City Council Minutes 1977 12-15-77 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED
CITY OF THE VILLAGE OF YORKVILLE , ILLINOIS , HELD AT CITY HALL ,
DECEMBER 15 , 1977 .
Mayor Thanepohn called the meeting to order at 8 : 07 P . M . and led the
Council in the Pledge of Allegiance to the Flag .
Roll call was taken as follows :
Ward 1 - Beach Ward 2 - Hanback Ward 3 - Simmons
Harker Smith
A quorum was established . Alderman Wolff was absent from Ward 1 .
Alderman Harker made a motion to waive the reading of the minutes
and approve the minutes as presented , seconded by Alderman Hanback .
Motion carried 5-0 .
The reading of the bills was waived . Alderman Smith moved to authorize
payment of the bills presented , seconded by Alderman Hanback . Roll call
was -taken as follows :
Beach - Aye Hanback - Aye Simmons - Aye
Harker - Aye Smith - Aye
Motion carried 5-0 .
ATTORNEY ' S REPORT - Alderman Hanback made a motion to waive the reading
of and pass the Ordinance establishing a Business & Economic Develop-
ment Commission passed October 24 , 1974 to increase its membership ,
seconded by Alderman Smith . Roll call vote was taken as follows :
Beach - Aye Hanback - Aye Simmons - Aye
Harker - Aye Smith - Aye
Motion carried 5-0 .
Alderman Simmons made a motion to waive the reading of and pass the
Ordinance establishing the 1978 regular meeting dates of the Yorkville
City Council as follows :
For the months of January , February , April , May , June , July ,
August , September & October , the second and fourth Thursdays ;
for the months of March and November , the third Thursday only ;
and for the month of December , the second Thursday only .
Alderman Smith seconded the motion . Roll call vote was taken as
follows :
Beach - Aye Hanback - Aye Simmons - Aye
Harker - Aye Smith - Aye
Mo ion carried 5-0 .
At orney Dickson stated that in regards to a conversation with the
Vi lage Attorney of Oswego relating to the patrol of Yorkville ' s
st eets by the Oswego Police Department , when there is a voluntary
ex hange , they wish to insure Yorkville ' s Police while responding
to calls and patroling while in the Village limits of Oswego and
Yorkville to cover Oswego while responding to calls and patroling
while in the City limits of Yorkville . Marilyn Merkel has advised
the insurance company and the Oswego Police will be covered the
ev ning of December 15 , 1977 while responding to calls and patroling
th City limits of Yorkville . Oswego Police Department wishes to
en er into a formal agreement for future exchange and calls , but
Al erman Simmons stated the new insurance company wishes it to be
th opposite way . Mayor Thanepohn stated an agreement was needed
fo other surrounding Police Departments for assists of this nature .
Al erman Wolff arrived at 8 : 15 P . M .

Attorney Dickson reported that in regards to the Conover suit , a motion
to dismiss has been filed and it comes up for argument on Monday , December
19 , 1977 .
MAYOR ' S REPORT - Alderman Beach moved to allow Jackie ' s Tap and other
City liquor license holders to have a 2 : 00 A . M . closing time on
Saturday , December 31 , 1977 ,, seconded by Alderman Smith . Motion carried
6-0 .
Mayor Thanepohn read the resignation of Al Spera from the Yorkville
Police Department for personal reason , effective December 31 , 1977
at 3 : 00 P . M . Alderman Smith made a motion to accept the resignation ,
seconded by Alderman Simmons . Motion carried 6-0 . Mayor Thanepohn
indicated to Lt . Spera the gratitude of himself and the City for his
10 years of dedicated service . Alderman Smith and Director Madden
expressed their appreciated to Lt . Spera for his cooperation and
service to the Community .
Alderman Smith made a motion to accept the appointment by Mayor Thanepohn
of Ronald E . Diederich to fill the position that will be vacated by
Lt . Spera effective January 1 , 1978 , with the personnel policy applicable .
The motion was seconded by Alderman Wolff . Motion carried 6 -0 .
TREASURER ' S REPORT - Alderman Wolff moved to approve Treasurer Merkel ' s
report , seconded by Alderman Harker . Motion carried 6-0 .
POLICE - Alderman Harker moved to approve the Police Report , seconded
by Alderman Wolff . Motion carried 6-0 .
PLAN _COMMISSION - Alderman Beach reported there would be no December
meeting of the commission .
PARK COMMISSION - Alderman Smith corrected the meeting date of the
Park Commission minutes to be December 5 , 1977 , deleting December 1 , 1977 .
Alderman Smith requested Director Dalton to make a report for the City
Council on the Commission ' s activities . The skating rink was delayed due
to the weather .
COMMUNITY CENTER - Alderman Smith reported the Sub-committees were all
actively working with interest . There will be a meeting with the
Department of Local Governmental Affairs representative on December 8 ,
1977 at 7 : 30 P .M . at City Hall to see what help is available through
grants .
Alderman Smith moved to authorize the Community Center Advisory Committee
to utilize the City Planner services as needed at a cost of approximately
$85 per meeting , seconded by Alderman Simmons . Motion carried 6 -0 .
OLD BUSINESS - Attorney Kramer in behalf of his client Robert Loftus
asked that the City Council consider the Petition for the Vacation of
Powers Court . Alderman Beach then read the minutes of the Public
Hearing of November 17 , 1977 ( see copy attached) . Alderman Beach
then read the conditions which had been required by the Plan Commission
meeting of October 25 , 1977 , Sec . 77 . 28 , but had not yet been met ,
i . e . , condition No. 2 , Condition No . 3 ( see copy .attached) and agree-
ment by Attorney Kramer and Mr . Loftus providing for 2 inches of
bituminous surfacing of all parking lots ( see copy attached ) . Alderman
Beach then read a letter from Building Inspector Madden ( see copy
attached) stating, that the surfacing was not satisfactory .

Attorney Kramer then replied that conditions 2 & 3 would be accomplished
upon completion of Powers Court . In the meantime an escrow account
would be set up in the amount of twice the estimated cost of these two
conditions .
Concerning the parking lots Attorney Kramer stated that Mr . Loftus had
signed a contract with Midway Contractors for grading , preparing and
applying a 2 inch surface . No provisions were made for an inferior job
at a reduced price . He also stated that Mr . Loftus has a guarantee
from Midway Contractors that the surface is 2 inches thick , will not
crack , and will be waterproof for a period of 2 years .
Attorney Grant then took the floor and explained that the final
engineering , plans and bonding were being deferred until they were
sure that the City Council was going to vacate Powers Court . He then
asked the City Council to consider the vacation of Powers Court with
the understanding that all the previously discussed conditions would be
provided for by performance bonds before the final signing of the
vacation and of the final plats .
Attorney Dickson asked to be supplied by the Petitioners with a final
plat of Powers Court as it was originally dedicated .
Attorney Dickson then expressed an opinion that if approval of
vacation be given , the final platting and vacation would be conditioned
upon that bonding .
A discussion was then held between the Attorneys and City Council to
determine what features would need to be bonded and the amount of the
required bonds . The Secretary was instructed by Mayor Thanepohn to
poll the Council on the question , "Would you , upon presentation of
acceptable bonds , and that covers a lot of ground , vacate Powers
Court? Deadline of completion of required conditions will be set at
June 1 , 1978 . " Also added to the condition of the question was the
agreement of the Petitioner to pay the City Engineer ' s fees . This was
agreed to by the Petitioner , Loftus . Roll call poll vote was then taken
as follows :

Smith - Yes Harker - Yes Wolff - Yes
Poll vote was unanimous .
PUBLIC PROPERTY & BUILDINGS - Alderman Harker moved that the Council
purchase four more chairs for the new conference room at the Water
Tower , seconded by Alderman Wolff . Motion carried 6-0 .
POLICE - Alderman Smith reported that arrangement had been made with
Al Spera to continue as Firearms Instructor with the Yorkville Police
Department .
FINANCE
Alderman Simmons announced the Budget Time-table . There will be a
meeting January 19 , 1978 at 8 : 00 P . M . with the Department heads and
committee chairmen , Finance Committee and Treasurer Merkel . The
meeting will be held at the Maintenance Building conference room .
February 16 , 1978 will be a meeting between the Finance Committee ,
Bill Sanders , Auditor and Treasurer Merkel .
March 16 , 1978 at 7 : 30 P . M . preceding the City Council meeting there
will be a Public Hearing on Revenue Sharing .

April 13 , 1978 , at 7 : 30 P ,M , preceding the City Council meeting there
will be a second Public Hearing on Revenue Sharing and a Public Hearing
on the Budget .
Alderman Simmons then called for a meeting of the Insurance Committee
at City Hall on December 29 , 1977 at 8 : 00 P . M . Alderman Beach asked
that discussion on the City Planner be included . Alderman Wolff asked
that a meeting also be included with the Water Committee regarding
Mezger ' s proposed subdivision .
Alderman Smith moved to adjourn the meeting at 9 : 10 P . M . , seconded
by Alderman Wolff .
