MINUTES OF THE REGULAR MEETING OF THE MAYOR AND At,DERN W OF THE UNITED CITY OF THE
VILLAGE OF YORKVILLE, ILLINOIS HELD AT THE CITY HALL ON NOVEMBER 14, 1974 AT 8:00 P1
Mayor Coleman called the meeting to order with the Pledge of Allegiance to the flag,
He then called the roll as Clerk Brant was not present. Upon roll being taken, the
following Aldermen were present:
1st Ward-Wolff 22nd Ward Hanback 3rd Ward-Ellis
Thanepohn Simmons
Mayor Coleman asked for introduction of guests. Reading of the minutes-Ald. Wolff
moved to accept the minutes, seconded by Ald. Ellis, motion carried. Reading of thi
bills-Ald. Ellis questioned the bill from Western Safway Scaffolds. Mayor Coleman
stated this was for rental of scaffold being used in the Maintenance Bldg. The Ill.
Bell Telephone bills were also questioned and according to the bills this addition:
cost was for converting to touch-tone service. The Markelz-Office Products bill was
questioned and this was for 6 chairs and a letter tray. Ald. Ellis moved the bills
be paid, seconded by Ald. Hanback, motion carried.
Attorney's Report-Attorney Grant presented An Ordinance Authorizing the Towing Away
of Illegally Parked motor Vehicles. He pointed out this is a blanket ordinance to
cover all no parking zones in the city with a $10 fine within 24 hrs. after the tim
such car was removed, plus $3.00 for each additional 24 hrs. or fraction thereof.
Also that the expenses of towing and storage of said vehicle be paid directly to th
commercial towing service. Ald. Thanepohn moved to accept the ordinance amending th
parking ordinance, seconded by Ald. Wolff. Roll call vote: Wolff-aye; Hanback-aye;
Thanepohn-aye; Ellis-aye; Simmons-aye, motion passed unanimously.
Attorney Grant presented An Ordinance Amending the "Wheel Tax Ordinance" of October
10, 1957 of the United City of the Village of Yorkville, Kendall County, Illinois.
Mayor Coleman had been asked if a person on Social Security and Medicare but not of
the age of 65 could be included in this ordinance. The council felt they would run
into too many special conditions and left the ordinance as written. "The annual fee
to be paid for Passenger Vehicle licenses of persons 65 years of age m over shall b,
50¢. Such fee for said persons shall apply only to one passenger vehicle owned and
operated by each person of the age of 65 years or over." Ald. Hanback moved to acce:
the ordinance as read, seconded by Ald. Ellis. Roll call vote: Wolff-aye; Hanback
aye; Thanepohn-aye; Ellis-aye; Simmons-aye, motion passed unanimously.
Mayor's Report-Mayor Coleman nominated Jeff Ross as patrolmen of the Police Depart-
ment at the salary of $700.00 per month effective October 14, 197+ and he shall hav,
all benefits as provided by the Personnel Policy adopted May 11, 1972. Ald. Wolff
moved to accept this nomination, seconded by Alderman Thanepohn, motion carried.
Mayor Coleman nominated J. T. Johnson as employee of the Public Works Dept. at the
salary of $700.00 per month and he shall have all benefits as provided by the Per-
sonnel Policy adopted May 11, 1972. Ald. Wolff moved to accept this nomination,
seconded by Ald. Thanepohn, motion carried. Each alderman was given a copy
of a letter to the Mayor from Charles Stading in regard to the Little League Assn.
Mayor Coleman referred this to the Park Committee and asked they meet with Mr. Stad
ing. Mayor Coleman reported a new policy will be implimented in regard t
the mail. All mail will go to the City's P.O. Box 0, picked up by the City Secret&
who will sort and distribute it into mail bins for the Mayor, P. D. , Public Works
Dept. and Clerk. Mayor Coleman read a letter from Postmaster Harry Crawford in reg&
to delivery of city mail covering both sides of the street. He said delivery will b,

made only on one side of the street unless it is a designated dead-end street, whic'
would have delivery on both sides. Discussion. City Engineer Bob Anderson
reported on a letter from the Dept. of Agriculture stating the application was deni
because the average income in Yorkville is sufficiently large enough to support thi
project. Mr. Anderson will do some calculating and get back to the Council at the
next meeting. A letter from the Bureau of Budget objected to the population
projection and Mr. Anderson will get the County's projection and submit that figure
Mayor Coleman had received a letter of thanks from the Civil Defense for our co-
operation in the downed aircraft exercise that was held recently.
City Clerk's Report- Mayor Coleman referred a copy of a letter from the E.P.A. to Mr
Anderson as the letter was written to the Mayor but he had not received it. Mayor
Coleman read letters from Central Limestone regarding increase in the cost of rock
as of November 1, 1974 and Coffman Brothers Trucking notifying the city of a revise
credit policy. He also read a letter from the Illinois State Geological Survey re-
garding photo revised topographical maps that are available at a cost of 75¢, this
was referred to Mr. Anderson. Mr. Ron Thanepohn presented the city with a
claim for $38 in damages to his car due to the condition on Fox Rd. Attorney Grant
stated there is no definitive ruling in the State Statute on such matters. Discussil
Mayor Coleman suggested Mr. Thanepohn take the claim to the city's insurance agent
and Attorney Grant will get an opinion from the Attorney General's office.
Mayor Coleman read a copy of a letter from Fred Dickson to the Illinois Municipal
League asking the League to consider accepting a project of codifying ordinances.
Treasurer's Report-Ald. Thanepohn questioned the YBS User Fee Account. Mrs. Merkel
said she will bill them and the city gets a percentage of the total. Ald. Ellis asks
Mrs. Merkel for a comparison on sales tax. Ald. Wolff moved to accept the Treasurer
Report, seconded by Ald. Ellis, motion carried.
The Police Report, the Superintendent of Public Works Report and Street Department
Report were all presented. Ald. Wolff moved to pass these reports, seconded by Ald.
Thanepohn, motion carried.
Plan Commission-Ald. Thanepohn questioned if the County had passed the building of
the trucking terminal on Rt. 47 and 71. Discussion. Mayor Coleman read a let,
from the Kendall County Building and Zoning in regard to the Rt. 34 Corridor Study
stating Yorkville's share of the cost would be $2,700. Discussion. Mayor Coleman
referred this back to the Plan Commission and Mr. Clarage.
Attorney Grant wrote a letter to the Illinois Commerce Commission in regard to the
speed, of trains going through Yorkville. In answer to this, they state, to their
knowledge, we cannot control the speed of trains through town. The legal speed is
30 miles per hour. They recommended sending them a letter stating the times and spec
clocked and they will see if they can get some volunteer cooperation to slow the
trains.
Old Business-Glen Gabel, revised plan for apartment building with variance. A dis-
cussion as to what the proper procedure is concerning this variance. Ald. Thanepohn
moved we approve this variance, seconded by Ald. Wolff, roll call vote: Wolff-aye;
Hanback-aye; Thanepohn-nay; Ellis-nay; Simmons-nay, motion did not pass. Ald. Than-
epohn moved that we set a public hearing as soon as possible, not less than 15 days,
seconded by Ald. Ellis, roll call vote: Wolff-aye; Hanback-aye; Thanepohn-aye; Elli:
aye; Simons-aye, motion passed unanimously. (Clerk should publish a public hearing

notice in the Aurora Beacon News for December 5, 197+ at City Hall at 7:30 P.M.
New Business: Blaine Harker sanitary use permit. Mr. Harker wants to get his hook-
up made and ask the City Council and Mayor to write to the E.P.A. and request this
hook-up. The pressure test must be made first. Mayor Coleman recommended this lette
be sent out as soon as the test is complete. Mr. Madden will draw up the letter and
Mayor Coleman will send it to the E.P.A. Ald. Thanepohn so moved, seconded by Ald.
Ellis, motion carried.
Committee Reports:
Water: Ald. Wolff asked for permission to proceed to install a new line in the East
alley as this water line keeps breaking. Discussion. Ald. Ellis moved that we auth-
orize the chairman of this committee to pursue this engineering, seconded by Ald.
Thanepohn, motion carried.
Police: Ald. Thanepohn reported on a recent committee meeting. He stated it is eith
time to trade or retire a squad car. The committee recommends the purchase of an
additional squad and to send out bids to be opened at the December 5th meeting, kee
ing the 3rd squad car. This would give two to be run on the road and the third to b
used for investigations and law enforcement work such as ordinance violations etc.
Ald. Thanepohn moved that we send out bids for a squad car per specifications to be
opened December 5, 1974, seconded by Ald. Ellis. Roll call vote: Wolff-aye; Hanback
aye; Thanepohn-aye; Ellis-aye; Simmons-aye, motion passed unanimously. He stated 27
violations of junk, junk cars, inoperable vehicles, etc. were turned in and these
are being taken care of. The committee recommends the council's approval of the ILE
Co-op Operation, which will be on a one-year trial basis. The ILEC supplies a squad
and 2 detectives to the city and the cases are turned over to theaL The city's cost
is $300 for maintenance of a squad. Ald. Thanepohn moved that we cooperate in the
ILEC Detective Program, seconded by Ald. Ellis, motion carried. Ald. Thanepohn alsc
reported a request to the Public Property & Bldgs. Committee for a shed for stolen
goods and referred a request to the Finance and Audit Committee for a typewriter.
The Dept. is working on a Human Resource Program.
Public Property & Bldgs: Ald. Simmons reported a 11 ' x 10' shed for the P. D. woulc
fit between the 2 back windows. Mr. Wheaton of M & W. Construction Co. gave a bid c
$1,000, which includes everything but painting. Ald. Simmons moved to accept this
bid for the shed and be installed by M & W Construction, seconded by Ald. Wolff, Rc
call vote: Wolff-aye; Hanback-aye; Thanepohn-aye; Ellis-aye; Simmons-aye, motion
passed unanimously. Specifications are ready for heating and air-conditioning for
the Maintenance Bldg. Storm windows have been ordered for City Hall. The heating ar
electrical work are hooked up in the other part of the Maintenance Bldg.
Finance & Audit: Ald. Thanepohn reported an IBM typewriter could not be purchased 3
less than $500. $531.00 is as cheap as you can buy one even under the State of Ill.

typewriter for $531.00, seconded by Ald. Wolff, motion carried.
Library Board: Ald. Simmons stated the Library is having trouble collecting fines
and getting books back. He asked if Attorney Grant could draw up a letter. Attorney
Grant will draw up a form letter for the Library's use.
Ald. Thanepohn moved to adjourn to executive session at 10:05 P.M., seconded by Alc
Wolff, motion carried.
