AN ORDINANCE OF THE UNITED CITY OF YORKVILLE,KENDALL
COUNTY, ILLINOIS, CODIFYING UTILITY POLICIES REGARDING FEES
FOR VACANT DWELLINGS
WHEREAS, the United City of Yorkville (the "City") is a duly organized and
validly existing non home-rule municipality created in accordance with the Constitution
of the State of Illinois of 1970 and the laws of the State; and,
WHEREAS, the City desires to codify certain approved policies for utility fees
for temporary and permanent vacancy of dwelling units; and,
WHEREAS, The Mayor and City Council desire to have these fee waivers part of
the Yorkville City Code.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of
the United City of Yorkville, Kendall County, Illinois, as follows:
Section 1: That Title 7, Chapter 7, of the Yorkville City Code is hereby amended
by adding Section 4 to read as follows:
"7-7-4 Utility Service and Billing Policies
A. Temporary vacant utility account fees; A utility customer that will be absent from
its residence for a period of more than 60 consecutive days with intent to
reoccupy the residence, may apply to have its water and refuse charges waived
during that period except for the following charges per each complete billing
cycle:
(1) YB SD wastewater treatment fee,
(2) Sewer maintenance fee,
(3) Water infrastructure fee,
(4) Sewer infrastructure fee, and
(5) Road infrastructure fee.
It shall be the responsibility of the utility customer to inform the City of their
return and reoccupancy of the residence.
B. Vacant residence utility account fees; A residence that is vacant for more than 60
consecutive days without expectation of reoccupancy such as in foreclosure or if
abandoned may apply to have its water, sewer and refuse charges waived during
that period except for the following charges per each complete billing cycle:
(1) YBSD wastewater treatment fee,
(2) Sewer maintenance fee,
(3) Water infrastructure fee,
(4) Sewer infrastructure fee, and
(5) Road infrastructure fee.

Section 2: This Ordinance shall be in full force and effect upon its passage,
approval, and publication as provided by law.
