MINUTES OF THE ZONING BOARD OF APPEALS OF THE CITY OF YORKVILLE
HELD AT CITY HALL ON OCTOBER 8, 1984 AT 7:00 P.M.
Chairman Behrens called the meeting to order. Roll call was taken with the
following members present: Mr. Medin, Mr. Behrens, Mr. Lindblom, and Mr. Huber.
Also present were Mr. Tom Grant, Attorney for the petitioner, and Mr. Ron Robb,
the petitioner. A quorum was established.
Re: Petition for a side-yard variance by Robb Container Corporation
Chairman Behrens read from the notice of the public hearing. The notice stated
that Robb Container Corporation, an Illinois Corporation, is requesting a
side-yard variation to ten feet, on the east side of the lot on Van Emmon
which would be less than that required under Section 8.01-D-2 of the Zoning
Ordinance. Mr. Behrens stated that the meeting on October 2, 1984 was can-
celled due to the lack of a quorum and continued for six days. Attorney Grant
stated that he would be representing the petitioner. Mr. Robb stated that the
public notice needed to be amended so as to read a Delaware Corporation rather
than an Illinois Corporation. Mr. Behrens stated that copies had been sent
to the abutting property owners which would include Roger D. Olson, Robert
Walker, and Paul Kraberf none of which were present at the meeting. The
certified receipts were retruned and signed by the above property owners.
Attorney Grant stated that the notice of the rescheduled public hearing was
published in the Kendall County Record on Thursday, October 4, 1984. He
stated that the petition basically spoke for itself. He presented the attached
aerial picture of the property located an Van Emmon St. . The portion of property
that is going to be expanded for warehousing purposed is on the north edge of
the property back up to the lot line. They would need the variance for the
east side of the lot where doors for trucks to unload would extend out past
the existing building. They would need to be as close to the lot line as
possible. The ordinance would allow 14.035 feet without applying for a
variance. A variance would allow approximately 101� feet. They are requesting
10 feet which would be a difference of approximately 6 inches.
Mr. Medin stated that there is nothing directly adjacent to the property.
Mr. Huber inquired as to whether the wood fence is directly on the lot line.
Mr. Robb stated that the fence is on the lot line, but the lot line does not
run directly north and south. It would be 10 feet at the closest point.
Attorney Grant stated that on the map is shows a right of way for Commonwealth
Edison. Commonwealth Edison was contacted, and it was found that the right- of
way was not correct as shown on the map.
Mr. Behrens inquired as to how many feet away the building would be from the
back lot line. Attorney Grant stated that the building would be approximately
32 feet, and it would be between 10 and 11 feet off the back lot line.
Mr. Behrens inquired as to whether there was any more discussion. He stated
that the Commission can only advise to the City Council their recommendation.
He therefore made a recommendation, based on the findings of Section 8, A
through F, of the petition, that the City Council grant the petition. A roll
call vote was taken.
Mr. Lindblom - yes Mr. Huber - yes Mr. Behrens - yes Mr. Medin - yes
All members were in favor.
Mr. Lindblom made a motion to adjourn the meeting, and Mr. Behrens seconded
the motion. The meeting was adjourned.

PETITION FOR VARIATION
TO : The Zoning Board of Appeals , Zoning Enforcement Officer , and
Mayor and City Council of the United City of the Village of
Yorkville , Kendall County , Illinois .
The undersigned , ROBB CONTAINER CORPORATION , an Illinois corpora-
tion , being the record owner of the following described lot , piece or
parcel of land , situated in the City of Yorkville , Kendall County ,
Illinois , to-wit :
That part of Lot 12 (sometimes called Sub . Lot 12 ) in
Section 33 , Township 37 North , Range 7 East of the
Third Principal Meridian , which lies South of the Chicago ,
Burlington and Quincy Railroad right of way and North of
Van Emmon Street , in the Village of Yorkville , in Kendall
County , Illinois ,
herewith makes application to the Zoning Board of Appeals of the
United City of the Village of Yorkville , Illinois , and to the City
Council of the said City for a variation from the strict letter of the
regulations of the Zoning Ordinance of the City of Yorkville .
The undersigned represents as follows :
1 . That ROBB CONTAINER CORPORATION , an Illinois corporation , is
the record owner of the real estate herein described .
2 . That said real estate is located on the North side of East
Van Emmon Street within the corporate limits of the City of Yorkville
and is presently improved with manufacturing and warehouse buildings
utilized by ROBB CONTAINER CORPORATION in its manufacturing processes .
3 . That the entire parcel of real estate herein described is
presently zoned M-1 , limited manufacturing district , under the pro-
visions of the Zoning Ordinance of the City of Yorkville .
4 . That attached hereto and made a part hereof and marked as
Exhibit "A" is an aerial view 'of the subject parcel of real estate
identified thereon as parcel ,no . 004 .
5 . That ROBB CONTAINER CORPORATION , the Petitioner herein ,
desires to expand its warehousing capabilities and capacities
and to utilize the northernmost portion of the parcel of real
estate herein described , which is presently vacant and unimproved
and that the undersigned is requesting a variation from the strict
letter of the regulations of the Zoning Ordinance to authorize the
issuance of a building permit for a warehouse building on the
northernmost portion of said real estate .
6 . That , specifically , ROBB CONTAINER CORPORATION is requesting
a variation from the strict regulations of Sections 8 . 01 -D-2 of the
Zoning Ordinance to authorize the issuance of a building permit
for the construction of said warehouse facility with a side yard , to
the East , of ten ( 10 ) feet , less than that required by the Zoning
Ordinance .
7 . That the Northerly lot line of the parcel of real estate
herein described is 140 . 35 feet in width and that Section 8 . 01 -D-2
of the Zoning Ordinance would require a side yard of not less than
14 . 035 feet .
8 . The undersigned further submits to the Zoning Board of Appeals
and to the City Council of the City of Yorkville , as follows :
a ) That the parcel of real estate herein described is
presently used for manufacturing purposes and that this application
is made not by reason of mere inconvenie'nce to the owner but by reason
of the fact that a valuable portion of the parcel of real estate
herein described is not now usable for warehouse space due to the
limitations of the Zoning Ordinance .
b ) That the condition upon which this Petition for Variation
is based is unique to the property for which the variation is sought

and is not applicable , generally , to other properties within the
same zoning classification .
c ) That the aforementioned hardship is not attributable
to any activity of the owner but is occasioned by reason of the
existing dimensions of the parcel of real estate herein described
and the provisions of the Zoning Ordinance concerning the use of the
same .
d ) That the granting of the requested variation will not
be detrimental to the public welfare or injurious to other property
or improvements in the neighborhood in which the subject real estate
is located .
e ) That the proposed variation will not impair an adequate
supply of light and air to adjacent property or substantially
increase the congestion in the public streets , or increase the danger
to the public safety , or substantially diminish or impair property
values within the neighborhood .
f) That the warehouse addition proposed to be constructed
on the subject parcel of real estate will add to the assessed value
of property in the City of Yorkville for the common benefit of all
property owners in the City of Yorkville .
WHEREFORE , the undersigned , requests that the Zoning Board of
Appeals conduct a public hearing on this Petition as required by law,
and that the Zoning Board of Appeals and the City Council of the City
of Yorkville take all necessary action upon this Petition within a
reasonable period of time .
