City Council Minutes 1976 10-28-76 49 OCTOBER 28 , 1976 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE .VILLAGE OF YORKVILLE , ILLINOIS , HELD AT THE CITY HALL , OCTOBER 28 , 1976 . In the absence of Mayor Thanepohn , City Clerk , Olga Schneider called the meeting to order and nominated Alderman Smith as Mayor -Pro-tem , seconded by Alderman Erickson . Roll call vote was taken as follows : Erickson - Aye Simmons - Aye Smith - Aye Groner - Aye Motion carried . Alderman Smith led the Council in the Pledge of Allegiance to the Flag . Roll call was taken as follows : Ward 1 - Beach - Absent Ward 2 - Erickson - Present Wolff - Absent Groner - Present Ward 3 - Simmons - Present Smith - Present A quorum was established . The reading of the minutes of the October 14 , 1976 meeting was waived . Alderman Erickson noted one correction under the Library Board , Page 5 , Line 2 , should read $4 , 500 inlplade of $4 ,000 . Alderman Simmons moved to approve the minutes as corrected , seconded by Alderman Erickson . Motion carried . ATTORNEY ' S REPORT - Attorney Dickson dispursed several items to be studied for the next meeting , dealing with the Route 34 Coreidor Study incorporation into the Comprehensive Plan , Amendment to Proposed Ordinance for reclassification under the Zoning Ordinance of Properties along Route 34 and Route 47 , and an Amendment to the Trash Ordinance . Alderman Groner moved to accept the Proclamation to observe Veteran ' s Day, November 11 , 1976 , seconded by Alderman Erickson . The Proclamation is to be published . Motion carried . The judgment of Mr . Morrisey was placed in the hands of local council in Iowa for collection purposes by the insurance company . The insurance company asked our contribution of $355 for the guarantee . There was no motion to this effect . In respect to the Land And/Or Cash Contribution Ordinance , /attorney Dickson brought the matter up to date . Recently the Supreme Court of Illinois has passed on this , but the grants have to be specifically tailored to the needs of the community . CITY CLERK - The Madsen Development Corporation has received the E . P .A . permit to construct the Senior Citizen Housing . HUMAN-RESOURCES -COMMISSION - The commission plans to go out to all the Organizations in the community in establishing the Human Resource Bank . STREETS & ALLEYS - Alderman Simmons reported the East Main Street res ur `acing had been completed . Alderman Wolff arrived at 8 : 15 P . M . 5 0 Page 2 October 28, 1976 Alderman Simmons moved to pass a Resolution requesting the Department of Transportation check into our water problem at Route 47 and Somonauk Street . The motion was seconded by Alderman Wolff . Motion carr ied . TREES & PARKS - Alderman Groner reported there was an article in the Aurora Beacon the previous night requesting assistance - in Construction at the dam with materials and help both . The Bi -Centennial Park Dedication was held Sunday , October 24 , 1976 . New Christmas decorations have been ordered for . the downtown area . The existing decorations will be put on the bridge . There was good response from the tree program and the delivery date is November 6 , 1976 . PUBLIC PROPERTY & BUILDINGS - The water & sewer lines are being run to the City Hall for the new restroom . LIBRARY BOARD - Alderman Erickson reported a check has been received from Wayne Gutzwiler of the Library Board in the amount of the $4 , 500 loan . The meeting was adjourned temporarily at 8 : 25 P . M . Alderman Beach arrived at 8 : 38 P . M . and the meeting was reconvened with Mayor Thanepohn ' s arrival at 8 : 42 P . M . BUILDING & ZONING - There was lengthy discussion concerning the sprinkler system at the Yorkville National Bank basement . As a result of the letter Alderman Beach sent to YNB President , Mr . Henning , Building Inspector , Elden Madden had a meeting 'October 28 , 1976 in the morning at the State Fire Marshall ' s office in Chicago . From that meeting Mr . Madden stated that "No Way" could they waive the sprinkler system in said building under the BOCA code . Mayor Thanepohn related a discussion with Mr . Henning earlier in the day that if it deemed necessary by the Fire Marshall the bank would concur with their decision . Alderman Beach moved to deny the request from the Yorkville National Bank to waive the required sprinkler system, second by Alderman Simmons . Roll call vote was taken as follows : Beach - Aye Erickson - Aye Simmons - Aye Wolff - Nay Groner - Abstain Smith - Aye Motion carried 5-1 . MAYOR''S REPORT - Jeaness Medin was appointed to the Human Resources Commission to fill the vacancy of William Thomas . Alderman Wolff moved to accept the appointment , second by Alderman Simmons . Motion carried . Unofficially the railroad crossing has been shipped to be installed by mid-November . The E . P . A . permit has been received for the North Bridge Street water main extention and is good for one ( 1 ) year . In the Revenue Sharing Bill there is now a need to report any increase or decrease in any tax or any substantial reduction in employment or services . The Revenue Funds also have to be spent in a 6-month period . 51 Page 3 October 28, 1976 It was referred to Finance Chairman , Alderman Smith and Treasurer , Marilyn Merkel . The Madsen Senior Citizen Housing Permit was issued and construction should begin the following week . There was also a permit issued for construction of Skip ' s Body Shop on E . Van Emmon Street . Mayor Thanepohn reported the meeting that He , Elden Madden , Alderman Beach and Larry Langland had at Carol Stream on the Impact Study was very constructive . PLAN COMMISSION - Alderman Beach reported on the meeting of October 2 197 . voted for The 15oard unanimous] )Athe Petition for the Pre-annexation Agreement for Mr . Woodworth ' s plat and recommended it be passed to the Zoning Board of Appeals for a public meeting concerning the 9 lots zoned R-1 to be rezoned to R-2 . It was determined the next meeting on November 23 , 1976 , at 7 : 30 P . M . would be a joint meeting of a representative from the School Board , our City Attorney , Mr . Clarage , Building & Zoning Committee , Mayor Thanepohn and any other interested parties to study the Cash And/Or Land Grant Ordinance . YBS BOARD - Action taken at the October 18 . 1976 meeting was the Board agreed to pay $800 for preliminary study for the special sewer assessment extension from North of Walnut St . on the east side of Route 47 to approximately 400 feet north of Route 34 . The study will determine the cost for each property owner . No construction permit will be issued until E . P .A . permits are obtained . The Board reviewd a complaint from Brian Mulhern , developer of Swilly Green Apartments in Countryside Center asking why he was billed for sewer usage from time permit was issued when actually the apartments in question were not rented . The Board determined the Ordinance actually meant the user would pay at time of hook-up . The Board will review the wor' ing of this Ordinance for possible correction . Mr . George Griffin , Engineer , requested the City provide a map of the City sewer boundaries . The Public Works Office took care of this request . Alderman Simmons moved to adjourn�he meeting at 9 : 18 P . M. , seconded by Alderman Smith . Motion carried .
