Public Safety Minutes 2000 11-28-00 UNITED CITY OF YORKVILLE PUBLIC SAFETY MEETING MINUTES NOVEMBER 28, 2000 Attendees Mayor Prochaska Chairman Kot Mike Anderson Paul James Rose Spears Tony Graff COLONIAL PARKWAY Chairman Kot stated that since we had residents here regarding item number 2 we would start there. The issue is restricting parking to the south side of the street. The residents whoa re present want to make sure that mailboxes are not blocked. Resident Mrs. Johnson stated that you can drive out head first, but is concerned about visibility pulling out between parked trucks. Mayor Prochaska stated there is a distance restriction for parking at a driveway. Chief Graff stated this is generally about 30 feet. Mayor Prochaska stated the residents also have a concern with the mailman being able to get into the mailboxes between parking. Chief Graff stated that Mr. Wywrot,the City engineer has indicated they will follow IDOT standards. Mrs. Johnson stated that one of the trucks that parks there is 19 feet long and the other is 20 feet long. Chief Graff stated that trucks would still be able to park there. Mrs. Johnson stated the buildings are 96 feet long,the mailboxes are 10 feet from he driveway, and asked that each be considered individually, as this is a curve. Chief Graff stated there is always a bit of risk,with 96 feet that will probably be 2 long spaces allowing for the mailbox. Mayor Prochaska asked if the visibility issue becomes a speed limit issue. Chief Graff stated probably not, if it is warranted 25 mph will be lower. Mayor Prochaska stated that if it is lowered and is not warranted anyone ticketed could come back on the City. 1 Chief Graff stated that the speed limit is 30 mph mow, but studies are not done the way you would think. Mayor Prochaska stated that IDOT finds by 80% of how drivers use the roadway for driving speed. Mrs. Johnson stated that people drive on the lawn to straighten out the curve. Chief Graff stated that perhaps a traffic calming devise might be used. Rather than a speed bump, they use a hump around colleges. This could be done if IDOT will allow it to be done as an MFT project. They are looking for a pilot to use this method for traffic calming. Chairman Kot asked how far Mr. Wywrot has come with the study. When he has it finished then we can sit down with the residents, and once established we can enforce. Mayor Prochaska stated he agreed with marked parking spaces. Chief Graff stated that Mr. Wywrot would follow the standard so we can use MFT funds. Chairman Kot stated this would be on display when ready. Mayor Prochaska stated that the City Council has voted for parking on one side only. Chief Graff stated that John Sleezer has ordered the signs, but needs a copy of the ordinance before he can post it. Mayor Prochaska stated its passed. Alderman James asked if parking be marked when signs go up. Mayor Prochaska stated that signs can read no parking between signs, and parking areas can be marked with yellow. The ordinance is in effect now. Mrs. Johnson asked about parking on holidays, can the parking ban be lifted. Chief Graff stated he didn't think it could be lifted, due to MFT funds being used. Mayor Prochaska agreed that would be tough, but if there is a group coming , you could ask the pastor of the church about parking in their lot. Chief Graff stated that if the church parking lot is not posted you can park there. Mr. Alaniz asked about snow route parking. 2 Chief Graff stated that would remain the same. They are looking at the snow plan later this week with Public Works. Mayor Prochaska stated some mailboxes may need to be moved, we may have to look at this. POLICE AND FIRE COMMISSION: Presentation by John Broihier Mr. Broihier stated that he has represented the Police Commission for 22 years, since 1978. The City of Yorkville is at about 5000 population and will require when it is officially 5000. The statute states that appointment can be by the Mayor with City Council approval and the association can provide pamphlets for the setup to regulate the Police Department. Under the law the Board of Fire & Police Commissioners have 3 electors and they must be of two different political parties, so only two can be from the same parry.. They must be a resident of the community for a minimum of 1 year and the appointment is for a term of three years. The first appointment should be 1 appointment for 1 year, one for two years and one for three years, so that as it goes along the term is staggered. You cannot remove them from the board. The act started with the EEOC to protect and remove bias and prejudice. The board makes all appointments within the Police Department. The statute requires the board to adopt rules and regulations, and applies only to full-time Police Officers. Statute mandates that they establish an eligibility list with rules and start testing. The statute states that hires are done by the board. Input form the Chief comes in indirectly through the scoring process. There is a wide range of checks through background, testing,physical, etc. The selection must be from the list of the top three for promotion . A Board Member can be replaced at the end of his term,there is no guarantee of re-appointment. These are generally unpaid positions, but some municipalities pay a stipend or per the meeting, but most do not pay members. Mayor Prochaska asked how the City Council has input. Mr. Broihier stated the whole idea is to be independent. Most submit their own budget. They also hear disciplinary actions. The Chief can suspend, but must notify the Board. This must be adopted within 30 days of being notified of reaching the 5000 population mark, based on official notification by the Census. The Board must file an affidavit of their affiliation. Chief Graff asked if the City Council can pass an ordinance based on the Census. Mr. Broihier stated you have 30 days , so you should probably have everything in place and ready to go. and the Chief should probably be under the City Manager. If their rules follow the state statute then the City Council controls their expenditure of money. The association offers programs for new commission members on a variety of issues. The Board has to enact their own rules and regulations. Chief Graff stated that he planned to speak to other Commissions and perhaps do joint testing. Mr. Broihier stated there is good and bad to joint testing. Based on size it may or may not work for you. NOISE ORDINANCE UPDATE Chief Graff stated the City cannot enforce any noise restrictions outside of the city limits. A brothel cannot be within 3 miles, but you have no say about noise across borders. He is working through the states attorney's office and the City could bring suit against the PNA Camp on behalf of the residents. Kendall County is working with PNA and on drafting an ordinance. WE can adopt Oswego if similar. We would want it to include a permit for special use to be used for parties, etc. Mayor Prochaska stated that if it specifies a break in the music/noise we must be careful with the Riverfront Festival as people watch to see if we follow our own ordinance. Chief Graff stated that they are looking at manufacturing area for guidance. 60 DB is not unusual and per Oswego it doesn't apply since residential is not in a manufacturing area. Mayor Prochaska stated we would refer to our Zoning of manufacturing vs. residential. Chairman Kot stated that we would address our own concerns in our ordinance. Mayor Prochaska stated that we will have our ordinance for litigation situations. Chief Graff stated that 10-7 noise to lower DB to 55 after 10 PM. This standard is taken from the EPA. A mower is about 60. A boom box is higher. Chairman Kot stated this would come back to PS in December. Chief Graff stated that in January they can write tickets for boom boxes. BUDGET REVIEW Chief Graff stated that they are within the overtime limit, they had a good summer and overtime is in check. Investigation overtime is starting to go up as interviews have to be done in the evening most of the time. They are working on scheduling training for when they are on days to eliminate overtime. LOCKER ROOM Chief Graff stated that the money is not there, but Ron Diederich talked to the contractor and in January they expect it would be $18,000 to $35,000. due to heat and air conditioning which you have to have due to the showers. One furnace and only 1 main air duct downstairs, so he would like to get quotes. Would start in May, but he would like to see about starting earlier if cheaper to do earlier. He will get process in January. UNIVERSITY OF ILLINOIS - CHICAGO:Assessment Report Update Chief Graff stated that the officers were embracing the program and more and more officers are participating. They decided to have a mix of people instead of just three. The DARE Officer position should be offered to other officers. Barry Groesch will become the Community Officer, no conclusion on that, but he is working toward it. 4 GRANT UPDATE On the Crime Stopper Hotline, they have it all together and the number is 553-8585. Chairman Kot stated that there is a reward system that includes $100., plus certificates to Video Villa, Pizza Express and Pizza Hut. The P.D. is doing a compliance check and all buyers must be 21 years old and have an I.D. Chief Graff stated that on the Early Warning Weather Siren they are working on a map with siren locations and securing easements for Amurol and/or F.E. Wheaton which is a better location with more coverage. All the rest are being secured. The one at Lyons Farm needs to be moved for better coverage and should be closer to town. All equipment is in, and will be installed at KenCom. Chairman Kot asked what the time table is. Chief Graff stated that all easements will be completed by the end of December. They are all moving along fast. Amurol or F.E. Wheaton, Phil Knierim, Kendall County and Tim McCann and Cooper are all underway. They have received the first check from Illinois First. Chief Graff stated they have no report for the Glen Palmer Dam. The Engineer will try sonar. The level is dropping, and they need to remove obstructions from under the bridge. The remains of the old iron bridge that are still down there PERSONNEL REPORT Chief Graff stated that onew of our Yorkville officers got and A-,the best evaluation on being certified as an Instructor for Less that Lethal. The department had 7 DUPs,the camera is doing great. They have had lots of calls, but not criminal, and everything else is back in check. Mayor Prochaska asked about the truck enforcement. Chief Graff stated that is a separate report. It is not itemized on this report. Crime peaks in September, October and November are minimal. Alderwoman Spears asked about the Ecstasy drug and others. Chief Graff stated that Oswego is working on a seminar for parents. Tom Cross is active in this. Alderwoman Spears stated that Yorkville is a BUZZ word on campus. Chief Graff stated that we have one dealer. Regarding Ecstasy, Jumbo passed the test, it is not a strong odor, so it requires ideal circumstances. The Department is working with the school on some random issues. Chairman Kot stated that Jumbo is working with Officer Pleckham on some undercover work. 5 Chief Graff stated they will work on having a meeting in the Spring. after Oswego has theirs with Tom Cross. MILEAGE REPORT Chairman Kot stated that there are extra miles being put on the Expedition by Officer Klengel, but there is a good reason. PROPOSED BUDGET Chief Graff stated that the Police Department is just about where it should be, the officers have given him good input and Lieutenant Martin has done a study. We have 1 officer to 400 people, but there are other factor that you can't predict, such as the schools crossing over into Kendall County. The Department is just about where is should be with hiring one more officer this year. Oswego can't hire them fast enough to keep up with their construction/population growth. With the COPS Grant we are where we should be. NEW VEHICLES Chief Graff stated they are looking at purchasing 3 new vehicles next year. They haven't decided regarding rebuilt, it is typical of used cars, and other areas start to go, and they will need painting. Cost for one vehicle is about$41,000. with equipment that includes a laptop, radar and all radios. The video tapes can be changed out,the department has three. Chief Graff stated that when Broadband comes in, we will be connected internally and externally. We can do E-packet, that is not a lot. It will mean lots of training for Holly, Sandy and the staff. Mayor Prochaska stated that the bigger thing is looking at the cost. Chief Graff stated they will need one main server, a host server. They need to prioritize. For engineering they need to be networked. They need an independent network. DSL is at Kendall County. Ameritech is coming in. If the Library connects it is $238.00. Our America On Line lines are $80.00. Hope to have it by Summer. If we get Broadband this year and add to the Infrastructure each year. WE can add to Administration as part of the budget. Mayor Prochaska stated that we have a plan to be where we want to be over time. CAPITAL EQUIPMENT Chief Graff stated that the Equipment List will be with the Budget, with it's priority where it fits. AGAIN. ON POLICE AND FIRE COMMISSION Chief Graff stated that in regard to a Candidates list, a list is good for 2 years and the list would have 10 to 12 people on the list. Lists are not expensive, and you can do an oral interview. Mayor Prochaska stated that we have to be careful. Alderman James stated that you could weed the list down. 6 L Chief Graff stated the process is to week down the list through a process of testing,physical, written, etc. Sometimes after the written you have as few as 14 or 15 left. JAKE BRAKING Chief Graff stated that the Jake Braking Company has put out a notice, their name is copy written, and a registered trademark. We would have to get an opinion that the name has lost its value as a copyright in order to use it. We must be careful to get the States Attorney to find out about using the term "Jake Braking". ADDITIONAL BUSINESS Chief Graff stated the Police Department's printer in the Records Division has died and a replacement is $1149.00 for an HP Laser Jet. and need Chairman's approval. The funds are available from Equipment Budget. He will call HP in Naperville and see if they can buy direct before purchasing elsewhere. WING ROAD Mayor Prochaska asked if we have monitored yet. Residents are coming back to complain, but they will have to annex before we can handle this problem. Chief Graff stated yes, we have, between 5 and 6 am.. They had car descriptions and everything, but we had someone sitting out there and got nothing. Chief Graff supplied a copy of a Speed Study from IDOT in December for Routes #126 and#34. LIQUOR ORDINANCE AMENDMENT Chairman Kot asked if we were ready on this. Mayor Prochaska stated we had to wait till the Public Hearing has taken place. VOICEMAIL Chief Graff stated that the new system is not as friendly, Molly has just programmed a group box and a memo is coming out on this. Chairman Kot stated we need to have standard for use on this. Mayor Prochaska stated that we need to make a point to do a voicemail message to the Mayor and Aldermen for a serious incident, and voicemail boxes should be checked every day.
