MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL" OF THE ;UNITED CITY
OF THE VTLLAGE OF YORKVILLE, ILLINOIS, HELL AT THE CITY HALL, APRIL,
14, 1977 .
Mayor Thanepohn called the meeting to order at 8 : 04 P.M. and led the
Council in the Pledge of Allegiance to the Flag.
Roll call was taken as follows :
Ward 1 - Beach Ward 2 - Erickson Ward 3 - Simmons
Groner Smith
Alderman Wolff was absent from Ward 1 . A quorum was established .
Alderman Groner moved to waive the reading of the minutes and
approve them as presented, seconded. by Alderman Smith. . Notion carried.
Alderman Erickson made a motion to approve payment of the bills
presented, seconded by Alderman Beach. Roll call vote was taken
as follows :

MAYOR 'S REPORT - Mayor Thanepohn announced there will be a canvass
of the election, Tuesday, April 19, 1977 at 8 : 00 P .M.
Alderman Erickson made a motion to nominate Mrs . George Cies as an
election judge, for the City Election, April 19, 1977 in Ward 2.,
seconded by Alderman Simmons . Motion carried.
Mayor Thanepohn read a letter received from Irene Harberts on the
near loss of the Lucas boy ' s life and risk of 4 citizens lives in
saving him at the Blackberry Creek and lake area near Oountryside
Center on April 10, 1977 . Mrs . Harberts requested a meeting with
the key people to discuss the matter for future safety in the area.
Mayor Thanepohn sent a letter setting the date for the meeting to
be on, Thursday, April 21, 1977 to Park Commission Chairman, Joyce
Ward, Public Works Director Madden, Fire Chief Devick, Police Chief
Prickett, Mr. & Mrs . Harberts and Aldermen Simmons & Smith . At this
time the matter will be 'fully discussed . The findings will be brought
before the next City Council meeting .
The article Mayor Thanepohn wrote for the Illinois Municipal League
Review that was published in the January issue has been used
extensively through seven states promoting a Town Meeting. A call
was also received from the National League of Cities in Washington
D. C . regarding the article . The Mayor will be going to Arlington
Heights the 3rd week of April to represent the City ' s Town Meeting.
CITY CLERK - Clerk Schneider reported there has been a meeting of
the judges for the City Election on April 19, 1977 for briefing.
A letter was received from Frank Thornberg & Co . with literature
for election supplies for the next election.
There will be a Building Department Annual Dinner at the O 'Hare
Mariott Hotel on May 4, 1977 for anyone interested.

TREASURER'S REPORT - Alderman Eji.ckson moved to accept the treasurer' s
report, seconded by Alderman Smith. Motion carried.
Treasurer Merkel reported the City would be receiving no anti-reces-
sion funds for the next period.
POLICE REPORT - Alderman Erickson moved to accept the police report,
seconded by Alderman Smith. Motion carried.
Alderman Wolff arrived at 8 : 13 P .M.
PUBLIC WORKS REPORTS - Alderman Groner moved to accept the Public
Works Reports, seconded by Alderman Simmons . Motion carried.
Director Madden reported the new rubber railroad crossing should
be completed by Friday and the blacktop approach by Monday, April 18 ,
1977 .
PLAN COMMISSION - Alderman Beach announced the next meeting would be
on Tuesday, April 26 , 1977 at 8 : 00 P .M. The Cash And/Or Land Grant
Ordinance will be discussed.
PARK COMMISSION - Alderman Groner reported on the March 9 , 1977 meeting.
The Ordinance was discussed . A .report was given on the funds available
in the new proposed budget , and the facilities available through the
City and High School . The use of the school gymnasium will be looked
into further. The Commission is currently advertising for applications
for a Director.
Alderman Groner further reported on the April 12 , 1977 meeting.
The Commission asked for some working capital for the Recreational
Director. The Commission will try to limit work to small scale the
first year until it is well organized. The duties of the Director
will be promoting of the Park Program, coordinate all of the programs ,
have all the facilities to be used available , list project chairmen
and volunteers for all projects , and oversee and direct activities .
A report will be forwarded to the Council after each meeting . The
Commission asked for a Central office to. work from and a phone .
They plan to sponsor bus trips to places of interest , promote instruction-
al classes and promote open recreation. The next meeting will be
April 19 , 1977 ,at 7 : 30 P .M. at City Hall .
BUSINESS & ECONOMIC DEVELOPMENT COMMISSION - Alderman Wolff reported
on the April 12 , 1977 meeting. Alderman Wolff made a motion to
direct the City Planner draw up a concept & sketches ; and cost estimates
for the Central Business area sidewalks and lighting . Alderman Smith
seconded the motion . Roll call vote was taken as follows :

OLD BUSINESS _ Attorney Grant , presented the Woodworth Revised Annex-
ation Agreement and a new map showing a small parcel that will be
annexed on a straight annexation at a later date where the lift
station is to be located to serve both the present parcel annexation
and the future parcel to be annexed. The Merchants National Bank
was removed as mortgage holder and is now free of mortgage incumbents .
Mayor Thanepohn then read the Zoning Board of Appeals letter of
recommendation of December 9 , 1976 recommending that upon annexation
to the City, the parcel be zoned R-2 Single Family Housing from the

present R-1 Single-family Housing , Alderman Wolff made a, motion to approve
the Annexation Agreement as presented by Dale , Douglas, Alice and
Mary Ann Woodworth. The -motion was
secondea by Alaermarr r,ricxson. Discussion rollowed. Alderman Beach
questioned the soil conditions upon which Dale Woodworth presented a letter
from the County stating the soil was suitable for the building purposes .
Building Inspector Madden questioned the collection fees for water and
sewer hookups . They will be collected by the City at the request of the
Developers and transferred back to the _Developers every 30 days .
Building Inspector Madden will be responsible for enforcing the sidewalk
covenant requiring sidewalks on the streets to be put in by the builder
and/or owner before a final occupancy permit is issued.

OLD BUSINESS - Alderman Beach commented briefly, due to unfounded criticism,
on the Engineering Fees to attempt to clear the issue . In 1976 there
were 31 invoices for engineering totaling $193173 . 69 . This amount included
sewer sealing, well construction expenses , new Bicentennial Park and
street resurfacing, amounting to approximately $15, 000 of the total. The
remainder was spent on miscellaneous small items .
STREETS & ALLEYS - Alderman Simmons made a motion to resurface
E . Van Emmon Street from the East edge of Route 47 to the East edge
of the City limits a distance of 2,6952 feet or . 51 of a mile at an
estimated cost of $73,396 . 02 to be pent between the MFT and MVT funds ,
-seconded by, Alderman ,Wolff. Roll ca__1 vote was taken as follows :

Motion carried 6-0 .
WATER - Alderman Wolff reported the pump is in at Layne Western for
Well No. 4 and will be installed as soon as the electrical work is
completed.
STREETS& ALLEYS ( con 't . ) - Alderman Simmons made a motion proposing
add-on or er for pa c Ong on Conover and Anderson Courts in Countryside
Center Subdivision at an estimated cost of $2,200 . 00 when they are doing
the resurfacing on the Maintenance Building parking lot . The motion was
seconded by Alderman Wolff. Roll call vote was taken as follows :

Motion carried 6-0 .
Mayor Thanepohn suggested that at the time of the E . Van Emmon project
it be considered to tie in the resurfacing of the area in front of
the Police Department .
TREES & PARKS - Alderman Groner made a motion on the Committee 's recom-
mendation to accept the bid from Au-Sable International for Model 185
Lo-Boy tractor at a cost of $33980 . 98 . The motion was seconded by Alderman
Beach. Alderman Erickson commented he was against purchase of the tractor
as he felt it could be hired out with less expense . Alderman Beach
commented that it was being purchased from a local firm. Roll call vote
was takke followed:

Alderman Groner made a motion to advertise for part time help for the
summer to be used in the Park and Public Works Departments at a rate
of $3 .75 per hour with no benefits except industrial insurance . The
motion was seconded by Alderman Beach. Motion carried.
Upon request from Scoutmaster Butts, Alderman Groner made a motion
to hire a Boy Scout under the "Send a to Camp" project for
2 days amounting to 15 hours work at $2 . 00 per hour or a total of
$30 .00 . The motion was seconded by Alderman Erickson. Motion carried.
The new dam sign reading "Danger Yorkville Dam - Mandatory Portage"
has been received.
SEWERS - Alderman Beach reported that there were still 10 down spout
violators left .
LIGHTS, TELEPHONE & GAS - Alderman Erickson reported that check was
received n the amount of $2,770 from the Developers of Fox Industrial

Park for the street lighting. The check was deposited into the General
Fund and a check written in the amount of $2,770 was forwarded by Elden
Madden to Commonwealth Edison to initiate the installation of street
lights in Fox Industrial Park .
Mayor Thanepohn reported there would be a substantial increase in
private lines rates according to the Illinois Commerce Commission.
PUBLIC PROPERTY & BUILDINGS - Alderman Groner reported the interior of
the library was in the process of being painted and the new drapes & rods
have arrived . Alderman Erickson made a request of the City Crew to
help in painting a difficult area in the library .
Alderman Groner moved to add an additional bill from Sears for the
drapes amounting to approximately $300 . 00 to the March bills for pay
ment , seconded by Alderman Erickson. Motion carried .
Alderman Wolff requested the Chairman of the Public Property & Buildings
to take a look at the addition to the Maintenance Building and take
into consideration making it into a meeting room, gathering together
the estimated costs and reporting back to the Council .
ASSISTANT LIQUOR COMMISSION - Mayor Thanepohn will have a sample application
ready at the next Council meeting to possibly be made part of the Liquor
Ordinance .
BUILDING & ZONING - Alderman Beach reported that as a result of request
of John & Gary Conover to allow building on Unit 8 being denied by the
Plan Commission, there have been 2 meetings since with Conovers ' and
an oral agreement to annex Unit 8 to the City . There would be residents
zoning on 12 lots and 3 lots would be zoned B-3 • Conovers verbally agr
to abide by the Subdivision Control Ordinance , participate in the Cash
and/or Land Grant Ordinance and clarification of the sewer/water lines
problem.
Mayor Thanepohn asked for consideration regarding the Subdivision Con-
trol Ord. in planting trees every 50 feet along the front of the lots .
EMERGENCY SERVICES & DISASTER - Alderman Erickson announced the next
meeting will be April 21 , 1977 at 7 : 30 P .M. at the Courthouse .
Y .B .S.D. BOARD - Alderman Beach reported on the meeting of Monday, !N4rch

283 1977 . The Board voted to appoint Ralph Pfister as the Y.B.S.D. Repre-
sentative for the Illinois Association of Sanitary Districts Legislative
Committee . The Engineer reported the cost of covering the existing sludge
beds would be $2-3 per square foot more than constructing new sludge beds .
The Engineer also reported an aerobic digester would cost approximately
$175, 000 .
TENNIS COURT COMMITTEE - Alderman Smith has been in contact with Dr.
Garnett regarding the lighting on the tennis courts . The School Board 's
reasoning behind not paying for the lighting is the fact they would not
be used by the school during the hours the lighting would be needed.
Dr. Garnett suggested having the court under lights between the hours
of 7 : 30 P.m. and 10 : 30 P .m. , May 15 through September 15, 1977 .
FINANCE - Alderman Smith made a motion to pass the Resolution to
Transfer Unexpended Funds to Meet Budgetary Needs of the United City
of the Village of Yorkville, seconded by Alderman Erickson. Roll call
vote was taken as follows :

Motion carried 6-0 .
Discussion was opened for the Budget for fiscal year commencing
May 1 , 1977 and ending April 30 , 197
Alderman Smith made a motion to leave the Police salaries at $130 ,400,
seconded by Alderman Wolff.
Alderman Groner made a motion to amend the previous motion to read
"to reduce the police budget by $6,000 bringing it from 1130 ,400 down
to $124,400 . Roll call was taken as follows :
Beach - Aye Erickson - Aye Simmons - Nay
Wolff - Nay Groner - Aye Smith - Nay
Mayor Thanepohn voted Nay defeating the motion 4-3 .
Alderman Wolff commented he voted Nay because it was not stated where
the $6,000 would be placed within the budget .
Alderman Smith 's :original motion to leave the Police salaries at
$130,400, seconded by Alderman Wolff was put to vote . Motion carried.
Alderman Groner made a motion to reduce the Police Department,Shooting
Range, Equipment `from $500 to $250, .seconded by Alderman Erickson. Roll
call vote was taken as follows :

Motion defeated 1-5.
Alderman Smith made a motion to adopt the Budget Ordinance for the
Fiscal Year commencing May 1, 1977 and ending April 30, 1977 with the
following changes in funds included:
1 . Delete $14,000 from the Sewer Fund, Repairs & Maintenance and
transfer $1 ,000 of that amount to Streets & Alleys under a new
heading of "Curbs & Gutters" , bringing Streets & Alleys to a total
of $85,670, and Sewers to $30,300 balances .
2 . Reduce Snow Removal - Salt from $2,000 to $1 ,000 and delete the
Hauling Charge of $300 bringing the Fund balance to $33900 .

This results in an overall $14,300 decrease in the Budget Ordinance,
The motion was seconded by Alderman Erickson. Roll call vote was taken
as follows:

Alderman Smith requested an Executive Session in regards to Personnel .
Alderman Erickson moved to adjourn the Regular Session at 9 : 55 P.M. ,
