City Council Minutes 1977 05-26-77 May 26 , 1977 10 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE , ILLINOIS HELD AT TH-E CITY HALL , MAY 26 , 1977 Mayor Thanepohn called the meeting to order at 8 : 00 P . M . and led the Council in the Pledge of Allegiance to the Flag . Roll call was taken as follows : Ward 1 - Wolff Ward 2 - Hanback Ward 3 - Simmons Beach Erickson Smith A quorum was established . The reading of the minutes was waived . There was one correction on page 2 , under Plan Commission , line 2 , delete"7 : 30 P . M . " and add "8 : 00 P . M . Alderman Erickson moved to accept the minutes as corrected , seconded by Alderman Wolff . Motion carried . ATTORNEY ' S REPORT - A Resolution commending Mary Thomas (*copy attached) was presented by Mayor Thanepohn to Mrs . Thomas . Mrs . Thomas very . graciously accepted the commendation with a brief talk on the library services in Yorkville since 1864 . A Resolution commending Dr . George Block was presented and will be sent to Dr . Block with a cover letter . Alderman Wolff made a motion to accept both Resolutions , seconded by Alderman Smith . Motion carried . MAYOR ' S REPORT - Mayor Thanepohn received a copy of a petition from Burlington CB&Q regarding the request of the I . C . C . to do away with the mobile agency headquartered in Aurora that has been serving this area . The letter was referred to Attorney Dickson for study . The City has been assessed 120 or $ 1 , 837 . 68 for their share of the Juvenile Officer Program grant 2601 . It will be included in next month ' s bills . City vehicle stickers will go on sale June 1 , 1977 . The City Offices will be open June 25 , 1977 for last minute sales from 8 : 00 A. M . to 12 noon . The Mayor , Attorney & Finance Committee will meet May 31 , 1977 with the trust officer & financial manager of the Merchants National Bank in regards to the Beecher estate . Mayor Thanepohn stated there was no error in the Treasurer ' s Report year end balances as was corrected in the minutes of April 28 , 1977 and will stand as originally stated with $ 14 ,563 . 60 in the Water Fund , Replacement of Waterworks , Expenditure column and $145 , 436 . 40 in the Unexpended column . A letter was received from Al and Jean Brady of ABSCO advising the City of Yorkville that the alley on the west side of the property at 123 E . Hydraulic is not a public thoroughfare , but part of the property at 123 E . Hydraulic and requested it be made a matter of public record . It was referred to the Streets and Alleys Committee for investigation . CITY CLERK - A letter from the Albany Industries regarding s sealer for City streets . It was referred to Elden Madden , Supt . of Streets, PLAN COMMISSION - Alderman Beach reported the next meeting will be IV( Page 2 May 26 , 1977 June 28 , 1977 at 8 : 00 P . M. Alderman Beach then reported on the meeting of May 24 , 1977 . There was Public Hearing regarding re-zoning submitted by Harold Feltz with no objectors present . Harold Feltz presented a petition to re-zone property located at 410 E . Main Street from R-1 to R-3 . The motion , seconded and carried was to table the petition and place it on the June agenda . The . moti.on was seconded and carried to approve the prelimiinary plat of Steve Bazan ' s subdivision at the end of E . Van Emmon Road ( Ponderosa) . The motion was seconded and carried to recommend approval of the answers by Engineer Griffin on the questions of Crawford , Murphy and Tilly Engineers in regards to the Woodworth Subdivision . James Stark asked to present his ideas to the Commission for his Bristol Station development at the June meeting . after being advised to present a master plan and follow the recommendations of the impact study . Alderman Beach made a motion to approve Steve Bazan ' s preliminary plat for a Subdivision at the end of E . Van Emmon Road ( Ponderosa) , seconded by Alderman Wolff . Roll call vote was taken as follows : Wolff - Aye Erickson - Aye Simmons - Aye Beach - Aye Hanback - Aye Smith - Aye Motion carried 6-0 . PARK COMMISSION - Alderman Hanback reported the school has agreed to let the City use the gym and arrangements will be made for use of the equipment . The Recreation Director , Rick Dalton , started on the job Monday, May 23 , 1977 . After a discussion it was decided the medical insurance coverage is adequate and a waiver would not be needed for the park projects partici - pation . Alderman Hanback asked to purchase equipment needed BUSINESS & ECONOMIC DEVELOPMENT COMMISSION - Alderman Beach announced the next meeting would be June 14 , 1977 at 8 : 00 P . M. and Alderman Hanback will attend in his place . OLD BUSINESS - The motion was made by Alderman Beach , seconded by Alderman Wolff to approve the Woodworth Subdivision Plat as presented , noting that the objections filed by City Engineer ,Anderson , ( see attached letter) , had been satisfactorily answered and that any information requested by Mr . Anderson and not shown on the preliminary plat would be included on the final plat in the normal procedures . Roll call vote was taken as follows : Wolff - Aye Erickson - Aye Simmona - Aye Beach - Aye Hanback - Aye Smith - Aye Motion carried 6-0 . NEW BUSINESS - Alderman Beach made a motion , seconded by Alderman Wolff to refer Robert Loftus ' Application for a Subdivision to the Plan Commission meeting , June 28 , 1977 . Mention carried . Page 3 May 26 , 1977 U STREETS & ALLEYS - Alderman Wolff reported on his meeting with En ineer qq e son an uperintendent of Streets & Alleyys , Madden , regardIn� Tie ast and West Alleys . The Engineer will look into the estimates of blacktoping the West Alley & City Parking Lot down to the Pumphouse and its cost to each individual business . Alderman Wolff will work with the Attorney on the possibilities of ob- taining an easement on the East Alley and blacktopping it for more City parking area . WATER Alderman Wolff made a motion to hire a part time man at $3 . 75 an hour for the Public Works Department . The motion was seconded by Alderman Beach . Roll call vote was taken as follows : Wolff - Aye Erickson - Nay Simmona - Aye Beach - Aye Hanback - Nay Smith - Aye Motion carried 4-2 . Al.derman Wolff reported the City Engineer had received a call From Mar- shall Electric Co. reported the controls are on the way by plane and should be in anytime . The new 'well should be in operation by next Council meeting . Alderman Wolff also suggested making a parking lot at the back of the Maintenance Building due to the congested traffic in the area . HEALTH & SANITATION - Alderman Hanback will follow-up on the problem with the tires at Go-Tane . Alderman Wolff has not yet been able to contacft Pilmer on the garbage problem at the E . Van Emmon apartments . TREES & PARKS - Alderman Hanback asked the procedure for purchasing recreation equipment and was informed that he could expend up to $500 without Council authorization on equipment needed . SEWERS - Alderman Erickson gave a report on sanitary sewer infiltration . There will be a self-sealing manhole cover demonstration by Neenah Company Thursday, June 2 , 1977 at 8 : 00 P . M . at City Hall . for anyone interested . FUTURE PLANNING - Alderman Beach reported the Streets & Alleys , Future Planning and Business & Economic Development Commissision were working together on projects . LIGHTS , TELEPHONE & GAS - Director Madden reported Illinois Bell Telephone Company will not replace the part of the sidewalks where the large trees in question are located . They will go up the highway and cut over the bank and go from Main St . to Spring St . PUBLIC PROPERTY & BUILDINGS - A motion was made by Alderman Erickson , seconded by Alderman Hanback that the request for purchase of the property by John Steinwart at the end of W. Center St . for purpose of building a home be denied and the property not be sold at this time . Motion carried . Alderman Erickson reported on the meeting in regards to the conference room and additional 'office space at the maintenance building addition . Director Madden will draw up plans and specifications and upon their approval wi%ll be sent out for bids . The rest room at City Hall should be finished by June . 1 1 0 Page 4 May 26 , 1977 BUILDING & ZONING - Upon Committee recommendation Alderman Beach moved to a opt t e "Going Out of Business" Ordinance, seconded by Alderman Smith . Roll call vote was taken as follows : Wolff - Aye Erickson - Aye Simmons - Aye Beach - Aye Hanback - Aye Smith - Aye Motion carried . The Committee recommended that Public Works Director Madden study the Swimming Pool Ordinance and make a recommendation . It will be dis- cussed at the next Committee meeting . In regards to the Cash And/Or Land Grant Ordinance , background data on the City Services portion and also background data on Police Department is needed . Mr . Clarage will report at a later date . McDonald ' s Corporation Public Hearing before the Zoning Board of Appeals in regards to the variance of the "Golden Arches" sign is set for June 6 , 1977 . Alderman Wolff reported that Glen Gabel does not have a bond for sewer extensions and curbs that are already in . Inspector Madden reported he had informed Gabel ' s foreman that he must have a bond before putting in the water lines . A possible need for an injunction was discussed . FINANCE - Alderman Simmons made a motion , seconded by Alderman Hanback the utility bills be paid as they come in . Motion carried . Alderman Beach asked the Utility tax question be studied at the Finance Committee meeting on Thursday , June 2 , 1977 at 8 : 30 P . M . Mayor Thanepohn stated the Annual report submitted by Treasurer Merkel shows a solvent situation for the City . LIBRARY BOARD - Alderman Erickson was asked by Mayor Thanepohn to obtain a resume of Mary Thomas acceptance speech to possibly use for the newsletter . YBS BOARD - Alderman Erickson reported there were still 8 downspout violators . He will check into the penalty fine and give a final telephone call to each one . TENNIS COURT COMMITTEE - Alderman Hanback reported they were still in the process of obtaining the electrical costs of lighting . CHAMBER OF COMMERCE - Alderman Wolff stated the next meeting would be June 1 , 1977 . Alderman Wolff moved to adjourn the meeting at 9 : 32 P . M . , seconded by Alderman Beach . Motion carried .
