Plan Commission Minutes 1990 10-17-90 MINUTES OF THE PLAN COMMISSION OF THE UNITED CITY OF
THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS
HELD AT THE KENDALL COUNTY BOARD ROOM
OCTOBER 17, 1990 7:00 P.M.
The October meeting of the Plan Commission was called to order by Chairman Harold
Feltz with the following members in attendance:
Harold Feltz, George Stewart, Clarence Holdiman, Don Ament, Larry Langland,
Tom Lindbloom. (Lindbloom leaving shortly after 7:00 p.m. )
Absent: Sandy Adams, Gail Digate, Kevin Collman, Anne Lucietto,
Louis Nauman, Ken Johnson
The minutes of the September meeting were presented and approved; the motion was
made by Larryland; the second by Don Ament. Voice vote carried.
PC90-31 -- PRELIMINARY PLAT / JOHN CONOVER / 4TH SUBDIVISION / RT. 34
Mr. Tom Javorik presented the preliminary plat stating that it was jointly done by
himself and John Conover. The property has storm & sanitary sewer and water main
on site to service the subdivision. The project conforms to subdivision ordinance
with regard to frontage, lot size, sidewalk and street lights. All items will
show on the final plat.
Jim Clarage noted that the preliminary plat approval requires certain items that
are not shown on the present plat; mixed zoning districts should be indicated.
Mr. Javorik stated that zoning divisions are at the center line of the streets or
at the back line of the duplex lots. Mr. Clarage also noted the following:
Lot 11 in the flood plain should show a drainage easement; the limits of
flood plain should be shown on the plat so the commission can see what lots
are in the flood plain and which are not. Soil types and surface flow need
to be shown (although not critical since sewer and water are available) .
A pond area is shown as part of the project but is outside of the limits;
the drainage easement should be shown and if the area is not platted with
another subdivision, why can it not be platted with this one? Regarding
the out lots, where is the right-of-way on lot #9? There also needs to be
a cross section through the typical road showing sidewalk, curb, inches of
stone and blacktop, etc.
Mr. Javorik stated that all items would be addressed on the final plat. Larry
Langland asked about the north edge of lot 9; if no access easement is present,
it should be shown on the preliminary. Mr. Clarage stated that this would avoid
any future misunderstanding. Mr. Langland also questioned the 50' right-of-way
noting that he has always had to buy extra for turn lanes. Mr. Javorik stated
that the proper right-of-way as they know it is shown on the plat. Fran Klaas
said that if additional right-of-way is required the state or the county will
require whether it is shown or not. Mr. Clarage also added that commercial setbacks
are not shown along the highway; Mayor Davidson stated that this would have to be
shown to protect against business being right on top of the highway. Fran Klaas
said that the required setback iS 20' for B-2 zoning. (Rear or side yard) . Also
to be shown on the final plat is the no access strip onto Route 34.

George Stewart questioned the buffer area provision as well as the existance of
a maintenance agreement for lot 11. Mayor Davidson stated that prior to final
plat approval, there should be a letter from the developer stating who will
maintain and oversee lot 11; also there should be an agreement to the 30' setback
on Rt. 34; IDOT should be contacted to see what is happening with the intersection
and secure the same in writing.
It was suggested by Mr. Clarage that the minutes approving zoning be included in
the packet submitted before final plat approval. Fran Klaas noted that ;perhaps a
request for a 10' adjacent to state right-of-way easement to the city be included.
He further suggested discussion on the cul-de-sac and whether or not it was needed.
George Stewart thought that a dead end street with a "T" turn around could serve
the purpose and also provide for extension if needed in the future.
Jim Clarage summarized the items that are not shown on the preliminary plat and
need to be indicated on the final:
1. Show all zonings on the plat.
2. Remove cul-de-sac and show approved "T" turn around.
3. Show drainage easements at the creek on lot 11.
4. Flood plain limits should be shown.
5. Street specs and section exhibit is required.
6. Contact IDOT for input on Rt. 34 right-of-way requirement.
7. Show setbacks at 30' at Rt. 34.
8. Show a no access strip along the full Rt. 34 frontage.
9. Prepare an agreement on the pond in (or out) of the subdivision with
maintenance, easements, ownership, etc. , clarified.
10. Provide an approved type temporary "T" at the south end of Cannonball.
11. Copy of plat of annexation to be provided to the Plan Commission to show
what was approved after it is adopted.
12. Need to spell out that nothing larger than R2D duplex can be built where
indicated. (including future development)
13. Provide a continuous 10' utility easement along Rt. 34 frontage to be
written to the City of Yorkville.
The motion to recommend approval of the preliminary plat of the Conover 4th
subdivision on Rt. 34 subject to the recommendations listed by Mr. Clarage to be
on the final plat was made by Larry Langland. The second was given by George Stewart.

COMPREHENSIVE PLAN REVIEW
Working from the North downward, the Commission discussed and recommended the
following changes in the comprehensive plan.

Northern Boundaries -- eliminate present office park designation and show more
medium density residential and planned light industrial and research areas.
Consideration is given to the fact that the plan will be reviewed on a yearly basis;
changes could be made to accommodate manufacturing or other type developments.
Cannonball / Kennedy Rd. / Rt. 34 -- area now shown as medium density residential.
Gravel pit area can be approached at a later date. Other designations in the area
include commercial, retail sales, office area. No changes proposed at this time.
Discussion followed on the properties on the north of the tracks; Zepelak and
Indland realtors. Both are planned residential areas; the Mayor asked what, if
anything, should be changed. The opinion was to leave as is for now. Mayor
Davidson also stated a change made by the Council regarding the ordinance governing
sewer hook-up. Previously, a single homeowner was required to hook up to sanitary
sewer if within 2501 . Now any developer will be under the same guidelines; if
there are 10 homes, the criteria will be 10 x 2501 ; 100 homes, 100 x 2501 . This
will eliminate septic and well. If any developer comes in with a request for a
small parcel, the entire acreage will be platted.
Eldamain / Game Farm / High School area -- no change proposed.
Mayor Davidson asked if there was a need for automotive type zoning on Rt. 34.
The suggestion was for heavy commercial/automotive area across from the County
property heading out of town.
Southern area -- designate additional medium commercial/retail sales areas going
out Rt. 71. Consider same north on Rt. 47 as far as the Collins property. Heavy
commercial could be on southwest corner of Rt. 71 intersection.
Rt. 71 projection -- what is likely to happen within the next 5 years should be
considered as effecting major development potential. Larry Langland projected
that both sides of Routes 71 & 34 will be business/commercial areas.
Mr. Clarage will revise the comprehensive plan map according to changes and any
realignments recommended by the Mayor and the Plan Commission; all annexations
and rezonings will be provided so that the mile and one-half boundaries will be
accurately shown.
Mayor Davidson stated that a Plan Commission meeting is scheduled for Nov. 21 (the
day before Thanksgiving) . If no zoning is on the agenda, there will be no meeting.
George Stewart made the motion to adjourn; Don Ament seconded. Meeting adjourned
at 9:00 p.m.
