Plan Commission Minutes 1999 01-13-99 YORKVILLE PLAN COMMISSION CITY OF YORKVILLE KENDALL COUNTY, ILLINOIS January 13, 1999 The January meeting of the Yorkville Plan Commission was called to order by Chairman Lindblom at 7:00 p.m. Members Present: Tom Lindblom, Sandra Adams, Clarence Holdiman, Jack Jones, Dave Dockstader, Burton Callmer, Bob Wenman and Anne Lucietto December Minutes Mr. Callmer moved to approve the minutes as submitted. Mr. Holdiman seconded the motion. On a voice vote, all members present voting aye. Motion carried. Public Hearing PC 98-19 T&D Metal Products(Remline) Request for Annexation &Rezoning on the Corner Parcel Only Chairman Lindblom swore in all those wishing to give testimony. Attorney Jerry Hodge explained his client's request. He stated this is a "companion" piece to what was presented last month. This parcel is the comer lot located on Rt. 47 and Cannonball Trail. Mr. Hodge said the zoning is probably A-1 but there was discussion exactly what the zoning is. He stated there are no present plans for this property but the B-3 they are seeking fits into the city's Comprehensive Plan. Mr. Hodge said Remline has been cooperative with the city in the past by granting an easement through their property. Jim Rohrbach, 10 Amanda Ln., stated there was confusion last month about this property and upcoming council meeting dates. He said the zoning change should be considered when there is a specific use intended. Lary Casey, neighbor across the street, stated in the beginning this property was zoned A-1 and it was agreed upon there would be a buffer zone for the residents. He stated this was the"deal"with the county when the parcel was granted its current zoning and he does not want to see it change to B-3. Mr. Casey asked that the zoning be brought up when there is a specific buyer and use. Paul Buddy stated this would affect him because this property surrounds his. He agreed that the present zoning was intended to be a buffer. He opposes the B-3 zoning and asked that this remain a buffer zone. There were questions if the buffer zoning agreement was legally binding and is on the title. Jack Jones moved to adjourn the public hearing. Bob Wenman seconded the motion. On a voice vote, all members present voting aye. Mr. Hodge stated the reason for requesting zoning now is for the need of sewer and water for which the easements are in place. The consensus of the commission was for clarification of the zoning and buffer agreement. There was discussion if Remline would consider other alternatives such as a B-3 PUD. Mr. Dockstader moved to table the request until the meeting next month to investigate past agreements with the qty and the county and for Mr. Hodge to discuss the B-3 PUD with his dient. Ms. Adams seconded the motion. On a roll call vote, all members present voting aye with the exception of Ms. Lucietto who abstained. Motion carried. Adjournment Mr. Jones moved to adioum the meeting at 7:37 a.m. Mr. Wenman seconded the motion. On a voice vote, all members present voting aye.
