THE VILLAGE OF YORKVILLE, KENDALL COUNTY. ILLINOIS
HELD AT THE KENDALL COUNTY BOARD ROOM
OCTOBER 20, 1.993 7:00 P.M.
The October meeting of the Plan Commission was called to order by
Chairman Harold Feltz with the following members in attendance;
Harold Feltz , George Stewart, Clarence Holdimam,
Lawrence Langland, Sandra Adams, Michael Crouch,
Tom Lindbloom, Anne Lucietto; Bob Davidson
Others Present: Mayor Kittoe, Attorney Kramer,
Alderman Prochaska, Administrator/
Engineer Don Peck , Planner Jeff
Palmquist; Alderman Jones
' Chairman Feltz asked if there were any additions or corrections
to be made on the September minutes.
Hearing none, the motion was made to approve the minutes as typed
by Tom Lindbloom; seconded Bob Davidson . Voice vote carried.
PC93-16 - Annex & Rezone to City R-1 - Jerald Hanson
Chairman Feltz called the public hearing of PC93-16 to order.
Chairman Feltz asked if there was anyone here representing this
parcel .
Attorney Tom Grant stated the property is situated on the south
end of town on Route 47 east side and it' s immediately ajacent to
the County Highway Department property . The current use of the
property is basically Jerry ' s residence. The current zoning of
the property is Ag. We desire to bring it into the City , we want
to zone a portion of it to an R-1 Residential and the balance of
the property we want zoned B-3 Service Business District.
Jerry ' s plans right now is to develop the property adjacent to
the Highway Department with the mini warehousing facility .

Tom Grant stated he would like to answer any questions at this
time.
Larry Langland asked if Jerry would come into the B-3 property to
the south side.
Jerry Hanson replied we would like to use the present driveway
for access to the property .
Bob Davidson stated it looks like the mini warehouses are going
to land lock the rest of the property . We have to assume your

going to sell someday and I think it needs to be addressed that a
road can be put in here and are we going to address the rest of
the property at a later date.
Tom Grant stated were not asking for any subdivision approval at
all . The line shown on the map is strictly for zoning purposes.
This is not a subdivision at this point.
Jeff Palmquist asked if Jerry has considered just coming in all
as B-3 and have the house be non-conformant for the life of there
time at that residence.
Tom Grant replied we would just as soon not. If we had a fire
out there we couldn' t rebuild.
Dan Kramer stated you could always do it in the annexation agree-
ment. But the morgage market now is a little bit touchy about
that. It doesn' t have the proper zoning, it could be difficult
to get refinanced.
Dan Kramer stated we could put in the annexation agreement that
when it ceases to be used as a residence that it automatically
converts to B-3.

Bob Davidson stated the only problem with that is the easements.
Dan Kramer replied that could be put into the annexation agree-
ment.
Chairman Feltz asked if there was any easements that needed to be
put in.
Don Peck replied he would like to see an easement on Route 47 for
the sewer. '
Chairman Feltz asked how many feet would you be looking for.
Don Peck replied about 25 feet.
Chairman Feltz asked if there were any further questions or com-
ments. '
Hearing none, Chairman Feltz called an end to the public hearing

PC93-17 - Annex & Rezone to City R-2 - Christopher Valentine
Chairman Feltz called to order the public hearing of PC93-17.
Chairman Feltz asked if there was anyone here to represent this
parcel .
Chairman Feltz stated they will go on with the public hearing.
Is there anyone who has any questions or comments.
Randy Moore stated that there are questions that pertain to all
three parcels.
Chairman Feltz asked if they can do all three at once or should
they be done individually .
Dan Kramer replied in this case it might be better to do all
three. With the first two thos particular parties are not in±er-
ested in developing at this time. They would simply give con-
tinuity for the third parcel . I think the third parcel is what
everyone is interested in.
Bob Davidson recommended taking PC93-17 - Valentine and PC93-18 -
Herren together.
Dan Kramer replied he would table the first two and just continue
those until a future date.

Dave Powlowski stated it doesn' t appear to be very positive when
no one is here to represent the Valentine and Herren properties.
'
Tom Grant replied that I do represent both the Valentine and Her-
ren property . They have agreed to go along with an annexation if
it facilitates development. They have no current plans to
develop.
Chairman Feltz stated the public hearing on this specific
property will be deferred to a future date.
PC93-18 - Annex & Rezone to R-2 - Josephine Herren
Chairman Feltz stated the public hearing on this specific
property will be deferred to a future date.

PC93-19 - Annex & Rezone to R-2 - Oliver & Niles
Chairman Feltz called the public hearing of PC93-' 19 to order.
Chairman Feltz asked if there was anyone here representing this
parcel.
Jim Olson replied I ' m the land surveyor and planner in town and
will be preparing the plats and drawings for the Oliver property .
The Valentine property is 17 acres and the Herren property is
about 56 acres and the Oliver property is 141 acres. Of that 141 .
acres we will be presenting developing plans for 84 acres west of
Cannonball Trail . The total combination of all three parcels
then is 214 acres. In order to serve the property with sewer and
water, it will be necessary to extend those services from the ex-
isting Amurol site thru the village and up to the Oliver
property . Thats about 8,000 feet of sewer and water. The total
expense for that will be born by the developers of the Oliver
trak alone. The Valentine and Herren parcels are not contribut-
ing to that and as part of that school , Bristol School will be
hooked up to the water and sewer at no cost to the school dis-
trict. That will be done by the developers.
Jim Olson stated we are sensitive to the fact that Bristol is an
existing village. We are not trying to obliterate that by bring-
ing it all into Yorkville. It is necessary in order to extend
the sewer and water to annex into town and there not being any
corporate body in Bristol , we can not annex to Bristol . We think
this is keeping up with the county growth and development of the
cities out of the areas can be served with sewer and water rather
than have county lots on well and septic. The current develop-
ment parcel and I ' ll briefly outline what were thinking of doing.
We' re looking for some input as to what might be the best route
to go for developing the property and input from the local resi-
dents as to what they would like to see. We' re proposing the
westerly 84 acres be done solely as residential with no commer-
cial . There is no multi-family . We are proposing .some duplex
lots as there are in Prarie Park . There is a low area that ex-
tends from behind the Bristol Township Hall and runs up parrell
to Cannonball Trail and we propose about an 8 acres lake to be
built in that area with homes around it. There is another low
area in the northwest corner of the property which will be open
space of some sort and then we have park site directly next to
the area where Charity Lane comes in. We are asking for an
average lot size of 12,000 square feet and a minimum lot size of
10,000 square feet, a mininimum lot width of 75 feet for single
family . We would be asking for a slight reduction in the 100
foot width for the two family dwelling and a slight reduction in

the lot size of 15,000 square feet. The reason for that is the
type of people that are buying those units are not interested in
alot of maintenance. Part of the argreememt will include recap-
ture rights for the extrordinary cost that are being incurred.
We would ask the City to collect for the developer some reim-
bursement for the sewer & water extensions. We would ask that
the same peramaters what ever developed for this 84 acres could
be applied to the eastern parcel if that were to be developed in
the future. We will abide by the school impact fee and the City
impact fees. There will be no variations sought in any other or-
dinances. We would propose one entrance on Cannonball Trail in
mark of the lake area and one entrance from Corneils Road where
the west street goes up just west of the Bristol Township Hall .
There is one other street which extends into the property from
the south, I believe thats called Charity Lane and that we will
not extend. The 200 units would break down to 120 single family
lots and 40 duplex lots.
Jim Olson stated he would like to answer any questions at this
time. ^
Randy Moore stated this ha s a significant impact on this area.
The density and the type of houses you put up there is going to
define the roll Yorkville is going to play . We want to keep the
rural atmosphere, we don ' t want a Boulder Hill or a Naperville.
We see zoning that splits Bristol right down the middle. Your
not annexing Bristol but your going to go right down the middle.
Nobody ' s yet discussed where sewer and water are gonna rum. It' s
gonna run right down Cannonball Trail even though we don' t want
it. Your gonna tear out our trees, get our easements and your
run down there. We' re not against developing this land. I want
it developed at County standards which is one acre lots and pre-
annexation to Yorkville. Density is a big issue on this whole
thing, also look at infra structure. Yeah you can get sewer and
water out there but it also needs police protection and road
^ care. It' s very obvious this isn' t good for Bristol . The ques-
tion is, is this good for Yorkville.
Bryan Jaffke stated the acres for lots concern him as well as
duplexes being in Bristol . I ' m not against annexing into
Yorkville as long as it' s done the correct way . I ' m totally
against the concept of these buildings.
Jed Parish asked why didn ' t the developers meet with the Bristol
Township Board instead of going directly to Yorkville.
Harold Oliver replied we really didn' t know who to talk to first.
It' s like a catch 22. We' ll be glad to meet with Bristol in
regards to this development.

Jed Parish asked why they couldn' t stay with well and septic in-
stead of going with water and sewer.
' Harold Oliver replied the soil is not as good in that area. for
the wells and septic.
Chairman Feltz asked if there were any further questions or com-
ments.
Hearing none, Chairman Feltz called an end to the public hearing
of PC93-19.
PC93-8 - Annex & Rezone to City A-1 - John Conover '
Chairman Feltz called the regular meeting of the Plan Commission
to order.
Tom Grant stated that his comments also pertain to PC93-10 - John -
Lies. Rather than going to any specific zoning classification,
they want to bring those two parcels in under Ag classification.
Don Peck stated he had a meeting with Jeff Palmquist, myself and
all of the Conovers and that was the consenses. They want to go
City A-1 .
Chairman Feltz asked if there were any questions or comments on
this parcel . '
Hearing none, Larry Langland motion to recommend to the City
Council the zoning and annexation from Kendall County Ag to City
A-1 ; seconded George Stewart.

Chairman Feltz asked if there were any questions or comments on
this parcel .
Hearing none, George Stewart motioned to recommend to City Coun-
cil the annexation and zoning from Kendall County Ag. to City A-
1; seconded Anne Lucietto.

Chairman Feltz called the regular Plan Commision to order on
PC93-16.
Chairman Feltz asked if we could ask for our easements.
Dan Kramer replied it can be put in the annexation agreement,
just put it in your motion.
George Stewart asked if anyone knew what the zoning to the north
and west is.
Jerry Hanson replied he thinks it' s M-1.
Jeff Palmquist stated that was correct the zoning to the north
and west is M-1 with a little R-4.
Bob Davidson asked on B-3 zoning, the set back line is on the
side yard 20 feet. I think for set backs we ask for 25 foot
easement on th side and back for utilities.
George Stewart asked if that was the easterly boundary.
Bob Davidson replied the north, south and east.
Don Peck stated if he had 10 foot on the north, east and south
sides with a 25 foot in the front that would let you split with
the other people so he' s not taking the whole easement off the
south.

Tom Grant stated when they go to plat, ask for your easements
then.
Tom Lindbloom motioned to recommend annexation and zoning to City
Council as presented; seconded Anne Lucietto.
Bob Davidson recommend ammending the motion to include 25 foot
along Route 47 and 15 foot around the property on the three
property lines. ; seconded George Stewart. Voice vote carried the
ammended motion.

Tom Lindbloom stated I would like to express my frustration is
that the note that we got said there was going to be a map here
tonight. There is not. The documents we have says see attached
` list for contigous land owners, that is not accomplished. This
material was delivered on Monday morning, which gave me Monday
night and Tuesday night to review. I feel somewhat bad for the
people who showed up tonight. That when we couldn' t do our thing

here because the homework was not don b h y whomever. I don ' t
think the City comes across as having ther homework done either
way . When there are so many unanswered questions coming before

a public hearing and these people waste there time as well as our
time to come here and we can' t address the problem cause we
haven ' t got the tools to do it.
Chairman Feltz stated I think the people who do have there things
in, that we get it earlier. If they don ' t have the material they
can be left off the agenda.
George Stewart asked Jim that he had mentioned earlier that your
only having two streets one to Cannonball and one to Corneils,
it looked like there were two dedicated streets possible going
north.
Jim Olson replied all will be dedicated streets.
Bob Davidson stated we need to look at the storm sewers.
Chairman Feltz asked if there were any questions on density .
Bob Davidson stated he feels we need to see what the petitioner
brings back . They heard the same things we heard tonight.
George Stewart asked what they ' re asking for in lot size. How
large is the large and how small is the small .
Jim Olson stated the smallest is around 10,000 feet.
Bob Davidson stated there needs to be some consideration to the
lot size and I do agree that duplexes are not the right thing up
there now.

Jeff Palmquist asked if they are asking this to be processed just
a straight annexation of the 141 acres at R-2 with attached list
of variations.
Jim Olson replied there asking for annexation and Planned Unit
Development~
George Stewart asked the road that you propose along Cannonball ,
all the subdivision access would be from within the subdivision
and not having any access driveways on Cannonball .
Jim Olson replied there would be three ' or four houses, there
larger lots which would go out onto Cannonball as the ones do
now.
. Tom Lindbloom stated from a running of the City services, does
this make sense to have this island up there that far away from
providing police protection, and providing the kinds of services

that the inner city is now provided. What' s the additional cost
going to be and is it worth it.
Chairman Feltz asked if there were any father questions or-com-
ments on this parcel .
Hearing none, Chairman Feltz called on end to PC93-19.
With no further comments evident on the topics listed on
tonight' s agenda, Chairman Feltz adjourned the meeting at 10.00
p.m.
