City Council Minutes 1978 10-26-78 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, ILLINOIS, HELD AT CITY HALL, OCTOBER 26 , 1978. Mayor Thanepohn called the meeting to order at 8 :00 P.M. and led the Council in the Pledge of Allegiance to the Flag . Roll call was taken as follows : Ward 1 - Wolff Ward 2 - Harker Ward 3 - Simmons Beach Smith Alderman Hanback was absent from Ward 2 . A quorum was established. There were no guests . Alderman Harker moved the reading of the minutes be waived and the minutes be approved as presented, seconded by Alderman Smith. Motion carried . ATTORNEY' S REPORT - Alderman Simmons moved to pass the Ordinance Rezoning Lots 1 , 1 , and 3 of Block_ 2 of Worsley' s Addition to the Village of Bristol , seconded by Alderman Beach. Roll call vote was taken as follows : Wolff - Aye Harker - Aye Simmons - Aye Beach - Aye Smith - Aye Motion carried 5-0. Alderman Hanback was absent. MAYOR' S REPORT - Alderman Simmons moved to accept the resignation of Bill King from the Business & Economic Development Commission , effective immediately, seconded by Alderman Smith. Motion carried 5-0 . Alderman Simmons moved to approve Mayor Thanepohn' s nomination of Roy Dean to fill the vacancy in the Business & Economic Development Commission , with the term running until 1981. The motion was seconded by Alderman Harker. Motion carried 5-0 . Mayor Thanepohn reported on the Library Board meeting . A CETA employee has been hired who will work forty hours per week. The library will now be open Mondays and Wednesdays from 9 :00 A.M. rto 5:00 -P.M. and 6 :00 to 8 : 30 P.M. , Tuesdays and Fridays from 1 :00 to 5 : 00 P.M. and Saturdays 10 : 00 A.M. to 4 :00 P.M. Mayor Thanepohn reviewed the letter that detailed the agreement and was mailed to the Congregational Church. The action taken in the October 12 , 1978 Executive Session and voted on when reconvened into Regular Session on the same date was to offer the Yorkville Congregational Church $150 ,000 for the church , parsonage , property and equipment with the exceptions of any sanctuary furnishings and items and memorials and to allow the Congregational Church to use the building for a period of 5 years for Church services and Sunday School classes on Sunday mornings with negotiations open for further extension of time . The letter received from the Congregational Church stated acceptance of the City' s offer contingent on their ability to raise an additional $100 ,000 by March with an Aprill , 1979 closing date . PLAN COMMISSION - Alderman Simmons read minutes of the Plan Commission meeting of October 24 , 1978, regarding Blaine Harker ' s Pre-application Conference for Annexation of property at the south end of Fox Industrial Park. PARK COMMISSION - Alderman Smith reported on the October 17 , 1978 meeting. Winter programs are scheduled at Circle Center School and seem to be progressing well . 2563, Page 2 October 26 , 1978 OLD BUSINESS - Attorney Ji.m Wilson present.eO Stark' s Annexation Agreement for signatures . Attorney Dickson reminded the Council that the Annexation Petition only asked for Annexation to the centerline of the highway. However , he assured the Council the Annexation Ordinance could specify to the far side of the highway to comply with State Statutes . Alderman Wolff moved to authorize the Mayor , Clerk and all Aldermen to sign the agreement. The motion was seconded by Alderman Simmons . Motion carried 5-0 . Alderman Hanback was absent. NEW BUSINESS - A brief discussion was held on whether or not the City receives a gas allowance from Northern Illinois Gas for franchise. POLICE - Alderman Wolff reported that specifications for -the new squad car are out and he expects a good response from bidders . STREETS & ALLEYS - Alderman Beach read the bids received on the new utility truck for the Public Works Department. Bids were as follows : Coffman Brothers - GMC $7 ,866 . 17 Ron Westphal Chevrolet 7, 595 .00 Hamilton Chev./Olds 7 ,520 .60 Fanning Chevrelet 7,455 .00 Alderman Wolff mentioned that for the slight difference between bids of the local dealer , Westphal Chevrolet , and the lowest bid it would be advantageous to the City to buy the truck locally to avoid the expense of traveling to other towns for warranty service . Alderman Wolff then moved to purchase a 1-Ton Truck Cab & Chassis from Ron Westphal Chevrolet as bid, seconded by Alderman Harker. Roll call vote was taken as follows : Wolff - Aye Harker - Aye Simmons - Aye Beach - Aye Smith - Aye Motion carried 5-0 . Alderman Hanback was absent from voting. WATER - Alderman Smith called for a Committee meeting on November 2 , 197-8 at 7 : 30 P.M. at the Water Tower Conference Room. Eric son , City Clerk w ' a ANNEXATION AGREEMENT THIS AGKEEMENT, made and entered into this CO(O 7�t day of 1978, by and between the United City of the Villuge of Yorkville, Illinois, a municipal corporation located in Kendall County, Illinois, hereinafter referred to as "CITY", and James Stark and Patricia Stark, his wife, of Yorkville, Illinois, hereinafter referred to as +"OWNERS", WITNESSETH: WHEREAS, the Owners, James Stark and Patricia Stark, own the territory described in Exhibit "A" attached hereto and made a part hereof, a portion of which territory consisting of approximately 26 acres is within the corporate limits of the City, the remainder of which territory is not within the corporate limits of any municipality but which is contiguous to the City, and WHEREAS, the Owners are desirous of developing said real estate for business use and are desirous of assuring to themselves that the said land owned by them can be used for said purposes if said land is annexed to the City, and WHEREAS, the Owners have presented and the City has considered the tract of land here inabove-described for-business purposes in order to make said real estate a desirable addition to the City, and WHEREAS , the City is willing to annex the said land to the City and that the Plan Commission and the Zan ing Board of Appeals and City Council have heretofore approved the proposed land use, and the zoning of the same at the request of the Owners, and WHEREAS, all parties to this Agreement are desirous of setting forth certain terms and conditions upon which the land heretoforoescribed herein will be annexed to.the City and also providing for the orderly development thereof, and WHEREAS, James Stark and Patricia Stark, the Owners, and their representative have disoossed the proposed development and have had numerous public meetings with the Plan Commission, the Zan ing Board of Appeals and the City Council , and prior to the execution were hereof notice§/duly published and a public hearing was held to consider this Agreement as required by the statutes of the State of Illinois in such case made and provided, ­ 2 NOW, THEREFORE, for and in consideration of the mutual promises and covenants herein contained, the parties agree under the terms and authority provided in Chapter 24, Section 11-15:1-1 through 11-15.1-5 of the Illinois Revised Statutes, 1977, as amended,. as follows: ' 1, That upon the filing with, and presentation to, the City of a Petition for Annexation to the City, the City shall adopt an Ordinance Annexing to the City so march of the property described in Exhibit "A" as is not now within the corporate limits of the City; and that the City shall, in said Ordinance, zone the entire parcel of real estate described in Exhibit "A", subject to the further terms of this Agreement, into three (3) business districts appropriately zoned to B-1, B-2 and B-3, as indicated an the diagram attached hereto as Exhibit "B", and made a part hereof, and that said real estate be allowed the use, size, density, areas, coverage, maximum building height as set forth an Exhibit "C" which is attached hereto and made a part hereof. 2. That in connection with the development of the land hereinabove described, the Owners shall comply with fie provisions of the Subdivision Control Ordinance and of all other ordinances of the City in effect from the time of this Agreement and it is further agreed that all ordinances relating to subdivision control, zoning, official plan and building, housing and related restrictions which would affect that portion of the property described herein be continued ins affect for a term of ten (10) years from and after the date of this Annexation Agreement. 3. That the Owners have requested that the City grant to said Owners, a variance of the provisions of Section 7.03 of the Subdivision Control Ordinance, allowing Owners to install 40-foot streets and 75-foot right of ways, said request having been granted by the City. It is further agreed, that as a condition to the granting of the variance described herein, the City shall authorize and invoke an Ordinance prohibifng on-street parking within so much of the property described in Exhibit "A". 4. That the Owners shall execute covenants running with the land, to the municipality as well as to individual landowners prohibiting the installation for the construction of entrance- ways or driveways other than those which appear an diagram which has been attached hereto as Exhibit "B". - 3- 5. That the Owners agree that the presently existing wooded "preen" area which runs in an easterly and westerly direction along Walnut Street shall not be removed-from Walnut Street and the Owners property. That the Owners agree to install, extend and lay, at their initial expense, from the closest existing end of a water main as presently consituted to the property described in Exhibit "A:, the same be hg one (1) water main at least 8" in diameter, or such larger size as may be approved by the engineers, and it is further agreed that all hook-up ,charqes or tap-on fees collected by.the City within three (3) years of the date of approval of the final plat of the proposed development collected for connections made in the property described in Exhibit "A" shall be remitted to James Stark and Patricia Stark as a reimbursement for their expense in extending the water mains to the property described herein, together with interest thereon at the rate of 80/6 per _. annum*. The sums so collected shall be remitted to the Owners within thirty (30) days of collection, any hook-up charges collected by the City in excess of the cost of constructing water mains to the property described herein, together with interest at the rate of 8% per annum as aforesaid on the initial cost thereof shall be retained by the City regardless of when the same is collected. The City shall not be obligated to Owners for any costs of construction or laying of water mains to the property described herein, together with'interest thereon at the rate of 8% per annum, not collected by the City within three (3) years from the date of the approval of the final plat of the proposed development as aforesaid. 6. That the Owners shah install, extend and lay at their initial expense, sewer lines from the closest and of a sewer line as presently constituted in said City-to the property described in Exhibit "A" attached hereto, and shall install, if necessary, a lift station along said sewer line; that all hook-up charges or top-on fees collected by the City within three (3) years from the date of the final plat collected for connections within the property described in Exhibit "A" shall be remitted to James Stark and Patricia Stark as a reimbursement for their expense of extending sewer lines to the property described herein, together with interest thereon at the rate of 8% per annum. The sums so collected shall be remitted to Owners within thirty (30) days of collection. Any hook-up charges collected in excess of the cost of construction of the sewer Hines to the property described herein, together with interest thereon at the rate of 8% per annum as aforesaid an the initial cost thereof, shall be retained by the City regardless of when the same is collected. The City shall not be obligated to the Owners for any cost of construction or laying of sewer lines to the property v - 4 - described herein, together with interest thereon at the rate of 8% per annum, not collected by the City within three (3) years from the date of approval of the final plat of the proposed sub- division aforesaid. The reimbursement of hook-up charges and tap-on fees herein referred to shall apply only to tho;e hook-up charges or tap- an fees imposed and collected by the City and shall not deem to include any hook-up charges or tap-on fees or other charges imposed or collected by the Yorkville-Bristol Sanitary District. All of the aforesaid sewer installation, including the proposed lift station, shall be in accordance with specifications approved by the City engineer. 7. To the extent required by City Ordinance, of by the engineering studies, Owners agree to install any necessary water detension facility and suitable storm sewers to remove surface water from the proposed subdivision. 8. . The City hereby agrees to waive any and all futur a Impact Study Committee meetings pertaining to the property described herein and Owners agree to contribute the sum of $188.00 per lot as shown in Exhibit "B" in accordance with the recommended impact study contribution table, a copy of which is attached hereto as Exhibit "D" and made a part hereof. It is further agreed by and between the parties hereto that any land donated to the Cityby. Owners shall be appraised and that the amount of that appraisal shall be applied to, in lieu of, and constitute a reduction in the total obligation of the Owners for the Impact Study contribution as provided for herein. 9. It is understood that Owners' property which is being annexed to the City as a business development is not subject to a cash land grant ordinance. 10. That subsequent to the execution of this Agreement, and within six (6) months thereof, the Owners shall submit a Petition .for Annexation to the City so that the property described herein can be annexed in accordance with the terms of this Agreement. 11. That the Owners shall can form and be subject to all permit fees of the City which shall be in effect from time to time unless specifically stated to the contrary herein. 12. That the Owners shall conform and be subject to the Subdivision Control Ordinance of the'City at the time the property is platted unless specifically stated to the contrary herein. 13. That this Agreement'shall be in full force and effect for a period of ten (10) years . ti� - 5 - from and after its execution by the parties hereto, and shallbe and is binding upon the successore,i; executors, administrators and assigns of the respective parties hereto.
