Plan Commission Minutes 1992 10-21-92 4 MINUTES OF THE PLAN COMMISSION OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS HELD AT THE BEECHER CENTER., AUSTIN ROOM OCTOBER 21, 1992 7:00 P.M. The October meeting of the Plan Commission was called to order 1j Chairman Harold Feltz with the following member in attendance: Harold Feltz, George Stewart, Clarence Holdiman, Sandra Adams, Tan Lindbloom, Kevin Collman, Anne Lucietto;;Bob Davidson (arrived at 7:10) Absent: Gail Digate, Buck Kolkmeyer Others present: Mayor Ken Kittoe, Alderman Gary Bown & Pat Clark, Atty. Dan Kramer, Alderman Bill Baird, Don Peck, and interested citizens as listed on the sign-in sheet on file with the minutes. The minutes from the September meeting were presented for approval. The motidn_,to approve was given by Tan Lindbloom; the second was by Sandra Adams. Voice vote carried. DEAN FISHER DISCUSSION WITH THE CITIZEN'S COMMITTEE Chairman Feltz said the Plan Commission has been requested by the City Council to work beyond what they normally would on a P.U.D. and other things what Chairman Feltz would call architectural and landscaping. Chairman Feltz's noted he had a list presented with the packet for Plan Commission with the Citizen's Committee Requirements. Based on attendance there are citizen's who are participating. Chairman Feltz asked if there was a spokesman for the Citizen's Committee. Dr. Hatcher replied he would be acting spokesman for the committee. Chairman Feltz stated he would like to start with Dean Fisher telling us what he plans on doing and the--Plan Commission will make comments and get comments from the Citizen's Committee. Dean Fisher stated he received zoning for Autostar and Midas Muffler. He would like to work up a list for planning and development that he can move forward to d^fin-a.1 architectural plan and submit thosefor final approval. Dean stated it would be easier to start at the front of the property and work backward to try to specify certain things that seem to be of concern. He will try to reach a consensus and he will take fintes as they go. Dean stated as you can see there is a deexcelleration length planned that will be as per the states approval and request. It will be a continuation of widening of that land coming down from Kentucky Fried Chicken for access to the property. The property will maintain the standard access which is standard two lane road going in. Please note the 50 foot set back are utilized and they have more than enoughi,set back on the side yard. Dean 'stated they are trying to get 30 to 35 feet on building set backs and they maintain a 22 foot set back in the rear. The property will require a condition of balancing and they intend to do the balancing to the rear of the property using that earth as berm affect. The retention will be done thru the parking areas and also in front of both buildings. Dean stated there is a major retention area planned in the front of the Carstar building on one side. The parkin is basic to the needs of these types of businesses. Dean stated he did not know Yorkville's requirement as far as handicap parkin, although he has placed the handicap parking area in front of each office. Dean said he was not sure how the city calculated the requirements. Is it October 21,'1992 - Plan Commission Minutes Page 2 based on square footage of the office or the building. Obviously these buildings are more service orientated than customer orientated. Dean said the front of the building area will be used for customers and the rest of the building will be for service so therefore he is not sure how much handicap parking the city will require at this time. Dean explained the buildings themself are of designer blocks structure and they will be covered with that block and the doors will be of aluminum with bronze type glass or shadow type glass. The Carstar door will have an architectural front system on it and will have the standing seem Woof. "_ The colors will be gray and off white designer blocks, with gray blocks interlaced with blue cap and blue standing seems. The roof will have a blue awning interlining in the front. The Midas Store will be the same but maintain a flat roof through out and will have a cap on the top also. Dean plans to plant trees and schrubbery on the premises for architectural settings and also to include and inhance the area to cover the parking and the cars and somethings that maybe of concern. He notes also the trash areas are at the corner of each lot and will also be of the same, cnnstruction material as the buildings. Dean said they left the grass area-in the back of the lot with no plans for it at this time, obviously as you can see with normal set backs, he actually believes maybe some water retention will be necessary since no other business in the area at this time are doing any type of retention and it flows right thru that lot and that location. Dean explained as far as the Midas Muffler goes, they have a franchise rule of no cars parked outside overnight. They therefore will not have any cars on the property overnight. Autostar would obviously have cars parked overnight. Dean stated that when you see that marry parking areas he should explain this. At any given time we can have anywhere between four and six3austomers at this facility, when it's up and running and at it's strongest point,we also could have two to three insurance appraisalls on the premises and doing estimating out of our facility. We will also have in the neighborhood of twelve to fourteen employees at it's strongest and peak point.Looking at customer based parking in front, insurance and delivery car area next to the Carstar building office and internal up front personal to one side number 50, 49 and 48 thru a slight over flow of parking for employees on number 41, 42 and ten spots numbered 11 thru 20 for employees. The storage area will be sixteen spaced there and use space on the other side. This facility when it is up and running can service at it's strongest peak point, 120 to 150 cars per month. Dean statedthey need as much parking spaces as they can. Dean added a little sideline,in the future the insurance industry is beginning to use his facility as a out board claim center and he feels that would be a strong point of this facility. In the back he will have an earth berming affect. He does not propose an iron fence he proposes a wooden fence because it will look nicer and he Uan design it more appropriately for the area. He intends not to have any barbed wire on the premises and will use a high tech security system with sensors in the drive and in the building. Dean agreed and aubmitted environmental technical labratories reports on the equipment he intends to use. The reports show there EPM and VOC levels are far below the expectations of the EPA at this time. He intends to install those and are willing under P.U.D. to have this specified that we have to meet or exceed the IEPA and EPA standards. He understands the confusion that may result in the mixing room. He has already found out they far exceed anything Yorkville has specified in any ordinance for the mixing room as far as-fire protection. He intends to use the New York System. Dean stated the Halon systems is outlawed and not recommended. It is recommended that October 21, 1992 - Plan Commission Minutes Page 3 you contain a fire and that is the design of the mix room at this time. The mix room has a containment floor,in other words a spillage floor and a troft so nothing can leave the facility¢_it also has a blow out panel in it. The Midas Muffler store has an above grouNd hoist and does not use an underground hoist because the EPA is concerned if the underground hoist leaks it would contaiminate the underground. Dean stated as far as water retention goes he will meet the specifications of the state and city requirements. He would also like it to be knowdeverything will be paved and not gravel. Dean asked if there were any questions or comments he could possible answer. Chairman Feltz stated he would like to start with the landscaping because bhAts the first on the Citizen's Committee Requirements.and Jim Clarage has been doing some work on the print you submitted to them. Jim Clarage asked if Dean had a landscape plan that reflects previous comments and concerns of the Plan Commission in regard to berms and tree planting? Dean replied no that he was waiting for the discussion to take place and he wanted to make sure we- are'-all together on the length, height and ect. of the trees and berms. Dean-sdi.d he can spec these for them on the final plan which they intend to do. Jim Clarage asked Dean to look at the big picuture a few months ago, to take cross sections t1mu the property and those cross sections were to slice thru the property and go into residental areas and into areas ajason to where there are existing buildings so the Plan Commission in evaluating your proposal or helping you or your consultant when they laid out berms and landscaping would be able to see very clearly where the site problems are and where the buffering would be. Jim then asked if he had done cross sections thru for sight lines and visual impact of what he was proposing. Dean replied no. Jim stated you have to do this first and that will answer alot of questions for you. Dean stated he got busy with something else and that is why he was not able to meet that request at this time. Dean said he will definitely put it in his plans. Jim recommended that Dean need-;quite a comprehensive landscape plan proposal and recommended he not put parking in front of the building on Route 34. If your going into detail solution which is required by P.U.D., Jim thinks Dean should show existing topography on his exibit and final engineering. Dean agreed to do this.if there is not going to be a committee designing this project. Dean said he will incur that expense but the point their at now, we've spent three months "dancing around this project" in an unbelievable manner and don't think anyone would spend thousands of dollars in lay out and engineering time under the circumstances. Dean said he is ready to do this but we need to get on with it. That's why we're here tonight. To make sure we have an absolute idea on iahat the Planning Commission needs from them. Dean asked if the Planning Commission is going to act of the ridiculous letter of requirements by the Citizen's Committee. Chairman Feltz said he can not promise Dean what he brings in won't be changed but he would have to start somewhere. Dean stated he defnnetly does not want Yorkville to set presidence over his business. Chairman Feltz stated there may be potential, but there a long way from that point. Bob Davidson stated he feels there are two things to give direction on: 1) Input on height, type of fence and what type of bushes and trees the Commission will except and let him put it together. 2) Lets give him the input and guide lines to follow. October 21, 1992 - Plan Conrdssi.on Minutes Page 4 Chairman Feltz and the Plan Corrimission agreed'to put the landscaping issue aside until a better lay out showing fencing height, earth berms, elevation ect, is presented. Chairman Feltz asked for input on the parking/storage issue. Jim Clarage replied there is a sixteen foot minimum required handicap parking with proper ramps and designation. That is state law. Jim wants some kind of loop in the parking area instead of dead ends so emergency vehicles can turn around with out backing up. Chairman Feltz asked how many vehicles in the Carstar process would be provided parking for. Dean replied thirty spaces for storage. Chairman Feltz asked how the ca mission felt on the quanity of vehicle's and parking places. Bob Davidson if parking one thru five were for custcmers. _Dean replied yes. Bob Davidson asked if 6,7,8,9 and 10 were for customers and insurance people. Dean replied yes. Chairman Feltz asked if the Plan Camission was in agreement on the number of parking spaces and the thirty storage spaces. All agreed. Chairman. Feltz pointed out that the Ccmynittee:. would like to see hours of 9:00 A.M. to 4:00 P.M. George Stewart asked this to be stricken and move to the next item on the list. Chairman Feltz referred the hours of business to Atty. Dan Kramer. Dan replied the EPA has daytime and night time decimal levels which must be abided and if the decimal levels exceed the EPA they do have the right to restrict the hours the business is open. Bob Davidson asked Atty. Dan Kramer if the property is. sold under P.U.D. would all requirements be the same for the new owner as it applies for Dean Fisher. Dan replied yes they would and if they were not followed, the special use permit would be revoked. Chairman Feltz asked if the-Plan Cmmission if they would agree or disagree with letting the EPA or Governmental requirements govern the adequate business operation hours. All agreed. Chairman Feltz asked Dr. Hatcher if he was aware of the cost to do testing on this facility. Dr. Hatcher replied no. He continued to explain that most of the citizens and himself were not familiar with what quality of equipment Mr. Fisher would be using. Dr. Hatcher stated in order to understand this, the EPA and IEPA specifications need to be made available to them. Chairman Feltz asked Mr. Fisher to provide the Citizer°r':s Ccrm ittee with these spec s. Mr. Fisher agreed. Chairman Feltz asked Atty. Dan Kramer if the city would allow occupancy permit before the equipment would be tested or the facility tested to meet EPA requirements. Dan replied he highly doubted the insurance company would allow operations to begin with out having the equipment and facility checked. Dr. Hatcher requested all specifications on the machinery and equipment be submitted to him so the Citizen's Caffrittee can review it before it's in it's final phase. Atty. Dan Kramer suggested two things on this special use permit: 1) When Mr. Fisher conmiits to what type of equipment is going td-be used,_,to give those specifications reports regardless if an independant contractor or independant labratory conducted the test. 2) When it is put into use, make sure to have it monitored by a qualified person who will not charge either of them an arm or a leg. Don Peck, City Administrator said the EPA has guide lines for all this and that would be a good place to start. Chairman Feltz suggested everyone be tested who will be contributing to the community. October 21, 1992 - Plan Commission Page 5 Chairman Feltz also recommended Mr. Fisher to provide to the city engineer the certified specifications on the equipment. Anne Lucietto stated she as an engineer who works with VOC nuclear systems has seen the equipment Mr. Fisher plans on using and was amazed because it is so close to alot of the equipment she puts out as far as gas treatment systems. For a litte paint system she was impressed. Anne stated that Mr. Fisher's equipment have carbon activated filtration systems and a temperature sensor that cuts of at less than 112 the fire rating of the paint. She also 'stated IPEA has the right to randomly test the business. Chairman Feltz stated the one thing they are going to leave open is the testing methods. This is so the Plan Commission and the Citizen's Committee will be able to get more information on methods of testing and the cost of testing. Chairman Feltz noted the Citizen's Committee is looking for 4,000 gal/hr with a 10" main for fire protection. Don Peck, City Administrator stated the ISO class 6 is what the City of Yorkville is using. The 7,500 foot square building with a height of 15 feet this relates--to a chart which is used by the Yorkville Fire Department which is under guidelines of the National Fire Protection Agency. Don also stated if you go thru the cubic foot requirements of Mr. Fisher Building, this relates to the 14,000 total gallons per fire at a rate of 750 gallons per minute. Tan Lindbloom, Assistant Fire Chief, sa±d 750 gallons per minute will be adequate for this building. Don Peck asked Dr. Hatcher where he received his information on the 4,000 gal/hr figure. Dr. Hatcher turned that question over to Ron McClaron. Mr. McClaron said he received his information from a fireman in Boling Brook and that from what he understood this firefighter was an expert. Chairman Feltz noted there are three fire hydrants ajasoned to the property. Mr. Tom Lindblom stated that was sufficient. Jim Clarage asked Mr. Fisher to bring to the next Plan Commission meeting a preliminary plan which shows floor plans, elevations and section details which calls out brick, metal ect. Mr. Fisher agreed to do so. With no further comments evident on the topics listed on tonightks agenda, the motion to adjourn was requested. Larry Langland so moved; Tom Lindblom gave the second. Requires 4000 gal/hr for 4 hours above normal usage. 10" Water Main. Should be available from 2 directions. Spray booths: Halon fire suppression system.
