Public Safety Minutes 1997 01-22-97 UNITED CITY OF YORKVILLE Committee Minutes - Public Safety Date of Meeting: January 22, 1997 Location: 111 W.Fox Time Convened: 6:35 P.M. Time Adjourned: 9:15 P.M. Attendees: Mayor Bob Johnson Kathy Jones Bert Callmer Tom Sowinski Tony Graff Jim Klaman Discussion: Old Business 1 .) Liquor Ordinance Review Proposed Draft - Discussing temporary licenses, hours and containers. Mayor Johnson is looking at this in three sections. 1 . Hometown Days, 2. Moose, and 3. Golf Course. Callmer would like to get through this and meet with Graff, Dan, and Mayor Johnson and then take it to COW. Three outdoor licenses will be allowed. This can be amended. Hometown Days is considered a Special Event/Use. A Special Event is limited to three days (72 hours). The Moose is in favor of this. They currently sell liquor inside and their patrons take it outside to throw horseshoes. Graff recommends talking with Dan about concerns on the number of outdoor liquor licenses. Hours of Sale - Saturday, Sundays, and National Recognized Holidays Noon to 10:00 P.M. Weekdays 4:00 P.M. to 10:00 P.M. Callmer thinks that 4:00 P.M. on weekdays is too restrictive. Changing hours to Friday & Saturday 11 :00 A.M. to 11 :00 P.M. And weekdays to 11 :00 A.M. to 10:00 P.M. Talk with Dan on the times. Jones asked when the licenses would be available for purchase? Now through May 15, 1997. But would like to change it to May 1, 1997. Might need to put in seasonal. Talk with Dan. Amplified Music - 75 feet is accepted by the State. Jones has a eroblem with Music until 10:00 P.M. on Sunday nights. Change Sundays, Noon to 8:00 P.M. The Establishment must have insurance and a quadrant off area. You should not have to have food. Talk to Dan. Food available for purchase. Draft reads that Liquor must be served outside by employee. Will change this to read Liquor must be served by employee of the Incense holder but consumed outside. License will cost $250 per season. Ask Dan about this. May need to be per year. License will cost $100 per license for a fraternal organization. If Liquor is served to a Minor the Establishment will loose both Liquor Licenses. Will invite all the current Liquor License holders to COW when this will be reviewed. They will be invited to . _ give their input. Class ARNC holder. Class G Beer Garden. Budget Review FY 96/97 - Overtime Usage Report Reviewed - When there is training, Graff uses part-time employees to cover the hours. 3.) Grant Update - Block Grant Review - Speed Monitoring Trailer - Grant was denied. There was only $1 .1 million to be give out, All trailers were denied. Grants were issued where needed. 4.) IDOT Update - Countryside Pkwy/Rt. 47 Update - Wywrot went to a meeting on January 20, 1997. He took all the information from the Study with him. IDOT is starting budget for July now. They will give some strong indication on amounts that they would like to see the City put toward a Traffic Signal at intersection of Countryside Pkwy and Rt. 47. 5.) Monthly Police Reports - December - Graff is working on annual report. He will have it completed by the next meeting. Offense report is missing. Graff will put copies in boxes. There were a lot of false alarms. The City could do an ordinance for false alarms. Could allow so many and then start charging, Sometimes alarms are caused by the extreme cold weather, but most of the time it is employee error. Automobile Report - Car seven was down for about a week. Most squad cars average 2000 miles per month. Three squad cars will have 100,000 miles by the end of the year. 6.) Policy/Procedure - Review - Drug Testing and Complaint Review - Complaint Reviewed has been reviewed by the Union. Will start April 1, 1997. New Business 1.) KenCom Intergovernmental Agreement - Proposed Revision This agreement was initiated by the County, Looking to amend two things. Anyone could ask for a review. In original Ordinance, agreement was supposed to be reviewed every three years. This does not happen. This would also allow them to use the money for some of their operational cost and not just equipment. It will help keep cost down. The surcharge money must be spent on equipment. Talking about additional money. It will help pay dispatchers. The County puts in all the Municipality phone lines. Microwave Technology is very expensive. There is a lot of maintenance. Should look into this further. Graff said Ameritech recommended checking into Microwave. Callmer said the whole communication industry is going to fiber optics. Graff will get some figures together for the Intergovernmental agreement. Jones is wondering if this should be review periodically. No one really see a reason to do it. Graff said agreements are not usually reviewed. Mayor Johnson thinks the County will be the one that will want a review. Take to COW. 2.) Municipal System Inc. - Demonstration - Computer Software for Park/Administrative Adjudication Process - Jim Klaman was here from Municipal Systems, Inc. Looking at Administrative. This would be for non-moving violations. Last year 126 tickets were written at $10 each. 86 of these tickets were paid. The rest were adjudicated or dismissed. Officers wrote parking tickets when they were able to. 1649 warning tickets were issued. A lot of tickets were for equipment. Over 1000 seatbelt tickets were written last year. Looking to do it differently. The Police Department does not get any money on fines until the amount goes above $47.50. The City could set up a Hearing Officer. In most communities this is done in the evenings or on Saturday mornings. Should you get a ticket and not pay it by the due date, you will receive a notice to come to a Administrative hearing. Process is by law. Then you go by the Hearing Officer. The Officer that wrote the ticket does not have to be present. If you decide that you want to fi ht the ticket, then you would responsible to go the County Clerks Office and pay the filing fees to go to court. This software was written to follow the law. Graff talked to Dan and Dan talked to the Judges. The Judges would be happy to give the court docket. Anyone can be appointed to be the Hearing Officer. Some communities appoint two Hearing Officers, in case one person is unable to attend. Ordinance is very specific with equipment and parking. Some communities are going to the Judge with minor things like Under Age Smoking. A Judge can refer something to an Administravite Hearing. Could also do an Ordinance for Building Violations. You do need a Officer or someone from the Police Department present at the Hearing. Can fine up to $250. That is the maximum fine under State Law. Graff would like to do a six month contract. Bring contract and go to Committee meeting or to COW. Mayor Johnson would like to take some time to look this over and he would like Graff to check the references comparable in size to Yorkville. Mayor Johnson would also like to meet with the Judges. Callmer is wondering if more tickets will be issued. Graff said no, but the warning tickets will become Administrative tickets. There will still be times when a warning ticket will be written. An attorney would not need to be present at an Administrative Hearing. The software knows when the notices need to be issue and the amounts of the fines. Cost is approximately $14,688 for a three year contract. Includes training, support and upgrades. Could do this on a monthly basis. Normally you would have one hearing a month. Callmer doesn't know if the City is ready for this. Callmer doesn't want this to be a revenue generator and go on ticket binges. 3.) Additional Business Next Meeting - Next meeting will be scheduled for February 26, 1997. No Passing on Shoulders - [dot is waiting because of the weather. There will be a sign put at Rt. 47 and Walnut. Another sign will go at Orange Street and Rt. 47. Ordinance for Carnivals - Dan has a sample ordinance. This will be back on agenda. Would like to have this completed by May 1, 1997.
