MINUTES OF THE PLAN COMMISSION OF THE UNITED CITY OF
THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS
HELD AT THE KENDALL COUNTY BOARD ROOM
FEBRUARY 19, 1992 7:00 P.M.
The February meeting of the Plan Commission was called to order by Chairman
Harold Feltz. The following members were in attendance;
Harold Feltz, George Stewart, Clarence Holdiman, Sandra Adams,
Anne Lucietto, Bob Davidson
Absent: Don Ament, Larry Langland, Gail Digate, Tom Lindbloom,
Kevin Collman, Louis Nauman
Others present: James Clarage, Atty. Dan Kramer, Don Peck,
Bill Baird, Mayor Ken Kittoe and interested citizens as
listed on the sign-in sheet on file with the minutes.
The minutes of the January meeting were presented and approved. The motion was
made by Bob Davidson, the second given by Sandy Adams. Voice vote carried.
The first order of business was a Public Hearing concerning the request for a
special use permit for a golf range (PC 92-2 Lee) . Those wishing to offer comments
were sworn in. Bob Lee presented the petition.
The property is located on Rt. 47 south of Mr. Lee's business and contains
approximately 18-19 acres. The front half is currently zoned B-3, the back half
is R-1. The property has been sold to Brent_ Schalhamer subject to the acquisition
of a special use permit for that portion of the property that is R-1 to allow for
the driving range. This use is permissable under the B-3 classification. The
back half would be where the balls would land; lights would not be directed
towards the residential area. Mr. Lee commented that the proposed use would be
appropriate for the area and suggested that any questions be directed to the owner
who could give more specific information related to the business.
Carol Wismiller received the following information in response to her questions:
business hours would be 10:00 a.m. - 10:00 p.m. seven days a week from the end of
March to sometime in October; peak periods would be late afternoon until 10:00
and all day on weekends; there will be a snack bar and vending machines; no liquor
sales permited; two nets as are customary with similar projects; minimal noise
from equipment.
Dale Butts of Yorkville Equipment asked which direction the project would face
and how it would be accessed. The driving range would face southwest and would
be accessed from Rt. 47.
With no furthers comments or questions from the public, Chairman Feltz closed the
Public Hearing and resumed the regular Plan Commission meeting.
PC92-2 SPECIAL USE PERMIT FOR GOLF RANGE (LEE)
Mr. Clarage initiated discussion cf specifics of the special use request and said
that they should be noted on the variance request to avoid any later problems.
Bob Davidson questioned the 18' strip of land designated for a driveway and asked
for clarification on the additional purchase options of the owner.

Mr. Lee stated that there would be one cut only off Rt. 47. This 18' driveway cut
would serve as access to this project, a proposed miniature golf range and the
additional 4 acres owned by Mr. Lee. Atty. Kramer said it would be legal as long
as all 3 properties would have reciprocal use.
Bob Davidson questioned the advisability of noting an easement for city sewer and
water at a later date.
Chairman Feltz suggested that the Plan Commission list any concerns related to
other than the special use request that the City Council should be made aware of.
Mr. Clarage summarized those points relative to the special use as follows;
1. No fences or fencing
2. No light towers or poles
3. No improvements or structures above grade
4. Only grass, open space, sand traps, target greens, water structures
In addition to the points listed above, the Plan Commission would like, because
this is a small part of a larger parcel that extends out to Rt. 47, to recommend
a minimum of 20' sewer and water easements. In regard to the property that does
extend out to Rt. 47, the Plan Commission wants it understood that nothing in this
review indicates any approval of the proposal as shown in the exhibits presented.
Bob Davidson said that the Council should make sure there is a 66' right-of-way
at the designated 18' driveway cut. Chairman Feltz agreed that 18' , is quite narrow.
Bob Davidson made the motion to recommend the zoning of special use for the golf
range under PC92-2 subject to the 4 conditions as summarized above. Sandy Adams
gave the second. Roll call vote carried as follows:

Davidson - yes Feltz - yes
Bob Davidson made a second motion to recommend to the City Council that they give
consideration to the concerns of the Plan Commission regarding the easements for
streets, sewer and water; cuts onto Rt. 47; the 66' driveway easement; and note
that the Plan Commission is not giving any approval on proposed use of the B-3
portion of the property. Sandy Adams gave the second. Roll call vote carried as
follows:

Atty. Dan Kramer opened discussion on the possibility of additional Agricultural
zoning as requested by the City Council. The addition of this classification to
the comprehensive zoning ordinance would serve the following goals -- (1) finalize
the boundary line with Plano as Eldamain Rd. and (2) address the concern of the
City regarding transitional fees. These fees can be charged at the time of annexation
or platting as long as the City and the developer agree. He presented two sample
ordinances from Plano and Oswego that utilize this type of zoning.

The Plano ordinance allows land to be annexed as AG; when the developer comes to
the City to request the change in zoning the transitional fees can be negotiated.
This ordinance allows additional residential building permits to the owner without
him having to change the zoning of the entire farm. Their criteria is one additional
building permit for a house without rezoning for every 20 acres. There are no
restrictions as to where or how many homes can be built.
It is Dan's opinion that the Plano ordinance may be too liberal in giving the
extra permits. It is necessary to offer something to the farmer in exchange for
annexation; perhaps a cap of 2 or 3 permits would be sufficient.
Discussion followed on the number of additional permits that should be offered and
the importance of having restrictions on the whole deal. Bob's concern is with
right-of-way and sewer/water easements and the relation of the single residential
homes to the overall concept. The important factor to include is to insure that
any proposed construction be brought to the Plan Commission to maintain some
element of control.
Oswego's ordinance was given as an example of the other extreme. They do not provide
for anything extra as far as additional building permits. There is no provision for
special or permitted uses in the AG zoning.
Atty. Kramer's suggestion is that the Plan Commission compare both ordinances and
pick out points that they feel could be utilized in an ordinance for Yorkville. He
will then draft a sample ordinance for approval.
Alderman Bill Baird asked that the matter of this ordinance be expedited. Some of
the landowners that could be affected by it have already been approached. Jim
Clarage suggested that the Plan Commission could ask the City Attorney to prepare a
draft that would lean towards the format of the Plano ordinance; if the draft
could be prepared for the March meeting it would save a lot time.
Bob Davidson feels that the additional permits be limited to 3 and perhaps include
the ability to negotiate and allow for more. George Stewart would like to see
one per 60 acres (like the County) . It was decided to let the City Attorney work
on the ordinance with the concerns of the Plan Commission in mind.
With no further business to discuss, the motion to adjourn the meeting was made by
Bob Davidson; the second was given by Sandy Adams. Chairman Feltz adjourned the
February meeting of the Plan Commission at 8:20 p.m.
