City Council Minutes 1978 02-23-78 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED 17 9' CITY OF THE VILLAGE OF YORKVILLE , ILLINOIS, HELD AT CITY HALL FEBRUARY 23 , 1978 . Mayor Thanepohn called the meeting to order at 8 : 05 P.M. and led the Council in the Pledge of Allegiance to the Flag . Roll Call was taken as follows : Ward 1 - Wolff Ward 2 - Harker Ward 3 - Simmons Beach Hanback Smith A quorum was established. The reading of the minutes from the February 9 , 1978 meeting was waived. Alderman Beach made the following correction: Page 2 , under heading "Plan Commission" , line 11 , delete "February 21 11and add"February 28" . Alderman Smith moved to approve the minutes as corrected, seconded by Alderman Wolff . Motion carried 6-0 . ATTORNEY' S REPORT - Attorney Dickson was absent . Attorney Tom Grant was asked to sit in as "Special Counsel" . Alderman Beach moved to table the Ordinance to reclassify Lots 1, 2 , 3 ,7 & 8 of Lee ' s Resubdivision of Loftus ' Subdivision of Block 3 , Unit 4 , of Countryside Center Subdivision due to conflict of interest . The motion was seconded by Alderman Wolff. Motion carried 6-0 . MAYOR' S REPORT - Alderman Wolff moved to accept Mayor Thanepohn ' s appointment of Betty Huston to the Park Commission to complete the term of Nancy Baird to expire April 30 , 1978 , seconded by Alderman Harker. Motion carried 6-0 . PLAN COMMISSION - Alderman Beach reported the next meeting will be February 28 , 1978 at 8 : 00 P.M. at City Hall . On the agenda will be Mezger' s Yorkshire Estates . Attorney Grant stated Mr. Mezger will submit an alternative proposal of 124 lots . Mr. Mezger will stay with the 71 lot proposal if an agreement can be reached regarding the water situation. HUMAN RESOURCE COMMISSION - Alderman Simmons reported the Accountability Session scheduled for March 30 , 1978 was discussed at the last meeting . The Community Center Committee should be geared to have some infor- mation for the public by that date . BUSINESS & ECONOMIC DEVELOPMENT COMMISSION - Mayor Thanepohn stated the Engineer s breakdown of the estimated costs for the individual property owners has been received and as soon as Attorney Dickson returns a ' legal agreement will be drawn up to submit to the property owners . OTTIZEN COMMENTS - Alderman Beach read the exerpt from the October 25 , 1977 Plan Commission minutes in regards to Bob `Mahoney' s re proposed rezoning . (**See attached copy. ) Valerie Smith representing Conover' s Countryside Residents opposing Mahoney' s rezoning stated the lot numbers differed between the Plan Commission minutes and lots #11 ,12 and 16 the Residents were concerned with as shown on the sketch (**See Attached copy. ) The Residents strongly oppose rezoning to business in a now residential area when there are other areas available. Mrs . Smith stated she had a statement from Pilmer Real Estate (**See attached copy. ) stating that business zoning would devalue residential property in the surrounding area. Mrs . Smith also stated the rezoning would pose a traffic and parking problem. 1 80 Page 2 February 23 , 1978 Mrs . Smith further stated the Residents had not been informed of the City' s Plan Commission Meeting on October 25 , 1978, to raise any opposition. Mayor Thanepohn stated the City Council has never seen the plans presented to the County Board. Alderman Beach stated that technically the City Council cannot take any action being there was no recommendation received from the Plan Commission. Mrs . Smith stated there has been a 32 signature petition opposing the rezoning filed and recorded with the County Clerk and another 82 signature petition was yet to be filed. Mayor Thanepohn stated the City Council would have to have detailed reasons behind any objections to the rezoning to present to the County Board. Alderman Wolff made a motion that a letter be sent to the Kendall County Board recommending withholding action regarding the Mahoney rezoning until the City Council receives a recommendation from the City Plan Commission. The motion was seconded by Alderman Harker. Motion carried 5-1, Alderman Beach voting Nay. Attorney Grant will draft a letter to the Kendall County Board with a copy going to the Plan Commission. OLD BUSINESS - The City Council recommended that Tom McNelis ask for a Variance in regards to abutting Walter and Olsen Streets on the westerly edge of his property. STREETS 8 ALLEYS - Alderman Wolff requested the Clerk to send copies of a letter from Crawford , Murphy 8 Tilly regarding Mezger' s proposed annexations waterline estimates to the members of the City Council. PUBLIC PROPERTY AND BUILDINGS - Alderman Harker stated he had no report on the library building furnace . BUILDING 8 ZONING - Alderman Beach reported a Public Hearing is scheduled, regarding Star k' s proposed annexation, for March 9 , 1978 at 7 : 30 P.M. at City Hall. FINANCE - Alderman Simmons reminded the City Council of the Finance Committee meeting , March 2 , 1978 at the Maintenance Building Conference Room. The meeting will begin at 7 : 30 P.M. with the following order : Police Dept. Representative, Police Chief, Public Works Department Representative and Director of Public Works . The new tentative budget will be reviewed immediately following . BUILDING 8 ZONING - Mayor Thanepohn stated a new zoning map would need to be published by March 31 , 1978 . FINANCE - A Public Hearing on Revenue Sharing is scheduled for March 16 , 1978 at City Hall preceding the regular meeting of the City Council . Mayor Thanepohn reported the City has been the recipient of a Petition to do away with the utility tax. The matter was tabled until Attorney Dickson returns . LIBRARY BOARD - Alderman Harker reported the next meeting will be March 22 , 1978 . Page 3 February 23 , 19718 1 Y.B. S . BOARD - Alderman Harker reported the Yorkville-Bristol Sanitary District has been nominated for an award in Category B to be given out on April 18 , 1978 . TENNIS COURT COMMITTEE - Alderman Hanback reported that $7 ,500 for lighting at the ten-n s courts was in the fund and specifications will be sent out for lighting 3 courts . CHAMBER OF COMMERCE - Alderman Wolff turned in the 1978 Dues bill for 60 . 00 to be included with the February bills at the next regular meeting .
