Discussion was held concerning the items below as identified by
number:
1. Chief Graff presented a draft of the ordinance to Suppress
Criminal Activity (formerly known as the Anti-Gang Activity
Ordinance) . This ordinance covers:
A. Graffiti- A definition of graffiti is given, as well
as the penalties for people participating in
the defacing of property.
B. Curfew- The proposed City curfew for minors is
discussed in the Ordinance, along with the
parental responsibility that will be enforced
if minors are involved in illegal behavior.
C. Temporary Questioning-The ordinance addresses the
ability of an officer, after
identifying himself as such to
stop any person in a public
place if the officer interprets
any behavior by the individual
to be that of someone who is
committing, is about to commit,
or has committed an offense and
question that individual without
placing him/her under arrest.
D. Gang Signs/Loitering- The "throwing" of any gang signs
or symbols in a public place,
and the penalties of doing so
were addressed in the Ordinance.
Loitering for the purpose of
causing street gang activity or
the recruitment of street gang
members was also addressed in
the Ordinance. (*The terms
"Street Gang" and "Street Gang
related activities" are defined
in the Ordinance) .
E. Maintaining a Public Nuisance- The definition of a
Public Nuisance as used
in the commission of
offenses and the
penalties are
addressed in the
Ordinance.
F. Cannabis/Controlled Substances- Loitering for the
purposes of using,
possessing, or selling
cannabis or a
controlled substance
is covered in the
Ordinance. A
definition of a "known
illegal user,
possessor, or seller
of substances" is
given.
G. Truancy- The policy of the City on Truancy is defined,
along with the procedures for the Chronic
Truants as defined in the Ordinance.
After reviewing the Ordinance, the Committee determined that
it would be beneficial to present the Ordinance to the
State's Attorney's office for their support. It will be
reviewed by the Committee of the Whole, and presented at the
Public Forums for input from the community.
2 . Chief Graff presented the Committee with a current budget
review for 1994.
3 . Chief Graff informed the Committee that in speaking with the
auditors, they have suggested that a separate account be
created for any D.A.R.E. funds or donations. This will be
presented to the Committee of the Whole.
4. Chief Graff told the Committee that he was approached by the
Yorkville Amoco who showed interest in offering a bid for gas.
The Committee asked him to approach all the 24 hr.
establishments for possible bids for gas.

5. The next meeting of the Public Safety Committee was set for
Monday September 19, 1994 at 5:30 p.m. at the Yorkville Police
Department.
