Chairman Behrens called the public hearing to order. The following
members were in attendance: Mr. Huber, Mr. Behrens, Mr. Medin, and
Mr. Lindblom. Also present were Mayor Davidson, Larry Jennings, Mike
Thanepohn, Jim Hayden, Don Ament, Mrs. Tom Zeiter, Attorney Tom Grant,
and Gary Conover .
ZBA-85-2 - Petition by John & Alice Conover for Variance from
Subdivision Control Ordinance (Sec. 8.05.01; 8.05.05;
8 .06)

Chairman Behrens read from the notice of the public hearing. It
stated that John And Alice Conover wished to petition for a variation
from the strict letter of regulations from the Subdivision Control
Ordinance regarding Section 8.05.01 (street surface), Section 8.05.05
(curbs), and 8.06 (sidewalks). Attorney Tom Grant spoke in behalf of
the petitioners. He stated that the area to be discussed would be the
portion of Conover's Subdivision which is undeveloped. They are
requesting that three variances be granted.
The first variance they are requesting is on the sidewalks. Attorney
Grant stated that there are presently no sidewalks in the rest of the
subdivision. They would like to continue this throughout the rest of
the subdivision. He felt that a precedent had been set in the sub-
division and that this variation would be an extention to the existing
subdivision. There has been a proposal made by the State for a side-
walk to come up from Game Farm Road. It would come across to Prairie,
east to west. They will show the sidewalk on their final plan.
They are also asking for a variation on the street surface and
curbing. They would like to put curbing on Leisure, north on Prairie
on the inside perimeter north all the way down to Sunset, and the south
side of North Avenue would be storm sewered. The north side of North
Avenue would not be curbed for drainage reasons. There will not be
curbing on the west side of Prairie. They do not wish to do anything
more in developing Sunset . They wish to leave it the same and keep
the existing ditch. They would like a variance granted on Leisure St.
in terms of the surface. They would like to put down a tar and chip
surface and put in curbing. The curbing will hold the roadway in.
The water will be drained to Blackberry Creek.
Mr. Lindblom questioned what the proposed road surface would be like
as compared to the existing road surface. Attorney Grant stated that
it would be basically the same except for the tar. It will not have
the same sticky effect. Mr. Lindblom inquired about the maintenance
and whether this surface would cause more cracks. Attorney Grant
stated that there is a good base down on Leisure St. already. He
stated that the main function is to hold the road in and sway the
water. Mr. Lindblom stated that most of the subdivision is not in the
city limits. Only Sunset St. is in the city limits. Mr. Lindblom
inquired as to what the city ' s overall plan is on roadways and gutters
and where they are going in terms of upgrading .

Mayor Davidson felt that the heavy truck traffic on North St. should
be looked into. The property will be zoned for business .
Mr. Medin could not see any reason not to recommend the variances.
Mr. Medin felt that since the subdivision is 3/4 completed that the
remaining portion should be put in the same way. He did not feel that
the whole subdivision should be changed. Mr. Lindblom felt that we
should be concerned with the portion of the subdivision which is in
the city limits .
Gary Conover stated that there is a tile under the road that drains to
the creek. They would like to drain it into another catch basin.
There is going to be a 15-inch storm sewer into the Game Farm area
that they would like to hook up to at their expense. He stated that
as of now, there has not been any rain problems in the subdivision.
Mike Thanepohn felt that there should be sidewalks in the subdivision.
Mr. Lindblom questioned if the rest of Conover's subdivision was to
come into the city limits and want sidewalks, where would the money be
derived from. Mr. Jennings stated that if the residents were to want
sidewalks, a special assessment could be set up for them. Mr.
Jennings felt that if the rest of Conover's subdivision were to annex
to the city it would be of no benefit to the city due to the cost of
city services to them. It was felt by some of the present residents
of Conover's that safety would not be a real big concern due to the
fact that the main traffic is from residents that live there.
Mr. Behrens inquired as to whether there was anymore discussion. He
felt that each of the variances should be voted on separately.
Mr. Lindblom made a motion that the variance from section 8.05.01
regarding the street surface be granted. Mr. Medin seconded the
motion. A roll call vote was taken.
Mr. Huber-yes Mr. Medin-yes Mr. Lindblom-yes Mr. Behrens-yes
The motion carried 4-0.
There was discussion held on the variance on standard low profile
curbing. Only the streets being annexed into the city are in
question.
Mr. Medin questioned the motion regarding the street surface. He
inquired as to whether the motion was only to include Leisure Streeet
or whether it would also include North Avenue. Gary Conover stated
that they would be putting a hot mix down on North Avenue. Prairie
Lane will stay as it is. Mr. Medin stated that the motion was to
pertain only to Leisure St.
Mr. Lindblom stated that there will not be curbs on the north side of
North Avenue and the west side of Prairie due to water run off. Mr.
Medin made a motion that the variance regarding section 8.05.05 on
curbing be granted. Mr. Lindblom seconded the motion. A roll call
vote was taken .
Mr. Behrens-yes Mr . Medin-yes Mr. Lindblom-yes Mr. Huber-yes
The motion carried 4-0.
Mr. Lindblom stated that he was not concerned with the sidewalks in
the business area. His main concern was with the residential area.
The sidewalk on North St. will go only to the intersection. There will
be a variation on both Leisure St. and part of North Ave.. Mr.
Jennings suggested that the two streets be voted on separately. The
variance would be east of the entrance on North Avenue.
Mr. Lindblom made a motion that the variance be granted on the eastern
portion of North Avenue on the sidewalk. Section 8.06 and that the
sidewalk variance on Leisure St. be denied. Mr. Medin seconded the
motion. A roll call vote was taken.

The motion did not carry 1-3 .
Mr. Huber made a motion that the variance be approved regarding
Section 8.06 and sidewalks on both Leisure St. and North Avenue. Mr.
Medin seconded the motion. A roll call vote was taken.
Mr. Medin-yes Mr. Behrens-yes Mr. Lindblom-no Mr. Huber-yes
The motion carried 3-1 .
Mr. Behrens made a motion that the meeting be adjourned. Mr. Lindblom
seconded the motion. The meeting was adjourned.
