' MINUTES OF THE ZONING BOARD OF APPEALS OF THE CITY OF YORKVILLE
HELD AT CITY HALL ON JUNE 4, 1984 AT 7:00 P.M.
Chairman Behrens called the meeting to order. Roll call was taken with the
following members in attendance: Mr. Huber, Mr. Becker, -`r. Medin, and Mr.
Behrens. Also present were Attorney Grant Wegner, A. &L- 1. Schlee, Ina L.
Schlee, and Dean Schlee. A quorum was established.
Re: 1984.2 - Petition for side-yard variance in Worsley's Addition
Chairman Behrens read from the notice of the public hearing. The notice stated
that Raymond Waclaw, William Carpenter, and Jeffrey Farren wished to petition
for a side-yard variance on Lot 3, Block 2 of Worsley's Addition. Attorney
Grant Wenger was present in behalf of the petitioners., He presented aerial
pictures of the property. He stated that in 1908 when the property was platted
there were no provisions for set-back lines, so according to current standards,
it leaves a very small area to build on. They are requesting that the side
yards by reduced from 30 feet to 10 feet. Mr. A. Earl and Ina Schlee are the
party interested in purchasing and building on the land. Attorney Wegner showed
photographs of the property. There is a tree line running on the west edge of
the property. He stated that if the property were to be salable to anyone
other than the next door neighbors they would need a variance. The zoning on
the property is R-1.
Mr. Huber inquired as to how the house would be situated on the property. Mr.
Schlee showed the plans for the house. There was question as to where the
front and side yards were. The driveway would come on to Main Street. Attorney
Wegner read from the Zoning Ordinance book. It stated that on a corner lot the
front shall be the narrowest side edge of the lot fronting on a street, pro-
vided that the owner may orient his building toward either street. This would
make the side facing Main Street the front yard. Chairman Behrens also pointed
out that Worsley Street is not-a very traveled road.
Mr. Becker stated that we were only allowed to give a 25% variance which would
be a reduction to 22 1/2 feet.
Mr. Medin felt that in order for them to build on the property the members
would have to recommend a variance from 30 feet to 10 feet.
Chairman Behrens inquired as to whether there were any more questions. He
stated that because of the age and uniqueness of the property that he would
entertain that a motion be made to any effect that the members felt suitable.
Mr. Medin made a motion that the members accept the petition and variance the
petitioners are asking for and to recommend it to the City Council. Mr. Becker
seconded the motion. A roll call vote was taken.
Behrens - aye Becker - aye
Medin - aye Huber - aye
The motion carried unanimously.
Chairman Behrens suggested that a letter of recommendation also be sent with
the minutes to the City Council. Mr. Becker was instructed to draft the letter.
Chairman Behrens moved that the meeting be adjourned. The.meeting was
adjourned.

Set Back line along Worslev Street , Lot 3. Block 2, of Worsley*s
Addition be reduced from Thirty (30) feet to Ten (10) feet, be
granted*

PETITION FOR SIDE YARD VARIANCE
TO: THE ZONING BOARD OF APPEALS MAY 11th, 1984
OF THE UNITED CITY OF THE
VILLAGE OF YORKVILLE,KENDALL COUNTY,ILLINOIS
GENTLEMEN:
The undersigned hereby applies to the Zoning Board of Appeals for an exception
or a variation in the application of provisions or regulations of the Zoning Ordinance
effecting the following described premises, in the manner and on the grounds hereinafter
set forth:
1. That the Petitioners, namely: Raymond Waclaw, William Carpenter and Jeffrey Farren,
are the owners in fee simple of the following described property:
Lot 3, Block 2 of Worsley's Addition to the Village of Bristol,
in the United City of the Village of Yorkville,Kendall County,Illinois.
2. That the Worsley's Addition was platted in Kendall County on August 7th, 1908
as it was annexed to the Village of Bristol, all as set forth in Plat Book 5, page 5,
a copy of said plat being attached hereto and made a part hereof as Exhibit "A".
3. That pursuant to said platting, no setback line or setback distances were established,
and that the only setback lines applicable in the regulation of said property and the build-
ing thereon is established through the Subdivision Control Ordinance presently in existence
in the United City of the Village of Yorkville, as adopted in 1971.
4. That the Petitioners have a bona fide purchaser willing to purchase said property
provided that the setback line situated along Worsley Street, is reduced to ten (10) feet.
5. That to strictly enforce the Subdivision Control Ordinance now in existence would
cause a particular hardship in the following manner:
(a) Due to the conditions of the specific property involved, failure to reduce
the setback line as requested would only result in a particular hardship
to the Petitioners, and not a mere inconvenience.
(b) That the conditions upon which the Petition is based are unique to the property
for which the variation is sought and are not applicable generally to other
property within the same zoning classification.
(c) That the alleged difficulty or hardship has been caused by the Ordinance
and not created by any person presently having an interest in the property.
(d) That the granting of the variation will not be detrimental to the public
welfare, or injurious to other property or improvements in the. neighborhood.

. (e) That the proposed variation will not impair an adequate supply of
light and air to adjacent property, or substantially increase
congestion in the public streets or increase the danger to the public
safety or substantially diminish or impair property values within the
neighborhood.
WHEREFORE, the Petitioners pray that the setback line along Worsley Street be
reduced from thirty (30) feet to ten (10) feet.
