ZBA Minutes 1998 10-14-98 City of Yorkville Zoning Board of Appeals October 14, 1998 Roll Call: Present Bob Wenman Mike Skinner Curtis Medin Harold Feltz Minutes There were no minutes from the previous meeting available. Member Skinner moved not to approve the minutes which were not available Member Feltz seconded the motion. On a voice vote all members present voting aye. ZBA Clarification Bill Dettmers addressed the Board concerning the law and authority of the ZBA body. He stated the authority of the Board is set by State Statute. He explained with variations the vote is legally binding but with zoning changes/amendments it is advisory. The consensus was to have the City Council and Dan Kramer review this and for an opinion. Public Hearing PC 98-13 Yorkville Lodging LLC Country Inn &Suites/Darryl Anderson Chairman Wenman called the meeting to order. Daryl Anderson, owner and developer of the proposed Country Inn & Suites, was sworn in. This project would be located on Highways 34 &47, behind the former Hardee's restaurant. He has developed 8 motels within the last 8 years (Super 8, Comfort Inns and Ramada Limited). The Country Inns franchise is owned by the Carlson family of Minneapolis. He passed out pictures of the lobby, rooms and exterior of the motel they wish to construct. This building would have whirlpool suites, double queen and king beds, fireplace, indoor pool and whirlpool. Mr. Anderson said when the building drawings were laid out on the lot, the building infringes on the setback requirement of 20 ft. on the north and south side yard setback. The building comes into the setback 10 inches on both sides. He requested a one foot variance to allow the 20 ft. set back on the north and south side. The parking would be within the variance. The access drive is a frontage, private drive. Member Feltz moved the public hearing be ended Member Skinner seconded the motion. On a voice vote, all members present voting aye. Member Feltz moved to accept the 19 ft side yard on the north and side yard as requested by the Petitioner. Member Skinner seconded the motion. On a roll call vote, all members present voting aye. Motion carried. Member Skinner moved to adiourn the meeting at 6:42 PM. Member Medin seconded the motion. On a voice vote, all members present voting aye.
