City Council Minutes 1980 04-10-80 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY (21) OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS HELD AT CITY HALL APRIL 10 , 1980 . Mayor Thanepohn called the meeting to order at 8 :00 P .M. and led the Council in the Pledge of Allegiance to the Flag . Clerk called roll as follows : Ward 1 - Beach Ward 2 - Harker Ward 3 - Simmons Wolff Hanback Pierce A quorum was established. Guests included nary Ellen Cammare representing the Morris Nuclear Waste Facility objectors . The reading of the minutes was waived. Alderman Harker moved the minutes be approved as presented, seconded by Alderwoman Pierce . Motion carried 6-0 . The reading of the bills was waived. Alderman Harker mo-ed to authorize payment of the bills as presented, seconded by Alderwoman Pierce . Roll call vote was taken as follows : Beach - Aye Harker - Aye Hanback Aye Simmons - Aye Pierce - Aye Wolff - Aye Motion carried 6 -0 . ATTORNEY' S REPORT - Alderman Harker moved to pass "AN ORDINANCE AMENDING AN ORDINANCE TO REGULATE THE CONNECTIONS TO SANITARY #4-80 SEWER MAINS IN THE UNITED CITY OF THE VILLAGE OF YORKVILLE ., ILLINOIS, AS HERETOFORE ADOPTED 9 JULY 1959 , AND SUSEOUENTLY AMENDED FROM TIME TO TIME" . The motion was seconded by Alderman Simmons . Roll call vote was taken as follows : Harker - Aye Hanback - Aye Simmons - Aye Pierce - Aye Wolff - Aye Beach - Aye Motion carried 6-0 . Alderman Simmons moved to adopt "A RESOLUTION AUTHORIZING CERTAIN LINE TRANSFERS FOR THE 1979-1980 BUDGET OF THE UNITED CITY OF #62-1980 THE VILLAGE OF YORKVILLE" , deleting the following under the last line uner "Water Fund" reading "Transfer $11 ,000 . 00 from Water Vain "Replacement to Transfer to Water Bona F, Interest Fund" . The motion was seconded by Alderman Harker . Roll call vote was taken as follows : Hanback - Aye Simmons - Aye Wolff - Aye Pierce Aye Beach - Aye Harker Aye Motion carried 6-0 . Alderman Beach moved to pass "AN ORDINANCE TO REZONE FT RECLASSIFY .979 ACRES IN THE SOUTHEAST QUARTER OF SECTION 23 to B_31�' (Robert #5- 80 E. Lee) , seconded by Alderman Wolff. Roll call vote was taken as follows : Simmons - Aye Pierce - Aye Wolff Aye Beach T. Aye Harker - Aye Hanback - Aye Motion carried 6-0 . Attorney Dickson stated that he met with Mayor Thanepohn , Director Madden and Leo Anderson in regards to formulating rough estimates of costs for the Beecher Community Building . There will be a formal contract submitted at a later date . The Ron Cobb Resubdivision Ordinance is being redone and will be presented at the next meeting . MAYOR' S REPORT - Mayor Thanepohn stated a thank-you card has been receive romthe family of Carl Wolff. Mayor Thanepohn appointed Ray Collins as full-time employee of the Public Works Department upon the recommendation of the Streets F Alleys , Water & Sewer Committees to start on the job April 16 , 1980 , Alderman Harker moved to approve the appointment of Ray Collins , seconded by Alderwoman Pierce . motion carried 6-0 . CITY CLERK - Alderwoman Pierce moved to grant permission to the Mental Wealth Association in Illinois to conduct door-to-door bellringer drives during the month of ray, seconded by Alderman Harker. Motion carried 6-0 . TREASURER - Alderman Simmons moved to authorize Mayor Thanepohn to sign tie Auditror ' s (Filbey , Summers , Abel , Good F, Kiddoo) Service Agreement , seconded by Alderman Harker . Roll call vote was taken (22) Page 2 April 10 , 1980 as follows : Beach - Aye Harker - Aye Hanback - Aye Simmons - Aye Pierce - Aye Wolff - Aye Motion carried 6-0 . Alderman Simmons moved to amend the present budget to include the overexpenditure of items in the Water Bond & Interest Fun not budgeted for , seconded by Alderman Wolff. Roll call vote was taken as follows : Hanback - Aye Simmons - Aye Pierce - Aye Wolff - Aye Beach - Aye Harker - Aye Motion carried 6-0 . Alderman Hanback moved to approve the Treasurer ' s Report as presented , seconded by Alderman Harker . P40tion carried 6-0 . POLICE - Alderman Wolff moved to approve the Police Department report , seconded by Alderman Harker. Motion carried 6-0 . Chief Randall commented that the D.W. I . convictions have been very successful . The defensive training combat weapons seminar at Ottawa was attended by all officers on a staggered basis . PUBLIC WORKS DIRECTOR - Alderman Harker moved to approve the Public Works Reports , seconded by Alderman Wolff. Motion carried 6-0 . Director Madden stated the 4x4 truck had been in an accident and. has been repaired by the insurance company of the other vehicle involved. BUILDING DEPARTMFNT REPORT - Alderman Simmons moved to approve the-Building Department report , seconded by Alderman Hanback . Motion carried 6 -0 . ATTORNEY"S REPORT (con' t .) Alderman Beach moved to adopt the Resolution objecting to the Federal take-over of the General Electric Nuclear Waste Storage Facility near Morris , #63-1980 Grundy County , Illinois . The motion was seconded by Alderman Simmons . Roll call vote was taken as follows : Beach - Aye Harker - Aye Hanback Aye Simmons Aye Pierce - Aye Wolff - Aye Motion carried 6-0 . PLAN COMMISSION - The next meeting will be April 22 , 1980 at 7 , 30 P.M. at City Hall . PARK COMMISSION - Discussion was held on the swimming pool owned presently by Dale Woodworth . The Lions club wishes to lease the pool for membership at $50 per family for the public , Jim Hall , representative for the Lions Club has requested $5 ,000 of City monies to be budgeted for if needed to help with expenses and/or insurance . Attorney Dickson could see no legal problems from this arrangement . The Lions Club would lease the pool and assume operation of the pool and any repairs the pool might need. The matter of budgeting X5 ,000 within the new budget was referred to the Finance Chairman. Alderman Wolff moved to place $5 ,000 in the 1980- 81 Budget to cover the pool ' s operation if needed , seconded by Alderman Harker. BUSINESS & ECONOMIC DEVELOPMENT COMMISSION Director Padden reported on the April 8 , 1980 meeting . There were 5 members , including the chairman __present . The East Alley is now a dead issue . The Commis< sion will be working on attracting more light industry to the area and look into sources of advertising and costs . A presentation will be made on findings at a later date to the City Council . COMMUNITY CENTER COMMITTEE Mayor Thanenohn stated he has spoken with Mr , Stark and it is Tis intention to maintain all. promises of the past . Director Madden stated the bill for the survey of the Beecher Commun- ity Building property has been received and a 25% discount was given by Donahue , Thornhill F7 Olson with a not9tion that discount was PAGE 3 April 10 , 1980 (23) given due to a noteworthy cause . NEW BUSINESS - Alderwoman Pierce read the two sealed bids received for the purchase of 200 trees of various specific kinds as follows : 1 . Bazan Landscaping - $8 , 725 . 50 (balled F, burlapped) $5 ,953. 50 (bare-root) (secondary bid.) - $8 ,905 . 00 $6 ,421 . 00 2 . Winding Creek Nursery submitted a bid but was not extended F, totaled. Alderman Wolff moved to refer the bids to Committee and authorize purchase on committee recommendation , seconded by Alderman Harker . Alderman Wolff withdrew his motion . Alderman Wolff moved to refer the tree bids to committee for a recommendation to be presented at the next regular City Council meeting , seconded by Alderman Harker . Motion carried 6-0 . BUILDING F, ZONING - Alderman Beach stated he was working on the recommendation on the Plan Commission Format . EMERGENCY SERVICES F, DISASTER - Alderman Simmons read a letter received from John Taylor, en a ounty ESDA Director stating that effective April 1 , 1980 all maintenance responsibility for the warning sirens will be under each Village Director. Mayor Thanepohn stated the letter is predicated on our acceptance of the siren which has never worked properly to begin with and the City will not pick up maintenance until it does funtion properly . Alderman Beach moved to acknowledge the letter and refer the matter to committee for recommendation , seconded by Alderman Harker. Motion carried 6-0 . FINANCE - Alderman Simmons called a committee meeting for TIonday, April 14 , 1980 at 7 : 30 P.M. at the Water Tower with the auditor present to discuss the longevity policy . the Revenue Sharing requests and the Illinois Municipal League Risk Insurance program . PUBLIC PROPERTY F BUILDINGS - Alderman Hanback reported that the Illinois Dept . of Transportation has given the library an affirmative answer on the funding of the library replacement and keep Alderman Hanback informed on the progress to report to the City Council . STREETS F, ALLEYS - Alderman Beach reported he has received favorable comment on the pothole repair on the City streets . WATER - Alderman Harker reported that the bid of Ron Westphal Chevrolet oo r the new 14 ' step van truck was accepted for approximately $9 ,000 . The truck has been delivered to the department . Alderman Harker reported the committee had accepted the bid of Water Products for the Morgan to Van Emmon to S . Vain water line materials for approximately $16 ,000 . FINANCE - Alderman Simmons moved to tentatively adopt the 1980-81 Budget and lay it over for two weeks until the April 24 , 1980 meeting , seconded by Alderman Hanback. Motion carried 6-0 . The second Revenue Sharing Public Hearing will be held April 24 , 1980 at 7 : 30 P.M. Mayor Thanepohn reported that at the request of Al Spera the Mondays of April 21 F, 28 and r4.ay S F, 12 , 1.980 will be scheduled for Gun Safety Classes at City Hall . W ORDINANCE AMENDING AN ORDINANCE TO REGULATE THE CONNECTIONS TO SANITARY SEWER MAINS IN THE UNITED CITY OF THE VILLAGE OF YORKVILLE, ILLINOIS, AS HERETOFORE ADOPTED 9 JULY 1959, AND SUBSEQUENTLY AMENDED FROM TIME TO TIME WHEREAS, the UNITED CITY OF THE VILLAGE OF YORKVILLE has heretofore adopted an Ordinance entitled 'An Ordinance to Regulate the Connections to Sanitary Sewer Mains in the United City of the Villlage of Yorkville, Illinois," the same having been duly passed and adopted 9 July, 1959, and WHEREAS, the schedule of fees as outlined therein, pursuant to Section 4 therein as adopted by the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE by an amendment duly passed and approved 11 August, 1960, specifies that fees for each multi-family building shall be $250. 00, and WHEREAS, the City Council deems it far and equitable to charge a sewer permit fee for each apartment unit equal to the fees charged for a single-family residential unit for sewer permit within the UNITED CITY OF THE VILLAGE OF YORKVILLE. NOW, THEREFORE, BE IT ORDAINED by the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE that Section 4 of an Ordinance to Regulate the Connections to Sanitary Sewer Mains in the United City of the Village of Yorkville, Illinois, as heretofore Passed 9 July, 1959, and Amended Ftom Time to Time shall be amended to read as follows: r SECTION 4 A fee of $150. 00 shall be paid to the City Clerk for each Sewer Permit issued for each Sewer Permit issued to any applicant for any dwelling. For pur- poses of determining the fee, each unit of a residential building shall be considered a separate application and fee, whether the same be a single-family residence dwelling, or one unit within a multi-family residential unit. Each business, commercial, industrial, social, educational, religious establishment, other than residential units, shall likewise pay a fee of $150. 00. All such fees for Sewer Permits shall go to the Treasury of the City and the said fees shall be known as a "Connection Fee" . BE IT FURTHER ORDAINED that this amendatory Ordinance shall repeal only that part or portion of other Ordinances of the UNITED CITY OF THE VILLAGE OF YORKVILLE, heretofore passed and adopted, that conflict herewith, and in all other respects in "Ordinance to Regulate the Connections to Sanitary Sewer Mains in the United City of the Village of Yorkville, Illinois, " as passed and approved on the 9th day of July, 1959 , and hereto- fore amended from time to time, is hereby ratified and confirmed. This Ordinance shall be in full force and effect from and after its due passage, approval and publication according to law. A RESOLUTION AUTHORIZING CERTAIN LINE TRANSFERS FOR THE 1979 - 1980 BUDGET OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE WHEREAS, certain shortages and excesses exist in the line accounts for various items heretofore budgeted for the fiscal year of 1979 - 1980 for the UNITED CITY OF THE VILLAGE OF YORKVILLE, and WHEREAS, the City Council deems it expedient and proper to transfer excess funds from certain line items to balance the budget for the fiscal year 1979 - 1980, NOW, THEREFORE, BE IT RESOLVED by the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE that budget transfers for the various line items, as specified upon the attached schedules, be and the same are hereby made. WHEREAS, the government takeover would surely cause larger amounts of spent fuel . to be in storage , WHEREAS, a ,federally owned facility would accept waste from other states and foreign countries , WHEREAS, the questions of safety of transport and storage have not adequately been answered, WHEREAS, the Federal Government has not been able to find a final disposal site and Morris , may become a permanent radioactive waste facility by default , WHEREAS, if the waste facility is taken over by the Federal Government , Department of Energy, it would be regulated by another federal agency, the Nuclear Regulatory Commission, allowing a question of proper controls , WHEREAS, the citizens of the City of Yorkville have expressed strong onnosition to the Federal takeover of the General Electric Nuclear Waste Storage Facility near Morris , NOW, THEREFORE , BE IT RESOLVED by the Council of the City of Yorkville , Illinois , as follows : 1 .
