SEPTEMBER 9 , 1976
MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY
OF THE VILLAGE OF YORKVILLE , ILLINOIS , HELD AT THE CITY HALL ,
SEPTEMBER 9 , 1976 .
Mayor Thanepohn called the meeting to order at 8 : 00 P . M . and led the
Council in the Pledge of Allegiance to the Flag .
Roll call was taken as follows :
Ward 1 - Beach Ward 2 - Erickson Ward 3 - Simmons
Wolff Groner Smith
A quorum was established .
The reading of the minutes from the August 26 , 1976 meeting was waived .
Corrections were as follows :
Page 1 - Line 10 - Substitute the word "presented" for the
word "read" .
Page 3 - Library Board Report - Line 3 - Insert "concerning
the G . E . D . " following
the word " Institute" .
Page 3 - Library Board Report - Line 4 - Insert the word " ,also, "
following the name
"Thomas" .
Alderman Groner moved the minutes be approved as corrected , seconded
by Alderman Smith . Motion carried .
City Treasurer , Marilyn Merkel presented the following two bills
to the list already presented :
McNelis Tree Service - $730 Removal of several trees & stumps
Plano Police Dept . - $28 . 40 - Call forwarding
Alderman Wolff moved to approve payment of the bills , the two added
bills to be paid out of General Fund . Alderman Erickson seconded the
motion . Roll call vote was taken as follows :

Wolff - Aye Groner - Aye Smith - Aye
Motion carried .
ATTORNEY ' S REPORT - Alderman Groner moved to approve the Ordinance
epea ing an r finance Temporarily Closing to the Public , City Proper-
ties South of the Yorkville Dam in the United City of Yorkville , sec-
onded by Alderman Wolff . Roll call vote was taken as follo s :
Beach - Aye Erickson - Aye Simmons - Ay
Wolff - Aye Groner - Aye Smith - Aye
Motion Carried .
Alderman Beach moved to have Attorney Dickson draft an Ordinance to
permit Madsen Corporation Company to profile one ( 1 ) parking space
per unit , Block 5 , Unit 2 in Countryside Center Subdivision limited
to the Senior Citizen Housing area only . Motion was seconded by
Alderman Simmons . Motion carried .
Another Attorney will be handling the Bentley lawsuit with Attorney
Dickson monitoring the case, '

Priorities from the meeting of the Attorneys of the Municipalities
along the Route 34 Corridor suggested that all Zoning Ordinances
be ammended to require the Planning Commissions in reviewing land
use along the thoroughfares and make specific findings to the
impact of usage on traffic and existing access to the roads . Also
it was suggested to shape up the Subdivision Control Ordinances
along the thoroughfares to insist on frontage roads .
MAYOR ' S REPORT - There is approximately a 6% decrease in the City ' s
share of Real Estate taxes which is a greater reduction than
anticipated , 'and at the same time Mayor Thanepohn feels we have
increased and improved City Services .
Mr . Shindlebeck of Commonwealth Edison indicated he will see his
company will work in closer liason with the City . Elden Madden
had signed an order for a light on Fox Road earlier that day .
After a meeting with the Caterpillar Canoe Club it was determined
the portage should be on the southside of Palmer Dam . It was
referred to Alderman Groner to confer with the Club ' s representative
for the study the site and determine the location of the exit a-nd
re-entrance for a portage and the feasibility of a cable upstream
with legible signs noting it was a mandatory portage . It was also
suggested to place a warning sign at .Montgomery .
The Illinois Municipal League Conference will be September 10 , 11 ,
12 & 13 at the Hyatt Regency O ' Hare .
There was a request from the High School requesting a Parade Route
for their Homecoming , October 9 , 1976 forming at Hillside Nursing
Home to Game Farm Road to King to Main to Church and back to the
High School . The City is invited to participate . Alderman Beach
moved to approve the request , seconded by Alderman Wolff . Motion carried
No mini -bikes or unlicensed drivers would be allowed to participate .
Mayor Thanepohn read a report from Elden Madden on his recent
Regional Seminar on the Public Works Employment Act of 1976 he
attended on September 2 , 1976 . He related the main problem in
obtaining this type of grant would be the money was being sent
on high unemployment areas where Kendall County and Yorkville
do not apply .

A letter was received from the Illinois Department of Transportation
regarding the dam . They have since been out with a survey crew to ( ~-
mine the quantity and cost of materials for the dam project . They w
seek legislative authority for funds . Copies of letters have been
sent to State Representatives and Senator Mitchler .
Alderman Wolff moved to grant the request of Kendall County VFW
Auxiliary Post for their annual Poppy Sale Friday , September 24 ,
1976 and Saturday , September 25 , 1976, seconded by Alderman Smith .
Motion carried .
CITY CLERK - A letter was received from the Illinois Department
of Transportation regarding the Federal Highway Safety Act stating
the Pavement Marking Demonstration Project had been awarded to

A. C . Pavement Stripping Company of Des Plaines , Illinois .
TREASURER ' S REPORT - Alderman Wolff moved to accept the Treasurer ' s
Report , seconded by Alderman Erickson . Motion earried .
POLICE - Alderman Beach moved to accept the Police Report , seconded
by Alderman Wolff . Motion carried .
DIRECTOR OF PUBLIC WORKS - Alderman Wolff moved to accept the Public
Works Department reports , seconded by Alderman Erickson . Motion
carried . Alderman Beach thanked Elden Madden and his crew for erect-
ing the Stop , Yield and Street signs at Countryside Center .
PLAN COMMISSION - The next meeting of the Commission will be September
28, 1976 and at that time Alderman Beach plans to present the
recommendation of the Future Planning Committee that the Downtown
Development be turned over to the Business and Economic Development
Commission .
STREETS & ALLEYS - Alderman Simmons reported the lowest bid on the
E . Main St . project was approximately $3500 higher than the Engineer ' s
estimate and on the advice of Mr . Blanco the State Engineer and Bob
Anderson , the City Engineer , the recommendation of the Committee would
be to rebid the job . Alderman Simmons moved to reject all bids
submitted on the E . Main St . project , seconded by Alderman Erickson .
Motion carried .
Alderman Smith moved to rebid for the E . Main St . project with the
bids to be turned in by September 22 , 1976 at 2 P . M . The motion was
seconded by Alderman Erickson . Roll call vote was taken as follows :

Wolff - Aye Groner - Aye Smith - Aye
Motion carried .
WATER - Interstate Contracting Company will begin erection of the
new pumphouse in 2-3 weeks , with a possibility of 2-3 months delay
on delivery of the flange water pipes . The electrician will begin
approximately November 1 , 1976 .
Alderman Wolff moved to have the attorney draw up a Lease Option
Ordinance with payment to Layne-Western Company the amount of
$ 12 , 000 within 30 days after installation of pump & motor in Well
#4 , with the balance to be paid in monthly payments of $ 1590 . 05
per month for 24 months , totaling $50 , 161 . 25 . The motion was seconded
by Alderman Beach . Motion carried .
POLICE - Alderman Smith moved to increase the crossing guards salary
from $ 11 . 00 per day to $ 16 . 50 per day due to the increase in hours per
day , effective September 1 , 1976 , seconded by Alderman Wolff . Motion
carried .
TREES & PARKS - Alderman Groner reported there had been tree removal
done in the City Park and were still more to come down .
SEWER - Alderman Beach reported the Madsen Corporation representatives
will meet Monday , September 20 , 1976 with the Yorkville/Bristol
Sanitary District . At the same time Alderman Beach hopes to get the
go-ahead on the sewer grant plan of study from George Griffin .

LIGHTS , TELEPHONE & GAS - Alderman Erickson made a motion to install
a street light on Fox Road , seconded by Alderman Beach . Motion carried .
Alderman Erickson reported there have been 2 street lights installed
on Sunset with a 3rd to be installed .
A letter from Jack McEachern of Wayne Circuits requested street lights .
Thd developer would pay the cost of the lights with the City paying
the monthly rates . The City would , however , pay for the entrance lights
on Route 47 and possibly Rt . 126 . It was referred to Elden Madden
to contact concerning the engineering and installation of the
lighting .
BUILDING & ZONING - There will be a Committee meeting , September
13 , 1976 for the Fence Ordinance study .
The Madsen Corporation has applied for a building permit on the Senior
Citizen Housing project and the plans are now in review at BOCA .
An E . P .A . permit is required before the building permit can be issued .
EMERGENCY SERVICES & DISASTER - Alderman Erickson reported Al
Brady, coordinator , had sent out bids and received one bid at an
approximate cost of $7200 of which the City would pay one-half , although
no action would be taken until more information was received .
FINANCE - Alderman Smith moved pay Elden Madden ' s tuition fees for
his courses at Northern Illinois University , authorize him to use the
City pick-up truck for his day classes and pay mileage for his
personal car use for the night class , seconded by Alderman Beach .
Motion carried .
YBS BOARD - Alderman Beach announced a meeting on September 20 , 1976 .
BI -CENTENNIAL CHAIRMAN - Alderman Groner reported the plaque for the
griststone had been recast and has been re- installed .
Alderman Erickson moved to adjourn the meeting at 9 : 00 P . M. , seconded
by Alderman Wolff . Motion carried .
