City Council Minutes 1979 08-09-79 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE TTNITED (45) CITY OF THE VILI:AGE OF YORKVILLE , KENDALL COUNTY , ILLINOIS HELD AUGUST 9 , 1979 AT CITY HALL. Mayor Thanepohn called the meeting to order at 8 : 00 P .M. and led the Council in the Pledge of Allegiance to the Flag. Clerk Erickson called the roll as follows : Ward 1 - Wolff Ward 2 - Hanback Ward 3 - Simmons Beach Pierce Alderman Harker was absent from Ward 1. A quorum was established . Guests df the evening were Attorney Tom Grant , Mr . Robert Kyes , Mrs . Thomas Kelly, Mr.Paul Hick , Barbara Merten and JoAnne Snyder. The reading of the minutes was waived. Alderman Hanback moved the minutes be approved as presented , seconded by Alderman Beach. Motion carried 5-0 . The reading of the bills was waived. Treasurer Merkel presented the following two bills for payment : Plano Police Department $140 .75 University of Wisconsin 290 .00 (registration fee) Alderman Simmons moved to authorize payment of the bills including the two additions , seconded by Alderman Wolff . Roll call vote was taken as follows : Beach - Aye Hanback - Aye Simmons - Aye Pierce Aye Wolff - Aye Motion carried 5-0 . Alderman Harker was absent from voting . ATTORNEY ' S REPORT - Attorney Dickson read the Ordinance directing the sale of the City-owned property to Ralph and Arlene Blake . Alderman Pierce moved to pass "An Ordinance Authorizing Sale Of Municipally Owned Real Property , Being A Part Of Sublot ' A' , Section 32 , Township 37 , Range 7 East Of The Third Principal Meridian , Etc. Within The United City Of The Village Of Yorkville" . The motion was seconded by Alderman Simmons . Roll call vote was taken as follows : Hanback - Aye Simmons - Aye Pierce - Aye Wolff - Aye Beach - Aye Motion carried 5-0 . Alderman Harker was absent from voting . The Tax Levy Ordinance will be ready for passage at the August 23 , 1979 meeting. MAYOR' S REPORT - Mayor Thanepohn met with representatives of Illinois Bell Telephone , Commonwealth Edison and Northern Illinois Gas companies to discuss the Utility Tax surcharge . Being the matter is so complex at this time , Mayor Thanepohn will inform the public of the outcome as soon as it can all be put into understandable written form to everyone ' s satisfaction . CITY. CLERK - Clerk Erickson asked that reservations be made with her office for the Illinois Municipal League Conference AS SOON AS POSSIBLE . Alderman Simmons moved to designate Mayor Thanepohn to be the Voting Delegate to the 66th Annual Municipal League Conference to be held September 28 through October 1 , 1979 at the Conrad Hilton in Chicago , and Naydene Pierce as Alternate Delegate . The motion was seconded by Alderman , Wolff. Motion carried 5-0 . TREASURER - Treasurer Merkel should receive a partial tax distribution within the next week . Alderman Wolff moved to approve the Treasurer ' s Report , Seconded by Alderwoman Pierce . Motion carried 5-0 . POLICE REPORT - Chief Randall reported that he has had contact with the insurance company in regards to using the Kendall County Canine Unit . The Weed Ordinance list is completed and 37 letters were sent out and thank you cards will be sent out following complaince . Alderman Hanback moved to approve the Police Report , seconded by Alderman Wolff . Motion carried 5-0 . DIRECTOR OF PUBLIC WORKS - Alderman Wolff moved to approve the Public Works reports , seconded by Alderman Simmons. Motion carried 5-0 . BUILDING DEPARTMENT REPORT _ Inspector Madden noted that the parking lot (46) Page 2 August 9 , 1979 in the West Alley has been striped . Alderman Simmons moved to approve the Building Department report , seconded by Alderman Beach . Motion carried 5-0 . Inspector Madden noted that single-family residences have fallen off from the previous year considerably. PLAN COMMISSION - Alderman Beach reported that the next meeting would be Tuesday , August 28 , 1979 at 7 : 30 P .M. at City Hall. BUSINESS & ECONOMIC DEVELOPMENT COMMISSION - Alderman Beach reported that the next meeting would be Tuesday , August 14 , 1979 at 8 : 00 P.M. at the Water Tower Conference Room. OLD BUSINESS - Merten &: .Snyder - Following discussion Alderman Beach moved to recommend to the Kendall County Board that the City Council concurs with the Petition to Re-zone from A-1 to R-3- County Zoning , seconded by Alderman Wolff . Following discussion Alderman Beach then moved to amen!l the motion to recommend to the Kendall county Board that re-zoning from A-1 to R-3 be a] -lower' contingent upon the acxreement by the petitioner that the subject land will include a half-roadway of 33 ft . with utility ease- ments . and that the subject lane will be platted and conform to the Subdivision Control Ordinances of both Kendall County and the City of Yorkville . The Motion was seconded by Alderman Wolff. Roll call vote was taken as follows : Hanback - Aye Simmons - Aye Pierce - Aye G'olff - Aye Reach - Aye Motion carried 5-0 . Alderman Harker was absent from voting . Roll call vote was then taken on the original motion as follows : Hanback - Aye Simmons - Aye Pierce - Aye Wolff - Aye Beach - Aye Motion carried 5-0 . Alderman Harker was absent from voting. Clerk Erickson was directea to convey by Resolution the recommendation of the City Council to the Kendall County Board . Robbie Acres - James Knierum - Kendall Co. - Alderman Beach moved to recommend to the Kendall County Board approval of Robbie acres provided that the developer provide street lights , street marker signs , public access , no private driveways and 33 ft. access & public utility easements . Alderman Beach rescinded his motion. Alderman Beach moved to recommend to the Kendall County Board that the City of Yorkville concurs to the re-zoning of A-1 to R-3 of Robbie Acres Petition on Cannonball Trail . The motion was seconded by Alderwoman Pierce . Roll call vote was taken as follows : Pierce " Aye Wolff - Aye Beach - Aye Hanback - Aye Simmons - Aye- Motion carried 5-0 . Alderman Harker was absent from voting . Swanson Subdivision - Kendall County - Alderman Beach moved to recommend to the Kendall County Board that the City of Yorkville concurs to the re-zoning of subject property from A-1 to R-3 , seconded by Alderman Hanback . Roll call vote was taken as follows : Wolff - Nay Beach - Nay Hanback - Nay Simmons - Nay Pierce - Nay Motion defeated. Alderman Harker was absent from the vote . Harker Pre-application sketch for Annexation - Alderman Beach reported that the committee has no recommendation ready at this time . Robert Kyes - Upon recommendation by the Zoning Board of Appeals , Alderman Hanback moved to approve the non-comforming use of the residual lot owned by Robert Kyes , seconded by Alderman Beach . Roll call vote was taken as follows : Beach - Aye Hanback - Aye Simmons - Aye Pierce Nay Wolff - Aye Motion carried 4-1 . Alderman Harker was absent from the vote . Alderman Hanback moved to pass , Ordinance No. 12-1979 granting the following variances to Robert & Violet Kyes : 1 . to allow 10 ,800 sq. ft. proposed building site , a 90% variation . 2 . to provide a 34 ft. rear yard. Alderman Beach seconded the motion . Roll call vote was taken as follows : Hanback - Aye Simmons - Aye Pierce - Nay Wolff - Aye Beach - Aye Motion carried 4-1. Alderman Harker was absent from voting . Page 3 August 9 , 1979 (47) EMERGENCY SERVICES & DISASTER - Alderman Simmons reported that Chief Randall & Tom Usry will attend a Disaster Management Workshop on August 23 , 1979 . FINANCE - Alderman Simmons called a committee meeting in regards to the Tax Levy for Thursday , August 16 , 1979 at 8 :00 P .M. at the Water Tower Conference Room. POLICE - Alderman Wolff moved to reject the Police Garage Bids due to the high bids submitted , seconded by Alderman Hanback . Motion carried 5-0 . Alderman Wolff moved to advert se for sealed bids for a smaller pole type building for the Police Garage , seconded by Alderman Hanback . Motion carried 4-1 . Alderman Beach voted Nay. . Alderman Wolff moved to advertise for additional school crossing guards and requested Attorney Dickson to draw up an Ordinance creating a position for additional school crossing guards , seconded by Alderman Hanback . Motion carried 5-0 . Chief Randall reported that he was sending Attorney Dickson a Bike Ordinance to study and make recommendations . PUBLIC PROPERTY & BUILDINGS - Alderman Hanback reported on the Route 47 Bridge Public Hearing held August 8 , 1979 . There will be a functional replacement request needed , that will have to be initiated by the Library Board . Alderman Hanback stated it was his feeling that this would be done far enough in advance to allow for another building before the present building was demolished . SEWERS - Director Madden reported that the Tying of the sewers has been started . STREETS & ALLEYS - Alderman Simmons moved to advertise for bids to replace the sidewalk on Bridge Street on the west side of Route 47 in the downtown business area from Little Joe ' s Tavern to W. Van Emmon Street on a square foot basis . The motion was seconded by Alderwoman Pierce . Motion carried 5-0 . TREES & PARKS - Alderwoman Pierce reported that she received a letter regarding the use of 6-8" seedlings for landscaping , but it was not the size she had requested . Further information will be obtained . Alderman Beach moved to adjourn the meeting , seconded by Alderman Wolff . Motion carried 5-0 .
