MINUTES OF THE PLAN COMMISSION OF THE
The March meeting of the Plan Commission was called to order by Chairman
Tom Lindbloom at 7:00 P.M.

FEBRUARY MINUTES
Mr. Crouch moved to approve the February minutes as submitted. Ms.
Lucietto seconded the motion On a voice vote all members present voting aye.
Motion carried.
PUBLIC HEARING PC 97-1
Requesting a Special Use Permit to permit the sale of motor fuel as per
Ordinance 10-7C-2. The holder of legal title is Charter Bank Trust#333 and the
holders of the Land Trust are Nicholas Syregelas and family. The property is
located on the northwest corner of Rt. 47& Rt. 34. The applicant is Thornton Oil
Corp. by Mark Wardlaw.
Chairman Lindbloom swore in all who wished to speak at tonight's hearing.
Mark Wardlaw, Director of Development for Thornton Oil Corporation addressed
the Commission. He stated that Thornton Oil Corporation is a privately held
company based out of Louisville, KY. They own and operate 135 convenience
retail centers with gas in 6 states. He stated they run a clean and professional
operation.

This property is located at the intersection of Rt. 34 & Rt. 47. It is zoned for
retail but the Yorkville ordinance requires a Special Use due to gasoline being
involved. There have been two meetings with the Planning Staff to review the
plans. Mr. Wardlaw presented a plan with no variances. He said they are
preparing to observe the drainage requirements. They have presented their
plan to the Illinois Department of Transportation and have a letter of approval
from them for the right of way access. The plan incorporates a 3,800 sq. ft.
convience store with a canopy and 8 fueling pumps.
Dave Palowski of the Bristol Plan Commission expressed that this is an
excellent comer for a gas station but feels the biggest problem is that there will
be liquor sales. He added the other two gas stations on that comer already sell
liquor as do other gas stations in Yorkville. He is concerned that liquor will be
purchased and consumed by drivers which may lead to accidents. Mr. Palowski
also stated that the landscaping should be done attractively to enhance this
area.
Ms Lucietto moved to adioum the Public Hearing, Mr. Crouch seconded the
motion On a voice vote all members present voting ave. Motion carried.
NEW BUSINESS
PC97-1 Thomton Oil Company
Dave Dockstader asked if anyone has addressed left hand turns out of either
entrance. Mark Wardlaw said the Department of Transportation feels that they
will have consistant points to those that are currently existing on Rt. 47.
Jeff Palmquist asked if this was an existing out lot. Mr. Wardlaw said this will be
a sub divided lot but there is not a user for the other lot now. They are
proposing one entrance off Rt. 47 which will share access with Rt. 34. This
access will be put in at the same time. There will not be room for additional out
lots to the north on Rt. 47. Mr. Wardlaw said the detention has not been fully
worked out at this time and they do not anticipate changes to the site plan.
If there has to be many changes to the site plan, they will not proceed
developing the site.
Mr. Wardlaw addressed the various landscaping issues with green areas and
the set backs. He said they are willing to work with the landscaping
requirements. Mr. Palmquist said he would recommend landscaping along Rt.
47 in the 10 ft. parkway and a planting strip separation along the pavement on
the north side.

Mr. Wardlaw addressed Mr. Palowski's concern of the liquor sales. He stated
Thornton Oil does not sell hard liquor but will sell beer since the competitors do.
Their employees will undergo extensive training on the sale of alcohol to minors
or intoxicated individuals. He stated the national standards show that
convenience stores are not the culprit for drunk driving. He said they take this
issue seriously and do want be held liable to any form of accident.
Mr. Wardlaw stated that all of their underground tanks are regulated by the State
Fire Marshall, and their permit is secured by the State which then goes to the
local Fire Marshals for inspections. They work with a tank instillation company
out of Chicago and use a three tier system for monitoring.
Tony Graff asked if this would be a 24 hour operation, which Mr. Wardlaw
replied it would be. He also asked if the lighting would be included in the
environmental design for security purposes and if directional lighting would be
used. Mr. Wardlaw responded that they use security lighting on the rear
portions of the buildings. They primarily use 90 degree cut off lighting and
illuminate their lot with low energy lights. Mr. Graff stated that retail thefts tend
to be high in large volume gas stations. Mr. Wardlaw said that the pumps are
controlled by the cashier and they have pay at the pump. The company has a
low percentage of theft.
Mr. Wardlaw presented the architectural drawing of the building. It has split face
block on the first 4 feet and tile, a glass atrium and an awning. He explained it is
their new prototype and is professional looking. They are breaking ground on a
store in West Dundee.
Mr. Wardlaw stated their dumpsters are completely enclosed with four foot split
faced block. It will look like an outbuilding with the same architecture. There will
not be a car wash facility.
Ms. Homvan-Toftov moved to recommend the petition for approval. Ms. Adams
seconded the motion. On a roll call vote, all members present voting aye with
the exception of Mr. Jones who voted no. Motion carried 7-1.
PC 97-2
AG to A-1 Special Use MJ Farms
This petition came from Kendall County. Attorney Jim Olsen represented the
petitioners Mike and John Rosenwinkel. The property is located on the north
side of Galena Road, the second farm east of Rt. 47. The tower would be 400 ft.
The tower site of 8 acres would be immediately behind the farm buildings on the
north side of the road. The purpose of the tower would be for the Rosenwinkel's
farming business.

They farm in DeKalb County and run trucks to Morris and are getting out of their
radio capabilities. Other farmers in the area would be able to lease tower space.
There could be one or two commercial users also.
Mr. Olsen said the petitioners have appeared before the Bristol Planning
Commission and have a township public hearing scheduled for the end of the
month. This hearing notice will be published. The immediate neighbors will
have certified notice when the county hearing takes place. The Rosenwinkel's
will still farm the 8 acres where the tower will be located but there may be a
fence around the tower if the commercial user desires. There will be a building
at the base of the tower which will house the equipment. The commercial users
may add some prefab type housing. He said they are far enough away from the
Aurora airport and the frequencies will be different. This request has been
submitted to FAA.
Mr. Palmquist questioned what would happen to the tower if the farm land is sold
for residential use in the future. There was discussion on having a tower
ordinance. Mr. Graff asked if they've discussed the possibility of allowing Public
Safety to have a free spot on the tower for emergency communication. Mr.
Olsen said there is a physical limit of what can go on the tower.
Ms. Homyan-Toftov moved to approve Petition#97-1. Ms. Adams seconded the
motion. On a roll call vote, all members present voting aye. Motion carried.
Comprehensive Plan Review Results
Mr. Palmquist displayed the new plan map and explained the proposed changes.
He will be providing smaller copies later. He reviewed the northwest area
changes and reorganizations. The community park sites were identified. This
will continue to be reviewed and discussed at a later time.

Ms. Lucietto moved to adioum the meetino at 7:56 p.m. Mr. Crouch seconded
the motion. On a voice vote, all members present voting ave. Motion carried.
