M . and led the Council ' in the Pledge of Allegiance to the Flag . Clerk called the roll as follows : Ward 1 - Wolff I-lard 2 - Harker hard 3 - Simmons Beach Hanback Pierce A quorum was established . Guests included Marshal Stevens in regards to a pinball license application , Dr . Coleman of the Plan Commission , James Clarage , Jim Callison from F . S . Services , Attorney Kramer and Mr . Knierum regarding Robbie Acres . The reading of the minutes from the October 11 , 1979 meeting was waived . Alderman Hanback moved the minutes be approved as presented , seconded by Alderwoman Pierce . Motion carried 6-0 . ATTORNEY ' S REPORT - Alderman Wolff moved to pass the Ordinance Annexing Territory to the United City of the Village of Yorkville , Kendall County , Illinois known as the Beaudry Church Property on Route 126 and Mill Street . The motion was seconded by Alderman Harker . Roll call vote was taken as follows ' Beach - Aye Harker - Aye Hanback - Aye Simmons - Aye Pierce - Aye Wolff - Aye . Motion carried 6-0 . Alderman Harker moved to adopt the Resolution Approving the Resubdivision of Kenny Resubdivision , Tuma And Fox River Gardens , Bristol Township , Kendall County , Illinois , seconded by Alderman Simmons . Roll call vote was taken as follows : Harker - Aye Hanback - Aye Simmons - Aye Pierce - ,Aye Wolff ,- Aye Beach - Aye Motion carried 6-0 . Alderman Harker moved to approve the Architectural Agreement regarding the with James Clarage & Associates and the City of YorkvillelP blic Library , as architectural consultant with compensations to be 617% 0 the project construction cost with the initial design phase to be done on . an hourly basis which is to be credited to the standard fee when the project proceeds . The motion was seconded by Alderwoman Pierce . Roll call vote was taken as follows ' Hanback - Aye Simmons - Aye Pierce - Aye Beach - Aye Wolff - Aye Harker - Aye Motion carried 6-0 . MAYOR ' S REPORT - Mayor Thanepohn reported on Student Government Day held earlier on October 25 , 1979 . Mayor requested student representatioi at City Council meetings in order to form a liaison between the school administration , students and the City . Mayor Thanepohn stated the area Finance meeting will be attended on November 1 , 1879 at 8 ! 00 P . M . by Finance Chairmen , Mayors and City Treasurers from Plainfield , North Aurora , Plano , Oswego , Sandwich , etc . Mayor Thanepohn reminded the Council of only one meeting in November on the 15th at 8 : 00 P . M . There will be an Accountability Session on November 29 , 1979 involving both the City Council and The Community Center Advisory Committee . Alderman Wolff moved to grant the request of the Knights of Columbus of Oswego to hold their annual Tootsie Roll Drive , seconded by Alderman Hanback . Motion carried 6-0 . Mayor Thanepohn reported he received a letter from the Illinois EPA in regards to the Infiltration/Inflow portion of the Yorkville Facilities Plan and they concur with the conclusion that 1 / 1 is possibly excessive . A Sewer System Evaluation Survey is now needed to determine locations of extraneous water entry into the system' and the cost-effective level of sewer rehabilitation . A checklist of items needing to be submitted was enclosed . To ensure continued review of the project , correspondence in response to the letter of October 19 , 197 must be made within 60 days . (64) Page 2 nctober 25 . 1979 PLAN COMMISSION - Alderman Beach read the minutes from the October 23 , 1979 Plan Commission meeting . In regards to Item 79 . 30 , Countryside Subdivison , Unit 8 , John Conover, Dr . Coleman requested that copies of the letter requesting Mr . Conover to comply with the Yorkville Subdivision Control Ordinance also be sent to the Chairman of the Kendall County Board and George Bell . Attorney Dickson stated that the plat does not comply with the City Subsivision Control Ordinance and is within the( one and one-half ( 12) mile jurisdiction of the City and that the reasons set forth for denim be presented in writing within 90 days of filing . must Alderman Hanback moved to approve the Resolution No . 52- 1979 Concern- ing Application for Approval for Unit #8 , Countryside Subdivision , Bristol Township , Kendall County , Illinois , setting forth the reasons for denial of the plat . The motion was seconded by Alderman Wolff . Roll call vote was taken as follows : Pierce - Aye Wolff - Aye Beach - Aye Hanback - Aye Harker - Aye Simmons - Aye Motion carried 6-0 . Alderman Beach moved to approve the Petition for Rezoning from B-3 to M-1 by Ivan Anderson for a parcel on Rt . 47 & 71 within the 12 mile jurisdiction of the City of Yorkville , seconded by Alderman Wolff . Roll call vote was taken as follows : Wolff - Aye Beach - Aye Harker - Aye Hanback - Aye Simmons - Aye Pierce - Aye Motion carried 6-0 . OLD BUSINESS_ Alderman Beach moved to approve the Preliminary Plat of Robbie Acres (James Knierum) contingent on the circular turn-around at the end of Kathleen Court being enlarged to 100 ' curb to curb , and that there be more engineering on water retention and runn -off , subject to City Engineer ' s approval , to be indicated on the Final Plat . The motion was seconded by Alderman Harker . Roll call vote was taken as follows : Beach - Aye Harker - Aye Hanback - Aye Simmons - Aye Pierce - .Aye Y6l ff - Aye Motion carried 6-0 . PARK COMMISSION - Alderman Hanback reported the commission met on Tuesday , October 23 , 1979 to discuss the winter programs to be sent to the press . BUSINESS & ECONOMIC DEVELOPMENT COMMISSION - Alderman Beach announced the next meeting would be November 13 , 1979 at 7 : 30 P . M . at the Water Tower . COMMUNITY CENTER COMMITTFE - Alderwoman Pierce reported the next meeting would be November 19 , 1979 at 8 : 00 P . M . at the Water Tower at which time the outer-drawings of the Community Center Building would be avail - able for review . SFNIOR CITI7FN REPRESFNTATIVE - Mrs . Charlotte Smythe states the Senior Foxes appreciate the welcome they are given at the City Council meetings each time . NE14 BUSINESS - City Council received an application for sewer construc- tion permit from owner of George ' s Restaurant at Routes 34 & 47 . Following a discussion of the permit and construction plans it was moved by Alderman Wolff and seconded by Alderman Harker that the application permit and plans be referred to the sewer committee for review at a meeting at the Water Tower Conference room on November R , 1979 at 8 : 00 P . M . Motion carried 6-0 . BUILDING & ZONING - Alderman Beach moved to Amend the Subdivison Control Ordinance , Section 3 . 01 - "Jurisdiction" , by deleting the ''contiguous" , and directina Attorney Dickson to draw up an Ordinance Amending the change . Motion was seconded by Alderman Wolff . Alderman Beach moved to Amend the Subdivision Control Ordinance , Section 8 . 06 - Sidewalks , by deleting `'having an average lot width of one hundred and twenty ( 120) feet , or less . " , and directing Attorney Dickson to draw up an Ordinance Amending the change . Motion was seconded by Alderwoman Pierce . Motion carried 6-0 . Page 3 October 25 , 1979 (65) FMERGFNCY SERVICES & DISASTFR - Alderwoman Pierce reported the Committee was beginning work on the phone book of emergency numbers . FINANCE - Alderman Simmons announced there would be a committee meeting immediately following the adjournment of the regular meeting in regards to the Pinball License application . LIGHTS , TELEPHONE & GAS - Alderman Wolff asked the City Council give consideration helping fund the lighting of the high school football field when budgeting for the next year . POLICE - Alderman Wolff moved to adopt the Resolution Adopting Rules & Regulations for the Police Department of the United City of the Village of Yorkville , seconded by Alderman Hanback . Roll call vote was taken as follows : Pierce - Aye Wolff - Aye Beach - Aye Harker - Aye Hanback - Aye Simmons - Aye Motion carried 6-0 . SEWERS - Alderman Harker moved to advertise for seated bids for the Public Works used truck F backhGe to be opened November 15 , 1979 at the regular meeting of the City Council , seconded by Alderman Han - back . Motion carried 6-0 . STREETS & ALLEYS Alderman Simmons moved to authorize expenditure up to $2 , 500 for draintile for the East side of Mill Street from East Ridge Street to Fast Van Emmon Street , seconded by Alderman Wolff . Roll call vote was taken as follows ; Beach - Aye Harker - Aye Simmons - Aye Hanback - Aye Pierce - Aye Wolff - Aye Motion carried 6-0 . Alderman Simmons moved to authorize expenditure up to $ 1 , 000 to purchase a snow-blower for the Pubtlic forks Department to be used to clear the sidewalks on the Route 47 Bridge , seconded by Alderman Harker . Roll call vote was taken as follows - Harker - Aye Hanback - Aye Simmons - Aye Pierce - Aye Wolff - Aye Beach - Aye Motion carried 6-0 . TREES & PARKS - Alderwoman Pierce thanked the City Public Works Employees who helped planting tulips in the park the past week . LIBRARY BOARD - Alderman Harker reported the board had met October 24 , 1979 with Mr . Clarage present . Preliminary drawings were presented for review. Mayor Thanppohn stated that if the Library and Community Center buildings were on the same site the same building structure should be adapted to both . TREES & PARKS (con ' t) - Alderman Beach reported he sent letters to all City Council members following the Committee meeting regarding the McHugh Property . addressed to Attorney Wilson . TENNIS COURT COMMITTEE ; - Alderman Hanback reported there were $ 135 maintenance expenses for the past month and the school would pick up half of that expense . Conover and Alice V. Conover for approval of the plat of Unit #8, Countryside Subdivision, Bristol Township, Kendall County, Illinois, and WHEREAS, it appears that the proposed subdivision is within 1 1/2 miles of the corporate limits of the UNITED CITY OF THE VILLAGE OF YORKVILLE, and is governed by the Subdivision Control Ordinance and the Comprehensive Plan of the UNITED CITY OF THE VILLAGE OF YORKVILLE, and WHEREAS, it would appear that the proposed plat for Unit #8, Countryside Subdivision is deficient in many respects, including a failure to provide curbs and gutters, street lights, adequate storm water detention or sewers, sidewalks, as well as dedication of the public utilities and easements for storm-sewer and utilities, NOW, THEREFORE, BE IT RESOLVED by the UNITED CITY OF THE VILLAGE OF YORKVILLE that the application of John G.
