Plan Commission Minutes 1991 12-18-91 n MINUTES OF THE PLAN COMMISSION OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS HELD AT THE KENDALL COUNTY BOARD ROOM DECEMBER 18, 1991 7 P.M. The December meeting of the Plan Commission was called to order by Chairman Harold Feltz with the following members in attendance: Harold Feltz, Don Ament, Larry Langeland, Bob Davidson and Anne Lucietto. Absent: George Stewart, Sandra Adams, Kevin Collman, Clarence Holdiman, Gail Digate, Tom Lindbloom and Louis Nauman. Others present: James Clarage, Don Peck, petitioner Jerry Lynch and Dick Swagger, engineer. The first order of business was the Public Hearing on the petition to rezone from R-2 to R-3 Special Use for Bed and Breakfast, the property at 507 W. Ridge Street. PUBLIC HEARING - PC91-12 The Public Hearing was opened with the swearing in of anyone wishing to offer comments on the above petition. Jerry Lynch is proposing purcashing the property at 507 W. Ridge Street, if the special use for bed and breakfast is granted. The house is located on Lot 12 and it is that lot only that the special use is being requested for. The house consists of 3 bedrooms, 1 for his use and the other 2 for the bed and breakfast. The Home Checkers went through the residence and found no structural problems. Ellsworth Windett made an objection, stating that if the request is granted, the special use remains on the property; however the Plan Commission members assured him that the special use would be for a bed and breakfast only and any other use would have to be applied for. Suzanne Brady, executor of the property across the street, made an objection stating that the subject property consists of the house plus 2 vacant lots and was concerned that the special use could be expanded. The Plan Commission members assured her that if the special use was granted, it would be only for Lot 12 which contains the residence. PC91-12 FINAL PLAT - ROLLING HEIGHTS SUBDIVISION Dick Swaggert, professional engineer for the Rolling Heights Subdivision submitted an updated Prelininary Plat which shows the sewer, water and contour lines. At the last Plan Commission meeting, 6 items were of concern. 1) Sewer main. Mr. Swaggert stated he met with the City Engineer. Fill was brought in and some of the lots will be served with gravity feed. 2) Storm Water Runoff. The detention pond is shown on Lot 12 . 3) Large cul-de- sac shows the island as requested. 4) Sewer easements shown. 5) Mainly on lots 11 and 15, the type of construction of a residence is shown. 6) All lots must be single family and shown that way on the final plat. Concern was shown that the 10 feet of concrete fill on Lot 12 will take 3 to 5 years before anyone can build on it. James Clarage made the following recommendations: 1. That a statement be written on the Final Plat stating that only one single family residence per lot can be constructed. 2 . Two concrete monuments to be shown on the recorded plat on corners that would be agreeable to petitioner's engineer. 3 . On Final Plat, drainage certificate is required by owner and engineer, not to adversely alter drainage flow. 4. In regards to the lots with substantial fill, wording on the plat should be "prior to issuance of a building permit verification on soil bearing capacity must be submitted before the permit is issued" The City Engineer has been made aware of the problems of low profile, compaction and new contours. Bob Davidson made the motion to recommend approval of the Final Plat of PC91-12 - Rolling Heights Subdivision, with recommendations of James Clarage and the City Engineer not sign off until the Preliminary Plat meets his approval. Anne Lucietto seconded. Roll Call vote carried as follows: Ament - yes, Langeland - yes, Davidson - yes, Lucietto - yes, Feltz - yes. Motion carried. PC 91-20 REZONE REQUEST FROM R-2 to R-3 SPECIAL USE FOR BED AND BREAKFAST AT 507 W. RIDGE STREET, YORKVILLE Bob Davidson stated that he owns property adjacent to the subject property. R-2 and R-3 Special Uses were discussed. The area is all single family homes. James Clarage recommended that the petitioner submit a Plat of Survey, a Site Plan showing improvements, an Overlay showing specific areas that will be used for the Bed and Breakfast, and also show buffers and the parking areas. It was suggested that perhaps this particular special use could be R-2 - Item 13 , which would be Planned Residential Development. Harold Feltz asked the petitioner to bring the information as recommended by James Clarage to the January meeting for consideration. PC 91-20 was tabled until the next regular Plan Commission meeting in January. Comprehensive Plan The Comprehensive Plan will be discussed at the January Plan Commission meeting.
