May 13 , 1976 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE , ILLINOIS, HELD AT THE CITY HALL ON MAY 13 , 1976 Mayor LeRoy Thanepohn called the meeting to order at 8 : 00 P .M . and le the Council in the Pledge of Allegiance to the Flag . Roll call was taken as follows : Ward 1 - Beach Ward 2 - Erickson Ward 3 - Simmons Wolff Groner Smith A quorum was established . Guests included Mr . & Mrs . Bill Lowe of the Senior Citizens , and Ron Robb . .Reading of the minutes was waived . Alderman Groner moved the minutes be approved , seconded by Alderman Smith . Motion carried . Three ( 3) bills were added to the list by the City Treasurer : Kendall County Record , February , $85 . 20 & March , $294 . 35 Roosevelt Aurora Post (flag kits) - $48 . 00 Wheeler Signs , Inc . (7 signs for the baseball fields ) - $33 . 50 A motion was made to accept the payment of the bills presented , withholding 5% of the Tri -County Excavating & Wrecking , Inc . pending germination , by Alderman Beach , seconded by Alderman Wolff . Motion carried . MAYOR ' S REPORT - Committee Appointments were made . Streets & Alleys , Water and Health & Sanitation remain the same ; Police placed Alderman Smith as Chairman , and added Alderman Erickson as member ; Trees & Parks remains the same : Sewers placed Alderman Beach as Chairman ; Future Plannino remains the same ; Lights Telephone & Gas adds Alderman Smith as a member ; Public Property & Buildings placed Alderman Groner as Chairman ; Assistant Liquor Commissioner is Frank Wolff ; Building & Zoning remains the same ; Finance adds Alderman Wolff as member ; Emergency Services & Disaster places Alderman Erickson as Chairman and Alderman Groner & Alderman Wolff as members with Al Brady - Co- Ordinator . Tennis Court Committee Chairman is Alderman Smith , Bicentennial Chairman is Alderman Groner , Chamber of Commerce Representative is Roger Simmons , YBSD Representative is Alderman Beach , City Attorney is Fred Dickson , City Engineer is Robert H . Anderson of Crawford , Mur- phy & Tilly, and Business and Economic Development Commission Repre- sentative is Alderman Wolff . The Human Resource Commission Represen- tative is Alderman Smith and the Planning Committee Representative is Alderman Beach . Alderman Erickson represents the Disaster Committe with the Red Cross . A review of the past projects and proposed projects was presented by Mayor Thanepohn . In the past year mutual respect was developed that FORM 601-49 ® U.S.A. Page Zj May 13 , 1976 puts the Public interest before our own personal considerations ; the tennis courts became a reality ; the Plan Commission was expanded ; the island in the Fox River was removed ; our first park since 1849 was established ; a comprehensive road program has begun ; the new well was drilled and paid for with no tax increase or raising of water rates ; the Human Resource Commission was established ; a reforestatio program was begun ; our park and recreational facilities were greatly improved ; sewer sealing was successfuN ; 24 hour Police communication became a fact ; insurance consolidation saved money; the Budget Officer system was established ; we led the way in continuing the ILE Investigation Unit and initiating the ILEC Juvenile Program; completi of the roads at Countryside Center ; the Business and Economic Develop ment Commission was structured ; a liason was established with the Senior Citizens ; extending the vehicle sticker sales from January to June to benefit citizens ; engaged in the Route 34 Corridor Study : hotted the Harvest Festival , the largest parade ever held in Yorkvil built a mini -park by the Library ; welcomed the State Wrestling Cham pions home ; Established a new committee to cover Emergency Services and Disasters ; and ended the year with the conclusion of Town Meeting ' 76 . Proposed programs for the coming fiscal year were outlined . (See the attached copies . ) Mayor Thanepohn appointed Ron Robb for a. term of 5 years upon the accepted resignation of John Behrens , to the Zoning Board of Appeals . The Board was then structured by assigning terms to the remaining 6 members as follows : 1 James Morganegg - 4 years Tom Lindblom - 6 years Donald Walters - 1 year Martin Behrens - 7 years Delmar Becker - 3 years C . Richard Ellis - 2 years When these terms expire all further appointments will be for a 5 year term as the Ordinance calls for . Alderman Wolff moved to accept the appointments , seconded by Alderman Groner . Motion carried . Mayor Thanepohn reappointed Fred Dollman and Lawrence Langland for four (4) year terms to the Planning Committee . Alderman Wolff moved to accept the appointments , seconded by Alderman Simmons . Motion carried . Mayor Thanepohn appointed Linda Hanback for a three (3) year term upon the accepted resignation of LaDonna Tweedy . The remaining eight (8) members were assigned terms as follows to the Library Board Robert Yuill - 3 years Mary Jo Gardner - 1 year Carol Munson - 1 year Bert Erickson - 2 years Martin Behrens - 1 year Wayne Gutzwiler - 2 years FORM 601-49 ® U.S.A. Mayor Thenepohn appointed John Steinwart to the Business & Economic Development Commission for a three (3) year term upon the accepted resignation of Ernest Zeiter . Alderman Groner moved to accept the appointment , seconded by Alderman Smith . Motion carried . The Human Resource Commission will remain the same with Mayor Thanepo re-appointing William Thomas and Richard Mau . A motion was made by Alderman Wolff to accept the re-appointments , seconded by Alderman Smith . Motion carried . Bert Erickson is representing the Disaster Committee with the Red- Cro Mayor Thanepohn nominated Elden Madden as Director of Public Works at a salary of $ 15 , 500 .00 per year effective May 1 , 1976 with 50% from each General and Water Funds . He shall have all benefits as provided by Personnel Policy adopted April 8 , 1976 . Motion to accept the nom- ination was made by Alderman Simmons , seconded by Alderman Wolff , with all Aldermen voting Aye . Motion carried . Mayor Thanepohn nominated Elden Madden as Building Inspector to serve at the pleasure of the Building Council and to be paid $4 , 500 . 00 per year , effective May 1 , 1976 . Motion to accept the nomination was mad by Alderman Smith , seconded by Alderman Simmons , Aldermen Beach , Wolf Groner , Simmons & Smith voting Aye , Alderman Erickson voting Nay . Mot carried . Mayor Thanepohn nominated Fred 0 . Christian as General Foreman of the Public Works Department at a salary of $ 1 , 050 . 00 per month effective May 1 , 1976 . Mayor Thanepohn nominated Luanne Erickson as secretary for the Public Works Department at a salary of $3 . 00 per hour effective May 1 , 1976 , to be paid out of the Water Fund . Randall as Captain of the Police Department at a salary of $ 1 , 122 . 00 per month effective May 1 , 1976 . He shall have all benefits as provided by the Personnel Policy adopted April 8 , 1976 . Millen as Patrolman of the Police Department at a salary of $975 . 00 per month effective May 1 , 1976 . He shall have all benefits as provided by the Personnel Police adopte April 8 , 1976 . Baker and Arthur Thanepohn as School Crossing Guards at a salary of $ 11 . 00 per school day . Mayor Thanepohn nominated John Smith as part-time' employee in the Public Works Department at the pleasure of E1 en E . Madden , Public Works Director , at a salary of $2 . 75 per hour effective May 14 , 1976 . Motion to accept the nomination was made by Alderman Wolff , seconded by Alderman Smith , with all Aldermen voting Aye . Motion carried . Mayor Thanepohn nominated Fred H . Dickson as City Attorney to be paid a retainer of $2 , 400 . 00 per year and the privilege of billing the Cit, for extra legal services performed . Motion to accept the nomination was made by Alderman Beach , seconded by Alderman Simmons , with all Aldermen voting Aye . Motion carried . Mayor Thanepohn nominated Marilyn J . Merkel as City Secretary at a salary of $675 . 00 per month effective May 1 , 1976 . She shall have al benefits as provided by the Personnel Policy adopted April 8 , 1976 . Motion to accept the nomination was made by Alderman Wolff , seconded by Alderman Simmons , with all Aldermen voting Aye . Motion carried . Mayor Thanepohn nominated the firm of Crawford , Murphy & Tilly with Robert Anderson as City Engineer . They have the privilege of billing the City for engineering services performed . Motion to accept the nomination was made by Alderman Beach , seconded by Alderman Wolff , with all Aldermen voting Aye . Motion carried . Mayor Thanepohn nominated the Yorkville National Bank , The Bank of Yorkville , The National Boulevard Bank of Chicago and The Northern Trust Bank of Chicago to serve as City Depositories . Motion to accept the nomination was made by Alderman Wolff , seconded by Alderman Smith , with all Aldermen voting Aye . Motion carried . Mayor Thanepohn nominated the Chairman of the Finance Committee to be the fourth signature on all checking accounts in the absence of eithe the Mayor , Treasurer or City Clerk . Mayor Thanepohn reminded everyone of the Town Meeting ' 76 to be held , Saturday , May 15 , 1976 from 9 A . M . to 5 P .M . at the Yorkville High School . Alderman Wolff moved to approve payment of the City ' s assessed share of 12% or $ 1 , 340 . 40 for the 2nd year funding of Kendall County Investigative Unit Grant #1881 , seconded by Alderman Beach . Roll call was taken as follows : Beach - Aye Erickson - Aye Simmons - Aye Wolff - Aye Groner - Aye Smith - Aye Motion carried . Alderman Wolff moved to approve payment of the 1st year funding assessment of 9% or $ 128 . 52 of Grand # 1971 for funding of Kendall • County Juvenile Officers Program "Local Hard Cash Match" , seconded by Alderman Beach . Motion carried . Alderman Beach moved to refer Yorkville ' s Shire of $3 , 960 of the September 76-77 ILEC investigative Unit $33 , 000 budget . to the Police Committee for further study , seconded by Alderman Groner . Motion carried . As a result of the Route 34 Corridor Study Meeting , it was left to Peter Krenz , Attorney for the City of Plano, to get a consensus of th, other Attorneys involved . Mayor Thanepohn Proclaimed the 31st Day of May , 1976 as Memorial Day to be published . In observance of National Nursing home Week an open house will be held Sunday , May 16 , 1976 from 2-4 P . M . at Hillside Nursing Home . The Illinois Department of Transportation Division of Waterways will meet with the City on the Glen D . Palmer Dam Site to discuss any further precautions to avoid additional loss of life . A report from the Blue Ribbon Committee by form of a letter from Duan Hayden stated at this time most residents were receiving adequate medical care . Under the New Health Services Association Program Kendall County is being transferred into a new planning area . Until a group is organized we are unable to ask for any grants under state or federal agency level for clinic & equipment . It was suggests by Mr . Hayden to evaluate the program . Alderman Beach commended the committee for the time and effort spent on the committee . CITY CLERK - The City Clerk reported that we have received a copy of the Permit from Illinois Environmental Protection Agency allowing the Miller Subdivision sanitary sewer to be operated with the special condition that the sewer line itself must be approved by the City of Yorkville . Mayor Thanepohn informed the Council that the Director of FORM 601-49 ® u.S.A. Page 7 May 1 3 . 1 9 7 6 Public Works had contacted Mr . Bauer of Illinois E . P .A . and also had written him a letter stating that the main had not yet been tested an that no building permits would be issued in the subdivision until the lines have been tested by the property owner ' s agents and approved by our Engineers . The Illinois Municipal League Conference will be held September 10 , 11 , 12 and 13 of September 1976 . TREASURER - Alderman Wolff made a motion to accept the Treasurer ' s Report , seconded by Alderman Smith . Motion carried . POLICE - Alderman Beach made a motion to accept the Police report , seconded by Alderman Groner . Motion carried . DIRECTOR OF PUBLIC WORKS - Alderman Groner made a motion to accept the Director of Public Works report , seconded by Alderman Wolff . Mo- tion carried . PLAN COMMISSION - Alderman Beach reported the Drobac riding stables petition has been tabled until a soil test from Mr . George Hinman had been secured. The Madsen Senior Citizen Housing Project to rezone has been resche- duled to the regular meeting in June . The Plan Commission will study a Cash and Land Grant Ordinance . BUSINESS & ECONOMIC DEVELOPMENT COMMISSION - The Commission will meet Thursday , May 20 , 1976 at City Hall . Committee apointments and assignments have been made . NEW BUSINESS - Blaine Harker ' s final plat was referred to the Plan Commission for review and study . Alderman Beach made a motion to waive the $300 Permit Fee and the Water Fee for the circus to be held June 7 , 1976 at Countryside Cente seconded by Alderman Wolff . Motion carried . Alderman Wolff moved to grant a license to the Yorkville JayCees to sponsor the above mentioned circus for 2 performances on said date on the condition they obtained a corrected copy of the insurance policy , seconded by Alderman Groner . Motion carried . The Yorkville JayCees will be responsible for cleanup after the circu STREETS & ALLEYS - Alderman Simmons reported the Clean-up Campaign went very well . Alderman Simmons also had a report from Elden Madden that Russell Naden ' s opinion from the County Board was that the County would accep responsibility of the Fox Road culvert problem . WATER - Alderman Groner moved to pay $65 . 00 membership fee to the FORM 601-49 ® U.S.A. Page 8 May 13 , 1976 American Waterworks Association for Elden Madden , Director of Public Works , seconded by Alderman Smith . Motion carried . POLICE - Alderman Groner made a motion to pay $45 . 70 to Jim Jerabek for court time since leaving the department , seconded by Alderman Wolff . Motion carried . TREES & PARKS - The July 3 , 1976 parade request to close down Route 7 was denied . An alternate East/West route was suggested for the procession , with periodic interruptions to route traffic thru Route 47 . The baseball scheduling has been solved . The sign has been erected and the planting finished at the E . Van Emmon fields . The Riverfront Bicentennial Park has been completed and the seed has begun to germinate . Alderman Groner asked that the draft of an Ordinance imposing a $500 fine for littering at the Park & No Parking except in designate( parking areas . The matter was referred to Attorney Dickson . Attorney Dickson will also look into the matter of an Ordinance establishing a reduced speed limit in the area of the E . Van Emmon ball park . SEWERS - Alderman Beach made a motion to accept the Resolution To Authorize A Representative To Sign Grant Documents , seconded by Alderman Wolff . Roll call was taken as follows : Beach - Aye Erickson - Aye Simmons - Aye Wolff - Aye Groner - Aye Smith - Aye Motion carried . Alderman Wolff made a motion to accept the Resolution Of Intent Regar( ing Initiation of Facilities Plan Step 1 Work , seconded by Alderman Simmons . Roll call was taken as follows : Beach - Aye Erickson - Aye Simmons - Aye Wolff - Aye Groner - Aye Smith - Aye Motion carried . Alderman Wolff made a motion to accept the Resolution Regarding Financial and Legal Capabilities , seconded by Alderman Smith . Roll Call was taken as follows : Beach - Aye Erickson - Aye Simmons - Aye Wolff - Aye Groner - Aye Smith - Aye Motion carried . Engineer Bob Anderson presented a Certificate of Legal Capabilities t( be signed by Attorney Dickson . The Engineering Agreement was changed from a time and expense basis t( FORK 601-49® U.S.A. Page 9 May 1 3 , 1 9 7 6 to a lump sum agreement . BUILDING & ZONING - Alderman Beach had been informed that some of the residents of Countryside Center had secured legal council as objector! to the Madsen Senior Citizen Housing project . Alderman Beach thanked Mayor Thanepohn and Attorney Dickson for hostir the Route 34 Corridor Meeting . LIBRARY BOARD w, Iderman Erickson reported on the April 29 , 1976 meeting . There.., iscussion on the budget deficit . The Council was thanked for the work that had been done and needed doing . The balanc( of cash on hand for April was $4 , 452 . 00 . DISASTER & EMERGENCY SERVICES - Alderman Erickson reported on the County-wide meeting of the Committee . Mr . Brady reported on the difficulty to obtain bids for sirens . Yorkville ' s need would be for 3 sirens in order to obtain a grant for one half the cost , the cost of one siren being $7 , 160 . 00 . or $3 , 580 . 00 for Yorkville ' s share . There would be a need for funds since there havon ' t been any appropriated for the project . A Plan of Action will be presented in the near future . One recommenda- tion would be for all City Employees to have training in First Aid . ADJOURNMENT - Mayor Thanepohn entertained a motion to adjourn by Alderman Wolff at 9 : 47 P . M .
