Mayor Thanepohn called the meeting to order at F : 00 P . M . and led the
Council in the Pledge of Allegiance to the Flag .
Deputy Clerk Madden called the roll as follows :

Alderwoman Pierce was absent from Ward 3 . A quorum was established .
The reading of the minutes was waived . Alderman Wolff moved to
approve the minutes of the October 25 , 1979 meeting as presented ,
seconded by Alderman Harker . Motion carried 5-0 .
Alderman Harker moved to authorize payment of the bills presented ,
seconded by Alderman Simmons . Roll call vote was taken as follows :

ATTORNEY ' S REPORT - Attorney Dickson read the amendment to the Sub-
division Control Ordinance regarding Jurisdiction (Sec . 3 . 01 )1 and.-.
Sidewalks ( sec . $.06) . Alderman Beach moved to pass the Ordinance
# 19- 1979 entitled ''An Ordinance Amending Sections of the Subdivision
Control Ordinance of the United City of the Village of Yorkville ,
Kendall County , Illinois . Motion was seconded by Alderman Hanback .
Roll call vote was taken as follows :

An Amendment to the Ordinance to ''License and Regulate Amusement

of the Village of Yorkville , Kendall County , Illinois'' was read by
Attorney Dickson . A motion was made to pass Ordinance #20- 1979 by
Alderman Simmons , seconded by Alderman Harker . Ro11(,Call vote was

MAYOR ' S REPORT - Mayor Thanepohn read the Proclamation commending
the Yorkville High School Football Team.
Mayor Thanepohn read the Proclamation designating November 18-24
as Family Week .
TREASURER - Alderman Simmons moved to approve the Treasurer ' s Report ,
seconded by Alderman Harker . Motion carried 5-0 .
POLICE - Alderman Wolff moved to approve the Police Department Reports ,
seconded by Alderman Harker . Motion carried 5-0 .
DIRECTOR OF PUBLIC WORKS - Alderman Harker moved to approve the Public

OLD BUSINESS - Attorney Dickson reviewed the Annexation Ordinance
for Yorkshire Estates . Alderman Beach moved to pass the Ordinance#21 -1979
Annexing Territory to the United City of the Village of Yorkville ,
Kendall County , Illinois , sedonded by Alderman Wolff . Roll call vote

Attorney Grant described a Variance being requested for road grade
in Yorkshire Estates . Motion was made by Alderman Beach , seconded

The Final Plat and Engineering Plans for Robbie Acres was presented by
Attorney Kramer in behalf of Jim Knierum. Alderman Beach moved to
approve the Final Plat and Engineering plans for Robbie Acres , seconded

NEW BUSINESS - Deputy Clerk read the bid received from Far] Corrigan " of
$1019 . 00 for the truck and backhoe combination advertised for sale by the
City fo Yorkville . No other bids were received . Alderman Simmons moved
to accept the Corrigan bid of $ 1019 . 00 , seconded by Alderman Wolff . Roll
call vote was taken as follows :

Alderman Wolff reported that no bids were received on the 1976 Olds which
the City had advertised for sale .
Alderman Wolff then read the sealed bids on the new squad car to be
purchased by the City of Yorkville . The following two bids were received :

Alderman Wolff moved that bids be reviewed by Police Chief and if low
bid meets all specifications , the bid of Ron Westphal Chevrolet Sales in
Yorkville with the trade- in will be accepted . Motion was seconded by Alder-
man Harker . Roll call vote was taken as follows :

Motion carried 5-0 . Alderwoman Pierce was absent from voting .
BOILDING & 70_NING - Alderman Beach gave a summary of a letter he received
from Jim Wilson , attorney for the developers of the McHugh Farm . City
Officials and Plan Commission Members are invited to make a tour of the
detention ponds in Arlington Heights for a demonstration of what is planned
for the Mc Hugh Farm development . Alderman Beach said he had polled the
Council members and would contact the Plan Commission members .
Alderman Beach then read a request for review of a Prelimary Plan of
Wildwood Subdivision in respect to Annexation and Rezoning . Also ,
there was a request for an Impact Study of the proposed plan . Mayor
Thanepohn stated that the Impact Study would be made concurrently with the
Plan Commission Review.
Alderman Beach then moved that the Wildwood Subdivision Petition for
Annexation and Rezoning be referred to the Plan Commission , seconded
by Alderman Harker . Motion carried 5-0 .
Mayor Thanepohn reported that the Building Department is utilizing the
services of Paul Buddy and John Simmons , both licensed plumbers , to
ma=ke our plumbing inspections . This arrangement conforms with the
State ' s Mandate as interpreted by the Attorney General .
FINANCE - Alderman Simmons reported on the Five-City Meeting of Mayors ,
Treasurers & Finance Chairmen . The meeting was quite successful and
Plainfield is asking_ that a follow-up meeting be held in their City
in March of 1980 .
Alderman Hanback moved that the discussion of a Pinball License Appli -
cation by Timothy Boeger be removed from the table at this time . Seconded
by Alderman Beach . Motion carried 5-0 .
Application was then discussed and motion was made by Alderman
Simmons that the Application be denied . Alderman Harker seconded the
motion . Roll call vote was taken as follows :
Simmons - Aye Hanback - Aye Harker - Aye Beach - May Wolff - Aye
Motion carried 4- 1 . Alderwoman Pierce was absent from voting .
Application was denied .
LIGHTS , TELEPHONE & GAS - Alderman Hanback reported no progress"
in the Cable TV installations . Alderman Wolff explained that the delay
was caused by the misunderstanding in zoning and use of the proposed
area in Plano and that installation will commerce when this is resolved .
POLICE - Motion was made by Alderman Wolff with a second by Alderman
Harker to purchase equipment for the new squad car similar to that
already installed on the present squad car . Roll call vote was taken
as follows :

PUBLIC PROPERTY & BUILDINGS - Alderman Hanback gave a summary of the
meeting with the Illinois Department of Transportation agents in
regards to payment for , or replacement of , the present library building .
Motion was then made by Alderman Hanback to adopt a Resolution which
waives the requirement of an appraisal by the Illinois Department of
Transportation and to enter into an agreement with the State of Illinois
for Functional Replacement of the library . The motion was seconded
by Alderman Harker . Roll call vote was taken as follows :

Motion carried 5-0 . Alderwoman Pierce was absent from votinq .
Mayor Thanepohn explained that it would be necessary for the City
Council to appoint a liaison man to deal directly with the IDOT
representative . Motion was made by Alderman Beach , seconded by
Alderman Wolff to adopt a Resolution designating Alderman Hanback
as City Representative to work with IDOT for replacement of
the library . Roll call vote was taken as follows :

Motion carried 5-0 . Alderwoman Pierce was absent from voting .
Mayor Thanepohn brought the Council ' s attention to the newspaper
containers placed on City sidewalks for distribution pf papers . No
one on the City Council knew of any requests for permission to place
such containers . Matter was referred to committee .
SEWERS - Alderman Harker reported that the Petition by George ' s
Restaurant to hook on to the City Sewer System has been withdrawn .
Motion was made by Alderman Harker with a second by Alderman
Simmons to engage Baxter & Woodman of Crystal Lake , Illinois to
represent the City of Yorkville as Engineers in completion of the
I & I Study and next step towards completion of the EPA Grant
development . Roll call vote was taken as follows :

Motion carried 5-0 . Alderwoman Pierce was absent from voting .
WATER - Alderman Harker made a motion that the Mayor write a letter to
IDOT requesting the State of Illinois to provide engineering for a
water main to be installed on the proposed bridge spanning the Fox
River . Motion was seconded by Alderman Simmons . Roll call vote
was taken as follows :

Alderman Beach asked for adjournment to Executive Session to discuss a

AN ORDINANCE AMENDING AN ORDINANCE TO
LICENSE AND REGULATE AMUSEMENT DEVICES,
BILLARD PARLORS AND PINBALL MACHINES
IN THE UNITED CITY OF THE VILLAGE OF YORKVILLE,
KENDALL COUNTY, ILLINOIS
WHEREAS, the UNITED CITY OF THE VILLAGE OF YORKVILLE
has heretofore passed an Ordinance to License and regulate
Amusement Devices, Billard Parlors and Pinball Machines, known
as Ordinance NO.11-197,P on thea7/�d_ay of a , 1978, and
WHEREAS, the City Council has considered it be in
the best interests of the public health, safety, and welfare
to provide additional regulations regarding the location, manage-
ment and usage of pinball machines and mechanical amusement
devices.
NOW, THEREFORE, BE IT ORDAINED by the UNITED CITY OF
THE VILLAGE OF YORKVILLE that Ordinance_ No. entitled An
Ordinance to License and Regulate Amusement Devices, Billiard
Parlors and Pinball Machines in the United City of the Village
of Yorkville, Kendall County, Illinois, be and it is hereby
amended to add the following sections, to-wit:
Section 13. REVIEW OF APPLICATIONS BY APPROPRIATE
REGULATORY AGENCIES
All applications for licenses required by this Ordinance,
when filed, shall be referred to the City' s Building and Zoning
Officer to assure compliance with the applicable Building, Zoning,
and Housing Ordinances of the City, and no license shall be granted
to any applicant at any location unless and until the City's Building
and Zoning Officer shall have first certified that the proposed
location complies with the applicable Building, Zoning, and Housing
Ordinances of the City.
Upon receipt of any application for license required by
this Ordinance, the City Clerk shall forward such application to
such other appropriate agencies or administrators as may be affected,
including by not limited to, local Liquor Control Commissioner,
if liquor is to be sold upon the premises where such pinball machine
or mechanical amusement device is to be held, and to the Kendall
County Health Officer, if food is to be dispensed upon the premises.

No license shall be issued until such agency or administrator,
as the case may be, shall have certified that intended location
of the place of business is in compliance with all other appli-
cable ordinances.
Section 14. LOCATION AND MANAGEMENT OF PREMISES
FREQUENTED BY MINORS
No license shall be granted to any place of business
under this Ordinance to operate, maintain or conduct a billard
table, pool table, or pinball machine or amusement device for
the use of minors, which is within three hundred feet (300)
of any school or tavern. For purposes of this Ordinance, tavern
shall be defined as "any place of business whose chief or
principal function is the sale or dispensing of alcoholic
beverages, and not chiefly or principally in the business of
selling food, as measured by gross sales of food compared
to gross sales of alcoholic beverages" .
Every place .of business that permits minors to play
billards, pool, pinball machines, or mechanical amusement devices
shall have in attendance, as a manager or operator of such place
of business, a responsible person, of good moral character, who
is the age of 21 years or more.
Section 15. REPEAL OF INCONSISTENT PROVISIONS
This Amendment shall take effect from and after its
passage and publication according to law, and shall repeal any
inconsistent provisions of any prior ordinances, or parts thereof,
only insofar as the same are consistent with valid provisions of
this Ordinance.

OF THE UNITED CITY OF THE VILLAGE
OF YORKVILLE, KENDALL COUNTY, ILLINOIS
WHEREAS, the UNITED CITY OF THE VILLAGE OF YORKVILLE
has heretofore passed a Subdivision Control Ordinance on the
25th day of September, 1975, and
WHEREAS, the City Council of the UNITED CITY OF THE
VILLAGE OF YORKVILLE considers it in the best interest of the
City to make certain technical amendments to the Subdivision
Control Ordinance,
NOWT THEREFORE, BE IT ORDAINED by the City Council
of the UNITED CITY OF THE VILLAGE OF YORKVILLE that SECTION 3.01
of the Subdivision Control Ordinance of the City as heretofore
passed on the 25th day of September, 1975, be and the same is
amended to read as follows, to-wit:
3.01 - JURISDICTION
This Ordinance shall apply to all subdivision
of land within the incorporated limits of the
City of Yorkville and to all land outside of the
corporate limits of the City of Yorkville, not
more than one and one-half miles beyond its
corporate limits.
BE IT FURTHER ORDAINED that SECTION 8. 06 of the Sub-
division Control Ordinance as heretofore passed shall be amended
to read as follows, to-wit:
8.06 - SIDEWALKS
Concrete sidewalks shall be installed within all
subdivisions.
This Ordinance shall take effect and be in full force
and effect from and after its passage and publication, as provided
