MINUTES OF THE REGULAR MONTHLY MEETING OF THE MAYOR AND ALDERMEN OF THE UNITED
CITY OF THE VILLAGE OF YORKVILLE, ILLINOIS, HELD AT THE CITY HALL ON FEBRUARY 8,
1973, AT 8:00 P.M.
Mayor Coleman called the meeting to order and adked the City Council and visitors
to stand and give the Pledge of Allegiance to the flag. He then directed the clerk
to take the roll. Upon roll being taken, the following Aldermen were presents

Mayor Coleman directed the Clerk to read the minutes of the regular meeting. Alder-
man Madden moved to dispense with reading the minutes as all aldermen had copies.
Seconded by Alderman Florence. Motion carried.
Alderman Florence moved to dispense with reading the treasurer's report as all
aldermen had received copies. Seconded by Alderman Madden, Motion carried. Mayor
Coleman brought to the Council's attention an increase of $808.22 in sales tax
due to the opening of Countryside Shopping Center and Christmas shopping.
Mr. Bill Tange, a representative of BOLA, explained the building codes available
to the council. These are codes covering, one and two family dwellings, plumb-
ing, mechanical, fire prevention and mainetance of existing bldgao The cost of
membership, which includes code interpretation, approving architectural engineer-
ing of proposed buildings, 2 representatives with power to veto on new amendments,
is $100.00 per year. Copies of the codes are $10.00 each. Discussion. Alder-
man Madden moved the city attorney draw up an ordinance, for presentation at
the next regular council meeting, adopting the complete BOCA code. Seconded
by Alderman Thanepohn. Motion carried. Alderman Madden moved to join BOCA and
have as the 2 representatives the Building Inspector and the Chairman of the
Building and Zoning Committee. Seconded by Alderman Thanepohn. Motion carried.
Mayor Coleman asked each visitor to introduce themselves.
Chief of Police Prickett read the Police report.
Street, Water & Sewer and Building Inspector's Reports were read by Supt. Price,
Alderman Madden brought to the Council's attention 21 times more water is new
being used by the city than in 1962.
Mayor Coleman directed the clerk to read the bills. Alderman Madden moved to
dispense with reading the bills since the council had received copies and asked
the bills be paid if found to be correct. Seconded by Alderman Florence. Motion
carried.

Mayes Coleman reported on January 309 1973, the purchase of the land near the
Palmer Dam for $1,433.00, the average assessed valuation of three appraisals.
Alderman Thanepohn moved to affirm the purchase of said property. Alderman
Florence seconded the motion. Roll cull vote:

Mayor Coleman stated the Planning Commission will have a public hearing on the
comprehensive planning report. Mayor Coleman recommended as members Alderson
Madden, Thanepohn,Ellis and Leo Anderson, Alderman Florence moved to confirm this
recommendation. Seconded by Alderman Follmer. Motion carried.
City Clerk asked each alderman for 5 judges to serve on the board of election
for the April 17, 1973, city election. The selection of judges is done by the
Alderman of each ward not seeking re-election.
Mayor Coleman reported $19,000 had been received from Was P. Morrissey, making
a total of $609000 restitution on water tower bonds.
Mayor Coleman referred a letter from E.P.A. to Alderman Thanepohn on a permit
needed for work on the sand bar at Palmer Dam.
Mayor Coleman stated he had acted on the complaint to the Health Dept* of no
garbage pickup from Mrs. Donna Reed.
Mayor Coleman read a letter from Mr. Gerald Oehring of the Kendall Co. Title
Company in regard to the ownership of the alley east of Rt. 47 between Van Eamon
and Hydraulic. There are no grants or easements on record to the city for this
property. Discussion. Mayor Coleman turned the matter over to the City Attorney.
Mayor Coleman read a letter from ALSAC, St. Jude Children's Research Hospital,
thanking the city for permitting their drives in the pest years for children
afflicted with leukemia and request permission for the 1973 drive (Sept. 23rd).
Alderman Florence moved permission be granted. Seconded by Alderman Follser.
Motion carried..
Mayor Coleman read a list of complaints from Richard J. Groner on conditions
existing on Main Street, fire lane behind Homer G. Dickson, Inc., running of
stop sign at Main and Van Eamon, parking on sidewalk on Van Eamon between Main
and Bridge. Mayor Coleman stated the complaints have to do with police action
and turned it over to the Police Committee.
OLD BUSINESS-
The petition of John Gengler to amend the Yorkville Liquor Ordinance asking for-
"...all retail class liquor license establishments within said City to remain
open and to serve and sell at retail alcoholic liquor within the same time span
as permitted by the County, to-wits Friday from 7100 a.m. to 1100 a.m. Saturday
morning and, further, from 12100 noon Sunday to 12100 midnight Central Standard
Time Sunday, unless so-called Daylight Savings time shall be in effect in the
United City of the Village of Yorkville, during which time your Petitioners
request that the retail class liquor establishments in said City be allowed to
remain open from 12:00 noon Sunday to 12100 midnight Sunday Daylight Savings Time
and from 7x00 a.m. Friday to 1100 a.m. Saturday morning, Central Daylight Time."
Alderman Thanepohn moved to adopt by resolution the above changes in theliquor
ordinance to be effective immediately and give the Mayor and Clerk authority to
sign said resolution. Seconded by Alderman Florence. Roll call votes

George Griffin explained to "the Council what has taken place in regard to Apple
Tree Courts sewer situation. The E.P.A. states Ter Jac does not have the authority
to relinquish any or all of their permit. Mr. Griffin explained Ter Jac would
like to enter into an agreement with the city and the Sanitary district to re-
linquish the remainder of their permit to Apple Tree Courts and when the new
sanitary plant is in operation the first permit to be approved would be given to
Ter Jac for the amount they gave up. Apple Tree Courts cannot be hooked up as
it stands now. Discussion. Alderman Florence moved we allow no more occupancy
in Apple Tree Courts until the outcome of the of sewer usagees
Alderman Thanepohn seconded the motion. Discussion. Alderman Thanepohn withdrew
his second and Alderman Florence withdrew his motion but feel we should enforce
our ordinances. Alderman Thanepohn moved the Mayor and Clerk be empowered to
sign this document with the approval of the Superintendent of water & Sewer and
the city attorney. Seconded by Alderman Fullmer. Roll call votes

Motion carried 3-1. The city attorney was directed to write Mr. Kackert a letter
informing him further occupancy would not be tolerated.
NEW BUSINESSs
Mr. Loren Miller informed the city he would like to install temporary septic
system in Miller Subdivision, one septic per four unit bldg. on 44,000 sq* fto
or every other lot and at the completion of the sewage treatment plant and
issuance of permits would remove septic system and make connection to.- the sewer.
Mr. Price stated purcilation test would have to be made to see if the area will
accept a septic system.
Alderman Madden presented in the absence of the Chairman of the Water Com-
mitteea proposed contract with Wallace & Tiernan Division for electro-rust
proofing of water tower under Plan B at an annual cost of $17500. Alderman
Madden moved to enter into this contract for one year. Alderman Thanepohn
seconded. Roll call votes

Alderman Thanepohn recommended going to two council meetings a month for a
smoother flow of business and to eliminate a one month layover. Discussion.
Alderman Thanepohn moved to go to two council meetings a month commencing in
April and the ordinance be amended setting meetings on the 2nd and 4th Thursday
of each month. Alderman Follmer seconded. Motion carried. The City Attorney
was directed to amend this ordinance and present it at the next meeting.
Alderman Florence showed the Council a Notice the County Building Inspector
uses on all new buildings. Discussion. Alderman Florence moved to buy some
of these notices for the city building inspector to use. Seconded by Alder-
man Follmer. Motion carried.
Alderman Thanepohn recommended the purchase of a conference table and chairs
for the Council's use and the Public Building and Property Committee investigate
the cost of said table and chairs and report back at the next meeting.

Alderman Florence stated the old squad car had been advertised in the Kendall
County Record, Fox Valley Shopper, and Beacon News with sealed bids to be in by
February 24, 1973 to the City Clerk, reserving the right to reject any or all bids.
Alderman Florence stated 3 more applications for patrolman had been received.
Chief Prickett recommended John Britt for full time instead of part time. Dis-
cussion. Mayor Coleman stated these matters should be discussed at police com-
mittee meetings before coming to the council and the chairman of the police
committee will set a date for the next committee meeting.
COMMITTEE REPORTS:
Streets and Alleys-Alderman Madden reported the library would like the sidewalk
repaired in front of the building. It was recommended other sidewalk repairs be
looked into and all done at one.time.
Trees and Parks-Alderman Follmer reported some equipment -had been purchased to
repair the lights in the park. Alderman Madden stated the American Legion was
going to work on them, too and suggested Mr. Bob Kyes be contacted.
Sewers-Alderman Florence questioned the storm sewers that dump into the city
sewer. Mr. Price said new storm sewers were needed. Mr. Harker's application
has been rejected but was advised to send it in again in 90 days.
I,,ights. Telemhone & G.s-Mayor Coleman said the city is still paying the gas bill
on the old library building and has advised the gas company to turn the gas off
and a refund will be issued on the bill.
Building and Zoning-Alderman Madden said zoning maps should be available by next
week.
Finance and Audit- Alderman Thanepohn reported on the reviewing of city officials
salaries and recommended salary changes of $25 per meeting for the Mayor, Liquor
Commissioner $300 per year, City Clerk $1,200 peryear, Clerk's secretary $20.00
per meeting, Treasurer $720 per year, Aldermen $25 per meeting. The position of
the city collector is being eliminated by the hiring of a city secretary. These
changes will not be effective until the next election for that office. Discussion,
Alderman Thanepohn moved these salary changes be made by ordinance. Seconded by
Alderman Madden. Roll call vote:
