MINUTES OF THE REGULAR MEETING OF THE MAYOR AND ALDERMEN OF THE UNITED CITY OF THE
VILLAGE OF YORKVILLE, ILLINOIS HELD AT THE CITY HALL ON JULY 11, 197+ AT 8:00 P.M.
Mayor Coleman called the meeting to order with the pledge of allegiance to the flag.
He then directed the Clerk to take the roll. Upon roll being taken, the following
Aldermen were present:
1st Ward-Wolff 2nd Ward-Hanback 3rd Ward-Ellis
Thanepohn Simmons
Mayor Coleman asked for introduction of guests. He then directed the Clerk to read
the minutes of the last meeting. Ald. Ellis moved to accept the minutes with any
corrections to be made. There being no corrections, Ald. Wolff seconded the motion,
motion carried. Mayor Coleman directed the Clerk to read the bills. Ald. Ellis
questioned the General Electric bill. Clerk Brant stated this was for the actual sei
Ald. Ellis asked how many sets the city owns now and was told 3 at this time. Ald.
Hanback questioned the Hamilton Olds bill and Clerk Brant reported it was for body
work. Ald. Thanepohn moved the bills be paid as listed, seconded by Ald. Wolff,
motion carried. (List of bills are attached. )
Attorney's Report Attorney Grant reported he had obtained copies of all the water
ordinance and amendments and would review the whole thing, which will take some timf
He presented 'an ordinance regulating traffic by designating stop intersections" at
Church and Center and Church and King. Ald. Ellis questioned the fine amount. Chief
Prickett stated on the printed tickets a minimum of $1.00 is stated. It was recom-
mended the police committee change this when new tickets are printed. Ald. Ellis
moved to accept this ordinance, seconded by Ald. Wolff. Roll call vote: Wolff-aye;
Hanback-aye; Thanepohn-aye; Ellis-aye; Simmons-aye, motion passed unanimously.
Mayor's Report-Mayor Coleman read a letter sent by certified mail from the Citizens
For Better Environment asking permission to canvas the city this summer. They will
supply complaintant forms, research them and if necessary, file a formal complaint
with the EPA. A list of workers would be furnished the Police Dept. Discussion. Ald
Thanepohn moved to refer this to the Health & Sanitation Committee to find out more
about the organization and what is involved, seconded by Ald. Wolff, motion carried
Mayor Coleman read a letter from the Kendall County Building, Zoning and Planning
Office asking a council representative attend a meeting July 17, 197+ at 4:00 P.M.
at the Annex in regard to proposed national flood insurance programs. Ald. Thanepohi
will attend this meeting.
City Clerk's Report-Clerk Brant opened a tire bid from B.F. Goodrich, Aurora, Ill.
for 6 tires per specifications for the 350 Ford truck. $280.86 plus $30.00 wheel
balance for a total of $310.86. Ald. Thanepohn moved that the matter be referred to
the Street Committee chairman to make a decision. Discussion Ald. Wolff stated sine,
this was the only bid and specifications were followed there was no need to refer
the matter. Ald. Thanepohn withdrew his motion. Ald. Wolff moved to accept the bid
from B. F. Goodrich and have them mounted and balanced, seconded by Ald. Ellis, mot
carried.
Treasurer's Report-Ald. Ellis asked if that was for all the cement work at the main
tenance building out of the Revenue Sharing Acct. and was told it was. Ald. Wolff
moved to accept the Treasurer's Report, seconded by Ald. Thanepohn, motion carried.
Police Report-183 cases reported to the ICC for the month of June. General Superin-
tendent of Water and Sewer Reports presented. Ald. Wolff moved to accept all three

reports, seconded by Ald. Simmons, motion carried.
Clerk Brant read the Zoning Board of Appeals report. The Board met to consider the
petition of Glen Davidson: That the present B-1 Zoning Classification Boundries be
re-aligned so that lots three and four in their entirety would be zoned as B-1, the
following described real estate-that part of the Southwest Quarter of Section 28,
Township 37 North, Range 7 East of the Third Principal Meridian described in the
petition. The meeting was attended by the petitioner, two lawyers, and many inter-
ested individuals along with 4 zoning board of appeals members. After much discussio
it was the unanimous decision of the board that they recommend to the City Council
that the petition be denied.
Old Business: Brian Mulhern's Planned Unit Development-Attorney Max Peterson present
a landscaping plot plan for Lot 1, Block 9 and Proposed Covenants & Restrictions,
Exhibit D, which are as follows:
1.All yard areas and shrubbery on all lots shall be regularly maintained.
2.All parking area, private driveway areas, and private sidewalks shall be regular
maintained and snow shall be removed and cleared from such areas on a regular ba
as weather conditions permit.
3.No fences of any nature whatsoever shall be constructed between any lots which
would impede access to open areas between buildings.
4.All persons residing in any buildings on any lot shall have common use of, and
access to all grounds, parking areas, private access drives to parking areas,
and walkways.
5.No buses, self-contained mobile camper units or vans in excess of the length of
normal pickup motor vehicle, camping trailers of any nature, semi-trailers, or
semi-tractor motor trucks, shall be parked in, about, or upon the parking areas
or access drives on any lot for a period of time in excess of six hours.
Attorney Peterson stated it was agreed upon to change item #2 to read "All parking
area, private driveway areas, and private sidewalks shall be regularily maintained t
the owner or owners. . . ." The City Planner had requested a landscaping plan for
the entire development but Attorney Peterson said there was not time to have it at
this meeting. Discussion. Ald. Simmons asked about recreational equipment or areas
for children. Mr. Mulhern had rejected swings, slides, etc. from a safety stand poir
Ald. Ellis and Ald. Thanepohn pointed out with the large number of people residing
in this development, a pool, tennis courts or some sort of recreational facilities
should be provided by the developer. Much discussion on this matter. Ald. Wolff move
until Mr. Mulhern can give the Council a full landscaping plot and some type of re-
creational facilities the matter be tabled, seconded by Ald. Hanback, motion carriec

ye; Simmons-aye, motion passed 4 to 1. Mayor Coleman then asked for a roll call
vote on the motion. Wolff-aye; Hanback-naye; Thanepohn-aye; Ellis-aye; Simmons-aye,
motion passed 4 to 1. More discussion. Ald. Thanepohn moved to reconsider his first
otion. After some discussion, he withdrew this last motion.

COMMITTEE REPORTS-Streets d Alleys: Ald. Ellis reported 83 loads of brush had beer
picked up in June, with 67�rog the storm of June 20, 1974, and 71 loads this month
from that storm. The city employees have been working very hard to clean up all the
trees and limbs along the streets. Ald. Ellis reported he had checked at the Court-
house on the description of the pr6perty tb be vacated by ordinance referred to him
last meeting. He found this was at one time Atherton St. and according to the asses-
sor's office has already been vacated but no ordinance has ever been recorded. Attoz
Grant will re-write the ordinance with the correct description. Mr. Tom Lindblom
asked where this property goes after it is vacated. He was told it will be divided i
alf and go to the property owners on either side.
Water: Ald. Wolff stated if there was a real crisis the water would last about a hal
day and the committee recommends spending some money and getting the old well into e
working condition. Ald. Wolff moved to spend $2,500 out of the Water Fund to revamp
the old well to make it workable, seconded by Ald. Simmons. Roll call vote: Wolff-
aye; Hanback-aye; Thanepohn-aye; Ellis-aye; Simmons-aye, motion passed unanimously.
Ald. Wolff also stated the city is not in a good situation in regard to water and
must think about another well very soon. Even without the growth of the city, a new
well is still needed.
Police: Ald. Thanepohn reported the committee is working out a plan for getting at
the dog situation and will present it at a later meeting. The committee requested
purchasing another portable radio and battery for $350. The Street and Water Depts.
are making good use of the ones they have. Ald. Thanepohn moved to, in fact, purcha-
one portable radio and battery, seconded by Ald. Ellis, motion carried. Ald. Thane-
pohn stated the committee would like to purchase a third squad car in December and
it takes 5 to 6 months to get a radio for the car and requests authorization to put
out bids. Ald. Thanepohn moved to put out bids for a two-way 4 frequency radio, sec-
onded by Ald. Wolff. Discussion. Ald. Ellis pointed out the Council would be voting
n a third squad car in essence. Ald. Wolff withdrew his second and Ald. Thanepohn
withdrew his motion.
Trees & Parks: Ald. Hanback reported on the meeting with the school board represent-
atives in regard to tennis courts and ball parks. There is no doubt land will be
allowed for 3 ball diamonds and 2 or three tennis courts. The school board will
specifically state what land can be used awed hopefully�by the next meeting. The
school board has a parking lot at Parkview School where they have put up standards
or tennis courts and asked that the city split the cost of $150 to $200 for three
tennis nets. Ald. Hanback moved the city share the expense of the tennis nets, secon
by Ald. Ellis, motion carried. Ms. Melody Horton presented a petition to the Council
with approximately 201 signatures requesting permission to hold musical concerts in
he City Park on Friday evenings 7 to 10 P.M. If any problems arise, the programs
could be immediately stopped. There will be a clean-up committee each Sat. morning.
Volunteer bands will be perform/agd would like to hire some bands. Mayor Coleman
recommended changing the hours to 7 to 9 but Ms. Horton stated she had contacted
ost of the neighbors around the park and they had signed the petition. Ald. Hanback
oved that $100 for a Friday evening be allotted this. Discussion. Ald. Hanback re-
scinded his motion. Ald. Ellis moved that Ald. Hanback, chairman of Trees & Parks,
be an active member of this committee in helping get bands and he be empowered to
spend up to $600 for the remaining part of the summer.' Seconded by Ald. Simmons,
motion carried. Mayor Coleman reported accordine5he Civil Defense Director Brady
he city can get some money back spent in picking up the brush from the storm.

Sewers: Ald. Wolff reported the Sanitary District has passed an ordinance for a user
barge. The city would do their billing and send them out with water bills. Ald. Wol
moved the city attorney draw up an ordinance to this effect, seconded by Ald. Thane-
ohn, motion carried. The old emergency truck is being offered for sale by the Fire
ept. and the committee feels it could be put to good use by the Supt. of Public
Works or the Water Dept. Bids are to be in by Aug. 1st and can be either with the
equipment on the truck or without.
Public Property & Buildings: Ald. Simmons reported the heating unit received by Artl
as damaged and returned. They will start on it tomorrow. Remodeling on the Police
Building will start next week.
Building & Zoning: Ald. Simmons pointed out Supt. of Public Works Madden was not
appointed as Building Inspector. Mayor Coleman appointed Eldon Madden as Building
Inspector at a fee of $5.00 per inspection after hours, retroactive July 1, 1A74.
Ald. Ellis moved to accept this appointment, seconded by Ald. Hanback, motion carriE
