City Council Minutes 2015 06-23-15 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF YORKVILLE,KENDALL COUNTY,ILLINOIS, HELD IN THE CITY COUNCIL CHAMBERS, 800 GAME FARM ROAD ON TUESDAY,JUNE 23,2015 Mayor Golinski called the meeting to order at 7:00 p.m. and led the Council in the Pledge of Allegiance. Minutes of the Regular City Council—June 9,2015 Mayor Golinski entertained a motion to approve the minutes of the regular City Council meeting for May 26, 2015 and June 9,2015 as presented. So moved by Alderman Milschewski; seconded by Alderman Tarulis. Minutes approved unanimously by a viva voce vote. BILLS FOR PAYMENT Mayor Golinski stated that the bills were $1,478,138.68. REPORTS MAYOR'S REPORT An Ordinance 2015-38 Authorizing the Issuance of General Obligation Bonds(Alternate Revenue Source),Series 2015A,in an Aggregate Principal Amount not to exceed $6,250,000 for the Purpose of Financing the Costs of Certain Capital Projects within the City,Refinancing Certain Outstanding Obligations and Paying for Costs related thereto,and Providing for the Levy and Collection of a Direct Annual Tax for the Payment of the Principal of and Interest on said Bonds (CC 2015-53) Mayor Golinski entertained a motion to approve an Ordinance authorizing the issuance of general obligation bonds(alternate revenue source), series 2015A, in an aggregate principal amount not to exceed$6,250,000 for the purpose of financing the costs of certain capital projects within the city, refinancing certain outstanding obligations and paying for costs related thereto,and providing for the Levy and collection of a Direct Annual Tax for the Payment of the Principal of and Interest on said Bonds and authorize the Mayor and City Clerk to execute. Ayes-8 Nays-0 Milschewski-aye, Teeling-aye,Koch-aye,Kot-aye, Frieders-aye, Tarulis-aye,Colosimo-aye, Funkhouser-aye Route 34 Improvements (Eldamain Road to Center Parkway)—APS Equipment (CC 2015-54) Mayor Golinski entertained a motion to remove the proposed installation of APS equipment form the Route 34 improvements project(Eldamain Road to Center Parkway)and authorize a letter to be sent to IDOT directing the removal of the APS equipment from the improvement plans. So moved by Alderman n Frieders; seconded by Alderman Koch. Alderman Funkhouser asked if there was any penalty,at this point,for making a change to the project. Motion approved by a roll call vote. So moved by Alderman Koch; seconded by Alderman Milschewski. Motion approved by a roll call vote. Ayes-8 Nays-0 Koch-aye,Kot-aye,Frieders-aye, Tarulis-aye, Colosimo-aye,Funkhouser-aye,Milschewski-aye, Teeling-aye PUBLIC WORKS COMMITTEE REPORT /1 Water Works System Master Plan—Agreement for Consulting Engineering Services (PW 2015-34) Alderman Funkhouser made a motion to approve an agreement for Consulting Engineer Services for the water works system master plan between the City and Engineering Enterprises,Inc. and authorize the Mayor and City Clerk to execute; seconded by Alderman Colosimo. Alderman Colosimo does support this plan. The City is spending close to a quarter million dollars.He asked if some money could be recouped for this research from communities wanting to join into this cooperative agreement.Alderman Teeling asked if the City has looked into the water conservation component. City Administrator Olson said that is a big component of the overall study.Alderman Teeling and City Administrator Olson discussed committee options to oversee conservation issues.Alderman Colosimo does not believe the City should have involvement through the green committees.Alderman Funkhouser doesn't want a separate committee but would prefer the matter be handled through Public Works.Alderman Frieders doesn't support doing this under the City's umbrella.He hopes this report will allow the City to keep an open mind to conservation alternatives. These types of plans can increase the amount of rain water back to the soil as opposed to sending it through the sewer system. Mayor Golinski mentioned the green committee is active at the Yorkville Congregational Church. Motion approved by a roll call vote. Agreement for Professional Services—BNSF Quiet Zone Study b. Agreement for Professional Services—Illinois Railnet Quiet Zone Study Alderman Funkhouser made a motion to approve an agreement from professional services for BNSF quiet zone study between the City and Engineering Enterprises,Inc. and an agreement for professional services for Illinois Railnet quiet zone study between the City and Engineering Enterprises,Inc. and authorize the Mayor and City Clerk to execute;seconded by Alderman Kot. The Council discussed the need, potential cost, and availability of grants to proceed with recommendations provided by this proposed study. The majority of the Council felt that it is pointless to spend the City's money to analyze a project that the City might never be able to afford. Even with the existence of grants,the City would still be responsible for part of the installation of controlled crossing gates needed to replace the train horns.Also,the City would be responsible for the upkeep and maintenance of the gates. PLAN COMMISSION Ordinance 2015-39 Amending the Yorkville Zoning Ordinance by Amending the Permitted Height of Fences in Corner Side Yards (PC 2015-07) The Minutes of the Regular Meeting of the City Council—June 23,2015—Page 4 of 5 Mayor Golinski entertained a motion to approve an Ordinance amending the Yorkville zoning ordinance by amending the permitted height of fences in corner side yards and authorize the Mayor and City Clerk to execute. So moved by Alderman Frieders; seconded by Alderman Koch. Alderman Funkhouser discussed the past fencing height ordinance and the possible changes in this new amendment. He would prefer to go back to the 6 foot height for fences in corner side yards.Alderman Colosimo and Community Development Director Barksdale-Noble discussed the requirements for repairing or replacing a fence.Alderman Milschewski asked for clarification for the repair of damaged fences. Community Development Director Barksdale-Noble said any fence damaged more than 50%has to be rebuilt to the current ordinance.Anything less than 50%damage would be left to the discretion of the home owner.Alderman Frieders asked if there was a line of sight evaluation when approving a permit. Community Development Director Barksdale-Noble yes.Alderman Funkhouser discussed the line of site for fences. Community Development Director Barksdale-Noble said most of the home owners associations don't allow for a six foot fences.Alderman Funkhouser is not in favor of having ordinances that create non-conforming situations.Alderman Koch wanted to clarify that the Council would be voting on the proposed regulation that is in the packet or the staffs regulation. Community Development Director Barksdale-Noble said that Alderman Funkhouser is asking to amend the ordinance as written to go from four feet to five feet to five feet to six feet. Alderman Funkhouser made a motion to amend the ordinance as written to allow for six foot solid fence on corner side yards; seconded by Alderman Colosimo. Mayor Golinski stated roll call on the motion to amend. Motion approved by a roll call vote. Summer Solstice Alderman Frieders reported that Summer Solstice is this weekend down at the river in Yorkville. STAFF REPORT No report. ADDITIONAL BUSINESS Road Repairs Alderman Teeling asked about the road repairs at Route 47 and Route 34. Metra Station In Yorkville /1 Mayor Golinski addressed the Metra station and the Council discussed this issue.
