City Council Minutes 1977 12-01-77 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE , ILLINOIS , HELD AT CITY HALL , DECEMBER 1 , 1977 . The meeting was called to order at 8 : 02 P . M . by Alderman Beach who sat in for Mayor Thanepohn , and the Pledge of Allegiance to the Flag was given . Roll call was taken as follows : Ward 1 - Beach Ward 2 - Harker Ward 3 - Simmons Smith Absent from Ward 1 was Alderman Wolff and from Ward 2 was Alderman Hanback . A quorum was established . The reading of the minutes was waived . Alderman Smith moved the minutes be approved as presented , seconded by Alderman Simmons . Roll call vote was taken as follows : Beach - Aye Harker - Aye Simmons - Aye Smith - Aye Motion carried 4-0 . The reading of the bills was waived . Treasurer Merkel added a bill from Jim ' s Trenching in the amount of $440 for 220 feet of water main at Fox Industrial Park . Alderman Beach added 2 bills from Betty Huston for secretarial services for the Plan Commission for September and October in the amount of $64 . 08 and for the Zoning Board of Appeals for the 11 /15/77 meeting for $20 . 00 . Alderman Simmons moved to authorize payment of the bills including the 3 additions , seconded by Alderman Harker Roll call vote was taken as follows : Beach - Aye Harker - Aye Simmons - Aye Smith - Aye Motion carried 4-0 . ATTORNEY ' S REPORT - Attorney Dickson reviewed and recommended passage of the Land Cash Grant Ordinance . Alderman Beach stated the Ordinance had taken 12 years of study and preparation and will hopefully stand up in court pending the decision of the Illinois State Supreme Court regarding the Illinois Home Builders Association of Greater Chicago ' s petition against the La.nd And/Or Cash Ordinance . Alderman Simmons made a motion to pass the Land And/Or Cash Ordinance , seconded by Alderman Harker . Roll call vote was taken as follows : Beach - Aye Harker - Aye Simmons - Aye Smith - Aye Motion carried 4-0 . Alderman Smith moved to approve the Resolution adopting and recommending the guide lines to be used by the Impact Study Committee to be used only for annexations , seconded by Alderman Simmons . Roll call vote was taken as follows : Beach Aye Harker - Aye Simmons - Aye Smith - Aye Motion carried 4-0 . Alderman Smith moved to approve the Public Works Reports , seconded by Alderman Harker . Motion carried 4-0 . Mayor Thanepohn arrived at 8 : 15 P . M . MAYOR ' S REPORT - Minutes from the Palmer Dam pre-construction meeting have been received from the Illinois Department of Transportation . A letter from the Illinois Department of Transportation was received regarding the traffic signal . Additional funds have been secured to permit installation of the traffic signal at Route 47 and Van Emmon Street during the current fiscal year . The City ' s cost will be Page 2 December 1 , 1977 -. $ 14 , 700 , one-half of the alloted Motor Fuel Tax for one year . The City will assume maintenance and energy costs of the system after installation is complete . Alderman Smith moved to re- instate Ronald Reuter to active duty in the Police Department , seconded by Alderman Beach . Motion carried 4-0 . Motion carried 4-0 . A thank-you was received from Joan Wolff for the cards and flowers during her stay in the hospital and recuperation at home . PLAN_ COMMISSION - Alderman Beach reported there were no minutes avail - able from the November meeting . There will be no December meeting . PARK COMMISSION - The next meeting is schuduled for Monday , December 5 , 1977 at 7 : 00 P . M . at the Water Tower Conference Room. HUMAN RESOURCE COMMISSION - Alderman Simmons reported there would be a questionaire to go out with the December mater bills . BUSINESS & ECONOMIC DEVELOPMENT COMMISSIOM - Alderman Beach reported the next meeting would be December 13 , 1977 at 8 :00 P . M . at City Hall . Two (2) copies of the Downtown Improvement Manual have been received . Alderman Beach made a motion to authorize the Attorney to amend the Ordinance to expand the Business & Economic Development Commission to seven (7) members , seconded by Alderman Harker . Motion carried 4-0 . COMMUNITY CENTER COMMITTEE - The next meeting will be Tuesday , December 6 , 1977 at 7 : 30 P . M . at City Hall . OLD BUSINESS - Attorney ' s Grant & Kramer asked the Kountryside Kommons final plat & vacation of Power ' s Court matters be tabled until all of Alderman were present and preferred not to call Alderman Wolff for a 3/4 quorum . Alderman Beach made a motion to table the matter regarding the approval of the final plat of Kountryside Kommons and Vacation of Powers Court. upon the request of Attorney ' s Kramer & Grant . The motion was seconded by Alderman Simmons . Motion carried 4-0 . COMMUNITY CENTER COMMITTEE , CON ' T - Alderman Simmons has visited the Oswego/Boulder Hill Community Center and Alderman Beach has visited the Batavia Community Center . Alderman Beach stated he felt the Batavia Community Center was more geared to Yorkvi1le ' s needs . Page 3 December 1 , 1977 1 .) 9 STREETS & ALLEYS - Alderman Beach reported the Fast-blest signs for Kendall Drive in Countryside Center have been ordered . Mayor Thanepohn reported the Communication System is being worked on . HEALTH 6 SANITATION - A letter was sent ' by the City Attorney to the Conservator of the McHugh Estate indicating the existing conditions and requesting abating them . The City has been contacted by Russ Chapman , a local representative of the property and there is consideration being given as to the necessary steps to take , on the matter . TREES & PARKS - Upon recommendation of the Committee Alderman Harker moved to give the gazebo project and 'tennis court lighting project to the Park Commission . The motion was seconded by Alderman Simmons . Motion carried 4-0 . Alderman Smith is to represent the City Council at the Park Commission ' s meetings . FUTURE PLANNING - Alderman Beach called a general full committee meeting Thursday , December 8 , 1977 at 7 : 30 P . M . at City Hall regarding re-neg- otiations with Mr . Mezger ' s Yorkshire Estatesland at P : 45 P . M . to hear Attorney Wilson representing Mr . Starks proposed business park . LIGHTS , TELEPHONE & GAS - Alderman Simmons reported that Director Madden had contacted I . B .T . C . regarding moving the City Hall phone to the Executive Conference Room at City Hall on December 7 , 1977 • PUBLIC PROPERTY & BUILDINGS - Alderman Harker reported the the windows & flower boxes at the library building have been taken care of . A new storm door for the Police Department has been ordered . BUILDING & 7.ONING - Alderman Harker made a motion to empower Alderman Beach to have the Land And/Or Cash Grant Ordinance printed , seconded by Alderman Smith . Motion carried 4-0 . Alderman Smith moved to empower Alderman Beach to have the Impact Study Guidelines printed , seconded by Alderman Harker . Motion carried 4-0 . Approximately 200 copies of each booklet will be printed to be sold to the public at a minimal charge and distributed to the persons involved with the matters . Alderman Beach moved to have Elden Madden , Building Inspector , attend the University of Wisconsin Extension ' s Building inspection Seminar , seconded by Alderman Smith . Motion carried 4-0 . It will be held January 16-20 , 1977 . Alderman Beach reported the following on the Impact Study meeting regarding Stark ' s business subdivision : Mr . Stark asked for a variance of street width from 56 ' to 33 ' . For sufficient water pressure for fire ptotection nothing less than a 12'' main could be accepted . There may be a need for a fire station on the north side of the river in the future . The Sanitary District requires more specific descriptions on how the lots are to be occupied as to demands on the system. Frontage roads were discussed . FINANCE - Alderman Simmons reported an updated Personnel Policy for the current year had been passed out •to all Council members . it is recommended to extend longevity on the wagg scale to include Marilyn Merkel and Luanne Erickson . Luanne Erickson is included under the Public Works Department and Marilyn Merkel is covered under Administrative 160 Page 4 December 1 , 1977 Personnel . Alderman Simmons made a motion to allow Marilyn Merkel to call in extra help at her discretion not to exceed 16 hours per week at $2 . 50 per hour , seconded by Alderman Smith . Motion carried 4-0 . Alderman Simmons made a motion to notify John Hancock Insurance that we have accepted their proposal and to notify Travelers Insurance that we will no longer be using their insurance , seconded by Alderman Smith . Roll call vote was taken as follows : Beach - Aye Smith - Aye Simmons - Aye Harker - Aye Alderman Simmons reported a 30-day cancellation notice had been received on the Liability Insurance . The City has another interested firm who is requesting a meeting with the City Council to discuss the proposal . It would include Workmen ' s Compensation , Commercial Umbrella policy , com- mercial vehicle policy , general liability and public officials . In regards to assistance calls within the Police Department there should be an agreement with each of the Cities to the effect if we help them, our insurance will cover us and if they come to assist us� their insurance would cover them. Alderman Smith made a motion to authorize Attorney Dickson to work out an agreement with Oswego for December 15 , 1977 to cover for Yorkville City Police , seconded by Alderman Simmons . Motion car- ried 4-0 . EMERGENCY SERVICES & DISASTER - Alderman Smith reported the siren has been hooked up but not tested to date . COMMENTS - Alderman Beach thanked Attorney Dickson , Director Madden , City Planner James Clarage and the Building and Zoning Committee for all of the input in the Land/Cash Grant Ordinance and the Impact Study Guidelines . Alderman Smith moved the meeting be adjourned at 9 : 05 P . M . , seconded by Alderman Simmons .
