Fox Hollow Annexation and Preliminary Plat-The Fox Hollow
subdivision is requesting that the School Transition fees be waived
for their subdivision, because the property would be rented to
persons 55 years and older. Fox Hollow is requesting this that
they be granted a special use permit . They had also requested that
the Land cash ordinance fees be waived. After the last E.D.C.
meeting that they attended, they have withdrawn the request for the
waiving of the land cash fees. Fox Hollow feels that their
subdivision of persons 55 and older would not affect the Yorkville
School District, therefore, they should not have to pay the
Transition fees . There was some concern from the City Council with
regards to the impact that the subdivision would have with regards
to the Bristol Kendall Fire Protection District and also the
Bristol Kendall P.M.S. services.
Dr. Engler, Superintendent, Yorkville School District felt that it
would not matter who would be living within the subdivision, that
whoever lived there would affect the City and the School District.
Even if the persons living within the subdivision, did not have
children, the persons living there may bring their families into
this area therefore creating the need for the development of other
subdivisions .
Alderman Prochaska was concerned that if the city were to waive the
transition fees, that this would someday lead to other per
contesting this matter and that waiving this fee would weaken this j
ordinance.
Anita Holmgren, School Board member, showed concern that all of the
persons working and living in this community are all working for
the betterment of the community and that the Schools are part of
the betterment, that we must have educated persons to help create
a better community.
Michael Crouch, School Board Member, showed concern with the
waiving of the fee that other developers would be asking for
waivers also. That a developer could present to the City Council
that maybe only 70$ of his development would be persons with school
age children. Would that developer request that 30V of the
transition fees be waived?
Alderman Prochaska also reminded those present that the transition
fees could only be assessed at the time of annexation. What would
happen if at a later date someone would move into one of these
units . This item would have to be written into the annexation
agreement so that it someone moved in with school age children,
that the fees would be assessed then at time.
This issue must be presented before Public Hearing and will be
scheduled on January 23 prior to the City Council meeting. This
issue may still be brought forth at the 1-,16-97 C.O.W. meeting and
on 1-21-97 at the E.D.C. meeting.
Garling Subdivision-Parts of this property have been sold off over
that past few years. The property is currently being redivided and
will have to be looked at to see if this property will fall within
the Subdivision Control Ordinances . The property is currently
zoned B-3 . There is a need to determine if there are nay non-
conforming issues to the B-3 zoning. There were also concerns for
the re-building issue on the properties that have already sold off
and have pre-existing structures on them. It is to be determined
what doesn't conform and presented at the next city council meeting
on January 9 .
Property Orange and Mill-There seems to be some concern with the
redividing of the property at the corner of Mild, and Orange i
Streets . It seems that there is a need to review the standards
that are used prior to the issuance of building permits, for future
reference. This matter is to be placed on the agenda for the next
E.D.C. meeting, to set in place specific policy or guidelines for
the older established property within the City of Yorkville.
Undesser-This matter will be tabled until the January 16, C.O.W.
meeting.

Park Standards-There has been an update to the Land Cash Ordinance.
The Parks Department, Joe Wywrot, and the Recreations Board have
seen the corrections and are in agreement . This matter will set a
standard for the wet areas in subdivisions so that a developer can j
not use the area of lakes as Parks set aside property. This item I
is to be placed on the January 9 council meeting agenda.
Additional Business:
A reminder that the meeting with the Bristol Sanitary District will
be held on Tuesday, January 7, at 6:00 PM.

The large lot zoning ordinance is being revised. and will be
returned to the C.O.W. meeting on January 16. These changes
include the pavement of driveways, and also addressed the issue of
City sewer and water vs. individual septic and wells. if city
sewer and water passes within 254 feet of property that has well or
septic failure, they must hook on to the city water and septic
lines.
The Public Works meeting change is for January 22 .
Alderman Callmer has noticed that the light that shines on the flag
in "Gazebo" Park is out and needs to be fixed.
Alderman Callmer showed concern to know if claims from the Yorks
and Corniels have been responded to. He was assured by Mayor
Johnson that they had been.
