October 29, 1998

ZBA Re-appointment
Mayor Johnson announced that he will re-appoint Don Altman to the Zoning Board of
Appeals. This will go to City Council on 11/5/98.
September Police Report
This will go to City Council on 11/5/98.
July/August Building Report
Ald. Spang noted that the math appeared to be in error for August. Amend and send to
City Council on 11/5/98.
Stormwater Detention Exemption
Ald. Prochaska referenced the 9/22/98 memo from Joe Wywrot. The memo recommends
that small existing in-fill lots be exempted from stormwater detention requirements. This
would apply to single-family and duplex residential lots less than 2.5 acres in size, and all
other lots less than 1.25 acres in size. Mr. Kramer advised that a public hearing is not
necessary. Would only apply to lots of record as of date of adoption by City Council.

Gary Schlapp-Kendall County Rezoning& Special Use Request within 1.5 miles of
Yorkville
Ald. Prochaska stated that this request to the county is for a special use permit to have a
caretaker onsite. It's only coming to the city for that reason. This issue was considered by
the Yorkville Plan Commission who recommended approval. Alan Garrow, atty. for the
petitioner, said that Dr. Schlapp wants to build a commercial kennel on this 5-acre parcel
on Cannonball Trail. The kennel complies with the current county A-1 zoning,but Dr.
Schlapp wants to have a full-time caretaker onsite. The building would be pre-engineered
with a 4' high brick fagade. Ald. Prochaska stated that the council is not considering a
petition to annex tonight,that may come later. Only thing to consider tonight is the
special use for a caretaker and some retail sales. Alan Garrow said that Dr. Schlapp is
willing to annex. Mr. Kramer said that the city could state its opinion on annexation at
this time if they chose to. Ald. Prochaska said it should be kept separate. Mayor Johnson
agreed. Ald. Spears asked if the retail sales issue could be discussed now. How many
delivery trucks?Dr. Schlapp said about 1 straight-body truck each week. Aid. Sticka said
that we would need to decide on water/sanitary and stormwater sooner or later.
Atty. Peter Krenz of Plano spoke representing the Cannonball Trail Civic League. He
said that this non-profit organization consists of all property owners along Cannonball
Trail between Route 34 and Route 47. His clients oppose the petition. The Yorkville
Comp. Plan calls for this area to be low-density residential. One of the intents of the
county Comp. Plan is to preserve property values. This development will hurt property
values. The curve in Cannonball Trail is also hazardous. The increase in traffic will be
significant. If the development occurs,what will the city zone it upon annexation?It
would have to b`B"district,which is not compatible with the existing residential
properties. Ald. Prochaska said that those questions need to be addressed by the county
before Yorkville could consider them. Tonight we are only dealing with the issue of a
caretaker and a small amount of retail sales.
Robert Halverson, representing the church, spoke to oppose the development. Jim
Rohrbach asked Dr. Schlapp if he plans to use the kennel for other purposes in the future,
perhaps grooming services or moving his vet. practice there. He is concerned with
property values and asked the city council to please adhere to its comprehensive plan.
Martha Price said that she spoke to Tom Lindblom, chairman of the Yorkville Planning
Commission, and was told that there was some confusion about what they were voting
for when they recommended approval. Dr. Schlapp said that he has no plans to move his
veterinary practice to this site. Ald. Prochaska asked staff to check with Kendall County
about the retail sales issue. Are retail sales allowed under the Special Use permit? This
petition will go to City Council on 11/5/98.
Art Sheridan—Motoring Plaza Agreement
Ald. Prochaska said that a public hearing is required for this annexation. The property is
currently in the City of Plano and needs to de-annex from them. Will this be on the Plan
Commission agenda in November? Atty. Kramer explained the procedure. Yorkville
needs to pass the annexing ordinance before Plano passes the de-annexing ordinance.
Ald. Spang is not comfortable with Section 2.B on Page 3 of the proposed ordinance.
Why should the city be required to amend its Comp. Plan to accommodate this
development? Atty. Kramer said that it is for the city's protection,but that it can be
removed if we desire. Ald. Prochaska said that section probably isn't applicable, and
could probably be stricken from the ordinance. Atty. Kramer said that this ordinance is
not the final document, and he is looking for input from the council. Ald. Spang asked if
the property is in the YBSD Facility Planning Area. Yes. Then strike that section, too.
Ald. Spang questioned the 10-year tax rebate; is this being too generous to the developer?
Ald. Prochaska and Mayor Johnson said that there are other tax revenues that the city will
keep, such as utility tax and property tax. Ald. Spang questioned the section about this
ordinance superseding other ordinances that might conflict with it. Atty. Kramer
explained that it is necessary to have this section remain to allow provisions of the
agreement to be enacted, such has the tax rebate. Aid. Spang concurred, as long as it only
applies to items mentioned in the agreement. Mayor Johnson said that this item will be
put on the next Economic Development Committee agenda.
Cannonball Hill
Jim Nanninga said that the revised preliminary plan has not been received yet. Ald.
Prochaska said there are 2 issues;the rezoning and the preliminary plan. There doesn't
appear to be any problems with the zoning, but the plan isn't ready for a vote yet. Table
this item to the next COW meeting unless the petitioner is willing to separate the zoning
issue from the preliminary plan approval. If petitioner agrees,then send zoning issue to
City Council on 11/5/98.
B-3 Parking Setback Revisions
Ald. Prochaska said this item has gone through the necessary committee reviews. Send to
City Council on 11/5/98.
Selection of City Planner
Ald. Prochaska said that EDC recommends Mike Schoppe as permanent planner. The
Ad-hoc committee interviewed 5 candidates, and Mike was first choice. Second choice
was Ruettiger, Tonelli & Associates, Inc. of Joliet. Ald. Spvng asked about Schoppe's
billing for travel time. Mike Schoppe said that he does not charge for time and mileage
for travel to meetings, but that he would charge for touring sites. Jim Nanninga
recommended that Ruettiger, Tonelli & Associates be used if Mike Schoppe's caseload
became too big. Both Ruettiger and Schoppe agree to this. Ald. Prochaska said a
resolution would be needed for both. Send to City Council on 11/5/98.
Farm Bureau Parking Agreement
Aid. Prochaska presented a draft agreement dated 10/27/98 for the property east of the
east alley between Van Emmon and Hydraulic. The Farm Bureau will be responsible for
any environmental problems that existed prior to the date of the agreement. Revise
Section 7 by listing the actual addresses for the Record and Hega buildings. Revise
Section 10 by saying"bituminous asphalt concrete paving"instead of"blacktopping".
Revise Section 11 by saying"events as approved by the Mayor or City Council"instead
of"festivals such as Yorkville Hometown Days for temporary booths or temporary
gaming."
Ald. Spang suggested that the 4 parking stalls to be used exclusively for the Farm Bureau
should instead be identified as being used by the owners of the property that currently
belongs to the Farm Bureau. City crews will do all necessary utility work required by this
agreement. No fees are payable to YBSD since the buildings are already connected. Take
this agreement to City Council on 11/5/98.

Cable TV Ordinance/Consortium
Ald. Sticka met recently with the other towns that would belong to the proposed
consortium. Minor changes need to be made before the ordinance can be adopted to make
it specific to Yorkville. Concerns were expressed about some of the items in the
ordinance. Take this to City Council on 11/5/98,but table it there if all issues are not
addressed by then.
Y2K Computer Technology Update
Ald. Kot said that the Police Dept. is creating an inventory of all city computers and
equipment that may be affected by the Y2K problem. Chief Graff said that Novell is the
system of choice. The new payroll software must be online by 1/1/99. Mayor Johnson
asked if we need to go to bid for this. Chief Graff said that the total cost is under$10,000
and Administration needs to get online quickly. Take this to City Council on 11/5/98 with
quotes from vendors.
Aurora Tourism Council
Ald. Burd brought up an item as additional business at this time because she had to leave
the meeting early. She is Yorkville's representative on the Aurora Tourism Council. The
ATC wants to know what Yorkville thinks about the future ring road around the Chicago
metro area. Preliminary routes have this road between Yorkville and Plano. The
consensus among the aldermen was that the concept of a road in that general area was
acceptable, but they would want more details before committing to it.
Developer Deposits
Atty. Kramer said the resolution is done. It's based on acreage, and will give the city
administrator authority to waive the fee for small developments. Take to City Council on
11/5/98.
Greenbriar Pond Acceptance
The Greenbriar developer is requesting that the city assume ownership of the wet
detention pond in the Greenbriar subdivision. This was discussed by the Park Board this
past October. They expressed concerns with maintenance costs. Table this to the next
COW meeting. Get a specific recommendation from the Park Board.
Public Works Garage Floor
Joe Wywrot presented quotes for ready-mix concrete and labor to build the floor in the
new Public Works garage addition. The quotes from Kendall County Concrete and
Prairie Materials are nearly identical ($61.00 to $62.50/CY). The low quote for labor is
from Brick-Like Foundations for$3600. Go with 3 vendors by splitting the concrete
order between Kendall County and Prairie. All three quotes are under$5,000, so there's
no need to go to City Council for formal approval. Begin work now.
