Plan Commission Minutes 1999 10-13-99 CITY OF YORKVILLE PLAN COMMON Kendall County Boaml Room October 13, 1899 7:OOP.M. He reviewed the agenda and stated that he would like to see the meeting progress as per the agenda. it was dlatennhrod that a quorum was In attendance. There was a review of the prior reeling minutes and a motion wes made my Andrew Kubota to accept the minutes as presented. The motion was seconded by 00 Wenman. The motion carried and minutes were approved. The meeting was then taken into Public Hearing for the item of PC 98-05,Cannonball Estates- Annexation and Rezoning. Alan Norton of Alan Date Farms and Development,Developer. See Public Hearing minutes attached. PC 89.68 Annexation a Rezoning Pn dhnhury Plan Camww*nN Estates. Additional discussion continued with regards to waiter retention,lot ace,access,and landscaping. Mr. Beads wed response to the issues. A berm would be added along Cannonball Trail and at a height of 7 ft. There would be an entrance both on Canmmbell Trat and Faxon Rd. The engineering report for the water retention and drainage he felt was W"uste. A comment made by Mr.Herne was made in concern of the water retention and It's capacity. He raised the concern of when the retention area Us with water that the water that Is In excess will back'up in the residerds basements. Mrs.Uggett was concerned with excess water flowing over Cannonball Trail. Mr.Jones stated that If the property and the detention area is engineered properly,the property should be adequately drained. Mr. Wywrot felt that the ground water would bads up some when the basin Is fled,however,the water will progress at a slower level and should not create a problem. Ms.L detto asked if the detention area was adequate to contain the volume of water necessary. Mr.WVmvt replied that they should be OK,but he needed added Information to confirm. Mr. Undbiorn was concerned with the k►ts located along Cannonball Trail. He stated that the lots were to be at least 112 acre and are currently listed at.4 acne. Mr.Jones suggested that the berm be reduced in size to entarge the lot sizes along Cannonball Trail. Mr.Undblom further stated that at the test meeting the Commission requested that the Cannonball Trail lots be at least 1!2 acre lots. Mr. Shoppe steed that the comprehensive plan showed the property to have 1 acre lots with extensive landscaping and a berm. Mr.Shoppe also suggested that sircler landscaping and a berm be placed on Fown Rd. After much discussion a request was made of Atty.Kramer as to the terns needed for this development. Atty. Knnrrror wed that it be divided into three individual items. Annexation. Zoning, and the Preliminary Plan. A motion was made by Andrew Kubota to sooept annexation with the following three conditions. 1 That all lots located along Cannonball Trait be at least 1/2 acre,2.The the cols akxg Faxon Rd. carry a buffer, 3.That the berm on Cannonball Trap be as designated by Mike Sipe in his letter dated 10-13.98. A motion was made by Lawrence Langla<nd to accept the Prerkrnnary Plan as presented wtlh the berm on Cannonball Trall and with a buffer along Faxon Rd. A r000mmendation was male to Mr. Norton that the lots airing Cannonball Try be clanged to at least 112 acre. Ms.Ludatto expressed to Mr. Norton that she was against the zoning bemuse of Me size of the lots,however,that didn't meant that she was in agreement with the people in opposition. PC 90460 Prelimkuwy Pain: Shadow Creek(fin 11/2 mites of the city Nmk) Information was presented by Mr. Hammer snowing thin his lore were an acre In size and also some were larger. The tats would contain n wells and septic. There was a review of comments by Mr.Wywrot. Mr.Shoppe commented that the property does mast the Comprehensive Plan and will follow with R-1 zoning,except for kit width. The average width is 140 fed and should be at 200 It. A suggestion was made to move the front yard setbacks and make them larger to make the d evelopnrent more open. A suggestion was made to add a trap system and to trove R a"n with the forest preserve property,since there Is no property set aside for parks. Thera was a concern with regards to city sewer and water from Mr. Langland and when the property Is surrounded by City property. After much discussion R was decided to vote can the PUD and the zoning. A motion was made by Lawrence Langiand that the property should conform to Cout#y R-3 P.U.D.. The motion was seconded by Jeff Baker. . At that time Mr. Niles felt that if the water and sewer were to go through the property that It would make sense to further develop the property he awns. The concept plan of Mr.Niles showed the Teri Ln.to form a culdesac. Mr. Shoppe questioned Mr. NNW why he would not have Teti Lane continue through Mr.Marker's development to the north. Mr. Niles stated that he would not extend the road through,because of the add traffic than It would allow. Mr.WywM stoted that with the length of the street that it should be a through street and not a cwidesac. The consensus of the Commission was that they were OK with the land use,compatibility to the area, and the lot sizes,however,they did not agree with the c uldesac. PC WIO Concept Plan-Fox River Estates,Wyndham Homes,Phil Kniedm Ms.Robin Caldwell with Gary Webber Associates presented the project to the Commission. The project had 40%open space, a 14 acre park ar facent to the Fox River,2 acres of sized park area. The project contains 202 units with a density level at 2.1 units per acre. The lots are smaller with more open area. A homeowners association would be set up to maintain the open areas. The Commissions suggestions were to make the lots at lease 10,000 sq.ft. The padre area adjacent to the dw was not acceptable,because most of lt is in s mod plane. Thane was much concern because the development only contained one entrance and one street crosses the railroad tracks. The Commission also felt that the duplex anew was incompatible with the area usage. The Commission suggested that the lots be 12,000 sq.ftA0,000 only N the green space backed up to the smaller lots. They also suggested that the duplexes be taken out completely.to have the property conform to the surrounding area property,and to create a better treflfc pattem. Mr.Alan Norton spoke with regards to some of the changes that have been made to the preliminary plan. The number of lots has been reduced to 111 and are all single family lots. He has Increased the area for parks and has mlocaated it to one area that would consist of 1 314 ages. The storm and retention area has also been consolidated. Mr. Onto Koch, Cannonball Trail Yorkville,spoke with regards to the zoning plan. He is concerned with the R-2 zoning and feats that the property should be zoned R-1. He stated that 1 acre lots had been discussed at a prior meeting and are not included in the plan. He was also concerned with truck traffic. He would also like to see the homes located Wong Ca nnonbaq Tray face Cannonball Trail. Mr.DO Garbe, Hickory Ln.Yorkville,spoke with regards to the impact this development would have on the groundwater at this location. He distributed documentation that shows the depth of groundwater and the aquifer material In Kendall County. He has had experience with water Problems in the past and feels that this would possibly create a problem if the property were to be developed as drawn. He also has a concern with Wound water contamination. He also wPuSed concern wih ponds in the area. Mr.Veme Henne,Route 34 Yorkville,spoke with regaMs to water f oodkup and retention. He presented a picture that shows of the property after a 3 inch rain in February and stated that should be approAmately developed m as like manner of the swrou ng propertyyllocateded on Cannonball Trail. Mr.Mr.Joel Gilbert, Cannoolm Trail Yorkville,owns the property next to the retention area. He has concern that the road would not support all the additional traffic flow. He Is also concerned with the development changing the flow of the creek water and he would not be able to provide adequate care for his livestock. He also stated that the retention area is a wet comer and floods easily. He is also concerned that the change of the flaw in water will affect his septic bed. Mr.Jim Liggett, C.annonbag Trait Yorkville, complimented the board on the concern with the water issue. He stated that In years prior there has been some teems with the water supply. He also stated that frozen ground,similar to the picture presented by Mr.Henn*, is similar to blacktop and r+ools. He stated that there was a problem created with the water line nm along Cannonball Trall and that there were some inaccurate er~ng reports. He Is conoemod drat possibly 70%of the basements would be under wafter level. Yes,that with tho layout of the develop rent,the properly meets the R-2 zoning requiremwrts,however,he would UM to am ttes property developed similar to the surrounding property.
