MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY
OF THE VILLAGE OF YORKVILLE , KENDALL COUNTY, ILLINOIS HELD AT CITY

Mayor Thanepohn called the meeting to order at 8 :00 P.M. and led the
Council in the Pledge of Allegiance to the Flag .
Roll call was taken as follows :
Ward 1 - Beach Ward 2 - Harker Ward 3 - Simmons
Hanback Pierce
Alderman Wolff was absent from Ward 1 . A quorum was established.
Guests were Attorney Tom Grant , Tom McNelis , Mrs . Blackman $!:Mrs .
Baker representing the Sensor Foxes , and Anita Blake and her Girl
Scouts .
The reading of the minutes from the August 14 , 1980 meeting was
waived. Alderwoman Pierce moved to approve the minutes as presented ,
seconded by Alderman Harker.
ATTORNEY' S REPORT - Copies of the Tax Levy Ordinance were distributed
to Council mem ers calling for a levy of $110 , 315 . Of that amount
$44 , 275 is for library purposes . The remainder is for other general
corporate pusposes , garbage pick-up and retirement of the installment
purchase of the Rowlands property. Alderwoman Pierce moved to pass
the"Ordinance for the Levy & Assessment of Taxes for the Fiscal (#8-80;
Year Beginning May 1 , 1980 $ Ending April 30 , 198a for the United
City of the Village of Yorkville , Kendall County , Illinois', ,
seconded by Alderman Simmons . Roll call vote was taken as follows :

MAYOR' S REPORT - Mayor Thanepohn read a Resolution Proclaiming
September 21 , 1980 as. Yorkville St. Jude ' s Children' s Research
Hospital Day. Chief Randall is chairman of the bike-a-thon fund
raising event along with the help Of the Girls Scouts .
CITY CLERK - Clerk Erickson reported the Syregalas Petition for
Annexation Agreement is being amended from B-1 to B-2 request
for rezoning. The Public Hearing will be held September 23 , 1980
at 7 : 30 P.M. before the Yorkville Plan Commission .
PLAN COMMISSION - Alderman Simmons read the minutes from the August 26 ,
1980 Plan Commission meeting regarding the following :
Public Hearing re : Glen Davidson Petition to Rezone B-2 to R-2 .

80 . 10 - Syregelas Pre-public Hearing Discussion regarding Petition
for Annexation Agreement .
Alderman Simmons reported on the Committee Meeting on 8/21/80 in regards
to Wildwood Subdivision . The discussion centered on the Green Area
and the Water Tower. There will be another meeting scheduled for
September 4 , 1980 at 7 : 30 P.M. at the Water Tower to meet with the
Attorneys and Engineers of both parties .
SENIOR COMMUNITY - Countryside Villages II will hold it ' s openhouse
on Sunday Septem er 7 , 1980 from 3 : 30 to 5 : 30 P.M.
SCHOOL COMMUNITY - Alderman Hanback reported he has received phone
calls regarding -busing fromiCountryside Center to the schools and
also from parents concerned with Rt. 47 being a hazardous crossing
also. Chief Randall directed the complaints to the Business Administra-

tion office - for the school district . The busing for Countryside Center
is made available through a grant from the Illinois Department of
Transportation to the school district.
OLD BUSINESS - Attorney Grant presented Glen Davidson 's Petition to
Rezone . Attorney Dickson stated there was no need for an easement across
the property in regards to the field tile . Alderman Simmons moved,-apon

Motion carried 5-0 . Alderman Wolff was auaent from voting .
Attorney Dickson was instructed to draw up an Ordinance .
Attorney Grant presented the Petiti6ft for Review G Approval of the -Pre-
liminary Plat of McNelis ' Subdivision. Attorney Grant stated that the
Public Walkway & Pedestrial Bridge was added to the easement on the
north end of Lbt 2 is shown an the Final Plat . Also on the Final Plat
is the drainage easement as requested by City Planning Consultant James
Clarage . The zoning will remain the same . Mr . McNelis plans to build
a new home on Lot 2 and sell his home on Lot 1 . Mr . McNelis stated
that on Lot 1 he is served by public water supply and a private septic
system, and on Lot 2 will be served by public water supply and there
is some indication that public sewers can be used. A septic system
will be used if this is not possible .
Alderman Simmons moved to Approve the Preliminary Plat of the McNelis
Subdivision upon recommendation by the York-k�ille .Plannirig .Commission,
and to authorize the Mayor and City Clerk to sign the Final Plat.
Motion was seconded by Alderman Beach . Roll call vote was taken as

EMERGENCY SERVICES & DISASTER - Alderman Hanback reported the Committee

i. regarding the faulty siren system.
FINANCE - Upon recommendation of the City Auditors , Alderwoman Pierce
moved to have Treasurer Merkel set up a separate fund for the Land/Cash
monies collected, seconded by Alderman Harker. Roll call vote was
taken as follows : :_.

Motion carried 5 -0 . Alderman Wolff was absent from voting ,
Alderwoman Pierce reported on the C.E .T.A. Program for the summer.
The program served 55 youths . A total of 288 hours were given to
Yorkville .
HEALTH & SANITATION - Alderman Beach read a letter received from Mary
Ellen CommariT stating the U. S. Senate has passed a bill which could speed up
federal takeover of the G .E . Nuclear storage facility at Morris and the
continuing efforts of Mrs . Commare and her committee in fighting the
issue . Mayor Thanepohn stated he would like to see the press take more
agressive action in keeping the public informed and to gain the valid facts
of the matter. June Gallagher of the Beacon News stated she has a
story all ready to go to press on this issue .
LIGHTS, TELEPHONE, `GAS & CABLE TV - Mayor Thanepohn reported that he
and Alderman Simmons will go over the electric franchises and also
review the telephone franchises .
PUBLIC PROPERTY & BUILD-
INGS _ - Alderman Harker called a meeting following the regular meeting
an requested the presence of Chief Randall , Mayor Thanepohn and Treasurer
Merkel .
POLICE - Alderman Hanback reported the pampklet ave been ordered for
the Alcohol & Drug Abuse Program and will be di tributed at the schools
as soon as they arrive .

SEWER - Alderman Harker reported that progress is being made regarding
tIT—Countryside Center sewer interceptor.
WATER - Alderman Harker moved to approve the Fees & Expenses
or .T. Johnson , to attend the Annual Water Supply Operators conference
in Springfield September 17- 19 , 1980 , seconded by Alderwoman Pierce .
Motion carried 5-0 .
STREETS & ALLEYS - Alderman Beach Questioned whether or not the
street intersections had been swept . Public Works representative
J.T. Johnson responded that the department has done some of the
areas but that priority projects had kept them from doing all and
the Van Emmon Water hook-ups and water line to the Game Farm Property
are on the agenda yet .this fall .
LIBRARY BOARD - Alderman Hanback reported that the Auditors recommended
having the City Treasurer take over the library treasury duties .
YBS BOARD - Alderman Harker reported the only business was passing
the tax levy for the YBSD.
Alderman Beach moved to adjourn the meeting , seconded by Alderman
Harker. Motion carried 5-0 .

AN ORDINANCE FOR THE LEVY & ASSESSMENT OF TAXES
FOR THE FISCAL YEAR BEGINNING MAY 1, 1980 &
ENDING APRIL 30, 1981 FOR THE UNITED CITY OF THE
VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS
WHEREAS, the City Council of the UNITED ,CITY OF THE
VILLAGE OF YORKVILLE, Kendall County, Illinois, heretofore did,
prior to the commencement of the fiscal year beginning May 1,
1980 and ending April 30, 1981, following a public hearing upon
the proposed Budget, approved said Budget for the fiscal year
and the said Budget was in the aggregate amount of $1,166,278.00.
Said amount did not include additional appropriations by special
' Ordinances, which special Ordinances are for the annual payments
to MABEL ROWLANDS for the purchase of real estate from her in the
amount of $9,040. 00 and other purposes, and for which, in part,
a levy upon all non-exempt property within the corporate boundaries
is needed.
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the UNITED CITY OF THE VILLAGE OF YORKVILLE, Kendall County, Illinois:
SECTION 1:
That the total amount of the budget for all corporate
purposes and public library purposes legally made to be collected
from the tax levy of the current fiscal year is hereby ascertained
to be in the amount of $110, 315. 00.
SECTION 2:
That the sum of $1, 182 ,208. 00, being the total of the
budget and appropriations heretofore legally made and which is
to be collected in part from the tax levy of the current fiscal
year of the UNITED CITY OF THE VILLAGE OF YORKVILLE for all corporate
purposes of said City and library, for purposes of providing for
a Policy Pension Fund, Illinois Municipal Retirement Fund, Bond
Fund, Installment Contract Fund, Health and Sanitation Fund, and
Corporate Fund, as budgeted for the current fiscal year by the
annual Budget Ordinance of the UNITED CITY OF THE VILLAGE OF
YORKVILLE for the year May 1, 1980, and ending April 30, 1981,
passed by the City Council of the UNITED CITY OF THE VILLAGE OF
YOOKVILLE at a legally convened meeting prior to said fiscal year,
be and the same is hereby levied upon all the taxable property in
the UNITED CITY OF THE VILLAGE OF YORKVILLE, subject to taxation for
the current year, the specific amounts as levied for the various
funds heretofore named being included herein by being placed in
separate columns under the heading "To Be Raised by Tax Levy" ,
which appears over the same, the tax so levied being for the current
fiscal year of said UNITED CITY OF THE VILLAGE OF YORKVILLE and
for the said budget to be collected from said tax levy, the total
of which has been ascertained as aforesaid and being as follows:

SECTION 3:
That the total amount of $ 110,315.00 , ascertained as
aforesaid, be and the same is hereby levied and assessed on all
property subject to taxation within the UNITED CITY OF THE VILLAGE
OF YORKVILLE, according to the value of said proporty as the same
is assessed and equalized for State and County purposes for the
current year.
SECTION 4:
The foregoing item of $12,000.00 levied for Health and
Sanitation is levied in excess of the Statutory rate by reason of
compliance with the Statutes of the State of Illinois relative to
an excess tax in relation to garbage disposal; the foregoing item
Of $44,275.00 levied for Public Library purposes is levied in
excess of the Statutory rate by reason of compliance with the
Statutes of the State of Illinois relative to an excess tax in
relation to Public Library levies; the foregoing item of $9, 040. 00
for the acquisition of real property is levied pursuant to the
Statutes of the State of Illinois and an installment contract
entered into heretofore by the UNITED CITY OF THE VILLAGE OF
YORKVILLE, pursuant to an Ordinance of said City, and is in excess
of the statutory rate applicable to the general corporate and
policy purposes of said City by reason thereof.
SECTION 5:
That there is hereby certified to the County Clerk
of Kendall County the several sums aforesaid constituting said
total amount of $110,315.00 , which said total amount of said
UNITED CITY OF THE VILLAGE OF YORKVILLE requires to be raised by
taxation for the current fiscal year of said City, and the City
Clerk of said City is hereby ordered and directed to file with

the County Clerk of said County, on or before the time required
by law, a certified copy of this Ordinance.
SECTION 6:
This Ordinance shall be in full force and effect
immediately from and after its passage and approval according
to law.

AN ORDINANCE RECLASSIFYING LOTS 3 AND 4 OF DAVIDSON 'S
SUBDIVISION, YORKVILLE , KENDALL COUNTY , ILLINOIS , FROM
B-2 BUSINESS DISTRICT TO -R-2 ONE-FAMILY RESIDENCE DISTRICT
WHEREAS, GLEN A. DAVIDSON and DONNA R . DAVIDSON, as owners ,
have petitioned the United City of the Village of Yorkville , Ken-
dall County, Illinois , to reclassify or rezone the real estate
hereinafter described from B-2 business district use to R-2 one-
family residence district use in accordance with the regulations
of the zoning ordinance of the United City of the Village of
Yorkville, to-wit :
Lots 3 and 4 of Davidson ' s Subdivision, Yorkville , Ken-
dall County , Illinois ; in the United City of the Vil -
lage of Yorkville , Kendall County , Illinois ; and
WHEREAS, said Petition to rezone or reclassify real estate
has been considered by the planning commission of the United City
of the Village of Yorkville , after due notice , publication and
public hearing ; , and'
WHEREAS , the planning commission of the United City of the
Village of Yorkville has favorably recommended and approved the
rezoning and reclassification of the real estate herein described
from B-2 business district use to R-2 one-family residence district
use as specified in the Zoning Ordinance of the United City of the
Village of Yorkville,
NOW , THEREFORE , be it ordained by the City Council of the
United City of the Village of Yorkville , Kendall County , Illinois ,
as follows :
SECTION ONE: That the following-described real estate be
rezoned and reclassified from B-2 business district use to R-2
one-family residence district use as defined by the Zonina Ord-
inance of the United City of the Village of Yorkville as enacted
March 28, 1974 , and subsequently amended from time to time , to-wit :
Lots 3 and 4 in Davidson ' s Subdivision , Yorkville , Ken-
dall County, Illinois ; in the United City of the Village
of Yorkville , Kendall County, Illinois;
Provided that the owners shall establish a "no access strip " along
the westerly lot lines thereof prohibiting vehicular access to and
from said lots from Bridge Street (Route 47 ) .

SECTION TWO: That the City Clerk and/or the Zonina Enforce-
ment Officer of the United City of the Village of Yorkville be and
is hereby instructed to change the zoning map of the United City
of the Village of Yorkville to reflect this rezoning and reclass-
ification .
SECTION THREE : That this Ordinance shall be in full force
and effect from and after its passage and approval as required by
law.

ORDINANCE AMENDING ORDINANCES CONCERNING RETAIL
OCCUPATIONAL TAX ACT, PASSED
AUGUST 14 , 1969, JULY 13 , 1967, JUNE 12, 1958, & APRIL 2, 1956
AND AMENDING ORDINANCES ESTABLISHING SERVICE
OCCUPATIONAL TAX ACT & USE TAX ACT,
PASSED APRIL 11, 1968 & JULY 13 , 1967 RESPECTIVELY
WHEREAS, HB 2921 (Public Act 81-1379) , effective
August 12, 1980 , has been adopted by the Illinois General
Assembly, and
WHEREAS, said Act amends Sections 8-11-1, 8-11-5, and
8-11-6 of the Illinois Municipal Code, and
WHEREAS, said amendments provide that certain farm
machinery and equipment is partially excluded from the municipal
retailers' occupation tax, service occupation tax, and use tax,
and
WHEREAS, it is the desire of the UNITED CITY OF THE
VILLAGE OF YORKVILLE that sales or use of such farm machinery
and equipment remain subject to said taxes.
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the UNITED CITY OF THE VILLAGE OF YORKVILLE, Kendall County,
Illinois, as follows:
Section 1. Ordinances concerning Retail Occupational
Tax Act, passed August 14 , 1969, July 13 , 1967, June 12 , 1958, and
April 2, 1956, and Service Occupational Tax Act and Use Tax Act,
passed April 11, 1968 and July 13, 1967 , respectively, are hereby
amended by adding thereto the following sections which shall read
as follows:
Section 1. Exclusion a-1 contained in Section 2
of the "Retailers' Occupation Tax Act" approved June 28 ,
1933, as amended, shall not apply to persons engaged
in the business of selling tangible personal property
at retail within the UNITED CITY OF THE VILLAGE OF
YORKVILLE.

Section 2. The farm machinery and equipment ex-
clusion contained in Section 3 of the "Service Occupation
Tax Act" ,approved July 10, 1961, as amended, shall not
apply to all persons engaged in the business of making
sale of service within the UNITED CITY OF THE VILLAGE OF
YORKVILLE.
Section 3. The farm machinery and equipment ex-
clusion contained in Section 3 of the "Use Tax Act" ,
approved July 14 , 1955, as amended, shall not apply
to the privilege of using in such municipality any
item of tangible personal property which is purchased
outside Illinois at retail from a retailer and which
is titled or registered with an agency of this State' s
government. "
Section 2. This Ordinance shall be effective upon its
passage and publication as required by law.
