Additional Business It was noted that the regularly scheduled June Plan Commission meeting would be cancelled. Mr. Heinen reported the Comp Plan Steering Committee met recently and will be moving out of the research phase and into the planning and development. A second speak-out event will be held in July and information will be brought to the Plan Commission in Spring of next year. The property is located on Lot 19 on Commercial Drive in Yorkville, Illinois. Memorandum To: Plan Commission From: Chris Heinen, Planner CC: Bart Olson, City Administrator Krysti J. Barksdale-Noble, Community Development Director Date: June 29, 2015 Subject: PC 2015-09 & 10 – Self Storage Facility (Rezoning & Special Use Permit) – Lot 19 Commercial Drive The property was annexed pursuant to an annexation agreement on March 23, 1995 to the City of Yorkville by the Inland Land Appreciation Fund, L.P as part of a larger land development plan subsequently zoned R-2, B-3 and M-1. The property in question fell under the B-3 zoning classification upon annexation. The petitioner is looking to construct nine (9) self storage buildings ranging from 2,000 square feet to 12,000 square feet in size and will have a total of 322 storage units. The main entrance will be located on Commercial Drive. The petitioner is proposing five (5) parking stalls, which includes one (1) handicapped accessible stall. The plan also indicates an additional three (3) parking stalls for the future, if needed. The property will be secured by fencing and an entry gate that will be accessible by the Fire Department via a Knox Box. The overall lot coverage, which includes buildings and pavement, is approximately 80%. This calculation is above the maximum required 60% lot coverage and the petitioner will be requesting a variance from the Zoning Board of Appeals to increase the minimum lot coverage requirement. There will be a 20 foot landscape buffer along the northern property line to help screen the existing residential properties to the north. The petitioner has requested relief from the Landscape Ordinance that requires a 30-foot landscape buffer for non-residential uses adjacent to residential uses. Per section 8-12-3F2 of the Landscape Ordinance, it states that any request for alternative methods of compliance shall be accompanied by sufficient explanation and justification, written and graphic, to allow appropriate evaluation and decisions by the city staff. The petitioner is providing written justification and will be implementing additional landscaping along the northern property line to accommodate the relief requested. Staff is supportive of this request due to the fact that the property to the north, a residence in unincorporated Kendall County, is designated as commercial on the Comprehensive Plan and will most likely be developed as commercial in the future. Two (2) monument signs are being proposed on the property. The first sign will be located at the northeast corner of the lot with exposure to Route 47. The second sign will be located at the entrance off of Commercial Drive. Additional wall signage will be placed on the northeasterly building as well. EXISTING CONDITIONS: The existing zoning and land use for properties surrounding the subject property are as indicated below: Zoning Land Use North Kendall County County Residences East B-3, General Business District Vacant/Commercial Building South B-3, General Business District Vacant/Commercial Building West M-1, Limited Manufacturing Vacant Parcel SPECIAL USE CRITERIA: Section 10-4-9F of the City’s Zoning Ordinance establishes standards for special use requests. No special use shall be recommended by the plan commission unless said commission shall find that: 1. The establishment, maintenance or operation of the special use will not be unreasonably detrimental to or endanger the public health, safety, morals, comfort or general welfare. 2. The special use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purpose already permitted, nor substantially diminish and impair property values within the neighborhood. 3. The establishment of the special use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district. 4. Adequate utilities, access roads, drainage or other necessary facilities have been or are being provided. 5. Adequate measures have been or will be taken to provide ingress or egress so designed as to minimize traffic congestion in the public streets. 6. The special use shall in all other respects conform to the applicable regulations of the district in which it is located, except as such regulations may in each instance be modified by the city council pursuant to the recommendations of the plan commission. AMENDMENT CRITERIA: Section 10-4-10B of the City’s Zoning Ordinance establishes standards for proposed amendment requests. Where the purpose and effect of the proposed amendment are to change the zoning classification of a particular property, the plan commission shall make findings based upon the evidence presented to it in each specific case with respect to the following matters: 1. The existing uses and zoning of nearby property. 2. The extent to which the property values are diminished by the particular zoning restrictions. 3. The extent to which the destruction of property values of plaintiff promotes the health, safety, morals or general welfare of the public. 4. The relative gain to the public as compared to the hardship imposed upon the individual property owner. 5. The suitability of the subject property for the zoned purposes. 6. The length of time the property has been vacant as zoned considered in the context of land development in the area in the vicinity of the subject property. 7. The community need for the purposed use. 8. The care to which the community has undertaken to plan its land use development. The applicant has provided written responses to these special use and amendment standards as part of their application and requests inclusion of those responses into the public record. Proposed Conditions of Rezoning & Special Use: Based upon the above review of the proposed self storage facility, should the Plan Commission consider favorable recommendation of the Rezoning & Special Use to the City Council, staff recommends the following conditions: 1. The project is subject to final engineering review and approval based upon comments provided in a review letter from Engineering Enterprises, Inc dated May 27, 2015. 2. The project is subject to final landscape approval and the petitioner must provide written justification for the relief of the 30 foot landscape buffer along the northern property line and must show additional landscaping above the required regulations on the final landscape plan. 3. The request for a lot coverage variance be submitted and a recommendation be given by the Zoning Board of Appeals. Final determination will be determined at a regularly scheduled City Council meeting. The final approval will be contingent upon a favorable recommendation of the variance by City Council. Staff Comments: The proposed rezoning of the property is supported by staff. A majority of the properties in the area, specifically to the west, are zoned M-1 and this property, and use, would fit in with the other lots in the subdivision. This proposed rezoning and special use was discussed at Plan Council on June 11, 2015 and the comments listed at that meeting are attached. A public hearing is scheduled on July 8, 2015 before the Plan Commission. A recommendation will be forwarded to the City Council for consideration at the July 21, 2015 regularly scheduled meeting. Additionally, the petitioner will be filing a lot coverage variance and a public hearing will be scheduled on August 5, 2015 before the Zoning Board of Appeals. A recommendation will be forwarded to the City Council for consideration at the August 25, 2015 regularly scheduled meeting. Staff will be available to answer any question the Plan Commission may have at Wednesday night’s meeting. Alderman Funkhouser then requested that the height of the corner side yard fence be increased to 6 feet with no opacity regulations. PC 2015-08 The United City of Yorkville, Kendall County, Illinois, petitioner, is proposing a text amendment to Chapter 6: Permitted and Special Uses in the Zoning Ordinance to revise Table 10.06.03, Business Uses to allow Fitness Clubs as a permitted use in the M-1 Limited Manufacturing zoning district. At that time, Alderman Funkhouser requested that staff look at an additional regulation for fences in residential districts. The request was to research the location of the fence lines along the side yards. Our current regulation allows the fence to extend within the required front yard setback; however, fences may not extend beyond the front plain of the house. The requested new regulation, as proposed by Alderman Funkhouser, would only allow the side yard fence to extend to the midpoint of the house, as illustrated in the examples below. Currently the City does not have a definition for the midpoint of a house or structure. Therefore, if the proposed regulation were to be adopted, staff would recommend the following definition: MIDPOINT: A point at or close to the middle or center of the longest plain on each side of the house. Memorandum To: City Council From: Chris Heinen, Planner CC: Bart Olson, City Administrator Krysti Barksdale-Noble, Community Development Director Date: June 15, 2015 Subject: PC 2015-07 Fence Height for Corner Yards (Text Amendment) Current Regulation House Proposed Regulation House Staff researched the following surrounding municipalities: Naperville, Oswego, Plainfield and Montgomery, and have discovered that a majority of them allow the fence to extend to the front plain of the home similar to our current fence regulations. Attached are their regulations. Additionally, staff feels the proposed regulation of limiting the fence to the midpoint of the home would diminish the homeowners’ ability to use the full length of their side yards. Also, there are several factors that may impede the location of the proposed fence. A window location or a service door may impede the location of the fence at the midpoint, as well as an air conditioning unit that would further reduce the usability of the side yard. Therefore, staff recommends the following compromise on a new location of front facing fences as illustrated below: The recommended regulation takes into account the possible snout portion of the home that is typically a garage and moves the front plain of the home to the main livable portion of the structure. If the proposed regulation were adopted, staff recommends adding the following definition: FRONT PLAIN: The horizontal plain measured at the main floor of the structure of the residence. Conclusion: Upon conferring with the City Attorney, if the City Council is inclined to adopt either of the proposed additional regulations as presented in this memo, a separate text amendment must be prepared and presented to the Plan Commission. Therefore, the Council may direct staff to prepare a new text amendment to the Zoning Ordinance and publish for a new public hearing at an upcoming Plan Commission meeting. Additionally, staff requests that a vote be taken on the original proposed text amendment to allow corner side yard fences to be increased from 3 feet and 4 feet to 4 feet and 5 feet as there are a few outstanding permits awaiting approval to move forward. Staff will be available at Tuesday night’s meeting to answer any questions from the City Council regarding this matter.
