APRIL 12t 1973 MINUTES OF THE REGULAR MONTHLY MEETING OF THE MAYOR AND ALDERMEN OF THE UNITED CITY' OF THE VILLAGE OF YORKVILLE, ILLINOIS, HELD AT THE CITY HALL ON APRIL 12, 1973, AT 8s00 P.M. Mayor Coleman called the meeting to order and asked the City Council and visitors to stand and give the Pledge of Allegiance to the fls.a. He then directed the clerk to take the roll. Upon roll being taken, the following Aldermen were presents ist Ward-Follmer 2nd Ward-Florence 3rd Ward-Ellis Madden Thanepohn McHugh absent Mayor Coleman introduced the visitors. Mayor Coleman directed the clerk to read the minutes of the regular meeting. Alder- man Madden moved to dispense with reading of the minutes as all had received copies and to accept said minutes. Seconded by Alderman Follmer. Motion carried. Mayor Coleman directed the clerk to read the bills. Alderman Florence moved to dispense with reading of the bills since all have received copies and all bills be paid if found to be correct. Seconded by Alderman Thanepohn. Motion carried. Seconded by Alderman Florence. Motion carried. Mayor Coleman stated another Revenue Sharing check in the amount of $3,829 had been received. Streets and alleys, water and building inspector's reports by Supt. Price. Attorney Bassak presented corrective deeds from the City of Yorkville to Laverne Hanson on the property lines at the reservoir and asked for a resolution approving the correcting deeds. Discussion. Alderman Ellis moved to approve the corrective deeds. Seconded by Alderman Thanepohn. Planning Commission Report read by Mayor Coleman. 3.02 Pre-annexation agreement, Dale Kissel, Developer was not approved and forwarded to City Council. 3.03 Country side Center Subdivision-petition of developer Robert Loftus to re-subdivide, tabled until developer can define property lines, curb lines & setback lines. Mayor Cole- man read minutes of the Public Hearing on the proposed zoning ordinances and proposed zoning map of the City of Yorkville. Mr. Anderson, Planning Commission chairman and Mayor Coleman set May 3, 1973 at 8s00 P.M. at City Hall for another comprehensive hearing so all complaints can be heard. Mr. Groner questioned a con- flict of interest of some members of the Planning Commission. Mayor Coleman ex- plained appointing real estate men to the commission was a recommendation of the -3- FORM 601-49® U.S.A. eMT7. 19 1923 State of Illinois as they are more aware of conditions along these lines. CORRESPONDENCE-Mayor Coleman read letters of resignation from City Attorney Anthony Bassak and Mrs. Jesse Schobert, library board member. Alderman Ellis moved to accept these resignations and extended the council's thanks to both parties for all the hours they have put in. Seconded by Alderman Thanepohn. Motion carried. American Red Cross expressed their appreciation for flying the Red Cross flag furing the month of March. National Cystic Fibrosis Research Foundation thanked the community for helping make their 1972 campaign a success and asked for permission to hold their march in 1973. Sept. has been proclained as Children's Lung Disease Month and Sept. 9th thru 16th being Children's Lung Disease Week. Alderman Florence moved to allow this march. Seconded by Alderman Follmer. Motion carried. OLD BUSINESS: Mayor Coleman directed the clerk to open the sealed bids received on the sale of 1971 Ford Custom squad car. Roy Boyle, Rt. 3, Box 4190 W. Chicago $725.00 E. Alderman Florence moved to accept the bid of Roy Boyle for $725.00 and as an alternate accept the bid of Clyde Miller for $700.00. Upon receipt of amount of bid, the Mayor and City Clerk be authorized to execute all papers necessary for the sale 6f said car. Seconded by Alderman Thanepohn. Conover Plat-Unit 7-Mayor Coleman had received a letter from Mr. Darryll R. Bauer, Acting Supervisor, Division of Water Pollution Control, commenting on the conditior. and provisions of Permit 1963-HB-189 issued to John Conover 'on May 139 1963- Letter refers to Pollution Regulations of I11, Rule 922a placing a time limit of 2 yrs. on a permit and Rule 901 with reference to construction of additional san- itary sewers that are designed and intended to serve more than one bldg. or are designed and intended to serve one bldg* with more than 15 people, a construction permit would be required. Discussion. Alderman Thanepohn moved to table this final plat until the April 26th council meeting. Seconded by Alderman Madden. Motion carried. Mayor Coleman turned the matter over to Ald. Madden to arrange a meeting of the original engineer, sanitary district, council representative and interested attorneys for the purpose of reaching some decision to be presented at the April 26th meeting. Attorney Bassak presented an ordinance to adopt salary changes(see attachment). Alderman Thanepohn moved to accept the ordinance as read. Seconded by Alderman Ellis. Attorney Ba.ssak presented the following resolution: WHEREAS, the Hartford Accident and Indemnity Company executed its Bond No. N-3783904 in the penalty of Three -4- FORM 601-49®O.B.A. APRIL 12, 1973 Thousand Dollars on behalf of Bessie B. Lough as City Collector effective April 29, 1972• WHEREAS, the Hartford Accident and Indemnity Company was requested to cancel this bond, effective February 1, 1973• WHEREAS, it is the desire of the United City of the Village of Yorkville to terminate liability under and cancel said bond ex- ecuted by the Hartford Accident and Indemnity Company which cancellation is to be effective as of the 1st day of February, 1973• NOW, THEREFORE, be it resolved that the Hartford Accident and Indemnity Company is relieved from all further liability as to future acts as of the 1st day of February, 1973, on its Bond No. N-3783904 in the penalty of $3,000.00, effective April 29, 1973• Alderman Florence moved to pass this resolution cancelling the City Collector's bond as of February 1, 1973• Seconded by Alderman Thanepohn. Mayor Coleman presented dedication of the alley east of Rt. 47 between Van Emmon and Hydraulic Streets. Discussion. Alderman Thanepohn moved this be tabled until the April 26th meeting and refer it to the Streets & Alleys Committee. Seconded by Alderman Madden. Motion carried. Mayor Coleman reminded the Council to file a statement of economic interest with the County Clerk before April 30, 1973• Alderman Thanepohn reported on the IMRF resolution for approval of prior service. Per Mr. Rex Renner this will not affect rates and approval is necessary to certify the prior service records and guarantee the employee credits involved for retire- ment. Alderman Thanepohn moved to accept this resolution certifying prior service. Seconded by Alderman Ellis. Mr. Dale Kissel and Attorney Edwin Simpson asked the Pre-annexation Agreement of Mr. Kissel's be forwarded to the Zoning Board of Appeals for a public hearing. Attorney Bassak stated he would contact Don Dirst, chairman, and set a time for a public hearing. Alderman Thanepohn reported the EPA does not require a permit to get the trees out of the River. NEW BUSINESS: Clerk read a petition from Ed. Salisbury to rezone from residential to business district uses property west of Rt. 47 between Washington St. & Franklin St. Mayor Coleman read a petition of 45 signatures opposing this rezoning. Discussion. Ald- erman Florence moved to refer this petition for rezoning to the Planning Commission. Seconded by Alderman Thanepohn. Roy Dean, representing Ter-Jac Construction Co. asked permission to close Kendall Drive in Countryside Center for a carnival to be held May 9th thru the 20th as a promotional attraction for the new shopping center, using R & J Amusements, Discussion. Alderman Madden moved to allow the closing of stated section of street for a carnival May 9-209 1973• Seconded by Alderman Florence. Aldermen Follmer, Madden, Florence and Ellis voting aye, Thanepohn naye. Motion carried. Mayor Coleman reported Mrs. Marjorie Himes had agreed to sell to the city a piece of property 100 x 100 east of the water tower for $2,500. The city will have to have a survey made of said area. Alderman Ellis moved to make arrangements to purchase this property at said price. Seconded by Alderman Thanepohn. Alderman Madden attended ameeting of the Kendall Co. sewer and water association. He recommends we get in on this organization right now and learn all we can about it and become a part of the organization. Discussion. Mayor Coleman moved Alderman Madden serve as a council representative to this county association. Seconded by Alderman Thaneophn. Motion carried.. Mayor Coleman read letters from EPA granting permits with special conditions to Countryside Center Subdivision, Log #1240-73, Permit #1973-HB-650; Apple Tree Courts, Log #895-73, Permit #1973-HB-648; Fox Industrial Park, Log #894-73, Permit #1973-HB-649"3 and a supplemental permit #1971-IA-1196-i, Log #896-73 to Countryside Center Subdivision. Mayor Coleman stated a draft of Reliance Insurance Co. in the amount of $25,000.00 had been received from Attorney Fred H. Dickson. Check should be placed in the Water Construction Fund. City has requested a list of the bond -holders from National Boulevard Bank for the 1959 water revenue bond issue. Attorney Bassak stated he had received $780 from a law suit for the city. COMMITTEE REPORTS: Streets and Alleys-Alderman Madden reported the committee, city engineer and superintendent of streets rode around last Sate and listed all the streets and requirements needing work. Next month the estimates will be in and bids in by June. Quentin Chatham's bid on sidewalks-front of library estimated at $300, possibly more if the base underneath is gone$ Heustis Street hill by Pilmer Apts. $345, without 4 or 5 blocks at driveway; front of James Brant residence $100, which will be halved by owners. Roy Lage will get at curbs and gutters on Orange Street as soon as weather permits. Police and Fire-Alderman Ellis questioned the bill for uniforms and flags for $173.77 and referred to the personnel policy"all costs of such uniforms must be approved by the city council in advance of their purchase". Discussion. Alderman Ellis moved these bills not be paid until some clarification is made to the Police Committee and presented at next council meeting. Alderman Thanepohn seconded. Motion carried. Trees & Parks-Follmer stated the backstop was delivered and more fencing would be needed after the backstop is put up. He had ordered a steel door for the monument in the park. & Library Future Plannin6 Alderman Ellis reported Jon Kot would be working on the Library overhangs Alderman Ellis asked the Mayor to please consider another counctil member to serve on the Library Board as their meetings conflict with another meeting he has to attend. Finance-Alderman Thanepohn asked all committees to get any capitol expenditures to the clerk right awgy so he can make up the Clerk's Estimate. a Alderman Ellis and Madden reported on a meeting they attended in Ka4ee held by the Dept. of Local Governmental Affairs. Revenue sharing is being paid on a quarterly basis for a 5-year program. Funds are to be used within a 24 month period or ask for an extension and there is assistance available just for the asking. Mayor Coleman stated a seminar will be held May 19 and 20 for newly elected city officials in Arlington Park. At 10,55 P.M. Alderman Follmer moved the meeting be adjourned. BE IT ORDAINED by the City Council of the United City of the VillaF3e of Yorkville, Kendall County, Illinois: Section 1: That in accordance with the Illinois Municipal Code, the compensation of the mosyor'sp8 sldermean of the United City of the Village of Yorkville, Kendall County, Illinois, is hereby fixed at Twenty-five ($25.00) Dollars for each regular City Council meeting attended. Section 2: That the compensation of the City Clerk of the United City of the Village of Yorkville, Kendall County, Illinois is hereby fixed at $1200.00 per year. Section 3: That the compensation for the Liquor Commissioner of the United City of the Village of Yorkville, Kendall County, Illinois is hereby fixed at $300.00 per year. Section 4: That -the provisions of this ordinance shall only apply 'to those city officials elected on or after April 16, 1973 and no other salary or compensation shall be allowed any alderman other than herein set forth. Section 5: That this ordinance shall repeal all other ordinances or resolutions of the United City of the IFillage of Yorkville heretofore passed and adopted that conflict herewith. Section 6: This ordinance shall be in full force and effect after its passage, approval and publication as provided by law.
