Resolution 2014-37 Resolution No. 4 a1 —37 A RESOLUTION APPROVING APROPRIATION OF FUNDS WHEREAS, the United City of Yorkville, Kendall County, Illinois (the "City"). has entered into an Agreement with the State of Illinois, through its Department of Transportation (the "Agreement') in which the said parties are to participate in sharing certain costs for improving a 2.9 mile portion of US 34 ("Veterans Parkway"), identified under US 34 (FAP 591), State Section(13C & 13) R&T, State Contract 66884, and; WHEREAS, in compliance with the aforementioned Agreement, it is necessary for the City to appropriate general funds and/or other funds to pay its reimbursement to the State for the engineering and construction costs of traffic signals, combination roadway lighting, shared-use trails, and relocation/readjustment of City owned utilities as cited in the Agreement. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and City Council of the United City of Yorkville, Kendall County, Illinois, as follows: Section 1. This the preambles hereinabove stated are hereby adopted herein as if fully restated herein. Section 2. That there is hereby appropriated the sum of Two Hundred Eighty-Four Thousand Dollars ($284,000) or so much thereof as may be necessary, from money now and hereinafter allotted to the City to pay its share of engineering and construction costs as provide in the Agreement. Section 3. Upon receipt of the first and subsequent progress payments made to the contractor, the City agrees to pay to the Illinois Department of Transportation of the State of Illinois, from any funds allotted to the City, an amount equal to the City's share of$284,000 divided by the estimated construction costs, $31,457,000 multiplied by the actual progress payment made to the contractor until the entire obligation incurred under the Agreement has been paid, based upon final bid unit prices. The City's actual monetary reimbursement obligation to the State will be based on final bid unit prices of the awarded contract. I I', BE IT FURTHER RESOLVED that the City agrees to pass a supplemental resolution to provide additional funds if the amount appropriated herein proves to be insufficient to cover its share of the costs.
