Special Park Board Meeting  ARC Building  201 W. Hydraulic Avenue  6:30 p.m.  January 15, 2015    Call to Order:  Seaver Tarulis called the meeting to order at 6:30 p.m.    Roll Call: Deb Horaz ‐ no; Kelly Sedgwick – no;  Seaver Tarulis – yes; Mark Dilday – yes; Amy Cesich  ‐ no; Dan Lane – yes; Matt Konecki – yes.    Introduction of City Official and Staff:     Tim Evans – Director of Parks and Recreation  Scott Sleezer – Superintendent of Parks   Shay Remus – Superintendent of Recreation     Other Guests:   None.    Public Comment:  None.     Presentation:  None.    Approval of Minutes:  The minutes from the December 18, 2014 were approved.  Motion to approve  the minutes made by Dan Lane and seconded by Matt Konecki.    Bills Review:     Bill List – January 8, 2015 – Dan asked about the tent rental deposit.  Tim said it is for next year.      Old Business:    131 Hydraulic Unit C – RFP Results & Presentation – Tim said he did ask the two people to come tonight  to present a presentation and they both let me know they withdraw being considered.  Tim contacted  the third person and said he would talk to the board to make sure you wanted them to come and what  direction the board wants to go.    Dan asked what the reasons were for withdrawing.  Tim said they said the location of their businesses  are doing well and they didn’t want to take on another place.   Tim said he told her she is the only one  left the others decided to withdraw.  Tim said he would ask the board if they want to see if other  businesses are interested.     Tim said in February she could come in and meet with the board.  Tim said staff is working on a proposal  as a backup plan.  Tim said they have met with the Chicago Whitewater Association about using some  space for office and doing some events.  Tim said they would probably want the old Geneva Kayak  building, but they might be open to others.     DRAFT Page 2 of 4  Tim asked the board if they want him to put the RFP out again.  Tim said he does not want the buildings  to be empty in the summer.  The board agreed.  Tim said the board needs to have a backup plan  Tim  said the board can discuss it at the February meeting.  Dan asked what happens if she is the only one  and the board doesn’t want her.      The board is concerned if there is a demand for her business.  Dan said the board won’t take her by  default. Tim said we can have some options at the next meeting and put out another RFP.  Tim  suggested to table this for now and in February decide how to move forward.  Tim wants to make sure  we have someone in there for the summer.      Tim said the Illinois Chicago Whitewater Association reached out to the city about partnering with us  this summer.  Dan doesn’t want it to be free.  Dan said he doesn’t understand how if someone has rent  at $300 how they want to discuss that.  Dan said why is it negotiable.     Dan said if the rent is $300 that is what it is.  Tim said that is for the board to decide.  Scott said he thinks  that the rent on commercial space is negotiated and it is a common practice.  Dan said $300 is  reasonable.  Scott said some may have the opinion it doesn’t hurt to ask.      Tim said Chicago Whitewater likes the kayak  chute here and we were discussing how to help us get  more people down to the area.  Tim said it seems like everyone wants more people downtown and if we  don’t have a great businesses opportunity, we need a plan B because we don’t want a business that will  fail.    Tim said the point of all this is to bring people downtown.  Tim said the city can leave the conference  room available to rent for birthdays or other meetings.  Scott said the ice cream shop could rent it out  and pay us a usage fee.  Scott said partnering with Whitewater would be smart because those are the  people that use this and would use the facilities and shop and enjoy Yorkville.      Matt said people have seen the businesses fail and they might be are reluctant.  Dan said there is no left  turn there, which he feels hurts businesses.  Dan said you have to drive around the block and it is not  good for businesses.     Scott said he thinks it gives the opportunity for the city to use the space and gives us time to get the  right fit.  Dan agrees the board should not rush to get someone in there just for the sake of getting  someone in there.  It needs to be the right fit.  Seaver said the water chute has not been used much and  partnering with the Whitewater Association would help.    Scott agrees.  Tim said we could hold more events.  Tim said he wants to drive more people downtown  and use the water feature, which then leads to them eating and other things.  Scott said the city could  paint the building and landscape it.  Scott said some high schools have kayaking teams.  Scott said if  there were qualified people involved in that sport here in Yorkville, schools would have a facility.      There was a discussion about putting up posts and gates that were permanent and Chicago Whitewater  would monitor that and take care of it.  Scott said a post every 50 to 60 feet.  Scott said they can be  painted to blend in. They are not large.  Tim said at the February meeting we will discuss this more and  bring back some options for the board to decide.      Page 3 of 4  Scott said at the Geneva Kayak building, there will be a significant amount of construction for at least a  year.  The playground will be there, joint trails and memorial area is being built.  Scott said people can  get to it, but there will be a significant amount of construction.  Scott said that might be a reason to  partner with Whitewater.  Tim said this item is tabled until next month.     Motion to table made by Mark Dilday and seconded by Dan Lane.  Motion passes.      New Business:    RFP for Riverfront Park Playground – Tim said this RFP is so we can get this out to potential playground  companies to get things moving on the playground.  Scott said we would like a nature theme.  Scott said  the cost is $90,000 in equipment with a volunteer build.      Scott said the city is constructing the park.  Scott said we will send this to playground manufacturers and  get their input and get storyboards following our directions in the RFP.  Scott said they will come back  with storyboards and we will look through them and pick the one we like the best.  Scott said hopefully  it will be back by the end of February and we will have things ready for the meeting in March.    Staff has to do infrastructure first before install.  Scott said actual installation would be late summer or  fall.  Tim said per the grant, it has to be done this year.  Tim said we would like to get this approved  tonight, so we can get it to city council and bring this back to the board in March.  Scott said we are  shooting for a 5‐12 year old playground.      Motion to approve the RFP for a nature themed Riverfront Park Playground for $90,000.  Motion made  by Mark Dilday and seconded by Matt Konecki.  Motion approved.      Parks and Recreation Survey  Results –  Tim said he will put this on the agenda for next month when  more board members are present.  Tim said it is a good tool and he thinks the city should do it once a  year or periodically and stay in touch with our residents.      Dan asked about the demographics and the ages etc.  Shay said it is built into the survey.  Shay said they  asked age range and how many in your household.  Shay said the highest majority was 134 people were  in the range of 30‐39 out of 263.  The board discussed the demographics and how they worked in the  survey.      The board discussed how often to do surveys and the best way to do them.      Reports:    Parks – Scott said the city is replacing a component at Fox Hill East.  The clatter bridge keeps coming  apart and we have replaced bolts, but we decided to take it out and put in a climber. Scott said the  shelter at Bridge it done and we are getting tables in.  Scott said the guys have been working in the FE  Wheaton woods.  Scott said we are taking down holiday decorations some are frozen to the ground.      Scott said Tim and him have been working on the two grants.      Page 4 of 4  Recreation – Preschool holiday parties went great at the end of December and the parents met the  teachers.  Registration for 2015‐2016 began and there are 14 kids registered for next year and we are  giving tours daily.    Ready Set Go is completely full with 40 kids and it is a great program, which is feeding into the preschool  program.  Basketball started with games last Saturday and we are using four schools there are 360 kids.   Dan said he likes to see the Recreation news in the Record.      Shay said they are planning summer special events bringing back the favorites and doing some new  ones.  Shay said they are having a Bunny Breakfast this year.      Additional Business:   None. The RFP was distributed to potential vendors and posted publicly shortly thereafter, with proposals due in December 2014. Attached are the three (3) proposals submitted for licensing the Riverfront Building at 131 E Hydraulic Avenue. Staff seeks Board approval of one of the proposals/proposer with whom to negotiate a license. In brief, the details of each proposal follows: 1) Java Plus – Coffee Shop a. Monthly rent of $300 c. United City of Yorkville, Illinois Request For Proposals The United City of Yorkville, Illinois will accept proposals for: The operation of a food service business at 131 East Hydraulic Street, Unit C, Yorkville, Illinois. Specifications and all contract documents are available at the Office of the City Clerk, Yorkville City Hall, 800 Game Farm Road, Yorkville, Illinois 60560 during the hours of 9:00 AM until 4:00 PM, Monday through Friday. Proposals must be submitted to the attention of the Director of Parks and Recreation at the above address no later than _____ AM on _____, _____, 2014 (the closing date). Proposals received after the closing date will not be accepted and will be returned to the Proposer. LICENSE AGREEMENT This LICENSE AGREEMENT (the “Agreement”) entered into this _____ day of __________, 2014, by and between the United City of Yorkville, Kendall County, Illinois, a municipal corporation (hereinafter referred to as the “City”), and __________, ___________ (hereinafter referred to as the “Licensee”). WITNESSETH: WHEREAS, the City is a duly organized and validly existing non home-rule municipality of the State of Illinois under the 1970 Illinois Constitution and the laws of the State of Illinois and the owner of property located at 131 East Hydraulic Street, Unit C, Yorkville, Illinois (the “Premises”); and, WHEREAS, the City and the Licensee desire to enter into this License Agreement for the operation of _______________. NOW, THEREFORE, in consideration of the mutual covenants and agreements herein contained, the City and the Licensee agree as follows: I. TERMS AND CONDITIONS 1. CITY ORDINANCES The Licensee will strictly comply with all ordinances of the United City of Yorkville and laws of the State of Illinois. 2. USE OF CITY'S NAME The Licensee is specifically denied the right of using in any form or medium the name of the City for public advertising unless express permission is granted by the City. 3. INDEMNITY AND HOLD HARMLESS AGREEMENT To the fullest extent permitted by law, the Licensee shall indemnify, keep and save harmless the City and its agents, officers, and employees, against all injuries, deaths, losses, damages, claims, suits, liabilities, judgments, costs and expenses, which may arise directly or indirectly from any negligence or from the reckless or willful misconduct of the Licensee, its agents, its employees, or any other person using the Premises, and the Licensee shall at its own expense, appear, defend and pay all charges of attorneys and all costs and other expenses arising therefrom or incurred in connection therewith, and, if any judgment shall be rendered against the City in any such action, the Licensee shall, at its own expense, satisfy and discharge the same. This Agreement shall not be construed as requiring the Licensee to indemnify the City for its own negligence. The Licensee shall indemnify, keep and save harmless the City only where a loss was caused by the negligent, willful or reckless acts or omissions of the Licensee, its agents, its employees, or any other person using the Premises. 4. INSURANCE REQUIREMENTS 4.1. Prior to the effective date of this Agreement, the Licensee shall procure, maintain and pay for such insurance as will protect against claims for bodily injury or death, or for damage to property, including loss of use, which may arise out of operations by the Licensee, or by anyone employed by the Licensee, or by anyone for whose acts the Licensee may be liable. Such insurance required of the Licensee shall not be less than the greater of coverages and limits of liability specified below or coverages and limits required by law unless otherwise agreed to by the City: Workers Compensation $500,000 Statutory Employers Liability $1,000,000 Each Accident $1,000,000 Disease Policy Limit $1,000,000 Disease Each Employee Comprehensive General Liability $2,000,000 Each Occurrence $2,000,000 Aggregate (Applicable on a Per Project Basis) Umbrella Liability $3,000,000 4.2. The Licensee shall have its Comprehensive General Liability (including products/completed operations coverage), Employers Liability, and Umbrella/Excess Liability policies endorsed to add the "City of Yorkville, its officers, officials, employees and volunteers" as "additional insureds" with respect to liability arising out of operations performed, including but not limited to claims for bodily injury or death brought against the City by the Licensee and/or the Licensee’s employees, however caused, related to the performance of operations under this Agreement. Such insurance afforded to the City shall be endorsed to provide that the insurance provided under each policy shall be Primary and Non- Contributory. 4.3. The Licensee shall maintain in effect all insurance coverages required by this Agreement at its sole expense and with insurance carriers licensed to do business in the State of Illinois and having a current A.M. Best rating of no less than A- VIII. In the event that the Licensee fails to procure or maintain any insurance required by this Agreement, the City may, at its option, purchase such coverage and deduct the cost thereof from any monies due to the Licensee, or withhold funds in an amount sufficient to protect the City, or terminate this Agreement pursuant to its terms. 4.4. All insurance policies shall contain a provision that coverages and limits afforded hereunder shall not be canceled, materially changed, non-renewed or restrictive modifications added, without thirty (30) days prior written notice to the City. Renewal certificates shall be provided to the City not less than five (5) days prior to the expiration date of any of the required policies. All Certificates of Insurance shall be in a form acceptable to the City and shall provide satisfactory evidence of compliance with all insurance requirements. The City shall not be obligated to review such certificates or other evidence of insurance, or to advise the Licensee of any deficiencies in such documents, and receipt thereof shall not relieve the Licensee from, nor be deemed a waiver of the right to enforce the terms of, the obligations hereunder. The City shall have the right to examine any policy required and evidenced on the Certificate of Insurance. 5. SUBLETTING OF AGREEMENT The Licensee shall not sublet the Premises or any portion of it, nor shall the Licensee assign this Agreement or any interest in it; any attempted assignment of this Agreement or subletting of the Premises shall be of no force or effect, and shall confer no rights upon any assignee or sublicensee. 6. TERM OF AGREEMENT The term of this Agreement shall be from _________, 2014 until __________, _____, with the City having an option to exercise two, two-year option terms. The Licensee may negotiate in good faith, on request of the City, for an extension to this Agreement, provided that the extension is approved by the City Council no later than one hundred twenty (120) days before the termination of the existing Agreement. 7. TERMINATION OF AGREEMENT The City reserves the right to terminate the whole or any part of this Agreement, upon thirty (30) days written notice to the Licensee, in the event of default by the Licensee. Default is defined as failure of the Licensee to perform any of the provisions of this Agreement or failure to make sufficient progress so as to endanger performance of this Agreement in accordance with its terms. In the event that the Licensee fails to cure the default upon notice, and the City declares default and termination, the City may procure, upon such terms and in such manner as the City may deem appropriate, supplies or services similar to those so terminated. Any such excess costs incurred by the City may be set-off against any monies due and owing by the City to the Licensee. 8. RELATIONSHIP BETWEEN THE LICENSEE AND THE CITY The relationship between the City and _________ is that of a Licensor and a Licensee. 9. GOVERNING LAW This Agreement will be governed by and construed in accordance with the laws of the State of Illinois without regard for the conflict of laws provisions. Venue is proper only in the County of Kendall and the Northern District of Illinois. 10. WAIVER OF LICENSE BREACH The waiver by one party of any breach of this Agreement or the failure of one party to enforce at any time, or for any period of time, any of the provisions hereof will be limited to the particular instance and will not operate or be deemed to waive any future breaches of this Agreement and will not be construed to be a waiver of any provision except for the particular instance. 11. AMENDMENT This Agreement will not be subject to amendment unless made in writing and signed by all parties. 12. SEVERABILITY OF INVALID PROVISIONS If any provisions of this Agreement are held to contravene or be invalid under the laws of any state, country or jurisdiction, it will not invalidate the entire Agreement, but it will be construed as if not containing the invalid provision and the rights or obligations of the parties will be construed and enforced accordingly. 13. NOTICE Any notice will be in writing and will be deemed to be effectively served when deposited in the mail with sufficient first class postage affixed, and addressed to the party at the party's place of business. OPERATING SPECIFICATIONS OF THE LICENSE AGREEMENT 14.1. In general terms, the City is seeking to grant the Licensee the exclusive privilege of operating ________________ in Unit C of the premises generally located at 131 East Hydraulic Street in Yorkville. 14.2. The City shall have the right to enter and to inspect the Premises at all times, without any prior notice to the Licensee. 14.3. The Licensee expressly acknowledges that the City has reserved the right to use the conference room located at the Premises upon providing, either verbally or in writing, the Licensee with two weeks’ notice. 14.4. The Licensee shall be responsible for all taxes and personal property, and maintenance work on the Premises and for maintaining the hot water heater that serves the Premises (the “Hot Water Heater”), which is located in Unit A of 131 East Hydraulic Street, Yorkville, Illinois. Any capital improvements done on the Premises over $5,000 in value, including any maintenance to, repairs of, or replacement of the Hot Water Heater, other than the initial improvements, shall be approved by the Park Board prior to commencement. For the purposes of this Agreement, maintenance work shall include regular upkeep of all components of the Premises and the Hot Water Heater, including maintenance and repairs. If any component of the Premises or the Hot Water Heater is in need of repair or replacement, and the repair or replacement is greater than $500, then the City shall be responsible for the replacement of said component, provided the cost of repair of the component is greater than 50% of the cost of replacing the component. The preceding sentence does not apply to any capital improvements initiated and installed by the Licensee as a result of the renovation of the Premises, or to any repairs or replacements that are necessary because of any damage to or destruction of the Premises, the Hot Water Heater, and/or Units A and B of 131 East Hydraulic Street, Yorkville, Illinois caused by or resulting from the actions or omissions of the Licensee. Any capital improvements done on the Premises of $5,000 or less, including any maintenance to, repairs of, or replacement of the Hot Water Heater, other than the initial improvements, shall be approved by the Director of Parks and Recreation prior to commencement. Any capital improvements must be inspected by the City and all work and contractors must be licensed, bonded, and insured. For all determinations made on the 50% repair/replacement cost above, the Licensee shall require no less than three bids from qualified contractors for all repair and replacement quotes. 14.5. At the end of the agreement term, the City shall conduct an inspection of the Premises, and the Licensee shall be informed of the outcome of said inspection. The Licensee shall be responsible for returning the Premises to its original state, subject to the discretion of the Park Board. 14.6. The Licensee does not have exclusive rights to all concession operations within the park, but rather, only to the specific operation at the Premises. 14.7. The Licensee shall be permitted to operate a business offering the following goods and services in the premises defined herein, without further action by the City, and all other uses and operations must be approved by the City: 14.7.1.1. _________________________ 14.8. The Licensee shall be permitted to sell alcoholic beverages at the Premises, provided that the City has issued the Licensee a liquor license for the Premises and the License maintains said liquor license while this Agreement remains in effect. 14.9. The Licensee expressly acknowledges that it may rent Riverfront Park free of charge only two times in each license year. If the Licensee desires to rent Riverfront Park more than two times in a license year, it must apply for such rental by filling out and submitting a City Park’s rental form and paying the applicable rental fee. 14.10. The City agrees to furnish to the Licensee access to City water and sewer utilities. The Licensee is responsible for applicable usage payments for all utilities (sewer, water, natural gas electricity, phone, internet, etc.), and is responsible for costs associated with utility connections and upgrades, including metering of the portion of the building to be used. The City shall furnish to the Licensee bi-monthly utility bills for water and sewer services. The Licensee expressly agrees to divide the monies owned for any natural gas bill between it and the Licensee of Units A and B based on the total square footage of each Licensee’s respective unit(s). 14.11. If the Licensee chooses not to occupy the Premises through the winter months, the Licensee shall take all necessary precautions and measures to properly winterize the Premises. These precautionary measures shall include, but not be limited to, maintaining a minimum level of heat no less than 60 degrees Fahrenheit to protect the Premises from extreme freezing conditions. If alternative methods of winterizing are to be utilized, those methods shall be subject to approval from the property owner. The Licensee is expressly prohibited from shutting-off utilities at the Premises or placing said utilities on snow bird operations at any time during the term of this Agreement. 14.12. The Licensee expressly agrees to be responsible for any and all damage to and/or destruction of the Premises, the Hot Water Heater, and/or Units A and B of 131 East Hydraulic Street, Yorkville, Illinois occurring during the term of this Agreement and caused by or resulting from the actions or omissions of the Licensee. The Licensee agrees to repair and replace said damaged or destroyed portions of the Premises, the Hot Water Heater, and/or Units A and B of 131 East Hydraulic Street, Yorkville, Illinois, at the Licensee’s sole expense, in accordance with all ordinances of the City and while this Agreement remains in effect. 15. PAYMENTS AND OTHER REPORTS TO THE CITY 15.1. The Licensee is required to submit certain payments, forms, financial statements, and other items on a timely basis. Failure to submit any of the required items in a timely fashion may result in a breach of the Agreement. 15.2. The Licensee, at minimum, shall make payments equivalent to 5% of the annual sum of the total adjusted gross receipts. The Licensee shall make said payment prior to February 1 of each year. 15.3. The Licensee shall make payments for the privilege of using the Premises of $250.00 per month for each month through the term of the Agreement, due prior to the first of each calendar month. 15.4. The Licensee shall provide the City with a security deposit in the amount of $1,500.00, to be due to the City prior to the start of the agreement term. Said deposit shall be held until after the end of the term of the Agreement, and will be used to offset any damage to the Premises. 15.5. The Licensee shall provide to the City, prior to the start of the Agreement, confirmation of insurance coverage for the Premises and the operations of the business for the entire term, with the City named as an additional insured on all policies. 15.6. Failure to meet any deadline for payment will result in an interest charge of 10% on said late payment. 15.7. The Licensee is required to submit to the Director of Parks and Recreation an annual concession financial statement by January 30 of each year. 16. PRINCIPAL CONTACT FOR THE CITY The principal contact for the City that will coordinate assistance to the Licensee will be Tim Evans, Director of Parks and Recreation. 17. EMPLOYEES The Licensee shall undertake to perform all services rendered in a neat, orderly and efficient manner; to use care and diligence in the performance of this Agreement; and to provide neat, orderly and courteous personnel. The Licensee agrees to prohibit any drinking of alcoholic beverages or use of illegal drugs or drugs which impair the ability of the employee or agent to safely and adequately perform his or her job while on duty or in the course of performing his or her duties under this Agreement. The Licensee also agrees to ensure that each employee driving a vehicle shall at all times carry a valid operator’s license for the type of vehicle he/she is driving. The Licensee’s employees will be attired, at all times, in a professional-type manner. 18. ACCIDENT PREVENTION Precaution shall be exercised at all times for the citizens, employees and property. The safety provisions of all applicable laws and building and construction codes shall be observed. Machinery, equipment and all hazards shall be guarded or eliminated in accordance with safety provisions. 19. TAXES, LICENSES & PERMITS The Licensee shall pay all sales, use, property, income and other taxes that are lawfully assessed against the City or the Licensee in connection with the Premises and the work included in this Agreement, and shall obtain and pay for all licenses, permits, certificates of authority, and inspections required for the work. The Licensee shall furnish to the City satisfactory evidence that it has all permits, licenses, and certificates of authority required to operate for the term of this Agreement. 20. DEFAULT If the Licensee fails to observe any portion of this License Agreement and there has not been sufficient cause to justify such lack of observance, the City shall serve notice, either personally or by affixing such notice to the Premises, that this Agreement shall be in default if the Licensee does not take action to remedy the lack of observance within twenty-four (24) hours of said notice. If at the end of the twenty-four (24) hour period, the Licensee has not made the necessary corrections, the City shall take such steps as are necessary to provide such services. The Licensee will be liable for any costs of such steps from the date of the notice of default. If deemed necessary by the City’s designated representative, the City shall have the right to take over all equipment and facilities of the Licensee. 21. CERTIFICATIONS 21.1. The Licensee makes the following certifications as required by law: 21.1.1. The Licensee certifies that it is not barred from bidding or contracting with any unit of State or local government as a result of a violation of either Section 33E-3 or 33E-4 of Act 5, Chapter 720 of the Illinois Complied Statutes regarding criminal interference with public contracting; and, 21.1.2. The Licensee swears under oath that it is not delinquent in the payment of any tax administered by the Illinois Department of Revenue as required by Chapter 65, Act 5, paragraph 11-42.1-1 of the Illinois Complied Statutes; and, 21.2. The Licensee shall at all times abide by all applicable federal, state, and City laws, ordinances, rules and regulations which may in any manner affect the performance of this Agreement. In order to be more recognizable Vicki and I began doing outdoor vending. Venues like Kane County Flea Market, Kane County Fair, Sugar Grove Corn Boil and Kendall County Fair were some of places we were hoping to get our “name” out there. What began as a summer experience (June-August) extended after 2 years. May-December added more venues. Adding whole bean coffee, loose leaf teas, and many non- coffee drinks, e.g. smoothies, 20 below frozen hot chocolate, apple cider and more. In February of 2013 we made a proposal to the Sugar Grove Library Board to open a coffee shop in their library building. I retired from teaching on June 3, 2013 and began Java Plus @ The Book Nook on June 4, 2013. We have been there for a year and a half and business has grown well and continues to grow. Our proposal to Yorkville is to make the business at 131 East Hydraulic Street a thriving, local coffee shop. Java Plus has had many opportunities to serve Yorkville at the 4th of July after the parade, at the Kendall County Fair and Hometown Days. People recognize the name and love the quality of product and service. This Coffee Shop would offer breakfast and lunch items and many other “sweet sensations”. (I will include a menu and prices) The times of operation will be evolving but since we offer breakfast items we need to be open at 7 a.m. Monday-Friday. At this point closing would probably be 5 p.m. (perhaps later if there are college/high school students who need studying time and place) Saturday morning would be a great gathering place for coffee and conversation so we will be open from 7 a.m.-12 noon. Sunday would offer a time for us and our employees to enjoy family and church so we are planning on closing on Sundays. Our proposal would be to open all 12 months of the year. Vicki and I have been in the coffee business for 9 years and have operated the successful shop in Sugar Grove for a year and a half. We have great experience in coffee and teas and running a successful coffee shop. The above proposals are initial. We have great plans to grow and be an even greater part of the community. We would love to reach out to parents of pre schoolers and offer reading times where retired teachers or others would read to these children. We also envision opening Friday evenings to offer entertainment featuring local artists. Types of entertainment that you would find in local coffee shops. In the near future we would also like to have gelato, something that would offer a unique opportunity for Yorkville. We also have access to many bakers and caterers for our food. We like to use local vendors because it keeps our health department cost down, and they can prepare an excellent product. Java Plus carries all the proper insurance from State Farm, as well as proper health department certificates including a food handlers managers license. After talking with the previous owner of the business (River City Roasters) we feel that $300 per month is acceptable allowing us to grow the business until road construction is completed. This zoning district shall apply to all existing and newly annexed land currently used or intended for use as open space, passive recreational areas, and parks identified in Yorkville’s Park and Recreation Master Plan. These regulations are also intended to provide for the protection, conservation and utilization of high-quality natural resources; preservation of wildlife habitats; creation of scenic vistas; provision of public gathering areas or facilities for safe and accessible outdoor space; connectivity between other green infrastructure via bike and hiking trails and paths; and maintain or establish appropriate buffers between differing land use types or intensities. 10-10A-2: Uses Permitted A. The following uses shall be allowed in this district: 1. Bicycle trails. 2. Community gardens. 3. Conservation areas. 4. Hiking paths. 5. Parks. 6. Stormwater detention facilities. B. Any other use determined to be compatible by the Plan Commission with the above-stated uses and those uses adjoining may be permitted. C. Signs are permitted in the OS-1 Open Space District, as regulated pursuant to the applicable provisions of this code. 10-10A-3: Special Uses A. Notwithstanding the provision of the permitted uses of this section, the following accessory uses, buildings, and structures shall be allowed in the OS-1 Open Space District: 1. Other uses, buildings and structures which are deemed compatible by the Plan Commission. B. Temporary uses shall be permitted in the OS-1 Open Space District subject to conditions, as follows: 1. Aside from city-sponsored events, any public or private festival, carnival or recreational sporting event shall be permitted only with prior review by the Park Board and approval by the City Council. 2. Aside from city-sponsored events, any indoor and outdoor art, craft, garden, concerts, shows and other amusement activities shall also require the prior review by the Park Board and approval of the City Council. 10-10A-5: Dimensional and Bulk Requirements A. Front Yard: Every building hereafter erected or enlarged shall provide and maintain a minimum front yard setback of thirty (30) feet. B. Side Yards: Each building hereafter erected or enlarged shall have a side yard on each side of each building of not less than ten (10) feet or a distance equal to 50% of the building height, whichever is greater, when adjacent to a residential district. C. Rear Yards: Every building hereafter erected or enlarged shall provide and maintain a minimum rear yard setback of twenty (20) feet or a distance equal to 50% of the building height, whichever is greater, when adjacent to a residential district. D. Building Height: The maximum building or accessory structure height shall be six (6) stories or eighty feet (80’). 10-10A-6: Floor Area Ratio Maximum floor area ratio for special use shall be established at the time a special use permit is granted. [ United City of Yorkville Zoning Ordinance ][ 1 ] CHAPTER 10 OS-2 OPEN SPACE DISTRICT (RECREATIONAL) 10-10B-1: Purpose The land use regulations established for the OS-2 Open Space District are intended to govern the use of city-owned recreational areas and park land in the City of Yorkville. This zoning district shall apply to all existing and newly annexed land currently used or intended for use as active recreational areas, public gathering areas or facilities and parks identified in Yorkville’s Park and Recreation Master Plan. These regulations are also intended to provide safe and accessible indoor and outdoor leisure and entertainment space for the general public while maintaining or establishing an appropriate buffer between differing land use types or intensities. 10-10B-2: Uses Permitted A. The following uses shall be allowed in this district: 1. All permitted uses in the OS-1 Open Space District. 2. Community center. 3. Playgrounds. 4. Recreation Center. 5. Building Mounted Wind Energy Systems (BWES) 6. Building Mounted Solar Energy Systems (BSES) 7. Amphitheaters and Outdoor Music Venues B. Any other use determined to be compatible by the Plan Commission with the above-stated uses and those uses adjoining may be permitted. C. In addition to attending professional development training sessions, staff met with potential playground manufacturers concerning Riverfront and Bristol Bay parks redevelopment.  The Request for Proposal concerning the playground equipment for Riverfront Park was approved and has been sent out to potential playground manufacturers.  Parks and Recreation staff finalized the 2015 Special Events calendar. Parks Report Beautification Division  Staff removed the Christmas decorations throughout town. This includes Town Square, Riverfront, City Hall, Beecher Center and the Library. Playground Division  Safety Inspection Staff inspected all playgrounds monthly visually checking equipment using a systematic approach looking for missing or loose hardware. Accessing the equipment pulling and pushing on each apparatus to check if it is secure and filled out inspection forms for each site. Turf Division  Staff changed the oil in all of the parks trucks and took them to the state safety inspection facility for their bi-annual vehicle inspection.  Trash Control Picked up all loose trash and debris by systematically walking a grid at each site, replacing liners in all trash cans. Recreation Report Preschool  The Preschoolers came back from the holiday break and began working on their curved letters and the number 3.  Registration began for Yorkville Residents on Monday, January 5 and for Nonresidents on Monday, January 12. Several families have come in for tours and have continued to register for the 2015-2016 School Year. We currently have a total of 14 students registered between the Three Year Old Program, Four Year Old Program, and the Jr. Kindergarten Program. Ready, Set, Go (Pre-Preschool)  The Ready Set Go Program continues to teach the daily routine of preschool while introducing a letter of the week. Now that we are half way through the year, the program will introduce worksheets that will work on colors and fine motor control. Basketball Leagues  All games for our Youth and Boys Basketball Leagues began on Saturday, January 10. A total of five schools are being used for practices and games throughout the season including the Circle Center Grade School, Yorkville Intermediate School, Autumn Creek Elementary School, Grande Reserve Elementary School, and Bristol Bay Elementary School.  The Kindergarten Basketball League began on Saturday, January 17 at the Bristol Bay Elementary School. A total of 26 kindergarteners registered creating a total of four teams. The players are having a great time learning and playing the game while being introduced to our league format. Adult Softball  The City Council passed the proposal to allow the consumption of alcohol at the Steven Bridge Fields on Tuesday and Thursday evenings during the Adult Softball Leagues as long as no alcohol is consumed on the fields or in the dug outs. We have begun advertising this change to the previous softball teams as well to new softball teams. Registration begins Monday, February 2 for both the Coed and Men’s Summer Softball Leagues. Special Events  We continue to plan and confirm details for the 2015 Special Events calendar.  We are excited to announce that we will be adding four Cruise Nights in the downtown on the first Wednesday of the month (June-September) to help promote the downtown businesses as well as combining it with the Farmer’s Market.  We have been meeting and reaching out to several businesses and individuals looking to sponsor, perform, or join one of our many special events.
