work together to keep our bees, and we are both knowledgeable and fully capable of maintaining our hives with no risk to anyone. I would respectfully ask you to reconsider my application. I wanted to say "thank you" for approving my permit for my one apiary on my property. I was hoping to speak with you in person regarding some concerns I have when I was at City Hall on Monday but you were out of the office until today. My friend Kathy Matzke also applied for a permit but she informed me that her permit was denied based on the "1000 feet rule." I feel that there are several issues and loop holes with this rule. First of all, it does not state in which direction the 1000 feet has to be between the two properties. It also makes no sense that a property with less than 1 acre of land can have 2 hives but you are not supposed to have even 1 hive 1000 feet from another. I would like to state that Kathy and I share each others properties and since each of us only has one hive, maybe we only need the one permit. I have also spoken with other bee keepers in the area, even one bee keeper whom makes bee keeping his living and has over 100 hives in the surrounding area, and everyone is an agreement that the "1000 feet rule" does not make any logical sense in the world of bee keeping. Barksdale-Noble, AICP Community Development Name Department If the Economic Development Committee (EDC) will recall at last month’s meeting, staff suggested a two-tiered approach to addressing property maintenance and design guidelines for the City’s downtown. The first was a long term strategy in which the Community Development Department would partner up with the Comprehensive Plan Update consultant, the Lakota Group, to create a Downtown Overlay District which defines the physical boundaries of the City’s “new” downtown area and establishes design criteria which would best enhance and preserve the historic quality and architectural character of Yorkville. This will create a cohesive overall look and feel to the downtown as it continues to redevelop parcel-by-parcel. The second, and most immediate, was a short term strategy, which staff has prepared below which establishes separate beautification criteria for the downtown in an effort to create a higher standard for property maintenance and repair in this area. Per the City Attorney’s concurrence, staff has created criteria which provides for increased property maintenance standards specific to the downtown area which are above and beyond the International Property Maintenance Code (IPMC) which applies to the remainder of the City. The table below compares the proposed increased standards for the Downtown and the currently approved IMPC standards. CURRENT IPMC STANDARDS PROPOSED DOWNTOWN BEAUTIFICATION CRITERIA Section 304.1, Exterior Structure The exterior structure shall be kept free from peeling paint, rot, and treated with a protective material to prohibit water infiltration. • All exterior surfaces of buildings and accessory structures, excluding roofs, shall be properly maintained and protected from the elements by paint or other protective coating applied in a workmanlike fashion. Painted or protective coatings shall be without blemishes throughout the exterior and shall be uniform in color. Trim paint shall also be without blemishes and be uniform in color or have a consistent color palette throughout. • Every foundation, exterior wall, window and all other exterior surfaces shall be free of holes, cracks, breaks, loose or rotted wood and any condition which might allow rain or moisture, vermin, pests or insects to enter the interior portions of the walls or to the occupied spaces of any dwelling, commercial building or structure. All building roofs and gutters shall be kept free of faded and chipped paint and shall be maintained in good repair and in good condition to prevent deterioration. • Building roofs and gutters must be cleaned (pressure and/or chemical), repainted or recovered with like material(s) when twenty-five percent (25%) or more of any exposed roof surface becomes discolored or is scaling. In the event a roof shingle or tile is replaced, the replacement shingle or tile shall be of the closest possible color and shade to the existing roofing shingles or tiles. Section 304.15, Doors: All exterior doors shall be constructed of wood, metal, or polymer material and shall be capable of locking and securing the structure. Section 304.18.2, Windows: All windows shall comply with the 2012 International Energy Code. Replacement windows shall be sized to closely match the size and style of the window being replaced. • Fences, exterior walls, exterior doors, exterior windows, dumpster enclosures, decorative walls and accessory structures shall be maintained in good state of repair. • Each exterior wall surface of buildings and structures shall be kept free of fading and chipped paint and must be cleaned (pressure and/or chemical), repainted or recovered with like material(s) when twenty-five percent (25%) or more of any exposed surfaces becomes discolored or is peeling. Section 304.9, Overhand Extensions: All overhang extensions including, but not limited to canopies, marquees, signs, metal awnings, fire escapes, standpipes and exhaust ducts shall be maintained in good repair and be properly anchored so as to be kept in sound condition. When required, all exposed surfaces of metal or wood shall be protected from the elements and against decay or rust by periodic application of weather-coating materials, such as paint or similar surface treatment. • Any awning or marquee and its supporting members shall be maintained in a good state of repair. Awning or marquees made of cloth, plastic or of a similar material shall not show evidence of excessive weathering, discoloration, ripping, tearing or other damage. • Loose or overhanging objects which constitute a danger of falling on a person or property shall be removed. Ordinance No. 2011-04: Prohibits any weeds, grasses, plants or vegetation, other than trees, bushes, cultivated flowers, vegetable garden crops or other ornamental plants to grow to a height exceeding eight (8) inches with exceptions. • Prohibits any weeds, grasses, plants or vegetation, other than trees, bushes, cultivated flowers, vegetable garden crops or other ornamental plants to grow to a height exceeding six (6) inches. • Shrubs shall be kept trimmed to a height not to exceed four (4) feet and provide unrestricted visibility at driveways and street intersections. • Overhanging branches of trees shall be pruned to a height of at least twelve feet (12’) above grade. • Landscaping shall be maintained in a good condition so as to present a healthy, neat and orderly appearance at least equal to the original installation and shall be mowed or trimmed in a manner and at a frequency so as not to detract from the appearance of the general area including disease free plants, weed-free mulch, turf trimming and removal of root systems which shows evidence of destroying public or private property. 302.1. Sanitation: All exterior property and premises shall be maintained in a clean, safe and sanitary condition. The occupant shall keep that part of the exterior property which such occupant occupies or controls in a clean and sanitary condition. • All trash containers and trash enclosures shall be maintained in a manner which prevents the accumulation of trash, debris, rubbish and litter by providing sufficient containers. All trash containers and dumpsters shall be located and maintained in such a manner so as to provide screening from public view. 304.18 Building Security: Doors, windows or hatchways for dwelling units, room units or housekeeping units shall be provided with devises designed to provide security for the occupants and property within. • Any means of securing all property including crime prevention devises shall be subject to review by the Building Code Official for safety and compliance with the building code. In no instance shall safety bars, grating, or other similar apparatus be allowed over any window, door, or other opening of any building. Any boards, panels or other means of securing structural openings shall be uniform in color and painted to match the exterior color of the building. We are seeking the Economic Development Committee’s comments, feedback and direction with regard to the proposed beautification criteria set forth in this memorandum. Additionally, we are still working in concert with the Lakota Group to define the “downtown” area so that we are consistent with our long term approach when implementing the above proposed design criteria.
