CORRECTED MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE
UNITED CITY OF THE VILLAGE OF YORKVILLE , ILLINOIS HELD AT THE CITY
HALL , AUGUST 26 , 1976 .
Mayor Thanepohn called the meeting to order at 8: 00 P . M . and led the
Council in the Pledge of Allegiance to the Flag .
Roll call was taken as follows :
Ward 1 - Beach Ward 2 - Erickson Ward 3 - Simmons
Wolff Groner Smith
A quorum was established .
Reading of the minutes was waived . Alderman Groner moved to accept
the minutes as presented , seconded by Alderman Wolff . Motion carried .
ATTORNEY ' S REPORT - Alderman Smith made a motion to approve The Ordin-
ance for Levy & Assessment of taxes for the fiscal year beginning May 1 ,
1976 and ending April 30 , 1977 with an amendment to correct , page 7 ,
under Public Library Fund reversing columns two (2) and three (3) , (copy
attached) , seconded by Alderman Wolff . Roll call vote was taken as
follows :

Wolff - Aye Groner - Aye Smith - Aye
Motion carried .
Alderman Simmons moved to pay the interest due the holders of the
1959 Water Bonds amounting to approximately $230 . 00 , seconded by
Alderman Wolff . Motion carried .
Alderman Erickson made a motion to retain Attorney Dickson as defense
attorney on behalf of Officer Randall and The City of Yorkville vs .
Michael Bentley for malicious prosectution and false arrest , seconded
by Alderman SMith . Motion carried .
Attorney Dickson forwarded several Ordinances on Housing Code Problems
to Alderman Beach to study .
MAYOR ' S REPORT - Mayor Thanepohn endorsed the Lion ' s Club Blood Drive ,
Tuesday , August 31 , 1976 from 3-7 P . M. at the Bank of Yorkville
Community Room and encouraged everyone who was able to participate .
Representatives from the Caterpillar Canoe Club and representatives from
other groups will meet with Mayor Thanepohn , the Trees and Parks
Committee and Director of Public Works on Thursday , September 2 , 1976 at
8 P . M . at City Hall to discuss the river ' s north side canoe portage site.
Commonwealth Edison informed Mayor Thanepohn that lights would be up in
the next few days . Alderman Smith reported that poles had been erected at
2 sites . The W. Dolph St . and southern-most pole on Sunset would be up
within a couple weeks .
Several letters had been received from the Illinois Commerce Commission .
I . B . T . C . proposed revisions in their terminations liability switching
systems . The other two were in regards to bus traffic.

Mayor Thanepohn read a Resolution that had been previously passed thank-
ing the Bristol -Kendall Fire Department Officers , Trustees & Members and
Parade Coordinator , Blaine Harker for their fine work on the 4th
of July festivities .
PLAN COMMISSION - After a discussion , Alderman Wolff moved to accept
McDonald ' s Subdivision Plat , seconded by Alderman Smith . Roll call
vote was taken as follows :

Wolff - Aye Groner - Aye Smith - Aye
Motion Carried .
Mayor Thanepohn read the recommendation by the Zoning Board of
Appeals to the City Council that the petition of Madsen Corporation
and Ter-Jac Construction Company decreasing parking from two (2)
per apartment to one ( 1 ) per apartment , all of Block 5 , Unit 2 in
Countryside Center Subdivision to granted . (Copy attached)
After a discussion period , Alderman Beach moved to grant the petition
for variance of decreased parking from 2 parking spaces per apartment
to 1 parking space per apartment , all of Block 5 , Unit 2 of Country-
side Center Subdivision , seconded by Alderman Smith . Roll call vote
was taken as follows :

Wolff - Aye Groner - Aye Smith - Aye
Motion carried .
Alderman Beach read a letter sent to Mike Morey of Madsen Development
Corporation encouraging them to proceed now for permits and not wait
until the last minute . In response , Mike Morey stated that revisions
of the Plans had been sent to IHDA for approval before presenting
them to the City Council .
HUMAN RESOURCE COMMISSION - Alderman Smith reported on the August 16 ,
1976 meeting of the Commission . It was decided a quarterly newsletter
would be more feasable and could be mailed to each home in the City .
An Editor to donate his/her time would be needed and the use of the
City ' s Xerox machine for copies . Alderman Beach asked it be referred to
the Finance Committee for further discussion .
There will be a publication in the local newspaper to help establish
the Resource Bank by filling out and returning forms printed . This will
be to enable the Commission to set up a central clearing house with
telephone service provided to refer the caller to the right party for
the problem at hand .
BUSINESS & ECONOMIC DEVELOPMENT COMMISSION - Chairman of the Commissi
Walter Olsen , gave a summary of the proposed projects to the Council for
discussion . Due to the recent tour of the Fox Industrial Park , the
schools had requested a tour of the Park for it ' s spring classes .
Other areas of discussion included the restoration of the downtown
area , being more instrumental in bringing new businesses into the
City , parking , and a basic survey by public opinion and by merchants &
owners opiniron of priorities . The Future Planning Committee will meet
with the Commission and relate any recommendations to the City Council .

Attorney Dickson suggested looking into studys for Federal funds .
Public Works Director , Madden , will attend the Chicago Regional Confer-
ence of the Economical Development Administration which might have some
bearing on the situations .
STREETS & ALLEYS - The bid openings for the E . Main St . project set
for September 9 , 1976 , was changed , due to the State Department of
Transportations ' s request , to August 30 , 1976 at 11 : 00 A . M . at the
Public Works Office . Alderman Simmons moved to accept the change in
dates , seconded by Alderman Wolff . Motion carried .
WATER - After examination of bids on Well House #4 , the Engineer recom-
mended acceptance of the bid of Frank Marshall Electric Company using
an approved brand of switching equipment which , when applied to their
base bid resulted in the lowest . of the bids received on the Electrical
Contracts . The motion to accept the bid of Frank Marshal Electric
Company for $24 , 765 and Interstate General Contractors Inc . at $41 , 100
totaling $65 ,865 was made by Alderman Wolff , seconded by Alderman Beach .
Roll call vote was taken as follows :

Wolff - Aye Groner - Aye Smith - Aye
Motion carried .
The Water Committee will meet September 2 , 1976 at 7 : 30 P . M . at City
Hall to discuss the pump and motor bidding .
HEALTH & SANITATION - Alderman Groner made mention of the problem behind
Azem ' s Restaurant .
Clean -up Days are set for October 11 , 1976 on the North side of the
City and October 18 . 1976 , on the South side of the City .
The motion was made by Alderman Simmons and seconded by Alderman Beach
to accept the street and improvements of Mulhern ' s Swilly Green
Development . Public Works Director , Madden and Engineer Crawford
confirmed that the street , Mulhern Court and water , sanitary-sewer and
storm-sewer mains had all been inspected and approved . Roll call
vote was taken as follows :

Motion carried .
LIGHTS , TELEPHONE & GAS - Alderman Erickson reported there had been no
word to date on the lighting for Fox Road . '
BUILDING & ZONING - Alderman Beach reported the structural problem at
ulhern ' s Swilly Green Apartment had been taken care of as well as
the one at Indian Trail West ' s model home .
LIBRARY BOARD - Alderman Erickson thanked Elden Madden and the City
Crew for painting the restroom in the library . Mary Thomas gave a pre-
sentation to the Library Institute concerning the G . E . D . at Northern
Illinois University . William Thomas also , gave a presentation on the
G . E . D . program here in Yorkville .

YBS BOARD - The Plan of Study was referred to the Board by Engineers ,
Anderson and Griffin and are now awaiting the report from George
Griffin .
Alderman Erickson moved to adjourn the meeting at 10 : 21 P .M . , seconded
