OCTOBER 14, 1976
MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY
OF THE VILLAGE OF YORKVILLE , ILLINOIS , HELD AT THE CITY HALL , OCTOBER
14 , 1976 .
Mayor Thanepohn called the meeting to order at 8 : 00 P . M . and led the
Council in the Pledge of Allegiance to the Flag .
Roll call was taken as follows :
Ward 1 - Beach Ward 2 - Erickson Ward 3 - Simmons
Groner Smith
Alderman Wolff was absent from Ward 1 . A quorum was established .
The reading of the minutes from the September 23 , 1976 meeting was
waived . Alderman Erickson made one correction on page 3 under
Emergency Services & Disasters , line 4 , to change the word "will "
to "may" . Alderman Erickson moved to approve the minutes as corrected ,
seconded by Alderman Beach . Motion carried .
Alderman Erickson moved to approved the September . 1976 bills ,
including an additional bill for payment to Betty Huston for
Plan Commission fees for June , July & August , seconded by Alderman
Smith . Roll Call was taken as follows :

Groner - Aye Smith - Aye
Motion carried 5-0 .
ATTORNEY ' S REPORT - Alderman Beach moved to adopt and publish
the Resolution establishing "trick-or-treating" hours on October
31 , 1976 from 4 : 00 P . M . to 7 : 30 P . M . , seconded by Alderman Simmons .
Roll Call was taken as follows :

Groner - Aye Smith - Aye
Motion carried 5-0 .
Alderman Beach moved to adopt the Route 34 Corridor Study by
reference into the Comprehensive Plan , seconded by Al'Aerman Groner .
Motion carried .
Attorney Dickson was directed to draw up an Ordinance incorporating
Phase 11 into the Comprehensive Study . Recording is required .
The Subdivision Control Ordinance will be reviewed to see if anything
could be added to discourage one-plat subdivisions .
Attorney Dickson will draw up a Resolution requesting the Department
of Transportation to study and restrict the addition of access roads
to Route 34 .
MAYOR ' S REPORT - Mayor Thanepohn has given permission to Al Spera to
hold Gun Classes on Tuesday nights at the City Hall until November 2 ,
1976 .
Alderman Groner moved to change the November City Council mee-ting
dates from November 11 , 1976 to November 4 , 1976 and the November
25 , 1976 meeting to November 18 , 1976 by Resolution , and - directed

the City Secretary to notify the news media , seconded by Alderman
Erickson . Motion carried .
Dennis Hastert was appointed by Mayor Thanepohn to Jim Morganegg ' s
unexpired term on the Zoning Board of Appeals . Alderman Simmons
moved to accept the appointment , seconded by Alderman Erickson .
Motion carried .
Upon the resignation of Bill Harthan of the Business & Economic
Development Commission , Mayor Thanepohn appointed Blaine Harker
to fill the vacancy . Alderman Beach moved to approve the appointment ,
seconded by Alderman Simmons . Motion carried .
Alderman Smith moved to pay Yorkville ' s share of approximately $2 , 080
of the County Investigative Unit , seconded by Alderman Simmons . Roll
call was taken as follows :

Groner - Aye Smith - Aye
Motion carried 5-0 .
Alderman Groner moved to draw up an Ordinance requiring the Plan
Commission to request an Impact Study from the Mayor whenever
significant land or housing developments are proposed to the Plan
Commission to take into account the impact of the School Adminstrator ,
Sanitary District Administrator , Fire District Administrator , Public
Works Director , Police Chief , Mayor and a County Representative , seconded
by Alderman Smith . Roll call vote was taken as follows :

Groner - Aye Smith - Aye
Motion carried 4-1 .
Alderman Wolff arrived at 8 : 40 P . M .
Mayor Thanepohn read a letter from HUD approving the Madsen Corporation ' s
Countryside Center Sr . Citizen Village and Villages in Plano , Mt .
Morris and Oregon and have reduced rents from $324 to $309 and from
$399-$379 .
A letter was read from the Yorkville School District thanking the
City Council for waiving the permit fees .
A letter was read from Senator Mitchler to the I . C . C . Chairman ,
asking for proper repair of the railroad crossing on Route 47 .
Alderman Groner made a motion to delete "leave not having to be
burned in wire containers , but to be burned on the person ' s property
in daylight hours only" from the Burning Ordinance , seconded by
Alderman Smith . Motion carried .
Sherriff Usry is to determine the action to make a mandatory portage
site at the Palmer Dam.
Mayor Thanepohn read a thank-you from Elden Madden for the cards
and plant sent him at the time of his brother ' s passing .

Mayor Thanepohn read a letter from the Lawrence Henning of the Yorkville
National Bank asking the City to waive the required sprinkler system
for the new bank building addition , due to the architects statements
that it was not necessary . He also asked who was to bear the expense
of the 6" water line needed for the sprinkler system . It was referred
to the Building & Zoning Committee meeting for discussion scheduled
for October 21 , 1976 at 8 : 00 P .M . at City Hall .
CITY CLERK - Olga Schneider informed the Council a letter had been
received from E . P .A . approving McDonald Corporation 73-B series
facilities for sewer extension permits .
A letter from the Illinois Department of Transportation was presented
on expenditure authorization for M . F . T . funds in form BRR-1029
credit transactions for M . F . T . Accounts to the local agencies to
be discontinued as of October 15 , 1976 .
TREASURER - The first tax distribution has been received .
Alderman Smith moved the Treasurer ' s report be accepted for audit ,
seconded by Alderman Wolff . Motion carried .
POLICE - Alderman Erickson moved to accept the Police report , seconded
by Alderman Smith . Motion carried .
DIRECTOR OF PUBLIC WORKS - Alderman Smith moved to accept the Public
Works Department reports , seconded by Alderman Erickson . Motion carried .
PLAN COMMISSION - Thd Land And/Or Cash Grant Ordinance was forwarded
to the City Council to be discussed at the meeting on October 21 , 1976 .
The Chairmen of both the Plan Commission and the Business and Economic
Development Commission will be asked to meet October 21 , 1976 with
the Council members to discuss the objections met and alternatives
suggested , concerning the relinquishing of the Downtown renovation
to the Business and Economic Development commission .
HUMAN RESOURCES COMMISSION - The next scheduled meeting is October 18 ,
1976 .
OLD BUSINESS - Alderman Erickson made a motion to pass the
Resolution requesting a permit from the Illinois Department of Trans-
portation to install a water main on the West right-of-way of
Route 47 on N . Bridge St . , seconded by Alderman Wolff . Motion
carried .
NEW BUSINESS - Three (3) bids were received for the new squad
car , including the trade- in of the 75 squad , as follows :

Alderman Groner moved the bids be referred to . committee for study.
The motion was lost for a second .

Alderman Wolff made a motion to refer the bids to Committee at
a meeting directly following the Council adjournment and on the
decision of the Committee order the car recommended . Alderman
Smith seconded the motion . Roll call vote was taken as follows :

Wolff - Aye Groner - Nay Smith - Aye
Motion carried 4 Ayes to 2 Nays .
Alderman Wolff moved to refer the Woodworth Pre-annexation plat
to develope and annex Parcel A , to the Plan commission , seconded
by Alderman Groner . Motion carried .
STREETS & ALLEYS - Alderman Simmons moved to send out for bi''ds
for the sidewalk East of the City Hall , 6 ' x90 ' and an approximate
cost of $750-$850 , seconded by Alderman Erickson . Roll call vote
was taken as follows :

Wolff - Aye Groner - Aye Smith - Aye
Motion carried 6-0 .
Alderman Simmons reported the E . Main St . work hag begun . The
man-hole covers have all been raised , the North half of the street
cored out and back-filled and part of the South half has been done .
The E . Van Emmon problem has been agreed upon and will be taken
care of in the next couple of weeks .
HEALTH & SAIJ'I'TATION - Alderman Simmons reported 6 loads of junk
had been hauled away on the North side of town during Clean-up
Days . Monday , October 18 , 1976 the City Crew would begin on the
South side of town .
The garbage problem on E . Van Emmon is being studied for a solution .
POLICE - Range hours signs and warning signs approaching the area
will be installed at the shooting range .
TREES & PARKS - On October 3 , 1976 , a good load of logs was cleaned
out of the river .
The Bi -Centennial Park Dedication Ceremony time has been changed to
2 : 00 P . M . on October 24 , 1976 . Alderman Groner has asked the High
School Band to participate , Mrs . Grace Palmer .and .the Scouts to parti -
cipate in the Flag Raising Ceremonies . A brochure will be put together
with a brief history of the City Buildings and services.
There will be an article on the tree planting project in the local
paper with a hopeful delivery date of November 6 , 1976 .
SEWERS - The Y . B . S . Board will meet Monday , October 18 , 1976 at
7 : 00 P . M . at Dallas Ingemunson 's office .
A letter was sent to E . P .A . regarding Stem 1 Plan containing
the signed cooperation agreement between the Y . B . S . D . and the City
of Yorkville , designating the City of Yorkville as lead agency
in the Phase 1 Grant .

Alderman Beach requested and received a list of the down-spout
smoking and intends to personall check them out .
PUBLIC PROPERTY & BUILDINGS - Alderman Groner submitted a proposal for
water & sewer lines to the City Hall . The City Crew will do the work .
BUILDING & ZONING - The BOCA Basic Maintenance Code was referred to
the committee meeting on October 21 , 1976 for discussion .
FINANCE - Alderman Smith suggested categorizing the Ordinances for
cross reference .
EMERGENCY SERVICES & DISASTER - Al Brady ' s resignation as co-ordinator
was accepted effective November 30 , 1976 .
LIBRARY BOARD - With the first tax distribution having been received ,
the Library will reimburse the City for $4 , 500 .
BI -CENTENNIAL CHAIRMAN - Alderman Groner presented a copy of the
Resolution to the Fire Department .
The Chamber of Commerce has been contacted on going in with the City
on the cost of the Christmas decorations for the downtown area .
Alderman Erickson moved to adjourn the meeting at 10 : 11 P . M . , seconded
by Alderman Beach . Motion carried .
