ZBA Minutes 1989 07-17-89 CITY OF YORKVILLE ZONING BOARD OF APPEALS p July 17, 1989 7:00 PM Chairman Martin Behrens called the meeting to order. Members present were Curtis Medin, Tom Lindblom, David Erickson, Lawrence Beach and Greg Huber. Also present were Mayor Bob Davidson, Fran Klaas, Tom Grant, Nora and Albert Vollendorf, Don Garbe, Arthur Crawford, Jim Olson, Kyle Price and Vern Henne. It was announced that Jim Clayton has dropped his Petition for Variance for private sewage treatment facility. Chairman Behrens opened the Public Hearing for ZBA89-5 - Variance request from Yorkville Subdivision Control Ordinance RE: Sidewalks, Section 8.06; Street Lighting, Section 8.07; Sanitary Sewer System, Section 8.10; and Water, Section 8.11. (Ivy's Subdivision-NE corner of Rt. 34 and Cannonball Trail-Tom Grant) - Kendall Co. Petition - 1"'1/2 mile jurisdiction. Attorney Tom Grant representing the Petitioner stated that this has been before the Plan Commission. There are five (5) lots. It will be on individual wells and septic as no water and sewer are available. Will put in streets and curbs, but do no wish to put in sidewalks.' Garbe Is an adjacent property owner, likes the country setting and does not want sidewalks and lights. N. Vollendorf: She has spent $9,000 on well and septic and does not want to spend money on sidewalks. Crawford: If you are now on well and septic, can City make a change, or can it be grand- fathered in? Davidson: Wells'and.-septics are grandfathered in unless septic fails. Sewer and water should be available this fall or next sprint;. Grant: This property and Conover's"is only property available on east side of Cannonball Trail and Rt. 47 left to be developed. It fits in with adjoining properties, has same rural atmosphere. Davidson: When it is adjacent to City it will be annexed. Grant: No problem w/annexing, a covenant runs with the land, when City requests, they will annex. Davidson: No benefit to force annex, unless surrounded by the City. Henne: Questioned the water runoff, has no water problems now. Garbe: What control does City have of zoning? Grant: Advisory only, . whatever is most strict, City or County. Henne: Questioned size of lots. Grant: The covenants cover this, the lots cannot be split. Huber made a motion to adjourn the Public Hearing. Seconded by Beach and motion carried. Chairman Behrens called the regular meeting to order. A discussion followed. Medin made a motion to recommend to the City Council the Variance request I;e approved except that a street light be required at the entrance to Ivy Lane on Cannonball Trail. Seconded by Lindblom. ROLL - Medin, Aye; Lindblom, Aye; Erickson, Aye; Beach,Aye; Huber, Aye. Motion carried. Chairman Behrens opened the Public Hearing for ZBA89-4 - Variance request from Yorkville Subdivision Control Ordinance Re: Sidewalks, Section 8.06; Street Lighting, Section 8.07; Sanitary Sewer System, Section 8.10; and Water, Section 8.11. (Fox Glen Subdivision- Fox Rd. - Norm-and Ted Graf) - Kendall:'Co. Petition - 1-1/2 miles jurisdiction. Jim Olson representing the Petitioner stated that this a rural subdivision, would have curbs, storm drains and water retention. Sidewalks would be a problem at crossing of ravine and would have to be put by the road. Huber: How would school children be picked up if no sidewalks? Olson: No lots on Fox Rd. Beach made a motion to adjourn the Public Meeting. Seconded by Medin and motion carried. Chairman Behrens called the regular meeting to order. A discussion followed. Lindblom made a motion to recommend to the City Council the Variance request be approved except that two (2) street lights be required, one at the entrance on Fox Rd., and the other at the entrance at Fox Glen Court.
