200700015758 Filed for Record in STATE OF ILLINOIS ) KENDALL COUNTY► ILLINOIS PAUL ANDERSON )ss 05 -15 -2007 At 11:15 am, COUNTY OF KENDALL ) ORDINANCE 40.00 RHSP Surcharge 10.00 ORDINANCE NO: 2006- l `c ORDINANCE APPROVING VARIANCES INCREASING THE MAXIMUM ALLOWABLE AREA OF THE GROUND SIGN FOR A BUSINESS LOCATED AT 7131 ROUTE 47 (SARAVANOS PROPERTIES, LLC) WHEREAS, Saravanos Properties, LLC filed ZBA Petition 2005 -58 requesting a variance to increase the maximum allowable area of a ground sign for the business located at the property specifically described in the attached exhibit "A "; and WHEREAS, the Petitioners plan to substantially improve the real property to enhance the value of the property, improve the aesthetics of the neighborhood, and promote safe travel along Route 47; and WHEREAS, the Zoning Board of Appeals of the United City of Yorkville held a public hearing with regard to said Petition; and WHEREAS, the Zoning Board of Appeals took public comment on the issues before it and made specific findings of fact related to the granting of the variance sought; and WHEREAS, the Zoning Board of Appeals recommended the approval of said requested increase in the maximum allowable area for a ground sign with the following conditions: limit the number of signs on the site, tenant panels are to be made using Lexan plastic and separate disconnect lighting; and WHEREAS, the Mayor and City Council of the UNITED CITY OF YORKVILLE have reviewed the findings of fact made by the Zoning Board of Appeals, considered the public comment presented at the public hearings and have determined that the requested variance is appropriate under the circumstances presented by the Petitioners; NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE UNITED CITY OF YORKVILLE, upon Motion duly made, seconded and approved by a majority of those so voting, the following Variance is hereby granted from the United City of Yorkville Zoning Code for the real property more fully described in Exhibit "A ": Page 1 of 2 1. Maximum Allowable Area for Ground Sign: 8 -11 -713 of the United City of Yorkville Zoning Code is hereby varied to permit a ground sign with a maximum allowable area of 198 I square feet as depicted in Exhibit `B" attached. The variance granted herein is contingent upon the construction of the ground sign identifying the business according to the design, plan and specifications presented to the Zoning Board of Appeals and City Council. No other variances from the City Code for design, plan or j specifications for said structure will be permitted.
