City Council Minutes 1979 04-19-79 (25) MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE , KENDALL COUNTY, ILLINOIS HELD AT CITY HALL APRIL 19 , 1979 . Mayor Thanepohn called the meeting to order at 8 : 15 P .M. and led the Council in the Pledge of Allegiance to the Flag . Roll call was taken as follows : Ward 1 - Wolff Ward 2 - Harker Ward 3 - Smith Beach Hanback Alderman Simmons was absent from Ward 3 . A quorum was established . Guests included representatives from 3 Cable TV Companies , Attorney Wilson, Mr . & Mrs . Dennis Pierce , Mr . & Mrs . Ralph Blake , Ron Westphal , and Jerry Papish of Geotech , Inc . The reading of the March 22 , 1979 minutes was waived . Alderman Harker moved to approve the minutes as presented , seconded by Alderman Smith . Motion carried 5-0 . The reading of the bills was waived . Alderman Smith moved to authorize payment of the bills , seconded by Alderman Wolff . Roll call vote was taken as follows : Wolff - Aye Beach - Aye Harker - Aye Hanback - Aye Smith - Aye Motion carried 5-0 . Alderman Simmons was absent from the vote . MAYOR' S REPORT - Alderman Beach moved to approve the appointment of Sandy Lindblom to the Human Resource Commission for a 3-year term to expire in 1982 , seconded by Alderman Wolff . Motion carried 5-0 . Mayor Thanepohn presented resignations from 2 police officers . Terry Schiltz resigned for personal reasons and Bob Perkins has accepted the position as Chief of Police in Earlville . Alderman Wolff moved to approve the appointment of Harold Martin III as patrolman, his salary to be in accordance with the wage schedule and also in accordance with the personnel policy, seconded by Alderman Smith . Motion carried 5-0 . Alderman Wolff moved to approve the appointment of John Raymond Kennedy as patrolman, his salary to be in accordance with the wage schedule and also in accordance with the personnel policy, seconded by Alderman Harker . Motion carried 5-0 . Alderman Wolff moved to authorize the closing of the Sewer Expansion Account and transfer funds to the General Fund - Sewer , seconded by Alderman Harker . Roll call vote was taken as follows : Beach - Aye Harker - Aye Hanback - Aye Smith - Aye Wolff - Aye Motion carried 5-0 . Alderman Simmons was absent from the voting . Alderman Smith moved to authorize the transfer of the Layne Western Contract payment (from Property Tax distribution) from the Water Fund to the General Fund, seconded by Alderman Harker . Mayor Thanepohn reminded their obligation to file a Statement of Economic Interest with the Kendall county Clerk . CITY CLERK - Clerk Erickson reported the audit report on Motor Fuel Tax funds has been received and can be viewed at her office . The Illinois Municipal League will conduct a conference for newly- elected officials May 18 & 19 , 1979 at the Arlington Park Hilton in Arlington Heights , Illinois and June 1-2 , 1979 at Forum 30 in Springfield , Illinois . Registration forms can be obtained at the Clerk ' s office . TREASURER - Alderman Hanback moved to approve the Ordinance Amending the Budget Expenditure Ordinance permitting the transfer and expenditure of the sum of $36 ,484,81 from the Capital Improvement Repair and Replacement Fund for the purpose of road repair and improvement , The motion was seconded by Alderman Beach . Roll call vote was taken as follows : Hanback - Aye Smith - Aye Wolff - Aye Beach - Aye Harker - Aye Motion carried 5-0 . Alderman Simmons was absent from voting . Alderman Wolff moved to pass the Ordinance Adopting the Budget for all Corporate Purposes of the United City of the Village of Yorkville , Kendall County , Illinois , in Liew of Appropriation Ordinance , for the Fiscal . Year Commencing the lst Day of May and Ending the 30th Day of April , A. D. , 1981 , with the provision to incorporate the Revenue Sharing requests of $ 1 ,000 to the Kendall Family & Youth Services and 41 ,000 to the Library into},the budget . The Motion was seconded by Alderman Harker . Roll call was taken as follows : Wolff - Aye Beach - Aye Harker - Aye Hanback - Aye Smith - Aye Motion carried 5-0 . Alderman Simmons was absent from voting . The final figure reflects a $978 , 132 .67 budget for 1979-1980 approximately $19 , 000 under the 1978-79 budget . Alderman Wolff moved to adopt the Resolution transferring the Budget for the 1978-1979 Fiscal Year and making line Transfers of Specific items , seconded by Alderman Harker . Roll call vote was taken as follows : Beach - Aye Harker - Aye Hanback - Aye Smith - Aye Wolff - Aye Motion carried 5-0 . Alderman Simmons was absent from voting . The Treasurer ' s report was approved as presented . POLICE - Alderman Wolff moved to approve the Police Reports as presented, seconded by Alderman Harker . Motion carried 5-0 . Chief Randall reported that several overweight truck fines were imposed and the case at Hornsby ' s was closed and the property returned . DIRECTOR OF PUBLIC WORKS - Alderman Smith moved to approve the Public Works reports , seconded by Alderman Harker . Motion carried 5-0 . WATER REPORT - March 1979 Well No . 2 - Checked & operated periodically . Well No . 3 - Pumped 7 ,055 ,000 gallons . Well No . 4 - Pumped 4 ,551 ,000 gallons . Total Pumped - 11 ,606 ,000 gallons . Up 1 , 272 , 000 gallons from one month ago . Up 555 , 000 gallons from one year ago . Average pumped - 374 , 387 gallons per day . Maximum pumped - 434 , 000 gallons per day . Chlorine fed - 145 lbs . Chlorine fed - 1 . 5 ppm . Water Samples - 5 routine , all satisfactory . Replaced Meters - 7 New Customers - 7 Leaks - None Chlorine booster pump at Well No . 4 malfunctioned and had to be rebuilt . A new pump was purchased and installed and the rebuilt one shelved for a stand-by unit . Volume register malfunctioned and was repaired by Water Department Personnel . BUSINESS & ECONOMIC DEVELOPMENT COMMISSION - Alderman Harker reported the Commission was working on brochures for the Illinois Department of Local Governmental Affairs and will eventually tailor them to fit the City . Page 3 April 19 , 1979 (27 ) OLD BUSINESS - Ralph Blake presented a Plat of Survey for a parcel of land he wishes to be put out for bids by the City of Yorkville . Alderman Wolff moved to advertise for the sale of 0 .178 acres of City land adjacent to Mr . Blake ' s property, bids to be received until 4 : 30 P .M. at the office of the City Clerk on MAy 24 , 1979 and opened at the regular meeting of the City Council May 24 , 1979 . , seconded by Alderman Wolff . Roll call vote was taken as follows : Harker - Aye Hanback - Aye Smith - Aye Wolff - Aye Beach - Aye Motion carried 5-0 . Alderman Simmons was absent from voting . Blackhawk Apartments - Attorney Wilson presented the final plat for the Blackhawk Apartment complex . Mr;. Papish of Geotech , Inc . presented revised engineering plans . Mr . Papish stated that Commonwealth Edison has requested public utility easements between lots 2 & 3 and lots 6 & 7 . Other minor changes were also made . Alderman Beach asked if there were to be lights in the parking areas . Mr . Papish stated that in his opinion they would be included in the building plans altho they were not located on the final plat . Mr . Papish also stated that ,�> it was the developer's intention to comply with the landscaping . Upon recommendation of the Plan Commission, Alderman Harker moved to approve the final plat for Blackhawk Apartments with the provision that the landscaping be included , seconded by Alderman Wolff . Roll call vote was taken as follows : Hanback - Aye Smith -• Aye Wolff - Aye Beach - Aye Harker - Aye Motion carried 5-0 . Alderman Simmons was absent from the voting . Alderman Wolff moved to grant the Mayor and Clerk the authority to sign the final plat upon the final approval by the Plan Commission, seconded by Alderman Harker . Roll call vote was taken as follows : Smith - Aye Wolff - Aye Beach - Aye Harker - Aye Hanback - Aye Motion carried 5-0 . Alderman Simmons was absent from the voting . Westphal Annexation - Alderman Wolff moved to grant a Variance to Westphal C evro et to allow septic facilities to be installed and allow 5 years to complete the sanitary sewer facilities from the date of the Annexation Agreement . The motion was seconded by Alderman Smith . Roll call vote was taken as follows : Smith - Aye Wolff - Aye Beach - Aye Harker - Aye Hanback - Aye Motion carried 5-0 . Alderman Simmons was absent from the voting . NEW BUSINESS - Horton Subdivision- Upon recommendation by the Plan Commission, Alderman Beach moved to approve the Preliminary Plat of the Horton Subdivision, seconded by Alderman Wolff . Roll call vote was taken as follows : Wolff - Aye Beach - Aye Harker - Aye Hanback - Aye Smith - Aye Motion carried 5-0 . Alderman Simmons was absent from the voting . OLD BUSINESS - Westphall Annexation Con ' t . - Alderman Harker moved to allow the owner to recapture collection fees on the sewer to be changed from 3 years to 5 years from the date of the Annexation Agreement, Seconded by Alderman Wolff . Roll call vote was taken as followS : Hanback - Aye Smith - Aye Wolff - Aye Beach - Aye Harker - Aye Motion carried 5-0 . Alderman Simmons was absent from the voting . The size of the water line will be determined as to the needs of the developer and upon the decision of D.lrector;.Madden and the Water Committee . Alderman Harker moved to pass the Ordinance Annexing Territory to the United City of the Village of Yorkville , Kendall County, Illinois , of Clarence & Ruth Holdiman & Sharan A . Bazan (Westphal Chevrolet) , seconded by Alderman Smith . Roll call vote was taken as follows : Smith - Aye Wolff - Aye Beach - Aye Harker - Aye Hanback - Aye otion carried 5-0 . Alderman Simmons was absent from the voting . EMERGENCY SERVICES & DISASTER - Alderman Wolff stated that work is being 4one on the program . LIGHTS , TELEPHONE & GAS - Alderman Smith , upon committee recommendation , moved to award the Cable TV franchise to Consolidated Cable Utilities , Inc . and direct the Attorney to draw up the necessary legal documents , seconded by Alderman Harker . The representative from Consolidated Cable Utilities , Inc . stated that as soon as the Ordinance was passed , construction could immediately begin . The representative from X .W. Mitchell requested Mr . Mitchell be given an opportunity to speak (28) Page 4 April 19 , 1979 again with the City Council to answer any questions . Alderman Smith responded that Mr . Alderman Simmons was absent from voting . POLICE - Alderman Wolff moved to authorize purchase of new uniforms for the Police, Department, expending approximately $1 ,500 .00 , seconded by Alderman Harker . The Earlville Police Department is willing to purchase the used Yorkville uniforms . Roll call vote was taken as follows : Beach - Aye Harker - Aye Hanback - Aye Smith - Aye Wolff - Aye Motion carried 5-0 . Alderman Simmons was absent from voting . Cable TV Con ' t . - Representative from X .W. Mitchell requested the franchise , not being exclusive , be granted to X .W. Mitchell as well . POLICE Con ' t . - Alderman Wolff moved expend $192 .00 to pay the City ' s share of sending, Chief Randall And Sgt . Reuter to the Concept of Consolidation Seminar , May 17-19 , 1979 , seconded by Alderman Harker . Motion carried 5-0 . SEWERS - Alderman Harker called a committee meeting for May 3 , 1979 at 7 : 30 P .M. at the Water Tower Conference Room . Alderman Harker received a letter from Director Madden stating that the sewers at the Woodworth Subdivision have been inspected by the developer' s engineer and the Public Works Department and found satis- factory . Alderman Harker moved that the sanitary system and lift station of Woodworth ' s Subdivision be approved as built, seconded by Alderman Wolff . Motion carried 5-0 . TENNIS COURT COMMITTEE - Director Madden stated that they were once again working on the wiring for the lighting . The newly elected officials were then sworn into office . Mayor Thanepohn gave the Oath of Office to Luanne J . Erickson , City Clerk . Clerk Erickson then gave the Oath of Office to Mayor LeRoy "Bud" Thanepohn , Treasurer Marilyn J . Merkel , Alderman Lawrence A. Beach - Ward 1 , Alderman Blaine Harker- Ward 2 and Alderman Naydene Pierce - Ward 3 . The meeting was adjourned at 9 : 50 P .M.
